down to about a quarter of a mile. elsewhere it is fairly clear as you're starting out on this tuesday morning. the tri-valley commute is all clear. we can see there's already a lot of people up and out the door. we're going to start out with clouds and start to see the sun peeking out. it's shaping up to be a really nice day. our headed for the mid-60s for the south bay. upper 60s for santa rosa and concord reaching 67. also 67 in antioch. we'll talk about the changes ahead in our forecast going into the rest of the week and weekend in a few minutes. >> thank you so much. we begin with parts of ukraine levelled as the fighting rages on. new drone video from a few miles from the russian border shows what's left behind after more than five weeks of russian shelling. some experts are starting to think the war is looking more and more like a stalemate. new overnight, russian missiles struck a government building and at least eight civilians and three military personnel are

said to be trapped in the rubble. there's no word on injuries or deaths. russia also now says it will only use nuclear weapons if faced with a threats of its existence. the u.n. says more than 1,100 people have died in the fighting and one in two ukrainian children have fled their homes. >> we have live team coverage on the latest developments. controversial statement that vladimir putin cannot remain in power. >> the fact of the matter is i was expressing the more outrage i felt toward the way putin is dealing and the actions of this man, just brutality. >> reporter: the president insisting he was not calling for a regime change and that his comments will not trigger more aggression from putin. >> the idea that he's going to do something outrageous because i called him for what he was and what he's doing, i think, is just not rational. >> reporter: allies voiced concern that russia will use mr. biden's words as propaganda. french president macron saying we can't escalate in either words or actions. facing fiercer resistance from ukraine, russian forces are shifting their focus to the east, a move that may be geared toward splitting the country in two. in kyiv, ukrainians are holding on to hope. >> but i think that if everyone

will keep kyiv, putin will win, and i don't want to let him win. >> reporter: president biden promising more aid as part of his $6 trillion budget proposal. russia and ukraine return to the negotiating table in turkey today. ukraine's president says he's willing to discuss his country's neutrality in order to end the war without delay. when it comes to negotiations, ukrainian officials say they will push for a cease-fire but will not give up any territory. >> brie, you mentioned the president's budget proposal. what else does it include? >> reporter: well, the president's budget proposal includes increased funding for defense spending, as well as increased funds to help law enforcement fight crime. it would also raise the corporate tax rate from 21% to 28% and impose a 20% minimum tax

rate for households making more than $100 million. >> brie, thank you. now, amid the fighting there is growing concern that ukrainian port city of odesa could be the focus of russia's next attack. people living in that area are preparing for the worst and guarding one of the most cherished buildings within the city. you can find out what residents are doing to protect the two centuries' old odesa opera house. that's coming up on the "today" show at 7:00, after us here on "today in the bay." now, the war in ukraine putting new pressure on fuel costs and with the double whammy for skyrocketing inflation, it is really adding to struggles for many people trying to make it in the bay. >> cierra johnson is joining us about the higher gas prices and the higher cost of living we're all going through. >> reporter: we do want to start with the gas prices and it's a story we've been following for

several weeks now. several mornings i've watched the prices go up. right now you can expect to pay about $5.99 a gallon for unleaded gas. this price has remained pretty steady for the last couple of days. but something that has not remained steady, the overall average gas price here in the state of california. now, according to aaa, the state average right now $5.91 a gallon. this is up from $4.82 just a month ago, and this time last year we were all paying $3.89 a gallon. and it's not just gas, but you mentioned just simply trying to make it in the bay and inflation and what we're expected to pay for other items outside of gasoline. so the u.s. bureau of labor statistics says that the average annual cost of groceries for american households is about $420 a month in 2020. after inflation, that is now

pushing $450 per month. and with inflation now at almost 8%, we spoke with a certified financial planner in alameda. he says many of his clients who have seen their bills for groceries and gas go through the roof, so what does he recommend? well, while the amount of money coming in has stayed the same, he recommends that you don't dip into your retirement or emergency savings or even go further into debt to cope with that inflation. instead, he says you should calculate your personal inflation rate, compare your bank and credit card statements from last year for the past three months and look at where your spending as increased the most. another piece of advice, focus on the needs rather than the wants. >> and that has been a huge benefit because then we can look at potentially cutting back some discretionary spending and reallocate that money to places where it's the most necessary. >> reporter: and another piece of advice is something we've

