someone fighting for their life in the hospital right now. >> reporter: i'm scott budman a huge thumbs down for facebook. coming up, why investors fled the social network. let the games begin. we're live in beijing as competition gets under way before tomorrow's opening ceremony. the news at 4:00 starts right now. thanks for joining us for this olympic edition of nbc bay air gentleman news. >> this is our new 4:00 time slot during these olympics. we go live to beijing in just a few minutes. we start at home with the brutal beating of a 49ers fan. he was attacked during last weekend's game down in los angeles. his name is daniel luna, and the story is eerily reminiscent of brian stone, the giants fan who was attacked many years ago. today luna's neighbors, customers and the 49er faithful are praying for the best. here is nbc bay area's melissa

colorado. >> reporter: it's the cozy restaurant known for rotisserie chicken, mistura restaurant managed to survive two years of the pandemic. now his loyal customers and nearby business owners along piedmont avenue are hoping he survives this tragic incident, too. >> to have this happen just as we're starting to feel like maybe there's a light at the end of the tunnel, maybe we're going to really start to get to a point where we can get through this, to have this happen to chef luna is heartbreaking. >> reporter: when daniel luna wasn't cranking out peruvian dishes, he was likely wearing some type of bay area sports gear as seen in one of his facebook profile pictures. police in englewood are searching for the person or group of people who pete up the 40-year-old chef landing him in the er in a medically induced coma. he was wearing a 49ers jersey when paramedics found luna in the stadium's parking lot a half

hour into the game. >> the heat of a moment, the football atmosphere, people tend to go overboard. >> reporter: we stopped by luna's home but no one was home. luna went to berkeley high, studied business at cal state east bay and worked at pg&e before opening his restaurant. the 49ers released a statement saying, quote, what happened to daniel luna is reprehensible and we strongly condemn all violence. >> it was a huge loss to this community to have mistura close. >> reporter: in oakland, melissa colorado, nbc bay area news. billboards went up today along the heavily traveled highway 4 in contra costa county. it's been more than a week since the 24-year-old alexis gabe disappeared. her cars were found in the car's ignition in oakley. on tuesday, police searched the

antioch home linked to her ex-boyfriend removing bags of evidence. her family is hoping desperately the billboards will generate more leads. >> the more eyes, the more people hear about it, hopefully someone will have seen something that happened that could help figure out where she's at and how to get her home. >> reporter: fly years will being posted along the east bay. oakley police have sent the information about the missing woman to various police agencies around the bay area. the shooting on board a greyhound bus in the gold country. one person dead, several others wounded. police say the shooter, 21-year-old assadi coleman boarded the bus in redding. he was acting paranoid after a phone call he received. coleman suddenly opened fire and shot five people including an 11-year-old girl and a pregnant woman. police say coleman than ran to a

nearby walmart and got into a fight with a couple before police managed to arrest him. investigators say coleman is currently wanted on a gun charge. they have not yet determined a motive for that shooting on the bus. her bail was denied. the los gatos mom accused of throwing alcohol and sex-fueled parties for toni guinyarders including her own sun has been told she has to stay in jail until she goes to trial. today a judge in clara county denied bail for shannon o'connor. her ex-husband also told the judge she shouldn't be released. she's accused of hosting parties for underage cards, plying them with alcohol and encouraging sexual assault. she's facing 29 felonies. the judge ruled that due to the seriousness of the charges and the fact she has no home in sclera county, it played a role in her decision.

