this is "today in the bay". a merry christmas eve to you all out there. we begin with a live look at the north american space command santa tracker there. you can see santa moving along moving those gifts and has the wet gear in the back as he moves to the bay area. he's preparing all year for just this moment. here it is. he's working in over drive, and then sleeps -- >> yeah, like a bear. >> good morning. i am marcus washington. >> i am laura garcia. santa is on his way to the bay area, and when he gets here he will have to contend with the wet weather. our parking lot, rain was really coming down overnight. we're in the microclimate weather alert this morning, this christmas eve. >> yeah, we will talk with

vianey in morning because she has things to talk about with the roads this morning, but first let's check in with meteorologist, kari hall. >> yeah, we are seeing it lighten up in parts of the north bay, but really coming down for areas to the south of there. we have seen pockets of heavy rain move into the south bay. as you are making plans to head out this morning, just a heads up that you are going to see heavy downpours in sunnyvale. we are seeing the biggest activity along with the rain moving through gilroy for the past hour or so. all of these heavy pockets for rain could cause ponding on the road that's hard to see because it's dark outside, and so if you have to drive allow extra time to get there, and if you see ponding on the road, do not drive into it. this system will continue to bring in more rain, and we'll talk about when it will have a

chance to soak in, and that's in a couple minutes. vianey, has breaking news with the commute. yeah, if you are familiar with highway 17, you know how messy and dangerous things can get. northbound 17 near the bear creek area, looks like there's a vehicle -- a solo spinout according to chp that is blocking one of the lanes again. this is northbound 17 at the bear creek area. there was one earlier we were telling you about. this is a sig-alert and is delayed because of a earlier crash, a big rig remains on its sides. no word on if there are injuries, but we will keep you up-to-date as more information becomes available. yesterday, midday, we told you about pretty bad flooding along the peninsula. >> yeah, and sadly two people drowned there.

the sheriff deputies said the two cars were stuck in the underpass, and emergency crews were able to save one man standing on the top of his car, but they could not rescue the people in the second car. it took public works crews a while to pump out the water and reprieve the bodies. neighbors say they had to tell the family members about this tragedy. >> their family came up from los angeles to spend christmas and new year's with them, and they have been trying to get a hold of them all day and no answer. >> neighbors say they are concerned because that underpass is one of the only ways to get into that neighborhood. if it floods again, first responders won't be able to get in if there's an emergency. we have sent out a push alert. this is when we learned about the bodies inside that car. a sad situation there. if you want to get alerts about what is going on around your community, download our free nbc bay area app to get the breaking news and alerts. 6:04 this morning. the city's tenderloin district

under a state of emergency. the vote and the proposal certainly not without controversy. >> today in the bay's damian trujillo takes a look at what it means. >> it means more police in the tenderloin and more services aimed at addressing the overdose and mental health concerns of the tenderloin. the order is expected to last 90 days. one supervisor said it's needed because there have been 17 overdosed in that community. they are giving zoning codes to a site in the tenderloin, and that site is providing mental health services and helping people get off drugs. supervisor walton voted no to protest what they see as a plan for more policing.

supervisor matt haney said the declaration is long overdue. >> this emergency order is a plan to flood the tenderloin with police and not social service workers, further harming those who are underserved and over policed. please do not pass this order. >> that was an attendee that was listening in. one said the public health order is a trojan horse designed to flood the tenderloin with police. others said this is the wrong move at the wrong time. in the end the mayor insisted that sitting back and doing nothing was not an option. the declaration can be revoked by the board of supervisors anytime or extended beyond the 90s days. >> thank you, damian.

6:06 right now. still no verdict in the elizabeth holmes fraud trial. yesterday the jury asked the judge for recordings of holmes talking up her company to possible investors. holmes, her family and attorneys came back to court to hear the 2013 interview along with the jury. on the tape she started planning about putting theranos machines in retail stores, and made claims that were not entirely true. legal analyst say it's not a crime since startup founders have rarely been honest all the time with investors. >> i will be surprised if the jury holds elizabeth holmes to that standard, and if they do founders in the nation should be quaking in their boots a little bit. >> deliberations are set to resume on mound. you can follow the elizabeth

holmes verdict watch. as soon as it comes down, we will bring you that and what is next for elizabeth holmes. this is where city leaders say the new year's eve fireworks celebration along the waterfront is a go. this is a big business night for restaurants. many say restaurants for late-night seating with a few of the midnight show is already sold out. even as we see a surge in covid cases, it could be a safe fireworks celebration. >> if you are outside and you have a few feet around you and there's a little breeze going and you are fully vaccinated and boosted, i would not feel a mask. i would be very comfortable doing that. >> but wear a mask in case you get to be shoulder to shoulder with others. it's a soggy one out there, all this rain, all these storms, a series of them hitting the bay area. kari has been keeping track of them all for us.

