good morning, everyone. it is sunday, december 26th. i hope you had a wonderful christmas filled with family and food. you're taking a live look at downtown san jose. gorgeous and cloudy skies but pretty clear especially compared to yesterday. thank you for joining us. i'm candace nguyen. meteorologist rob joins us with the micro climate forecast. it was clear driving into work but not for long, right?

>> we have clearing but chilly temperatures. 42 in san jose and clouds and 52 degrees, 50 in san francisco, 51 in oakland and inland valleys east bay. in the upper 40s in the afternoon off to the east san jose, still snow showers around mount hamilton will be a staple of the forecast the next couple days. mt. diablo seeing sleet at times. scattered showers for now and this bach of clouds drops down the coast impacting us by the afternoon. you can see how the rain and future cast starts to increase setting towards 7:00 tonight. part of the next wave of polar air dropping down the coast that will bring lowering snow levels and the potential, greater potential for hill pop mountain snow tomorrow and tuesday. we'll talk about this and how much rain to expect in the forecast coming up in about 12 minutes. back to you. >> thanks, rob. let's take you live to the

sierra. this is a live look at highway 89. whiteout conditions as you can see. the car is driving super slow there. i-80 is closed from colfax and nevada state line. parts of highway 50 are shut down. cal trans and chp reporting car spinouts. here is a look at the backup between pollock pines closed this hour. chains are required if you plan to head to the sierra. we have new video of how hard the snow is coming down. this snow at mount hamilton hitting the screen here in san jose. the roads are covered here in a few inches of snow. right now the chp says mount hamilton road is open but driving conditions are rough. take a look at your screen here, snow in the east bay. this is diablo range along san

antonio valley road. not just the snow, rain is causing headaches here. this here is southbound 880 in san jose just north of steven creeks boulevard. the wet weather is also causing issues up in the north bay. this hill slide closed one of two southbound lanes on bridge way. that's the main road through the town between molly stones. the tarp here you see was put on after a prior mudslide so you can see it didn't keep things from sliding again overnight. the lane is scheduled to reopen this morning. our storm ranger is on san bruno mountain continuing to scan this rain throughout the bay area. holy cow, you can't see anything there. very foggy. if you haven't already, download the free nbc bay area app that will give you access to the mobile doppler radar. you can put your own zip code in to see when the rain will hit your own neighborhood.

the on and off rain led to a few scrooge moments but the rain didn't stop many from outdoor holiday traditions. here is union square with the look at celebrations there. >> reporter: for some families, christmas isn't complete without a visit to union square. >> with covid and the turnout, it's surprising but other people have traditions like us were are the rains prompted people to pull out umbrellas and rain gear but they still came out and a lot went skating. the union square ice rink has been booked solid all day. >> it was raining while we skated. >> reporter: you still did it? >> yes, it was so fun. >> reporter: mixed is in tourists like this family from france. >> we're always prepared for rain. >> reporter: but the weather did create holiday challenges.

on the peninsula instead of slay bells ringing, the sounds were cars splashing through puddles. in redwood city. in san carlos, ted spent part of his afternoon struggling to keep drains clear. >> just the leaves are clogging the drains. and then every couple minutes i just unclog it and it reclogs itself again. >> reporter: in san mateo a downed tree meant a detour for some holiday drivers and run off from nearby creeks that are usually dry spilled off on streets. instead of a white christmas, it was gray and rainy but didn't dull the holiday spirit. >> thanks so much. let's take another live look at christmas in the park in downtown san jose. early in the morning but beautiful out there. the rain wasn't enough to get the christmas spirits down for some people. visitors pulled out umbrellas yesterday and headed to the park to look at lights and grabbed hot cocoa.

