interview with california's lieutenant governor. this is "today in the bay." are you watching us on tv? you know you can also watch us live on your phone, your device, online, on roku, fire, apple tv. i am kris sanchez in for marcus washington. >> i am laura garcia. look at that behind vianey arana. that's in san josé? >> yeah, the fog is so dense you can't even see downtown san josé. this is a live look right now. it's about 45 degrees, so temperatures are mild but the fog is so dense, not even just for san josé but really parts of the south bay down through morgan hill. look at the fog and visibility, and really dense through morgan hill, parts of concord and napa

and down to quarter of a mile in oakland as well, and in through the brentwood area, we will keep that fog for the first half of the morning. our temperatures are going to be similar to what you saw yesterday where we sort of started out in the 40s and then bumped up in the 50s and topped out in the low 60s. i will take you through your 7-day forecast outlook. the united states is now seeing more than 1 million new covid cases per day, and it's more than 63 million confirmed cases since the start of the pandemic. california has about 10% of that total with a positive test rate currently over 20%. ucsf is asking everybody to avoid its emergency room if they are hoping to be tested for covid. for staff there, the last few weeks have been a challenge with more patients and more staff illnesses. thankfully, they say more cases

are showing less severe symptoms. getting your hands on a test kit might be hard right now, tying up the resources at an er is not recommended. the white house is now trying to respond to the pressure promising more free tests and masks. the military medical teams are now helping overwhelmed hospitals. today in the bay's alice barr is live in washington. this comes as president biden tries to shake off a defeat in the supreme court. >> yeah, laura, the supreme court blocked what was an essential piece of biden's policy, a mandate for companies that have more than 100 workers to require the workers to be vaccinated, and the court said that was a no go on that. the president trying to redirect and get more tools out to americans, and the omicron surge may be beginning to level off in east coast cities, but

nationwide hospitalizations remain high. with no end to the war on covid in sight, promising high quality masks for free. >> they are an important tool to stop the spread of a highly transmittable omicron variant. >> he's also ordering another 500 million at-home test kits to send to americans doubling the total to 1 billion, with a goal of 8 tests paid for through insurance. >> we will roll out where you can order free test shipped to your home. >> and more foot soldiers headed to the front lines. even as he pressed the case for

vaccines -- >> as long as we have tens of millions of people who will not get vaccinated, we will have full hospitals and needless deaths. >> the supreme court blocking his mandate requiring vaccines or frequent testing with private companies with 100 or more workers. some business owners celebrating. >> i saw this mandate from the very beginning as perhaps the greatest example of government overreach. >> the high court did uphold a vaccine mandate at federally funded hospitals. >> there are questions about meeting the demand for all of these rapid tests president biden is ordering amid shortages in supplies and workers that have been persistent. there are also concerns that insurance companies may wind up passing the costs along to consumers. >> i thought that might happen. what about medical experts, what

about the timing of the president to ship out these tests and masks? >> there's widespread consensus this is the right thing to do, but the question is the timing. it's over the past month we have seen the unprecedented surge in covid cases, and it appears it's beginning to level off hopefully. it will be in a staggered way across the country depending on when the omicron surge hit, but there are experts saying why is it taking this long when we might be close to seeing the end of the tunnel. we needed this help a few weeks ago. >> exactly. maybe earlier planning. they are coming, they are coming, and hopefully they don't come too late. thank you so much, alice barr. and more masks will be available with students and teachers. kn-95 masks for students and teachers, and 10 covid sick days

for school staff. one supervisor said parents were already raising money to buy students high quality masks for students to wear in class. >> we decided to raise money through one of those sites where you can raise money and we are already up to $8,000. many parents have already made the orders. >> not all districts can do that, and for right now, they will have n95 masks for students. there's still a mad rush for covid testing, especially among students who are still in the classroom. the lieutenant governor said this. >> there have been so many people that wanted the test and could not get them. my child had exposure, and

fortunately we were able to test within our district in a couple of days, and the wait through our health care provider was ten days and the through the county it was seven days, and what are you doing to get the test done in a timely matter? >> it's very frustrating. i absolutely know. i think the fact that you found that the quickest way for testing was through your child's school is a testament to the fact that this state is really directing accessibility to testing through our public schools in order to be able to keep our schools open. it really is important to be able to keep our schools open for all these reasons. we are working hard to be able to increase capacity of testing beyond just our schools. i encourage everybody who is looking for a test that can't find one to go to our website.

it's super user friendly, covid-19.gov. mobile testing sites are back out in the field. it should be getting more convenient to get that test. again, if you are talking about getting your child tested to go to school, work through your school district and that is a very effective way to prioritize services there. >> based on how the omicron surged in other places, it peaked and then waned pretty fast. does it seem to you we are on the right track to see that decreasing toward the end of the month as the governor has said based on what the health professionals are telling him? >> as government officials we are doing our best to understand the science given to us by the california department of public health and the epidemiologists that we consult with, and the

good news is omicron, even though it spreads and it's more highly contagious than previous variants, it also appears to be a milder case. the projections are that it's likely to be the last way that will create this overwhelming of hospitals. this is all good news, but the governor put it this way, we don't know what we don't know, so we have to continue to be prepared for everything and be prepared to look at covid-19 as something that will never entirely go away, and we have to take the lessons forward, and at the same time there's a great deal of hope that this is the last wave and we are going to be back into a new normal where we can really go about our lives again in the coming months.

