up in 10 minutes. >> as rob just said, it's cold outside, it was a chilly new year's eve night plus, omicron cases are surging. that did not stop people across the bay area from celebrating the new year with some legal fireworks. sky rangers caught several going off and some are illegally lighting up the san francisco skyline as the clock struck mid night. a majority bay area county raised their fines for using illegal fireworks in hoping to created an added deterrent. there are less than bay area cities allowed safe fireworks, those are the kinds that do not fly into the sky or explode. those includes dublin, union city, gilroy and ramona park. the legal one over the bay may have been called off, thousands

>> that was tom jensen reporting for us. a deadly shooting in san francisco in richmond district late last night. san francisco police tweeted they're looking for information of what led to the homicide. it happened around 11:30 last night on 3rd avenue and corn wall street. police say there is only one victim. to the breaking news we brought you last night, police say it was a good samaritan who was shot trying to help the victim of a robbery at a bay area mall. it happened yesterday afternoon around 3:45 at the sun valley shopping center in concord. a group of people robbeto help that victim, he was shot. the shooter and thieves got away. the mall was crowded with shoppers on new year's eve. >> we called our loved ones and told them where we were and said

a prayer. >> reporter: concord police tell us the victim is in critical but in stable condition at the hospital. turning now to our coronavirus coverage, california's positivity rate skyrocketed this month. the state reported nearly 16% of covid-19 tests are coing back positive, that's 9% jump from the last update. just two weeks ago on the 15th, our positivity rate was down to 2.6%. our state's positivity has gone full circle, last year on december 31st, the positivity was 17%. that's the highest it ever been. by august it went down to 7.2% before cases started surging again in the fall and the holiday. with the start of the new year, soon it will be a new semester. covid testing will be the key to keep it spreading from schools after this two weeks holiday

we are seeing the most widespread of the coldest temperatures this morning. the freeze warning is in effect for the north bay valleys. we should see temperatures climbing to 49 and napa about 51. we'll have numbers close to 50 and low 50s in to san jose, one thing to keep in mind bay side today, the return of the king tides of coastal and interbay flooding could occur. peaking tomorrow at 7.21 feet after 10:00 and tomorrow another high tide at around 11:00. through the sierra, it should be a decent travel day. the more snow comes in, getting started monday and tuesday, unlike previous weeks, it looks like maybe one to two feet of snow. most of that is coming down for the second half of the week. rein chances returning to the bay area. by monday afternoon, you will see it there, most of this should be focused across the

north bay especially into tuesday and we catch a bit of a break as we get into thursday and perhaps the best chance of rain for us, bay area wide comes in there on friday. rainfall expectations as we spread out seven days, nothing too excess. the areas in red could see two or three inches of rain. we are talking from monday all the way through next saturday. nothing too extreme in the forecast. that rain and extra moisture will boost our temperatures up. after tomorrow we should lose the cold morning. san francisco back in the 50s and daytime highs trending upper 50s. the valleys that's been in the 20s and 30s, that means midweek temperatures start to go up in the 60s. our morning temperatures in low 50s. we'll have more news after the short break. hero faces seemingly impossible challenge. tension builds... the plot twist

on a new year's day walk. frank somervell was arrested after he rear-ended another car in downtown oakland. a witness shares this cell phone video with us showing a dark porsche pushing the audi. after the collision, he put his car on park to get out to make sure the other driver is okay, only to hear the porsche pushed his car into the pole. two men helping somervell to a safer location. he was checked to the hospital and booked on suspicion of dwi. he has not appeared on air by several months, we reached out

to management at channel 2 for comments, we have not heard back. we have not been able to reach somervell directly. new rules once again for masks. the city of berkeley and alameda and marin and contra costa has reinstated mask mandates. everyone will be required to wear a mask regardless of vaccination status with omicron being extremely contagious and spreading among the vaccinated. you will need to mask up in places like gyms and offices and churches. january 31st is supposed to be the last day for san francisco's mask mandate. it could be days even weeks before tens of thousands of people in the sierra get their power back on. pg&e says record snowfall caused severe damage to more than 5,000 areas of its power system. hospitals and critical supply