this was last-minute decision after some family members tested positive for covid while others have been planning to come here for weeks. >> to be honest with it being rainy, i didn't think there would be any people at all. to be honest, i thought this was closed. this say blessing. >> my favorite thing here is the trees. >> reporter: yeah? what do you like about the trees? >> because it's big and big and i like it because it has a ton of lights. >> christmas in the park scheduled to be open every day until january 9th. so go check it out. now, we are following developing news out of cupertino where a trespassing situation turned deadly. first responders called to a home yesterday morning. a resident fired shots at a trespasser resulting in death. they are investigating what p haened and what led to that

shooting. the identity of the killed suspect has not been released yet. turning to our coronavirus coverage as millions of people gather across the country for holidays, omicron cases are soaring forcing people to wait hours to get even covid tests. it putting a strain on hospitals and burnt out doctors for the second holiday season in a row. nbc's sam brock explains. >> reporter: covid's dominating grip on american life darkened another christmas. the united states surpassing 52 million infections since the start of the pandemic. new york and florida smashing the single day highs this week with los angeles county alone nearly notching 10,000 cases in a day. one california hospital treating patients in hallways and parking lots, again. >> we're here in the triage tent in the parking lot due to the covid surge that's going on right now. >> reporter: a demand for tests has driven up eye popping numbers.

log jams during the holidays. in miami, on christmas day, the flow in and out of this vaccination site is being monitored by police with lines of cars spilling on the main road going down for several miles until finally ending here all of these people desperate for a test. what time this morning did you get here? >> 8:00 in the morning. >> reporter: just to be safe, just to make sure i don't have anything to give my family. a sobering indication this latest wave isn't a milder version of past surges, this is the penn state icu one year after the arrival of vaccines. >> right now it very stressful. the hospitals are full. a lot of very sick ones are the unvaccinated population. >> reporter: at u mass memorial there are 14 beds in the icu, 12 of them covid patients, some of whom require proning. >> it takes six or seven of us, respiratory therapist to put them on their stomach so they can get better ventilation and

breathe better. >> reporter: a country hoping to move on from covid, though around 15% of eligible adults still refusing to be vaccinated. >> i can't believe that i didn't get the shot and i will be getting one because i don't want to do this again. we have much more ahead on "today in the bay". coming up, 2021 was a tough year for people but there is so much to be grateful here in the bay area. we're taking a look back at the stories that made us bay area proud.

tutu in south africa. cars out there and reporters. south africa's president confirmed his passing this president. tutu was a retired bishop who rose to worldwide fame during the 1980s fighting apartheid. he was 90 years old. >> free at last. >> reporter: bishop desmond tutu was recognize for the his fight against apartheid in south africa. >> noble peace prize for 1984. >> reporter: in 1984 he received the highest honor, the noble peace prize. tutu used the church as his base of power for south african blacks. he said he would never forget blacks were forced to carry and how they could be stopped and searched at any time for any reason. he became an activist leading marchers, always looking for ways to improve the life of

blacks in south africa. >> i'm always a man of hope and i believe the best about everybody. >> reporter: his method of protest led to a call for worldwide sanctions across the south african government. in 1984, he was named archbishop of johannesburg and two years later became archbishop of cape town, the highest office that can be held in the church one of his happiest days was the day nelson mandela was released from prison. he never waivered in his fight to promote brother hood and peace. after his retirement he worked as a global activist with democracy, freedom and human rights. he also campaigned to fight hiv, aids, tuberculosis,poverty,

sexism and homophobia. he included in 2009 the u.s. presidential medal of freedom, the nation's highest civilian honor from president barack obama. now closer to home here is what you can expect on "meet the press" with chuck todd. coming up, schools, america and race, how america's history is taught and the issue of critical race theory or crt after protests of murder of george floyd prompted conversations about the issues of structural racism in america. this is pitting parents against each other and school board members. some conservative groups are using this as a weapon and the discord at the local level is an all time high. we'll look how children should learn about america's trouble history and how the debate divided one community and i'll

talk to hanna jones who won a prize on the 1619 project about slavery in america ahead on a special edition of "meet the press". salvation army workers were hard at work in san francisco setting up getting ready to handout 4,000 meals to seniors around the city. the food isn't necessarily the most important part. >> what is more important than the food is maybe perhaps a visit from one of the volunteers. many of these people will go the whole day without a human interaction or someone to wish them a merry christmas. >> this is the 25th christmas in a row these volunteers have handed out meals in san francisco. san francisco's memorial church served up the annual christmas feast to the less fortunate yesterday. this is a look at prep work for the big event changeded to a meal delivery last year. this year the meals were enjoyed in person again after the big lunch, workers delivered meals

