broadcasting not only to your television but you can watch us live on roku, amazon fire and online. we're with you. good wednesday morning to you. thanks for joining us. i'm laura garcia. >> and i'm kris sanchez. marcus washington has the day off. we want to start your day with a look at your forecast. meteorologist vianey arana is in this morning. it has been nice the last couple of days, a lot of sunshine but starting out in the 40s and 30s. in san jose a live look in downtown is about 44 degrees. take a look at your dublin trend. we're at about 42 and then notice in the icons a mix of sun and clouds by 8:00 a.m. we'll stay in the 40s, bumping up to 50 degrees by mid-morning. in san rafael about 45 degrees and a mix of sun and clouds the first half of the day. don't worry, it looks like that high pressure will be sticking

around longer bringing us more sunshine. your extended forecast in a few minutes. back to you. >> thank you, vianey. a follow-up, san jose is now the first california city to have a booster mandate. councilmembers voted to approve mayor sam liccardo's mandate. they will need to show proof of a booster shot or recent negative covid test including what you saw there at the top, the s.a.p. and convention centers. the rules take effect immediately. vendors will have until february 4th to comply. have you run your errands, been to the store lately, you probably notice some store shelves are bare. this is a situation of people calling in sick combined with supply chain delays. cheryl hurd reporting from the east bay. i was looking for the milk.

it is very hard to find. >> reporter: and this east bay mom says that's not all. >> toilet paper. the cleaning supplies. >> reporter: everything from milk to medicine gone. grocery stores, drugstores, empty shelves all over the bay area and across the country. san jose state economist robert chapman wood who specializeness strategic management says the supply problem can be blamed on the omicron variant. >> we have millions and millions of people who got covid and what are they going to do? they stay home. they're not moving food. >> reporter: shoppers noticing the change and dealing with it. because they've been through it before. >> that's the way times are now. >> reporter: investors are seeing the pressure it's putting on companies and bracing for high costs for labor.

>> there's a problem with getting ships to unload things in port. >> reporter: covid cases and hospitalizations have hit record highs in the u.s. as the highly contagious variant spreads. there's a lot going on. i asked professor wood to look into the future asking him how long he thinks the supply situation will last. >> it does appear omicron is not as severe as alpha or delta. and so probably things will get somewhat better but it's really hard to predict how long that will take. >> reporter: he says stock up on what you need but don't go overboard. cheryl hurd, "today in the bay." governor newsom signed an executive order to help keep

them open providing staffing flexibility so in-person learning with happen safely. that means cutting through the red tape to allow qualified substitute teachers to fill in. short-term subs can get hired more quickly and the order makes it easier for retired teachers to return. the changes expire at the end of march. updating safety measures after teachers staged a sickout and nearly 1,000 students signed a petition asking for changes. it's providing kn95 and n95 masks. covid protocols updated to follow cdc guidelines. the changes go into effect immediately. new social distancing rules in effect. this after sonoma county leaders banned large gatherings with anything more than 50 people indoors or more than 100 people

forecast to increase in december. stocks rising yesterday with the dow and s&p 500 snapping a five-day losing streak and the nasdaq up for a second straight day. some of the anxiety signals it will raise interest rates and shrimp its balance sheet may have eased for now. wells fargo will stop charging customers fees for bouncing checks and waive some overdraft fees by the end of march following a similar announcement yesterday by bank of america and will give customers 24 hours to bring their balance above zero before charging them a $35 fee and give people who get direct deposit access to those up to two days in advance. the changes come amid skrut scrutiny of overdraft fees. consumers spent $170 billion on apps worldwide.

days bringing us this comfortable weather and, of course after we see the clearing the first half of the day we get a lot of sunshine and that's what's happening now. some areas of fog down to half a mile visibility concord down to three miles visibility. everywhere else we're doing okay when it comes to the fog. to your daytime highs, out and about the wind will not be a factor. nice and light about 7 miles per hour now. in the south bay, san jose, a high of 65 inching closer to the 70s. maybe even 68 in lou the east bay, 60s for concord. low 60s for oakland. 61 degrees. around the peninsula, 61. redwood city, heading to san francisco today, also expect to see some low 60s on the map in downtown. and up through the north bay, mid-and upper 60s. it will be comfortable generally across the board.

santa rosa, 65. ukiah, 66. so let's talk about your seven-day forecast because we are going to stay in the calm, dry weather pattern. today and even in through the week we will see a little bit of a drop in temperatures, though, heading into thursday dropping down with daytime highs in the upper 50s which, of course, we saw mid-60s this past weekend and then friday 59 degrees we bump back up into the 60s. notice the overnight lows. it gets cold out there. 30s once again on the map heading into the weekend for saturday and sunday night. and then looking way out ahead, we were monitoring the potential of maybe seeing a system approach. it looks like now that's going to stay off to the north. so we're going to stay dry here. a nice break after we had a series of much-needed storms in the bay area. back to you. >> thank you, vianey. 4:48 right now. an update in the elizabeth holmes trial. prosecutors will drop the three

wire fraud counts against holmes. those were the charges the jury deadlocked on back on january 4th. we're also learning holmes' sentencing hearing is scheduled for september 12th. holmes could face up to 20 years in prison. you'll recall the former theranos ceo was convicted on four counts of fraud and conspiracy. the jury found her not guilty of four other felony charges. well, someone call alfred hitchcock. a big problem in sunnyvale. leaders called the birds the second most common community complaint. >> now they are starting to infiltrate the downtown area, grabbing food off people's plates and the shoppers they leave a mess. damian trujillo explains how the city is responding. >> reporter: they flock to downtown sunnyvale looking for a