heard for so long, make sure you have that emergency savings. he recommends three to six months' worth of spending, another great piece of advice to make sure you're saving the overall portion of your paycheck. he recommends about 15%. of course, be sure to focus on your money because gas still very high here in marin county, as well as the bay area. we're live in mill valley, cierra johnson for "today in the bay." >> all great advice. just think about people who were already struggling to make it in the bay. now you have to cut even more. it's just so hard. thank you so much for that update. 5:07 right now. in a few hours talks resume for striking workers at the chevron refinery in richmond. the two side met for the first time yesterday after steelworkers walked off the job last week demanding higher wages. a union spokesperson says nothing was decided but workers are hopeful a new deal can be reached. pleasanton mayor jerry thorne has died.

thorne's career spanned 25 years, including eight years as mayor. his cause of death is not yet known. flags are being lowered to half staff to honor him. uncovering the hundreds of billions of dollars in fraud tied to government related payoffs. that is now the task of the federal government. when the pandemic hit, millions of americans were suddenly out of work. the government approved $5 trillion to help struggling americans and small businesses. some exploited the system. as nbc's lester holt found out, one case alone, covid relief money went to purchase a multi-million mansion. >> we knew from the get-go these loans and programs were tempting targets. >> absolutely. >> it was known here. >> it was known and people knew that the money needed to get out quickly and they knew that all you needed to do was put in the loan and get certified. >> that's michael horowitz, the chair of the pandemic response

accountability committee, which is uncovering the mishandling of these federal payments. it's part of the new nbc series "the fleecing of america", coming right after "today in the bay." the segments will be airing all week. >> we knew this was coming. it is 5:08 this morning. taking a live look at the bay bridge, as we get started with tuesday. and it's a little foggy out there to start this tuesday morning. meteorologist kari hall has been monitoring what we can expect from the temperatures today. you said the rain has moved out and we're dealing with something else. >> yes, so here's all of the rain that we were seeing yesterday with that storm system that's now bringing a lot of snow to the rockies and rain for the desert southwest. as we go into today, that continues to move away. let's talk about how much rain we measured with the storm that moved through. ben lomond got over 2 inches of rain, fairfax a little over 1 inch of rain. castro valley got 0.8 of an inch. we saw higher rainfall totals

for los gatos and concord, almost 1/2 inch of rain. san francisco, 0.1 of an inch and san jose 0.25 of an inch of rain. we will be drying out over the next few days. let's get you out on the roadways with a live look outside in dublin, starting out this tuesday morning, which we typically do start to see a heavier flow of traffic. as of now it looks good, except for this one accident i saw popping up in walnut creek on 680, and we're starting to see a little bit of a backup approaching that accident. you do want to allow extra time to get through this stretch. the rest of the commute is looking pretty good around the bay area, as we also look at the tunnel, it will be closing over the overnight hours. you may want to find an alternate route for tomorrow morning. we're going to be watching that and we'll talk more about weather and traffic in a few minutes. >> thank you. as you head out the door, a warning for speeding drivers.

live view at our bay bridge toll plaza camera, it is a nice and light flow this morning, and they may turn on the metering lights at 5:30. for now, let's check in with frank holland at cnbc. >> thank you. turning to wall street, stocks set to open slightly higher after all three major averages closed in the green on monday. meanwhile, the price of bitcoin surged past $47,000 on monday, extending a weekend rally and turning positive for 2022. in focus, consumer confidence data and the job openings and labor turnover survey are out at 10:00 eastern, ahead of the jobs report on friday. lululemon and micron will report earnings after the bell today. the price of bitcoin has surged over $47,000, extending rally that began on sunday when they broke past the key level of $45,000. the currency has been rising since friday, gaining nearly 7%