to people living on the streets. the church's foundation is serving san francisco's homeless and low income populations for over 50 years. the new year is just around the corner and as we round out the end to 2021 we're taking a few moments to look back at the past 12 months, which had been pretty tough. but today in the bay with a look at the stories that made us proud. >> reporter: we started 2021 but sharing the story of john decker, a santa rosa artist so inspired by the bravery of front line workers in the face of pandemic he decided to paint those faces. john created dozens of portraits, many of them nurses at the santa rosa hospital and gave them for free saying thank you. >> you share the skill you have

and i'm sharing mine. >> reporter: in may we brought you to a covid vaccination site in san francisco for a touching moment. serena had spent the past ten years of her life juggling mother hood and schooling to finally become a nurse. on the day of her graduation, she chose to work at the clinic rather than attend a virtual ceremony. when serena's co-workers heard that, they said it wouldn't do and surprised her that day with her very own graduation procession. not across a stage but a parking lot. >> that they recognized my hardship and they wanted to acre knowledge that and they were proud of me and just beyond words, really beyond words. >> reporter: and if that weren't touching enough, this is a story in august from kaiser permanente medical offices and the stuffed bunny left behind in an elevator

as being described going way above and beyond, robert douglas created flyers for the bunny but ended up tracking down every young patient who had come that day and called their family. robert finally found 2-year-old nathan who his parents said had been desperately missing his bun bun. robert returned the bunny and nathan's family sent back pictures of the reunion. >> saw him kissing the head of the bunny, i lost it. i shut my office door and just like this is like one of the best moments of my life. >> reporter: garvin thomas, "today in the bay ". >> we love your stories and need them. >> time to check in with rob. we had a cold and wet christmas, is something to expect for the rest of the week? >> we'll watch colder temperatures on the way into monday and tuesday. outside right now ano early in the morning but then things will

change by the afternoon. 30s around morgan hill and 42 in san jose and right now san francisco you can see a few breaks in the clouds at 46 degrees and a few isolated showers there off to the west. 42 currently in san jose and around the tri-valley this morning, 38 degrees in dublin and check out the hills to the south of livermore snow across the higher peaks and we'll see more opportunities for that over the next two days. lake tahoe, no problems finding snow. 17 degrees and the radar shows you the sierra continues to be challenging for driving conditions and we're expecting lowering snow levels in the sierra, too. traveling conditions tough through tuesday. winter storm warning into tuesday morning midweek to the end of next week should be gorgeous out there after all that snow and we'll see better road conditions heading towards new year's eve. right now, we've got partly cloudy skies around the bay area for the afternoon, more rain increasing for the afternoon,

peaking probably later on tonight, highs near 52 in san jose, 50 in san francisco and only upper 40s around the north bay and tri-valley this afternoon. storm ranger right now scanning a few snow fluries around mount hamilton and seeing a few scattered show here's and here in hayward and also a little mix of snow across the hills near livermore this morning, sleet and there a few light rain showers near san francisco but the satellite view shows you the next bach of moisture coming down the coast and this will change the fortunes once we pass lunchtime you see how the future cast spreads the rain peaking from 8:00 tonight to 8:00 a.m. tomorrow morning and for the afternoon monday we begin to see skies clear and have to see how much snow fell on some of the nearby hill tops and mountains. rain totals with this next storm through 5:00 monday looks to be highest in santa cruz and another inch or so in the wetter

locations and air cold enough for elevations above 3,000 feet at times today lower as we get into monday night for accumulating snow there in the santa cruz mountains, mount hamilton and mt. diablo and mount tam into tuesday. what is powering up low snow levels is that plunge of cold air down the coast it's going to be involved with the showers that we see tuesday into wednesday across the bay area and then by wednesday afternoon, things should start to dry out as you'll see here rain totals for monday night through wednesday, not as much as we're likely to see late today and monday morning and actually, the pattern does trend drier now for new year's eve. breezy at times for the 31st and first day of the new year looks relatively dry. next weekend maybe sunday night will be the next chance to see rain. most of the rain in the seven-day forecast between now and wednesday is brought on by cold temperatures, low snow levels. look at the highs tuesday.

