i'm marcus washington. >> i'm laura garcia, broadcasting not only to television, but you can watch us on roku, amazon fire, apple tv and online. first we want to start out with a look at the forecast. meteorologist kari hall is tracking what we can expect. >> we're starting out clear, also some cool temperatures as you're getting ready to head out the door. it was chilly yesterday, but you'll be happy to know there will be a warm-up. and a lot of people felt shaking in parts of the south county. we just had a 3.2 magnitude earthquake around gilroy, so we're watching that as we go into the morning to see if there is anything else going on. as far as our temperatures, once again, starting out chilly with some 40s in a lot of spots, but then we'll head for the upper 60s going into this afternoon. we'll be watching that. mike, what are you watching for early morning commuters? >> the lighter quake is too far south to have an effect on the b.a.r.t. system and no other systems affected, either.

we're going to keep listening for any impact. walnut creek, i believe this crash just cleared seconds ago. a car hit a deer in the area. no people injured and the deer is clear from lanes. no update on status as they are going to close that on the chp report. we're looking at the venetian and antioch bridges for light wind advisories. all the greeways are green. back to you. >> thank you very much. as kari just mentioned a small 3.2 magnitude earthquake struck south of gilroy. it was centered about 1.6 miles west of san juan bautista. be sure to follow us on twitter and let us know if you felt it. one person is dead and another suffering from major injuries. this is after a car plunged off interstate 280 near downtown san jose. it happened a little month 11:00 last night near the southbound 7th street off ramp. the crash never impacted freeway

traffic and the scene has cleared. the cause of the trash is under investigation. moving you forward. your masks can now come off. the state mandate ended at midnight. if you're vaccinated, you can go maskless in most public places. >> there are exceptions. the count of santa clara, as well as the city of vallejo are both keeping their mandates in place for now. cheryl hurd has more on the mixed emotions being expressed. >> i don't feel comfortable at all. i don't think there's enough information. >> reporter: that's how one shopper is feeling about the lifting of california's indoor mask mandate. but down the street at 24 hour fitness, people i spoke with can't wait to work out with their faces showing. >> i have a beautiful beard, i can't wait to show it off. >> reporter: 24 hour fitness is following the state's lead. fully vaccinated people can drop the mask indoors. >> we're not going to be specifically policing people with masks, whether they're vaccinated or not, or asking is

they self attest. >> reporter: all counties except santa clara plan to drop indoor mask requirements for vaccinated people. there are some exceptions. masks will be required in vallejo until city council members vote on it. you also have to wear a mask if you walk into a city building in hayward, san francisco, and burlingame. courthouses in san francisco, san mateo and alameda have rules to mask up. however, individual business owners can decide whether or not to lift the mask mandate. lynn nice, who owns labels in downtown walnut creek says she's deciding to continue to recover face coverings for employees inside her shop, at least for now. >> some live with parents who are older, some of my employees are over 65. i do think it's important to honor safety. >> reporter: cheryl hurd, "today in the bay." in other news this morning,

4:34, the ball is now in mayor london breed's court after san franciscans overwhelmingly voted to recall three board members. you can see how wide the margin was for each. all went well over 70% voting to recall. recall supporters were frustrated with the board's handling of the pandemic and priorities, they argued, were misguided. once the ballots are certified, breed will choose replacements to finish out those terms. voters will decide a new board this november. in a statement, mayor breed said in part, the voters of the city have delivered a clear message that the school board must focus on the essentials of delivering a well run school system above all wells. voters decided the finalist to fill the assembly seat. supervisor matt haney and attorney david campos received the most votes. the seat will be up for grabs again in november. 4:35 and the world is watching and waiting to see if russia makes a move against its

neighbor, while nato countries insist an invasion will force their hands. "today in the bay's" brie jackson reports an attack from russia will have an impact here at home. >> president biden warning that a russian invasion of ukraine remains a distinct possibility. despite russia's claims of a partial withdraw of troops. the administration saying it's seen no evidence of that. >> we've been transparent with the american people and with the world about russia's plans and the seriousness of the situation. >> reporter: the president stressing the devastating human cost of an invasion in ukraine and laying out consequences here at home. americans could see high gas prices soar even more. >> i will not pretend this will be painless. there could be impact on our energy prices. >> reporter: the administration will work with energy producers in congress to provide consumers relief if needed. on capitol hill, senators agree

with the markets. >> good morning. wall street is set to open slightly lower after stocks rallied yesterday with the dow, nasdaq and s&p 500 snapping a three-day losing streak, amid signs of tensions possibly easing between russia and ukraine. the dow rising more than 400 points. the s&p adding 1.5%, while the nasdaq jumped 2.5%. tech stocks leading the game, while energy slipped as oil prices pulled back. in focus today, reports on detail sales and import prices. viacom/cbs is changing its name to paramount as the media giant goes in on streaming. the switch was unveiled at a presentation yesterday to drum up excitement for the company's future programming, and now expects to have 100 million subscribers to its streaming services, including paramount plus by 2024. that same year paramount plus will become the exclusive home for all of the company's movies after they play in theatres starting in 2025.