and erasing all of its losses in 2022. there's no one particular catalyst or the recent move, but institutional demand for more exposure to bitcoin has been growing in the last week. goldman sachs became the first major u.s. bank to trade it over the counter and it's about to make an investment into a crypto fund. dairy queen is looking beyond blizzards and other desserts, expanding burger offerings. the new stacked burger line launches today and will offer customers five varieties. their biggest menu expansion in two decades. they have a flamethrower, a one cheese deluxe, two cheese deluxe and the original. the launch was slated for the fall of 2021 but they postponed because the labor crunch only exacerbated supply chain issues. marcus and laura, might be long lines at the dairy queen. >> who is up for a burger this year? >> me. you know i am. >> i'm hungry. i would take one. >> and i could take fries any

trending this morning, another honor for taylor swift. >> she's won grammys and even an emmy, but she set some guinness book world records, this she has not received until now. you can now call her dr. swift. the pop superstar is set to receive an honorary doctorate of fine arts degree from nyu. she also is set to deliver this year's commencement speech, not only for this year's graduating class but the classes of 2020 and 2021 who did not participate in a traditional graduation due to the pandemic. the event takes place at yankee stadium in may. it will be a full house. >> i guess they're offering classes, you can take classes on taylor swift as well. maybe her influence on the media or just in society. should be interesting. >> i hope she makes a good grade or there will be bad blood. let's get a look at

today. >> it looks pretty good as you're getting ready to head out. we are just seeing fog in parts of the north bay, elsewhere it is clear. we're down to a quarter mile visibility in santa rosa. napa, it's about a half mile. so allow some extra time to work your way through that and make it into the day. take a look at martinez. it's going to be a beautiful day for planning to get outside, going to the park. take a look at our trend as we see our temperatures starting out in the low 50s, heading into the mid-60s for later today. we'll see some upper 60s for the south bay, with morgan hill reaching 67 degrees, 65 in los gatos, and for the east bay we're up to 66 in hayward, and expect a high of about 62 in san mateo. looking at 60 in downtown san francisco. and santa rosa, 68 degrees, expect more dry weather as we go into the week. and it looks like it just kind of sticks around a while. the high pressure rebuilds across the region and drives that storm track farther to the

north. we're not looking at any more chances of rain through at least the next several days. as we look at our ten-day forecast, high temperatures for morgan hill, expect it to reach about 66 degrees for today, and then we see low 70s tomorrow, mid-70s for the end of the week into the weekend. maybe slightly cooler on sunday, but then it goes right back up. we have 80s within our sight for the middle of next week. for our inland forecast over the next several days, a lot of sun icons here as temperatures go from the upper 60s today. we'll see some mid-70s for saturday. it will be nice for getting outside. slightly cooler for sunday into monday. san francisco is going to see highs in the low 60s today. it trends more toward mid to upper 60s for the end of the week and sunday looks very windy, but it's going to be just slightly cooler compared to what we'll see on saturday. heading out this morning, as we take a live look at the golden gate bridge, we're starting to see a few more cars coming into

the city right now and we're going to see a smooth flow of traffic for many spots, except for one slowdown that i'm seeing around walnut creek. we're seeing an accident there on 680 and the approach coming southbound is looking a little bit slow as people try to go a little slower around that accident there. we do have the fog in the north bay traveling down 101, as well as 37, and we are going to see that fog at times get really dense. so just a heads-up about that. for the tri-valley, drive times are good except for it's starting to slow down on feb 84, to 680 takes you about 11 minutes. we are going to keep an eye on all of this. the fog the main issue for the commute in the north bay. marcus and laura. >> thank you so much. coming up next, nbc bay area responds. >> her new microwave isn't

good morning. michelle in san jose bought a new lg microwave using $169 in cash, and $45 in best buy credit. but two months later she says it stopped working. she said she called best buy for help but a rep instructed her to call lg, so she did. michelle says lg told her a refund was on its way. weeks went by, no update. michelle asked our team to turn up the heat. we contacted lg and best buy. lg told us they sent the refund a month ago to the wrong address. the check was re-sent to the

after a stolen car investigation. this is between 3rd and 4th street. in the last few minutes we learned that officers made an arrest right near the san jose state campus and police say so far they're not revealing any more details at this point. that police presence happened this morning in the exact same area where there's been a lot of other recent police activity, and that includes a weekend police shooting at a busy popular taqueria. "today in the bay's" bob redell joins us outside police headquarters. i understand that police have released new images from that shooting. >> reporter: correct. good morning, laura. this is in an attempt to correct what police say is misinformation circulating about that officer-involved shooting. you might recall san jose police officers responded early sunday morning to reports of a man with a gun inside the la victoria taqueria on san carlos. cell phone video shows officers walking up the stairs to the restaurant. a man walks out and officers fire their weapons.