north bay has been seeing dense fog for the past several days, down to half a mile in novato. now, let's get a check of how your temperatures will shape up. the satellite shows high pressure dominates in the forecast, and you notice any system goes off to the north, and there's a system to the south of us. that rain is going to miss us. we are going to notice isolated chances of mountain wind as well. the clouds are going to linger today and we are going to stay dry. daytime highs in san francisco, 59 degrees. oakland, 61. san josé, 63. concord, 64 degrees. because of the mountain wind we could see gusts 20 to 40 miles per hour in some of the higher elevation hours. north bay down to the south bay, we will look at air quality. the fact that we did see an improvement in the drought monitor, i get it, we get a

a new $22 million effort will turn one santa clara hotel into helping the homeless. it's on el camino real. 67 units of interim housing will be open by the end of the year. santa clara county is contributing$3 million. starting tomorrow, health insurance companies are going to provide free tests. >> consumer investigator, chris chmura, is showing us how to get the free tests. >> if you want your health insurance company to pay for an at-home covid test, and find out what your health plan's plan is. the federal government gave them

options. they can let you choose the store yourself, you pay and then they reimburse you. >> reach out to your health insurance company. >> be sure and keep your receipt and the original packaging until you get paid back. if your plan sets up a network, you don't have to buy from those stores and you can go out of network, but the maximum reimbursement is $12 per test. each on the policy gets eight tests per month. the feds say you get your free at-home test without any deductibles, co insurance, prior authorization or medical management requirements. insurance companies are only required to cover tests bought january 15th and afterwards. you can ask them to cover tests you bought before but they don't

>> thank you. happening today one of the bay area's longest tenured sheriffs is going to court. >> cierra johnson is live and will tell us where the case stands. >> reporter: the case stems from sheriff smith's allegations of misconduct where they claim she would do a pay to play, accept bribes for concealed carry permits. if smith denies the allegations, the case will go to trial, and if she loses the trial she faces removal from office. >> sheriff smith only has three options. she could plead guilty, which she is not going to do. she could deny the charges,

which is more likely. or her lawyers could object to the sufficiency of the accusations saying even if everything you said here is true, this is still not sufficient to sufficient a removal from office. >> reporter: it isn't just sheriff smith facing allegations. last year criminal indictments were brought against two high-ranking officials in the sheriff's office in the pay to play scandal. so the hearing will take place via zoom because of covid. because of covid and the delay in some of the civil calendars as well as the trial calendars, judge johnson suspects it could be as much as a year before it goes to trial. we will keep a close eye on this case and keep you updated on air

in washington for president biden's push for voter rights sweeping legislation. >> and nbc senior white house correspondent, kelly o'donnell, is tracking this. >> reporter: a real setback for president biden who is using some of the most valuable tools of his presidency, his time and political influence and he's being rebuffed by two senate democrats, moderates, joe manchin and kyrsten sinema. president biden has gone to capitol hill, and he's met with them in person and invited them to the white house late last night and officials say they had a respectful and candid meeting but no changes. where does that leave things?

chuck schumer said nothing is going to happen until next week, in part because of an expected winter storm headed this way, and in part, it's covid, not in general but specifically, hawaii democrat has tested positive and has to isolate, so democrats with their narrow majority don't even have their 50 senators to vote. they have the divide within their party. they say they are going to try and move forward next week to continue voting rights legislation to try again to change the rules of the senate, but so far it appears there's no visible path to get this done. it is a setback for the president who says this is about protecting democracy and has put a lot of the political capitol into getting this done. >> thank you so much. we have new developments in the novak djokovic drama, and boy, it has more twists and

it's kind of peaceful. nice live look there. look at san josé, down to less than a quarter of a mile. it's still pretty dense in through hayward as well. oakland, down to quarter of a mile. keep your distance. if you notice the fog is getting dense, try and keep a safe distance because you can't always see out in front of you. temperatures dipping in the 30s in novato. 39 degrees. that's cold. right now, satellite radar, we do have the high pressure dominating in the forecast, and it was weakening because we had a system dropping down. i should say, it's going to stay off to the north. the system from the south is going to cause a little wind in the mountain areas. for the south bay, we will be in the mid-60s in san josé. milpitas, 62. down through gilroy, 64 degrees. in through the east bay, take a look at your temperatures for

today. oakland, 61. concord 64. around the peninsula, san mateo, 58. redwood city, 60. if you are going to be in the city today, the winds right now are pretty breezy but it's going to be calm overall. up through the north bay, 66 in ukiah. let's look at your extended outlook. we will continue to stay dry because we have high pressure that will start to rebuild heading into the start of the workweek. that's going to keep any rain chances out of our forecast at least through saturday january 22nd. but we have models, and i did look at how the month of february was going to shape out, and it looks like we could get a better chance of getting more storms in the bay area, which have been very beneficial for the drought conditions here in the state of california. mountain winds from the northeast at 20 to 40 miles per hour. the conditions stay dry through the weekend. we will wake up to the foggy conditions again tomorrow into early sunday morning, and mlk day on monday, if you have it off you will wake up to the cool

welcome back. you're watching "today in the bay." we are getting a better idea of why it's still so hard to get a covid test at many county testing sites. the numbers we obtain tend to show 15% of bay area covid patients live in santa clara county, but in the last six months the county has been responsible for more than 20% of all testing. kaiser covers about 30% of the regions' patients but covers 12% of testing. one patient said getting tested through her provider is virtually impossible. >> we resorted to going to the county and the fair grounds. i went as far as morgan hill the other day just to get a test.