>> yeah, we're still seeing some of the widespread rain as we get a look at stormranger right now and the radar showing what is happening across the region. very difficult travel ahead through the central valley into the sierra right now. the rounds of rain that will taper off within the next few hours, but it's still pretty soggy out there for the start of our christmas eve. the hour-by-hour outlook shows drier conditions by late morning and even times of sunshine. there is still a around of quick-moving showers this afternoon, but we will have more widespread rain coming in early tomorrow morning. i will watch this. vianey, you have been watching several issues out there for the morning commute. >> yeah, especially for the east bay commuters. this is a big one. this is north bay 680 near the auto mall park exit. there's a hard close sig-alert. they are starting to divert

>> yeah, especially tomorrow. i think the rain is going to be very widespread tomorrow and continuing off and on throughout the day. there will be breaks today and you will see the rain come down, and we will watch "a christmas story." that's our favorite. we are taking a break from the showers in the north bay and it's spotty on the peninsula, and we are concerned about the rain moving through san josé and the alum rock area. in the south county we have already seen bouts of really heavy rain. we are looking at our overall trend for drier conditions as the system pushes to the south. overall we are looking at the atmospheric river moving now into southern california. we are getting the rain out ahead of a cold front that will be moving in. if you plan to drive through blinkies illuminated

drive-through, and in the evening we could see a chance of rain coming back. much of the afternoon looks like we will see a break, but there will still be a chance we could see spotty showers passing by. christmas day, once again it looks like the rain becomes widespread and heavy at times as colder air comes in. we could see snow on some of the bay area mountains, like mount hamilton, and mount diablo. we could see that continue into monday. we could see a break in the activity with a few pop-up showers this afternoon, and widespread rain returns on christmas and the heavy sierra snow will make it difficult to travel there. we are still looking at several feet of snow go into the next week. those windows of trying to get there and travel without having any major issues are going to be very small. looking at the next several

days, our temperatures will be dropping. take a look at how chilly it will be by the middle of next week. with air that cold we may see snow again on some of our bay area mountains. we are also looking at freezing temperatures right behind that. for san francisco, very wet this weekend, especially starting again tomorrow into sunday, monday as some people are heading back to work, and we are only looking at highs in the upper 40s. it gets colder from there, but it looks like we could see an end to all of this rain by next thursday. we will have a lot more updates before then, and vianey is keeping us updated on what is happening with a major issue in the east bay as well as the santa cruz mountains. >> yeah, i want to make sure folks are away alongside 17 near bear creek, there was an earlier crash being reported near this area. you could see the speed sensors turning yellow already. there's ponding water, and it's

meteorologist, kari hall, timing out whether your holiday plans will be a washout. a deadly discovery in the east bay while you were sleeping. firefighters pulling a car out of the water with a body inside. so many questions lingering this hour. flights canceled due to a surge in omicron cases. we're live at sfo with what you need to know if you are traveling today. this is "today in the bay." a merry christmas eve to you. thank you for joining us. i am laura garcia. >> i am marcus washington. we are in for a wet holiday weekend. meteorologist, kari hall, has been monitoring all of this, and that alert begins right now. many of the roads already closed. >> that's right. let's check the forecast with kari. >> yeah, we are seeing a lot of rain that moved through earlier this morning and was quite heavy, but it's starting to get a little lighter in some areas. we have seen the rain taking a

break in parts of marin, sonoma as well as napa and solano counties. we will see the rain continue for the south bay and pushing farther to the south, so east and south san josé seeing the heavy rain, and at this point moving off to the south and east. this is ahead of a cold front. there will be clearing over the next several hours. there will be a chance to get out there when we take a break from the rain for a little while. l.a., san diego dealing with heavy rain if you are going to be traveling. we will take a look at weather-related airport delays and how the weather will be shaping up for the rest of the weekend. that's coming up in a few minutes. vianey is keeping an eye on a couple issued that slowed the commute. >> yeah, the bay bridge toll plaza, no metering lights on for the past couple of days, so it's nice there. we are seeing several issues,

officials tell us they got a call just before midnight of a car in the water. took them nearly three hours to pull it out. police say the road ends at the boat launch, and it's possible the driver got confused in the rain and fog and ended up in the water. the victim has not been identified. now to an update for you. we are learning more about a shooting along 680 in danville. it happened around 10:00 last night, between sycamore valley road and diablo road. one of the victims has critical non-life-threatening injuries. police have not released a suspect car description. many are waiting to get home or waiting for loved ones, and many airlines are canceling flights because of the omicron variant. >> today in the bay's cierra johnson is live for us at sfo this morning. she's monitoring the situation

