health and their lives in jeopardy through that technology. now elizabeth homes was the last person on the stand in her own defense. she said that statements to business partners and investors was based on information she believed to be true at the time. intimate details of her relationship with sunny balwani said he was abusive and controlling. >> it's not just a failed startup. it's a situation where technology was put out on the market. representations were made by elizabeth homes that turned out to be inaccurate. people relied upon that and put their lives in the hands of her technology. >> reporter: i want to recap

some of what the jury also heard through the last couple of weeks. they heard testimony from 29 government witnesses, including a woman those theranos blood test shows she suffered a miscarriage when she was, in fact, still pregnant. and another test diagnosed prostate cancer markers in another patient, which was not true because the patient was a woman and did not have a prostate. elizabeth homes was the most compelling of the defense witnesses, crying on the stand and testifying about leaving stanford because she was raped and accusing balwani, a claim he denies. the trial of her ex-boyfriend sunny balwani will start in february instead of in january. closing statements are expected to take two days. our analyst says she believes the jury will feel the pressure of the holiday looming and they may want to hurry and try to

come to a decision so this case is not hanging over their holiday celebrations. >> no matter what the verdict, silicon valley certainly learned some lessons. >> scott mcgrew continues our coverage. it's clear that holmes underpromised and overdelivered here. that's standard practice in silicon valley. >> that's the claim but i think they get that home for two reasons. the product never went to market and the tests were often run on traditional testing equipment that theranos didn't tell people they had. the other reason is while silicon valley companies often over promise, claim a new feature for a phone or something is just around the corner, in this case they were working on life and death technology. people trusted those tests to

tell them whether they had cancer or aids. the other lesson i think silicon valley is going to take away from this is don't trust because a company has a first class board of directors that the board of directors knows what they're doing. theranos boasted two former secretaries of state. the former secretary of state and the future secretary of state here and here and a former defense secretary and a future defense secretary jim mattis among others. investors looked at this blue ribbon board and thought i can trust they know what's going on. but of course, they didn't. >> yeah you mentioned george schultz there as well. he was actually warned that things were a little amis. >> his own grandson worked in the labs, tried to warn his grandfather things were amiss to try to protect his grandfather's

what appears to be a gun. the incident terrified workers there and police quickly responded. the man then got in his car but officers quickly caught up with him. they say he ignored their orders and fired. >> the subject initially did not listen to the officers' commands, but eventually to come out of the vehicle with his hands up. eventually he did exit the vehicle holding an air soft gun that looked exactly like a real firearm. >> because he was holding an air soft gun, the department of justice is now among the agencies investigating. the four officers are on paid administrative leave. to our climate in crisis and possible help against future droughts with california's first new reservoir in years. state water commission voted yesterday to authorize more than $800 million for a may ultimately cost more than $4 billion. the reservoir will be located in

caloosa county. environmentalists argue it will take too much water from the sacramento river and harm endangered salmon. let's take a live look outside at san francisco where it's a wet start to the day. >> we're seeing areas of showers behind the main storm system, which is still passing through gilroy. you can see rain approaching from the west around mountain view and fremont. even though the more substantial rain has moved out, still a high impact on your morning commute with ponding on the roads. it will be a cool afternoon, low to mid 50s outside. this break from the rain not going to last long. look at that seven day forecast, rain back through the middle part of next week. >> right now the middle of this bridge westbound reports of a crash on the san mateo bridge

still seeing that impact on going on your thursday morning drive. >> you're talking about that rain having traveled across right here, the san mateo bridge. you can see the blinking center screen westbound toward foster city. we have least one lane blocked because of a crash. it turns out a car spun out on the span. that will be an issue heading toward the peninsula. chp coming from the other direction scrambling to clear those lanes before a secondary crash happens. we'll track that as we come up. very happy thursday to you. the federal open markets committee says the fed will wrap up helping the american economy sooner than first planned. likely raising interest rates as much as three times next year. this is the bitter pill that we need to take in order to fight inflation. and the turnaround for the fed which up until now was much more worried about getting people

back to work. americans were saying do something about inflation. well, this is doing something, really the only thing you can do to make prices go down, make it more difficult to borrow money and slow down the economy. that plan starts in march. wall street actually ralied a bit on the news, which isn't normally how investors react to higher interest rates. but in this case they were relieved to hear the plan. knowing about bad news is better than worrying about bad news. the bank of england is their version of our fed. it too will make decisions about interest rates today, but it's complicated by the fact england is having a much worse time with coronavirus right now. here, apple says it's moved its return to office date to who knows. a number of corporations have set date after date after date, year after year before realizing nobody really knows when this will be over. and reddit has filed to go public. the online bulletin board

