>> reporter: elizabeth holmes and her lawyers were called back to court today when the jury asked the judge to replay conversations between her and investors. >> we thus built the business around partnership with pharmaceutical companies and our contracts with the military. >> reporter: on the tape, holmes is heard talking about her plans to put theranos machines in retail stores, the potential for a future theranos ipo, and her company's relationships with the military and pharmaceutical companies. relationships we now know were exaggerated, but does it add up to fraud? not necessarily. after all, start-up founders in silicon valley have rarely been expected to be honest all the time with investors. >> so, i'm going to be surprised if the jury holds elizabeth holmes to that standard. and if they do, start-up founders across silicon valley

and the nation should be quaking in their boots a little bit. >> reporter: after this third full day of deliberations, still no verdict from the jury. >> by coming back into the courtroom and listening to these recordings, it's going to be a refresher for them and it may sway some opinion, but it's not going to sway if in the next couple hours. >> reporter: scott budman, nbc bay area news. >> we are closely monitoring this theranos case. as soon as the verdict comes down, we will bring it to you live. we will cut into our programming with legal analysis and a break down of what's next for elizabeth holmes. a body found in the napa river appears to be that of a missing woman. we first told you about the search yesterday. crystal mccarthy went missing last monday. police thought she may have been swept into the river during recent storms. a deputy spotted the body in the river near the third street bridge. they have tentatively identified the body as mccarthy. investigators are trying to

learn more about what happened. we are learning more about the south bay synagogue that went up in flames after hanukkah. the synagogue caught fire early yesterday morning destroying the entire downstairs. police now say it was not a hate crime, but they are not elaborating. the rabbi did tell us last night the video surveillance showed someone lurking around the building. inside four torah scrolls were saved. >> san francisco is pulling out all the stops to get people vaccinated or boosted for the holidays. the city set up a series of drop-in low covid-19 vaccination. here's nbc bay area's robert happen da. >> reporter: a steady stream of people showed up here at the kaiser tent on geary boulevard to get shots as quickly as possible. the weather didn't cooperate, but many people seeking covid booster shots were willing to stand in line at four san francisco clinics now taking

walk-up patients, no appointment needed. along with the kiedser tent, people were told they could drop in and get vaccinated at the chinese hospital, san francisco general and the southeast health center. for many in line, the convenience matched their urgency. >> i work in customer service at a coffee shop. so i felt it was pretty essential just to get it done. i got the first two. i'm around a lot of people. i wanted to get it done. >> it is our duty we need to take vaccine and make sure everyone, if we go back to fly, that everyone is safe. >> reporter: this new strategy open indefinitely comes as the city sees the beginning of a new public surge. cases tripled last week, three times faster than when the delta variant hit during the summer. >> the way they've gone up in south africa, london and new york. the earlier we get people getting those boosters, definitely the better. >> reporter: many we talked to agreed. what are your thoughts now after having done it? >> it's good. good to go.

>> reporter: the public health department is also making drop-in testing available at more than 20 sites and it plans to expand those sites to administer about 20,000 tests a week. again, as quickly as possible. in san francisco, robert handa, nbc bay area news. >> robert, thank you. the last minute maid rushing sites too busy. contra costa county is switching those testing sites to appointment only. you can't just drop in. the county announced two sites in richmond and san ramon. the county says it has distributed about 14,000 free rapid tests this week alone with many sites closed on holidays, the county says it plans on giving out more at-home test kits. a former minnesota police officer is back in custody and likely facing prison time. a jury today found kim potter guilty on two counts of manslaughter, rejecting she miss took her gun instead of a taser

in the struggle against daunte wright. >> we, the jury in manslaughter in the first degree while committing a misdemeanor find the defendant guilty. >> reporter: tonight the jury finding kimberly potter guilty of first and second degree manslaughter in the death of daunte wright. potter supported by her attorneys as the verdicts were read. outside the courthouse, cheers for justice. prosecutors argued potter made rash and reckless choices when the former officer shot and killed the 20-year-old during a traffic stop. potter saying she thought she was firing her taser when she shot wright with her gun. wright's mother. >> the moment we heard guilty on manslaughter 1, emotions, every single emotion you could imagine just running through your body at that moment. >> reporter: the fatal incident in the suburb of minneapolis last april, captured by numerous body cameras.

officers stopped wright because of an illegal air freshener and expired plate tabs and tried to take him into custody after a record check showed an outstanding warrant for a weapon. >> daunte wright caused his death unfortunately, but those are the cold hard facts in evidence. >> reporter: unarmed wright posed no threat. >> i would have preferred daunte wright respond to commands. does that allow her to shoot him to death? it does not. >> reporter: potter denied bail and escorted out of court in handcuffs facing 15 years in prison. >> we have account ability for death. accountability is not justice. justice would be restoring his life and making the family hole. accountability is an important step, a critical necessary step on the road to justice for us all. >> tonight we are remembering the life of a legendary writer

all right. back to our 49ers coverage. good news here if you want to look at some silver lining. tonight's loss doesn't really change their playoff standing. they're still the sixth seed out of seven. the downside, they gave this game away. let's go to nashville with coach kyle shanahan and jimmy garoppolo. >> the first offense was a bad one, shouldn't have thrown that. no one was open on the play. he just had to take it. >> not mincing his words. jimmy g. was so sharp in the game. it went down hill, throwing two interceptions. niners lose 20-17. anthony flores will join us from the locker room in nashville with post game coverage in a few