now. thank you for joining us. meteorologist rob is in this morning. rob, things seem to be clearing up this morning but just for a bit, right? >> probably for a few hours and we're seeing as you mentioned there in san jose, candice and walnut creek where it is 39. you see a little blue skies. we'll get sunshine for the morning before things change during the afternoon. cool day today. the clouds start to thicken up highs in the upper 40s in walnut creek and concord. 52 san jose 47 in napa and 50 for san francisco and 51 in oakland. right now the storm ranger showing you a few scattered snow flurries. this next bach of clouds will change things as we head towards the afternoon going from the sunny breaks we're seeing this morning to cloudy skies around lunchtime and see how the rain fills in as we head towards 8:00 tonight. you may notice the clearing a

sheriff deputies responded to a 911 call after 4:00 this morning. a homeowner fired shots at a trespasser killing the man. homicide detectives and crime scene investigators investigating what happened and what led to the shooting. the identity of the killed suspect has not been released yesterday. covid continues to keep a tight grip on the country. as of yesterday, more than 52 million americans have tested positive for the virus since the start of the pandemic and that's according to an nbc news tally. 5 million of those cases reported right here in california. it comes as our positivity rate reaches 5.4%. that's the percent of people testing positive for any strain of the virus. that is the highest it's been since the summer surge. a live look at sfo where many people are trying to get home for the holidays and maybe now just trying to get home. super rainy in san francisco. several airlines recently cancelled hundreds of flights. most of them due to a surge in covid cases among flight staff.

just yesterday, united cancelled 230 flights across the country. delta cancelled 130 flights. alaska did not have any cancellations related to covid but it did cancel some flights because of stormy weather conditions in the northwest. storms are ranging along the west coast and covid cases are climbing, that did not stop people from trying their hardest to get home to their sunshine a rainbows for the clayton family years. >> it's the hills and the fog ou you think you've never missed something like the fog. >> reporter: fog that could interfere with flights but not today. >> we've had family members get their planes cancelled. >> reporter: it turns out snow in seattle was the cause of some

delayed flights including alaska airlines and on united. >> we paid a lot to buy non-stop flights. >> reporter: 230 flights have been cancelled worldwide because of covid outbreaks among crews. >> she's still not here so almost two hours, two and a half hours late. >> reporter: still just being able to travel is making this holiday extra special. >> just makes the holiday season so much more meaningful. family makes the world go round. >> reporter: for christopher kelly, the best christmas present starts with seeing his brother's face at the airport. it's a thing they will never take for granted again. >> merry christmas to mom, dad, family, friends, grandgrandpare everybody that made it possible to get me here today. >> merry christmas to great grandma, our family, to grandma

trend thing morning, a super cool story of a dinosaur egg highlighting theling to birds. teams discovered the rare 66 million year old fossil in east china. it has a complete baby dinosaur in the egg apparently a few days old before it would have hatched. researchers say it shows a remarkable similarity between dinosaurs and the birds they evolved into. this is the first time any fossil has shown any signs of bird like posture known as tucking where the head is under the right arm. the covid surge affecting the music world. k pop group bts announcing three

of the seven members tested positive for covid-19. the group had just returned to south korea from their tour here in the u.s. the concert were the group's first in the u.s. since the pandemic began. all three members were fully vaccinated but no word yet if they received a booster shot. happening tomorrow, jury deliberations are set to resume in the elizabeth holmes fraud trial. on thursday the jury asked for recordings of holmes talking up her company to possible investors. holmes, her family and attorneys came back to court to hear the 2013 interview with the jury. on the tape she's heard talking about plans to put their machines in retail stores and a potential ipo and the company's relationship with the military and pharmaceutical companies. all claims that were not entirely true. legal analysts say that's not necessarily a crime since startup founders are typically rarely honest all the time with investors. >> so i'm going to be surprised if the jury holds elizabeth holmes to the standard and if

of course, that's changed in the last couple years especially with the three conservative appointments made by president trump. so liberals now worried about maintaining at least that minority of three would like the justice to resign sometime this year in order to make sure that everything goes smoothly with the next appointee made by president biden. >> but larry, president biden's term won't end until 2024. are liberals rushing things here? >> and that's where it gets interesting, candace. if i may, we have to give a history story for everybody. obama, president obama had an opening toward the end of his term. second term. at that point, almost a year to go, he nominated merrick garland and merrick garland was a known appellate justice and attorney general. mitch mcconnell the majority leader said we'll wait for the next election.