o'connor has continued to make phone calls from jail trying to manipulate witnesses and hide financial assets. >> it is not surprising to me that she continued to commit crime once in custody because we have a long pattern here that is clear from the facts of our case. >> i have to deal with the court's ruling. we have something we can do, we'll be doing that, filing a petition to the sixth district court of appeal, challenging the court's ruling today. >> not just her ex-husband. several of o'connor's accusers urged the judge to keep her in jail. if convicted, she could spend more than 20 years in prison. we're learning more tonight about a fire that damaged a four-story building and a beloved restaurant in san francisco's mission district. that fire started at mission and 16th early this morning. this is video from the citizen p app. firefighters had to rescue people inside. they say the building includes the popular tacaria loss coyotes

on the first floor. investigators say it appears the fire was caused by burning debris outside that spread to the building itself. a live look at the great wall. it is just after 8:00 in china. it is friday morning there. competition is already under way and team usa athletes are ready to go for gold. nbc's liz mclaughlin is live in beijing for us. liz, the opening ceremony is actually a day away for us here in the u.s., but just a few hours away from you. what are you expecting? >> reporter: absolutely. you can see team usa sporting these super cool parkas from ralph lauren, the official outfitter of team usa since 2008, the last time the olympics were in beijing. a lot of the details of that opening ceremony still under wraps, but i can tell you from the reversals, there will be

snowflakes involved and it will certainly be a spectacle. 14 years after the opening ceremony for the summer games in beijing, the parade of nations is set to walk through the national stadium once more, this time for the official start to the winter olympics. >> i'm going to be one of those names and faces added to just an incredible list of people that got a chance to lead team usa. >> curler john shuster and speed skater brittany bowe will be the flag barers. elana meyers taylor is in kwaern teen after testing positive for covid-19. canceled plans to sell tickets to the chinese public. foreign spectators band. >> even though you're not here, we're going to feel it. go team usa. >> olympic competition has already begun for some sports. with a shaky start for the u.s.

in curling, after the mixed doubles team fell to norway, finishing their first two days 1-2. u.s. women's hockey team is starting strong with a 5-2 win against finland. canada may again prove to be the biggest challenge for them. >> i think it's one of the best rivalries in all of sports, men's or women's. >> reporter: competition heating up at the winter olympics. a bit of a fashion rivalry, too, at this opening ceremony. you may remember the canadian tuxedo, those denim jackets from the tokyo games. canada is stepping up their game with a partnership with lululemon. i have one of their scarves here. we as the viewers can decide which nation as the best outfits, but it's the judges, the stop watches that will ultimately decide who is going home with a medal.

>> people especially have found a lot less joy seemingly on facebook and instagram. >> reporter: perhaps most damaging as rebecca jennings who covers internet culture for vox says is the exodus of young people from facebook and instagram moving to rival tiktok which is growing at hyper speed. facebook's response, the so-called metaverse, is not quite ready and not quite cool. >> i don't think people are waiting with bated breath to get on the headset and join metaverse. that sort of vision of what metaverse is came from people like mark zuckerberg who is not a cool person. >> facebook and spotify coming under attack for letting users spread misinformation on everything from elections to injections. they seem to be losing a key demographic. >> when this app started it was for college students. now most college students do not use the app.

as the year of the tiger kicks off, there are new efforts to make our streets safer for asian-americans. today a san francisco supervisor and community groups outlined their plan for the sunset district. here is nbc bay area's christie smith. >> reporter: residents in san francisco's sunset district can expect to see community ambassadors walking their streets in the coming months. one of several initiatives aimed at helping the community feel

safe. >> the sunset district thankfully remains one of the safest neighborhoods in our city. i also know that public safety and crime are issues of great importance to our residents and our small businesses, and especially our chinese community here in the sunset. >> reporter: supervisor gordon nar focused on reducing anti-asian incidents and other incidents like burglaries at homes and businesses. >> we've been doing safety walks in the neighborhood once or twice a week, hand ng out whistles, happening out information about the storefront vandalism grants. >> reporter: also bringing in a community organizer to focus on other crime prevention and safety efforts. companies have helped troo. >> the ring company has donated 1,000 ring video cameras and door bells to us, to the seniors. >> reporter: some of the people