police say the man was wounded, but is expected to survive. here's what san jose police say happened when their officers arrived. >> one of the subjects pointed a gun at another person involved, one of the arriving officers fired his handgun, struck the suspect at least one time. >> reporter: the department is responding to a report from the mercury news that the man they shot had actually disarmed someone inside and was walking out backwards while holding the gun. police released still photos they say is from an officer's body-worn camera. you can see a man holding what looks like a gun. the department also tweeted images of a fight inside the restaurant that they say triggered calls to police. the san jose police chief is scheduled to hold a news conference later today to discuss this officer-involved shooting. reporting live outside san jose police headquarters, bob redell,

"today in the bay." >> thank you. 5:33 right now and all eyes on turkey this morning. peace talks between ukraine and russia are under way right now. turkey's president ordered today's sit-down calling for real progress to end the conflict, but officials from both sides of the table have tempered expectations as the war is looking more like a stale meet with each day passing. the talks come as ukraine reports that they're making progress, pushing russia and troops back in the fight around ukraine's capital. russian troops have moved to circle and ought off ukrainian troops in the eastern part of the country. and neighboring poland not just helping with the flood of people, but animals as well. one vet clinic on the polish border is treating wounded animals and pets from ukraine. some refugees have refused to leave their furry family members behind. vet workers are helping animals rescued by animal rights groups. some of them include injuries of

broken bones, gunshot wounds. the group is already opening another warehouse to help shelter them. if you're looking for ways to help, head over to nbcbayarea.com, or our nbc bay area app. all you have to do is click on how to help ukraine war victims at the top of the page. testimony is picking up today in the criminal trial of former theranos executive sunny balwani. we have a live look at the federal courthouse where trial kicked off last week. the prosecution is moving quickly to try to establish close ties between balwani and disgraced founder elizabeth holmes. balwani is holmes' former boyfriend. holmes is now awaiting sentencing after being convicted on similar charges in january. the first witness in this trial, former employee whistleblower first took the stand. turning to our climate in crisis, get ready for new water restrictions. governor newsom issuing an

executive order calling for stricter conservation rules. now, he's directing the water board to consider a ban on watering grass at businesses and institutions and decorative grass. he's calling on local water agencies to go to what's called level 2 measures, meaning up to 20% cuts. the governor says california is coming off of the driest three months in the state's record recording history, and despite yesterday's rainfall, valley water says south bay reservoirs remain unchanged, averaging 25% of capacity. >> it's hard to see those levels so low. look at that. clear skies today as we take a live look at downtown san jose. kari is tracking our forecast and what's in store for today. >> think about the rain we got yesterday, it just soaked right into the ground. it's not going to help replenish the reservoirs, even they we got over 2 inches of rain in the

santa cruz mountains. brentwood a little over 1/2 inch of rain, castro valley about 0.8 of an inch. for los gatos, reaching 0.75 of an inch, over 1/2 inch in danville. san francisco barely got anything with 0.18 of an inch and san jose about 0.25 of an inch of rain. as you're heading out, things are dry. we'll see sun and clouds and temperatures from the mid-50s to 60s today. let's get you out the door with a live look outside for your commute through fremont. as of right now, it is flowing pretty well, but we have a problem spot. as you're heading through walnut creek on 680 southbound, we have a car on the roof and so -- on its roof, and so, unfortunately, it looks like it hit an animal and it flipped over and it's causing a big backup going 680

southbound into walnut creek. as we get a look at events you want to look forward to for tonight, billie eilish will be at the chase center and expect a lot of traffic in that area starting at 7:30 this evening. later today if you're going to be heading back to the east day, the caldecott tunnel will be closed between 10:00 p.m. and 4:30 in the morning. and that will be happening not only tonight, but wednesday night as well. you want to plan ahead because that may cause a big backup as well. we're seeing an accident on 24, too, as you approach the caldecott. it's 5:38, a controversial bill now law in florida. next on "today in the bay," the so-called don't say gay law. why advocates call it homophobic and the message it's sending to the rest of the country. >> and new fallout for will smith. some are calling for his oscar