49 degrees san jose, still seeing a few showers, not the heavy rain and wind that might have woken you up last night. it was really gusty outside. we have winds southeast at 5 miles per hour. 50 currently in san francisco. walnut creek, the rain transitioning to the southeast away from you. yesterday morning we did get gusts 20 to 40 miles per hour late yesterday. those wind speeds have come down as the rain bands pushes off south and east. the majority of the rain now is starting to move south and east. that's a trend that should continue through mid-morning. most of the showers should be gone. clearing skies set the stage for some very cold temperatures later on tonight. by lunchtime, pretty close to your high temperatures today of

low to mid 50s. it's not going to feel warm outside even with those sunny skies later on. low 50s for highs now. watch what happens by 11:00 tonight, 30s in the north bay and by tomorrow morning low to mid 30s and frost advisories for our valleys for the next couple of mornings. the next storm could be powered up by another atmospheric river monday through wednesday of next week. saturday is going to be dry. looks like most of sunday may end up being dry except for the north bay. the main event rolls in monday and tuesday. windy at times too all the way through wednesday. you can see the pattern there. later next week, christmas eve, christmas day right now trending drier. we're going to need after the first three days of next week. look at that seven-day forecast. chilly mornings ahead, frosty mornings likely for the valleys and a lot more rain spread out over the first half of next

week. reports of flooding, standing water all around the bay. no major freeways closed but we do have this affecting the san mateo bridge. you see another set of flashing lights. it is westbound heading toward the peninsula side from hayward on the decline after the high-rise getting down toward foster city we see a bit of slowing. one lane is blocked by a crash. it looks like a spinout is what happened as you approach the foster city exits. use caution heading from hayward toward the peninsula on 92. the dumbarton bridge is clear but that just got hit with some weather as well. that rain pushing down here. south county will be affected. we're reports of hillside slippage for highway 17 near the summit. be aware on those smaller roadways. there may be some rocks that have fallen down.

>> celebrating metallica's 40th anniversary. we'll have details a little bit later this morning. let's stick to the forecast right now. . san jose still seeing a bit of light rain. 49 degrees, winds speeds have come down. that probably woke you up last night. we had some gusty winds up to 40 miles per hour. you can see showers on approach from fremont into mountain view. the trend today will be those decreasing showers, highs in the 50s. frosty temperatures likely by this time tomorrow morning and more rain in the seven-day forecast. the rain and the wind leaving some bay area power

outages overnight. >> if you're heading out the door, you're going to want to be careful at those intersections where the lights are just dark. this is in one area that was a big problem spot overnight. cierra johnson is live. >> reporter: the lights have thankfully come on, but this time yesterday the lights were off. folks had to treat it as a four-way stop. as you can imagine with the slick roads and folks really not having any patience, it could really become dangerous. we have some video of what this area looked like last night. as you can imagine, it was dark. according to pg&e, by wednesday the power company says they restored power to more than 350,000 customers throughout northern and central california following that series of storms that started on sunday. here in the bay more than 1700 customers were without power.

a pg&e spokesperson said water got into an underground vault and shorted out electrical equipment inside that vault. pg&e crews were on site to make those repairs. the rain starting to slow down since we've been out here. we are expecting some more rain. i'll leave that forecast up to rob, but you do want to be prepared for when your electricity does go out. make sure you know where those flashlights are and make sure you have your phone charger. another great resource for tracking that storm is our nbc bay area app. you can check out the live radar right on your phone.

hospitals across the country are getting slammed by a new covid surge. i want you to take a look at these numbers. admissions are up, hospitalizations nearly 8%. and deaths, sadly, are up 5%. this is just over the past week alone. the delta variant still doing the most damage, but the omicron variant is popping up in more and more states. bob redell joins us this morning, tracking the bay area case rates so far. bob, medical experts say the current vaccines may be less effective against omicron, but we're still talking about that booster shot. they say it really helps. >> reporter: doctors say regardless, laura, get your vaccination shots, get both of them and then get that third booster shot. the vaccines definitely offer protection against the virus regardless of the variant and they certainly do a better job of keeping you out of the hospital versus not being

vaccinated. what about the mandates? do those work? here in california the governor just reinstated the indoor mask rule. the state was the first state to impose lockdowns, to have vaccination requirements for large gatherings and for students in schools, those type of requirements. the latest data, this is the seven-day average here in california compared to florida and texas, two states who have been much looser with their requirements. again, this is the past seven days as of yesterday. 113 cases per 100,000 people. florida only 78 cases per 100,000. texas, 102. again, those two states with fewer requirements have lower case rates. keep in mind those states are also warmer so there are fewer people inside this time of the year. look at the vaccination rates. in california, much greater, fully vaccinated almost 70% of the population.