we spoke with that live in the area say it's time the neighborhood got programs like this. >> i think it does bring peace of mind. >> reporter: in san francisco, christie smith, nbc bay area news. firing back, san francisco's da took after font to the police chief's decision to resolve an agreement regarding the investigation of officer use of force incidents declaring his office has done nothing wrong. the oversight agreement with police known as a memo of understanding had an immediate result when it was first signed three years ago. when boudin says when the memo gave his office power to investigate independently, police use of force incidents dropped nearly a dozen. the latest tussle started during a pre striel hearing for officer terrence stang who was accused of beating dacari spiers while responsing to a domestic violence calls. during that hearing, one of the

investigators testified she felt pressured by the da staff to withhold key information from the officer's defense team, information police believe would have helped clear the officer. the chief made the decision to resolve the agreement with the district attorney. >> we have done absolutely everything by the book in this case. there is not one iota of evidence of misconduct under my administration. >> the chief's office issued another statement today defending his decision to dissolve that agreement, refuting the da's claims that police are trying to take attention off stangel's trial. boudin says they'll go back to investigating police use of force cases the way they used to, without police cooperation. is there a lack of transparency in san jose. the city and its mayor are once again headed to courts over accusations that they're conducting city business in secret. today the online media group called san jose spotlight along

with the first amendment coalition filed a lawsuit claiming mayor sam liccardo and other city employees used personal devices and non-government email accounts to skirt the california public records act. it's similar to a legal battle san jose was involved with when mayor liccardo was accused of conducting private talks with lobbyists. >> we were told certain records didn't exist even when we had copies of those records. we uncovered how the mayor almost exclusively uses private emails for city business and deleted a public email thread. >> if those emails are not available to the public as they should be under california law, the public is stripped of its ability to see what it's lengthed leaders are doing. >> in response to this lawsuit which demands more transparency, the mayor's staff issued us this statement, quote, the city spent hundreds of hours reviewing and producing thousands of documents

requested by san jose spotted light but mistakenly missed two emails that were ultimately provided. the city added it's implemented procedures to pre vent future mistakes. a year-long battle with the cruise line and the travel agent. >> our consumer investigator chris chmura helped him navigate through a rough patch. >> reporter: joseph gilroy booked the laj end legends cruise for himself and his wife. they were supposed to go in the spring of 020. that's when we met our foe covid-19. the cruise didn't happen. joseph asked for a refund for more than a year with no luck. then he called us for help. we reached out. carnival said we reached out to the travel advisers who are coordinating this cruise and they contacted joseph directly. after learning they wanted a refund, thash used him a check,

and a few high clouds. currently 64 degrees. northwest wind at ten. tech dli an offshore breeze. the humidity is outside. 61 in livermore as we head back across the bay. emeryville looking good. 60 degrees. you see the clouds over san francisco. you might want to keep your phone or camera on standby as these type of mid and high-level clouds have made for fantastic sunsets of late. 58 degrees in san francisco with the wind northwest at 9:00. short term good news, strong guessi gusty winds have come through considerably. clear skies. 30s and 40s to start. by lunchtime nkts near 60 in san jose. highs tomorrow expected in the upper 60s around the santa clara valley. more low 60s from the north bay into the tri-valley. again tomorrow, high clouds at times moving north to south over the bay area. no sign of any rain.

as we take things out farther, the ten-day outlook in february should show at least a few inches of rain somewhere in the map. you're not seeing anything between now and the 13th because high pressure is sticking around and it's likely to get stronger for the second half of next week. not only are the storms bypassing us to the north. look at the seven-day forecast. some locations like the south bay, the tri-valley or the north bay towards the end of next week could be looking at 70s. unfortunately no rain in that forecast. let's look at that staft right now. san francisco, the wind picking up but not as long as the next couple days. we'll have to watch next wednesday and thursday for stronger winds. look at san francisco temperatures, upper 60s next week. here is a look at inland temperatures, as we go through the weekend, breezy for the hills, mid 60s. temperatures start to climb by the middle of next week, a few areas including south of san jose could see mid 70s in the forecast. so now it looks like any rain or snow chances keep getting pushed