bill into law. >> nbc's sam brock reports, it limits what grade schools, we're talking about third grade and younger, can learn about sexuality and gender or yen sagz in the classroom. >> reporter: good morning. good to be with you. there is no shortage of reaction in florida or throughout the country right now on the parental rights and education bill in florida, also known by its detractors as the don't say gay law that was just signed into law by governor ron desantis. he says that parents should have agency and discretion over what their kids are exposed to. critics say it's bigotry, plain and simple. the question now becomes how will the law work and how will it be applied? because it was very vaguely written. it specifies there's no instruction or conversation, even, about sexual orientation and gender identity for kids from kindergarten through third grade. then it says it was to be age and developmentally appropriate for grades after that. what does that mean? it could be something for the courts to determine. another thing about the bill is

how it's going to be enforced. it relies on regular citizens to file lawsuits against the school districts if they feel like policies have been violated, which means the school districts have to have a big pot of money available to defend those lawsuits should they come. you can expect a court battle over this, for sure. we talked to some same-sex parents here about the kind of message it sends in the fight for equality nationwide and whether they feel this is a massive step backwards. that's all coming up on "today." back to you guys. >> sam, thank you. 5:44, and new this morning state leaders are pushing ahead with a bill that would let poll workers hide their addresses from public records. the safe at home bill was originally designed to protect domestic violence victims. it was expanded to include people who work at abortion clinics and their patients. the push to expand the protection further comes following the 2020 presidential election and the capital siege. since then, a recent national survey finds one in six poll

workers have experienced threats from their jobs. back here in the bay area, the giants season opens a little more than a week from now. next week, to be exact. the team now saying one of its key players will start the season on the injured list, third baseman evan longoria is having surgery today to repair a ligament in his right index finger. it's not clear how long he will be out. the giants open up against the marlins for the first game. a lot of people this morning are probably wondering what will be the potential consequences for will smith, the fallout in the slap heard around the world. >> he probably should not fear having his oscar taken away, he was just awarded it. academy leaders have now launched an investigation and there are some reports that chris rock's joke that triggered will smith's actions was not clifrd during the show's rehearsal. the academy may decide to punish smith, but one insider tells the

month. this is new dramatic video of a dog rescued in southern california. take a look at your screen. the dog had been stranded for nearly two hours. this is in the los angeles river. look at them trying to get the dog. can't hold onto it. the rescuers tried to air lift the dog and owner to safety but the dog slipped through their hands. a bystander jumped in trying to help out as well, but then that person needed help, losing grip of the dog and firefighters had to rescue the bystander. eventually crews safely pulled the dog from the water. everyone is said to be okay. >> the currents were going against them, too, carrying the dog. >> and the dog is trying to stay afloat. >> they're lucky they could do a double-rescue. >> cool to see. thank you for those who are saving lives out there. >> happy ending. here we go, approaching 6:00 this morning. could russia be scaling back its invasion? the new details just into our newsroom signaling the potential decrease of violence in some

meteorologist kari hall has been tracking that. how are we looking today? >> not bad at all. we saw fog in parts of the north bay but even that looks like it's clearing up. visibility not too bad at about 1 mile and 3/4. heading out, it's clear and temperatures in the upper 40s. we're in for a lot of sunshine, so even though we're starting out chilly, it's going to warm up nicely and be in the mid-60s by early in the afternoon. going hour-by-hour for all of our microclimates, and san martin, expect temperatures at about 65 at 4:00, fremont 60 degrees, and 65 in martinez. seasonable weather, but it will warm up. we'll talk more about that and a look at the commute in a few minutes. >> thank you, kari. 6:00 right now, we begin with parts of ukraine levelled, as the fighting rages on. new drone video to show you here, just a few miles from the russian border, showing what's left behind after more than five weeks of russian shelling. some experts are starting to think the war is looking more and more like