going on. how is it looking this morning, cierra? >> reporter: good morning. i can tell you this airport is extremely busy. this is probably my third time here in about two weeks, and i have not seen it this busy this early in the morning. for some folks, they will not be have being that experience because hundreds of those flights, as you mentioned, grounded because of the omicron variant and how quickly it's spreading through the nation. to give you an idea of which airlines are grounding some of their flights, united airlines will cut flights from the schedule as the variant spreads across the country. alaska airlines canceled flights on thursday after some employees reported possible exposure to covid. in a statement that airline said

additional cancelations were possible on friday. nbc news has reached out to other airlines but did not immediately hear back in regards to today's schedule. just to give you an idea of how many people planned to travel, aaa estimates 109 million people, an almost 34% increase from last year, will travel 50 miles or more between december 23rd and january 2nd. 27.7 million people more traveling, so about 90% of where we were pre-pandemic. to give you an idea of what is going on here at sfo, leaders say traffic is about 60 to 65 prepandemic levels, and oakland about 90% of 2019 passenger levels. we did have a chance to speak with an individual going to hawaii, and he spoke about his thoughts about traveling with the omicron variant present.

>> for the past five days i have stayed home and i have stayed away from people, and i got the hand sanitizer, so i can just, you know -- the vaccinations are really powerful. if i am going to get something, it's probably going to be a cold. >> reporter: as i mentioned, we have been here for a couple days talking about travel as well as covid. i have seen a lot more face shields than earlier in the week. we see masks, but today i have seen a lot of folks wearing the extra level of poe techtion, and the mask mandate is in effect until mid mark. check and double-check your flight, departures or arrivals if you have family coming, because of those cancelations. >> concerning numbers there. thank you, cierra.

6:36. only on nbc bay area, a south bay family said their faith has been restored after a nativity scene was stolen from their front porch. that man seen here on this camera, walking up and grabbing the figurines and taking off, and then the man comes back an hour later to steal the rest of it. this was an heirloom passed down through generations. >> that somebody would just have the courage to just walk up and take a nativity -- i mean, who takes that? >> the family posted that video on next door. hours later a stranger bringing them a brand-new nativity set, saying they just wanted to help out. >> i love that. so nice. 6:37 right now. it's going to be a white christmas in the sierra. a live look at i-80 near castle peak. looks cold out there. we have video taken near donner pass. if you are trying to head up to

the sierra, make sure you are prepared. chains are required on highway 80 and highway 50. crews are worried about closing highways because of possible whiteout conditions. we have seen 80 closed multiple times, and it can be tough if you get stuck in it. >> we are going to be seeing this continue throughout the weekend, kari. >> we are seeing the snow levels lower, and it's making for difficult travel conditions heading to and through the sierra. we can see the snow still coming down there as the rain is starting to taper off in the bay area, and we are seeing a lot of the rain pushing to the south. if you will be traveling across the region, heads up there's still a lot of wet weather, not only here but across the southwest. if you are catching a flight, it looks like weather delays, things looking good here. no delays out east as we as here locally even with the rain coming down. we will continue to keep an eye

on that. if you are staying here and want to go through the drive-through lights in san josé, there will be good conditions this evening, not only for this but for looking at all the christmas lights around the bay area. the later you go in the evening, the better chance you have of that coming back. you will see showers returning around 10:00 or 11:00. the kwanzaa celebration happening on sunday at golden gate park, for that make sure you bring the umbrella if it's still going on. we will see soggy conditions. we talked about getting to the sierra. the temperatures are going to be cold. that snow continues. there will only be a few windows of opportunity to catch a break in some of the snow. afternoon. vianey, you have seen major issues on the roads this morning. what is going on now? >> i don't think the rain is helping at all. i had a viewer ask me if the

northbound 680 near the auto mall exit was still closed, and yes, it is. a big rig remains on its side and they are working to clear that out. one thing i did notice, the delays are starting to back up. if you want to avoid that stretch hop off scott creek road and take the milpitas boulevard surface street instead and avoid that stretch because they are diverting traffic off of the freeway at this time. no impacts to the southbound lanes. another quick update as well, highway 17 is getting messy. northbound lanes are slowing down because of an earlier crash and now we are seeing slow downs on the southbound lanes as well. back to you. >> thank you, vianey. 6:40 this morning. coming up next, would have, could have, should of for 49ers fans. this loss, what does it mean for the team heading down the home