california around 62, 63%. texas, 56%. compare the death rates. california by far the safer state. 189 deaths per 100,000 people. florida, 288 deaths per 100,000. texas, 252 deaths. yes, california has more deaths overall, but we also have a greater population. that's why we look at the per capita number. doctors believe thanksgiving gatherings contributed to the recent rise in covid cases. we are seeing this in a dising disruption in pro sports with players testing positive. you have several universities in the northeast moving final exams online. despite this surge, the white house says the nations schools and businesses will remain open while encouraging us to mask up

million. scary moments for one san francisco couple out of their nightly dog walk. a pack of coyotes surrounded them and then attacked their dog. >> it happened last week in richmond. the woman says the coyote grabbed her 13-year-old terrier roscoe and tried to take it away. her boyfriend ran them down and shouted at the coyotes until they dropped the dog. a veterinarian stitched up the dog and roscoe is recovering at home. >> we're very lucky to still have him. >> look at those eyes. san francisco animal care and control urging people to keep their pets on leash or indoors in those areas where coyotes are

bridge as your alternate. new overnight, wet roads may be to blame for a deadly crash on the peninsula. this is new video just into our newsroom. this happened around 10:30 last night. that's when a car lost control on northbound 280 in daley city and hit a power pole. that driver, sadly, was killed. all lanes were closed until about 1:00 this morning. chp still investigating the exact cause of the crash. president biden will not get his christmas wish that build back better will go up for a vote before the holiday. >> chuck schumer made that promise, but he's running out of time. >> and maybe running out of enthusiasm. build back better is facing some real resistance. one of the democrat joe manchin of west virginia who has teased the white house with the on again/off again interest in helping out. biden needs all 50 democratic senators to vote yes to get this passed. apparently manchin not ready

yet. another development is the sudden interest by the fed to try to control inflation. up until now bankers have called inflation transitory. now there are plans to raise interest rates and end the fed's economic stimulus in march. now, on paper central bank and build back better have nothing to do with each other, but some democrats have positioned build back better as stimulus. it's really so much more than that. it's a whole rethinking of our social contract with government. but at one point it made sense to talk about this as stimulus. now the fed is talking about how it needs to stop helping the economy. that may be more ammunition for manchin. president biden traveled to kentucky on wednesday to tour the damage and meet with first responders and victims' families. he was flanked by a number of local politicians, democrats and republicans. the group showing the traditional bipartisanship that america used to take for granted when americans needed help. >> in kentucky, we are good

not make it feel like 50s during the day. tomorrow morning's temperatures will be in the low to mid 40s in some of our inland valleys. then our attention early next week transitions to yet another atmospheric river. as we head into the weekend, we're going to have chilly temperatures. should be dry through saturday. sunday is trending a little bit drier. most of the rain chances should be up here in the north coast. the window from monday through about midday wednesday looks to have a lot of rain and probably some gusty winds too. if you have any outdoor plans, i think friday and saturday will be good days for that. the holiday weekend is trending drier for the second half of next week. friday and saturday look pretty good for outdoor plans. then another big rain event probably on our doorstep late in the weekend heading into early

arrested, accused of ransacking the nordstrom at broadway plaza. some 80 people swarmed nordstrom and got away with merchandise worth up to $200,000. the suspects are facing felony charges. investigators are still going through surveillance video working to identify more of them. the department of justice now charging three companies tied to the oil spill off of the southern california coast earlier this year. the grand jury has accused the companies of illegally discharging oil. that indictment alleges that despite getting several alarms, the companies continued operating the damaged pipeline on and off. it also alleges that some crew members had not been properly trained in the automated leak detection system. the rapper logic may have helped prevent a significant number of suicides according to a new study. ♪ i feel like i'm out of my mind, i feel like my life ain't mine ♪ >> the song's title is the phone

number for the national suicide prevention lifeline. nearly 10,000 calls were made to the hotline, a nearly 7% increase. 245 fewer suicides were reported than what would have been expected. 800-273-8255. nasa's spacecraft has touched the sun for the first time in history. it passed through the sun's upper atmosphere also known as the corona. it happened in april of this year, but nasa is only now talking about this. nasa launched the probe in 2008 -- 2018 to help scientists learn more about the sun. we are just over two months