4:46 this morning. meteorologist kari hall has been tracking what we can expect from the forecast today. how is it shaping up? >> it's going to be a little warmer this afternoon. we had a break from the warm weather with a cooldown for the start of the week and now we're trending upward. let's take a live look outside in walnut creek. all clear. we haven't had any issues with fog and the temperature right now at 42 degrees here. we will see our temperatures in the mid-40s by about sunrise and then you can see our upper 50s we'll have at 10:00, 62 degrees at 11:00. we to continue to warm up more from there, which will be an improvement over yesterday. reaching 68 in morgan hil. check out the seven-day forecast that's up at the bottom of the

screen. east bay highs reaching 69 in danville and in oakland 66 degrees, mid-60s, in daly city 62. the mission district heading up to 65 degrees and our north bay temperatures up to 70 in sonoma and santa rosa, napa today reaching 68 degrees. so it will feel nicer by the afternoon and there may be more people heading to the coastline. heads up if there will be a beach hazard in effect, as we could see sneaker waves. never turn your back to the water. we see an area of lowe across southern california bringing active weather there. there will be a couple more systems diving just to the east of us, and as we go into next week we'll be watching another one that could possibly bring in spotty showers. it doesn't look like rain chances are too high, but we are seeing a change in the weather

pattern that will bring in maybe a slight chance of rain down the line. our temperatures will be cooling off for the end of the weekend into early next week. mike, chp has wind on some bridges. >> they gave us word of the wind on the venetian and antioch bridge. no incidents reported overnight. in the north bay there is one incident southbound on 101 just past highway 37. the big rig is now on the shoulder. no injuries, but that's one of the few things on the chp report right now affecting any lanes of traffic. toward 580, a mild build in the traffic coming out of the altamont past. castro valley, key areas, no problem. south county, easy drive coming into the south bay. no problems on the peninsula. >> thank you very much. armed with a shotgun, three masked men tried to rob a jewelry store in redwood city. video shows it all unfolding.

they nearly succeeded, but the business owner had his own plans. "today in the bay's" ian cole has reaction from the family. >> reporter: surveillance video shows the van parked in front of the jewelry store and three masked men with guns jumped out and went inside to rob it. he says, in that moment you get scared, but you have to act and defend what's yours. he says the suspects pointed their guns at him and customers, shouting to get on the floor, demanding jewels and cash. ought alfonso pulled out his own revolver and fired back, catching them off guard as they took off. the bullet hit the door and shattered part of the glass. the sheriff's office is trying to track down those three men. it's the latest in a series of robberies across the bay area over the past three months. jewelry stores have been hit at the sun valley mall in concord, the southland hall in hayward,

and east ridge mall in san jose. the owners of plaza juliers say they were robbed nine years ago and insurance would not have covered the jewels potentially stolen on monday, so they had to defend their property. alfonso says, if we didn't have a gun, they would have taken everything. iia cole, "today in the bay." san francisco's police commission is expected to talk about the controversy surrounding chief scott and chesa boudin. it started with a breaking of a memorandum of understanding which resulted in how the da's office was handling use of force violations. the commissioners are expected to decide whether or not to compel chief scott to undo his decision. the latest bombshell allegation in this feud, boudin has reportedly dismissed the case against a woman whose rape

kit was used by police to identify her in another crime. that's according to the chronicle. boudin yesterday made his case a little more clear during a news conference. rape and sexual assault victim advocates are raising huge concerns. >> we're here today to denounce the practice of using rape and sexual assault survivor's dna without their consent, of storing their dna indefinitely. >> it is re-victimizing the victim. it is unacceptable. we need to address this. >> boudin says investigators compared dna from a rape kit collected in 2016 with dna collected at a recent felony property crime scene. now, chief scott this week said that if allegations are true, he will fight to end that practice. the cost of living is on the rise, making it harder for people to make it in the bay. next on "today in the bay," the city is seeing a major rent

increase. also, the steps experts say you can take to try to stop your rent from going up. >> and happening now, a renewed push to decriminalize jay walking. a state assemblyman plans to hold a news conference later this morning. he says that jay walking tickets are disproportionately given to people of color and can lead to interactions with law enforcement. last year governor newsom vetoed a bill that would decriminalize the practice. we'll be right back.

with her owner when a car pulled alongside her. a man jumped out and grab rosy. the frenchie was reunited with her owner a few days later. a suspect was arrested yesterday and taken into custody. new details, a 13-year-old has been arrested in connection with a shooting last friday with morgan hill. it happened in front of sun valley market. investigators say there was some sort of confrontation, that's when someone pulled out a gun and fired. no one was hurt. the shooter ran away. a monday, officers in san jose stopped a car with a 13-year-old suspect inside. he took off running, but was eventually captured. police say a loaded gun was tucked into his waistband. 4:57 right now. on the rise, coming up next on "today in the bay," the increase of child covid-19 hospitalizations across the country that have doctors sounding alarms. >> a nice day for a hike