jimmy g, but it was not all him. anthony flores has more on how the team came up short. >> they lose to the titans. the faithful were out in force. there was a lot of red in nashville. the offense marched down the field on their first possession. san francisco dominated early but only led 10-0 at the half. the momentum of the game changed on three throws by jimmy g. two of them were interceptions. this in the third quarter led to a tennessee touchdown a few plays later. then the titans had their first lead of the game at 17-10. the 49ers respond. the game was tied with two minutes to go and with seconds remaining on the clock, the titans kick a 44 yard field goal

are now seeing, it's pushing out of the north bay. we are getting a break and we are seeing scattered showers continuing for the southbound into the east bay. looking at the off and on rain we are seeing right now, it's getting lighter for antioch and discovery bay. we are seeing the rain letting up a little now in livermore. if you have to travel, i do advice you to wait a little bit until some of this rain continues to pass. we are seeing conditions improving out there after some very heavy early morning rain. now that atmospheric river is moving into southern california. you can see all of the moisture moving through there. if you will be traveling there or across the desert southwest, we are seeing heavy rain across arizona as well as well as the rockies. looking at the hour-by-hour forecast, we are seeing the rain trending drier for this afternoon, then we will see the rain returning, a chance of a couple spotty showers throughout today. for tomorrow morning, more

widespread rain coming back. we will see that rain sticking with us throughout the day on christmas. maybe even some snow on mount hamilton, as well as mount diablo, the santa cruz summit and the north bay mountain ranges where we will see rain continuing into monday as well. we are not seeing this letting up. here's what to expect with the rain tapering off this morning. there's still a chance of a spotty shower, but also a chance for sunshine. very heavy sierra snow. it has been nice to see the boost in the sierra snowpack. right now we are at normal for the sierra snow. we do have a lot more in the forecast right now at 100% of normal. we are looking at about four to eight feet of snow into the next week. that forecast is still on track. we will continue to see this as we go into sunday, monday, another cold front dropping in. looks like bitterly cold air, possibly some of the coldest air we have had in a long time.

that could mean snow on some of the bay area hills by wednesday. our temperatures may be near freezing by thursday morning, and we will also see some very chilly temperatures along with the rain in san francisco that will stay with us at least through next week. vianey, you have been tracking several issues on the roads this morning. >> fortunately there have been several spinouts, and also now seeing new delays popping up. this just popped up on my speed sensor. not sure what is going on, not sure if it's on the northbound or southbound lanes on 880. i will look into this. as it gets closer to the 7:00 a.m. hour, it's normal to see these issues come up. 680, northbound, that's a sig-alert. no estimated time on when this stretch will open. the backup heavy through the fremont boulevard area and highway 17 is getting messy, but your southbound lane is not impacted. christmas day is twinning on

6:55 this morning. welcome back. we are moving you forward with a look at the top stories here on "today in the bay." >> the san francisco's tenderloin district now under a state of emergency. >> the order will require a heavier police presence in the tenderloin and more services aimed at addressing the drug overdose and mental health concerns of that community. the order is expected to last 90

days. the supervisor haney said the move is needed because there have been overdose in that community. it gives the city power to wave codes. that site is going to provide mental health services and helps people to get off drugs. some supervisors voted no for the plan they see to allow more policing. supervisors got an ear full from citizens that attended the virtual meeting. one said the public health order is a trojan horse designed to flood the tenderloin with police. the declaration can be revoked by supervisors at anytime or extended after 90 days. >> that area does need help. thank you. still no verdict in the

elizabeth holmes fraud trial. yesterday the jury asked the judge for recordings of holmes talking up her company to theranos investors. holmes, her family and her attorneys came back to court to hear the 2013 interview along with the jury. on the tape she's heard talking about plans to put theranos machines in retail stores, and a potential ipo and the company's relationship with the military and pharmaceutical companies, claims that were not entirely true. the jury is set to resume duh deliberations on monday. as soon as the verdict comes down, we will bring it to you live with a legal analysis and what is next for elizabeth holmes. now a follow-up on how storms can be dangerous. we told you yesterday about flooding on the peninsula, and we know two people drowned in their vehicle when it got stuck in a flooded underpass in millbrae. those two cars were stuck in the flooded underpass, and emergency

crews were able to save one man who was standing on the roof of his car but they could not rescue the people in the second car. it took public works crew to pump out the water from the underpass and retrieve the bodies. a big business night for restaurants is a go. late-night seating with a few of the midnight show are sold out. even as we see a surge in covid cases, it could be a safe celebration because it's outside. a live look inside sfo. this is where we are seeing big crowds there on the move for christmas. some airlines have canceled flights today because of the covid variant. check your flight status before you leave for the airport just to make sure everything is