minutes. also tonight manager gabe capler is noticed. >> he joins in our race in america series. >> gabe, it's been a year and a half now since the killing of george floyd under the knee of an officer. what has it been like for you navigating this last year and a half with a lot of social activism? >> well, i can tell you myself and other leaders across our sport have felt a responsibility to talk to our players. and i don't think that means talking at our players. i think it means starting the conversations and listening to our players. but i think that extends to our families as well. look, these are tragic events,

and they are only -- they only make change if we take those tragic events and figure outweighs to limit them or eliminate them. and obviously nobody is going to be satisfied until they're completely eliminated in the future. >> you can join the conversation tomorrow at 4:30 on nbc sports bay area. as we head toward the new year, the cdc is worried about hospitals being under staffed and over booked during this ongoing covid surge. the cdc is changing the guidelines for health care workers. here are the new rules. they no longer have to wait ten days to come back to work if they test positive. health care workers now only have to wait seven days. that is, if they retest negative and don't show any symptoms. the cdc says isolation time can be cut even further if the hospital has a severe staff shortage. the fda is authorizing merck's pill to treat covid for emergency use, adding another tool in the nation's arsenal to combat the virus. that move comes a day after

another antiviral pill from pfizer. the merck pill is for those with mild to moderate covid at risk for disease. pfizer's bill is authorized for people as young as 12. both companies say the advantage of oral treatment is they can be taken at home which could help hospitals from being over filled. the party is still on, sort of. the famed times square new year's eve celebration is a go despite the soaring number of covid cases in new york city and the state. mayor bill de blasio there in new york says the crowd will be limited to 15,000 people. normally it ranges close to a million people. and, yes, masks will be required. >> let's all get together and let's be safe, but let's do it the correct way. wear masks. if you're not vaccinated, stay home and be cautious. >> just because you got vaccinated doesn't mean you won't get the covid, so, but at least they're checking, which is good. >> okay. another change. once you're inside the event

boundary, you will not be allowed to leave or go inside any business until the ball drops and it's all over. let's talk about our holiday leftovers now. not the food, the other things. >> all that stuff. what do you do with all those piles of cards, all those ribbons and all that wrapping paper and tissue? we asked consumer investigator chris chmura how we should deal with all this holiday waste. >> once wrapped so nicely and neatly, this package is now a mess. let's figure out what to do with it. reuse it, recycle it, refresh it? we're going to use guidance from the city of san jose. let's start with bows and ribbons. san jose says all bows and ribbons cannot be recycled. they can be thrown in the trash or you can save them and reuse them next year. wrapping paper is easy to reuse, too. well, some of it is. we understand not everyone's

unrapping technique today is exactly conducive for reuse next year. it's okay. san jose says aggressive wrappers can reuse the paper. one rule, the shiny stuff. san jose says wrapping paper that's shiny or contains foil or metallic pieces cannot be reused. trash that stuff. same goes for tissue paper. it contains the wrong fibers for recycling. they're too short to recycle. reuse it, trash it or compost it. as for cardboard boxes, they're recyclable. they recommend you flatten them down and it makes it easier for the recycling center. they're partly recyclable. greeting cards made a big comeback. mom says you keep them forever.

yeah, no. san jose says you can recycle them. but first, remove parts that have glitter, foil, metal, and ribbons. all of these will contaminate paper cycling. those fancy pants lined envelope aren't recyclable. here's a crafty alternative. use them to make gift cards for next year's presents. you can watch all of chris's stories. we include how to add your vaccine mobile card to your wallet. go to nbc bay area. santa could never miss a block party. it's the brightest treat around on eucalyptus avenue in san carlos. >> we do this every year and it's worth it. every year eucalyptus avenue decked out in lights.

people drive in, walk in from all over the bay area to catch a glimpse. i used to live in san carlos. the realtor said, this happens every year. you have to be used to this during the holidays. you have hundreds of thousands of people going through and you have to agree to put lights up on your house. you don't want to be the one guy. >> you're the grinch. >> i want to go there. >> they probably turn it off by the time we get off. >> like christmas with the cranks movie. everybody has to decorate, got to do your thing. okay, we have some rainfall in here. there is going to be a little bit of a window here tomorrow. look, maybe you still want to set up some christmas lights before christmas, you're finally feeling the vibe. we're going to 0 get in here and talk about rain chances coming our way. just a few isolated spotty showers tonight. a chance of fog to reduce

visibility, less than a half. tomorrow morning consistent rainfall primarily for the north bay. you can see yellow and orange. those are heavier pockets at 6:00 in the morning. that pushes out really quick and we should end up with some breaks of sun, clouds, a slight chance of spotty showers. tomorrow afternoon if you want to get some sort of lights up, i know it's going to be the day before christmas. maybe you're feeling last-minute cheer. that will be your window to do that. if you start out tomorrow morning, we're down to 46, south bay at 48. and we're coming in with those 40s over the east bay and north bay. san francisco starting it off at 50. daytime highs tomorrow are going to remain in the 50s throughout the bay area. not much changes as we head through micro climate. we'll go through them fast. 53 in san mateo. 52 in the mission. let's take it off to the north bay. 48 in clear lake and 54 in

sonoma. so, after tomorrow, once we head into christmas, we are looking at our next storm system getting here. i think on christmas eve, slight chance of a spotty shower. by christmas morning, you can see moderate rain, a few heavier pockets saturday morning. a chance of showers, but overall it would start to break up. totals on this for christmas day on saturday, anywhere from a quarter of an inch to half insure on average. we shouldn't have any problems. street drains could be clogged and cause isolated issues. sierra snow tomorrow into sunday, off the charts. 39 in south lake tahoe, 52 inches there in kirk wood. there is some information now about the central sierra showing. it is 150%, so nominal news.
