biggest warm-up expected on thursday. >> look at that. bay area, bracing for a heat wave. kari is keeping track of all of it. >> we do have a lot of changes coming our way. we're starting out nice and clear as you're heading out the door. today our temperatures reach into the upper 60s and low 70s. really nice for those outdoor activities. we start to see temperatures ramping up tomorrow, heading into the mid to upper 80s, and that won't be the hottest day of the week. so we are going to have a big time summer feel and then we head back to spring and then eventually winter. we have all kinds of weather in the forecast. we'll talk more about it coming up in a few minutes. >> thank you so much. a live look at the state capitol this tuesday morning. some state lawmakers pushing for tighter gun control measures after sunday morning's early morning downtown shooting just blocks from the capitol. the one man arrested in connection with the shooting is set to appear in court today. at this point police will only say 26-year-old dandre martin is

tied to the investigation. they're not saying how. last night people gathered for a candlelight vigil three blocks from the scene of the shooting. the six people who died have now been identified and police still believe multiple people opened fire. our cierra johnson will be live in sacramento with the latest developments ahead at 6:30. >> 6:02 right now. in the next hour ukraine's president volodymyr zelenskyy meets with the united nations security council. he's expected to ask for more military assistance as ukraine accuses russia of war crimes and the deaths of hundreds of people on the outskirts of kyiv. some of those images emerging from the scene, they're painful for a lot of people to look at. "today in the bay's" brie jackson is live in washington this morning. the global outrage against russia really growing this morning. >> reporter: absolutely, marcus. the biden administration is considering adding more sanctions on russia and tightening existing ones, after recent attacks. but before that meeting with the

u.n. security council that you just mentioned, ukraine's president zelenskyy says that new sanctions are not enough. now, a warning, the images you're about to see are quite disturbing. photos and videos purported to show dead bodies strewn on city streets where brought condemnation. the general assembly could vote on whether to suspend russia from the human rights council as early as thursday. secretary of state blinken will attend the nato foreign ministers meetings this week. they'll discuss joint efforts to hold president putin accountable and support ukraine, as well as promote a swift end to the war in ukraine. president biden is calling for putin to go on trial for war crimes. >> we have to gather all the details so this can be a war crime trial. >> the international community, and that includes the united states, will continue to collect evidence, will continue to contribute to investigative

efforts to make sure that russia is held properly accountable. >> reporter: russia's foreign minister rejected allegations, calling the scenes staged. u.s. defense officials say russian air strikes have declined and about two-thirds of their troops near kyiv have repositioned. meanwhile, brittain's defense ministry says ukraine's forces have retaken key terrain in the northern part of the country. despite the deadly scene in bucha, zelenskyy says he plan to continue negotiations to end the war, but he warns that russia is not done fighting. marcus. >> brie jackson in washington this morning, thank you. 6:04 right now. testimony resumes this morning in the trial of former theranos executive sunny balwani. "today in the bay's" kris sanchez joins us outside the courthouse in san jose. defense attorneys are trying to distance balwani's actions from elizabeth holmes. >> reporter: as you probably know by now, just about

everybody knows by now, those trials were separated legally, these two people being tried separately, but now the goal on the part of the defense is to make sure the jurors think of balwani and holmes separately as well. balwani was the chief operating officer at theranos and the government is trying to show that he was making executive decisions about the company's blood testing technology and devices, which we now know did not work. his team is trying to make the case that he was just following orders and that holmes was calling the shots. now, the last time court was in session last week, the former lab director was on the stand and this week we expect some on the same witnesses who testified in the holmes trial, which ended in four guilty counts. we did talk with a legal expert who says that painting sunny balwani as a mere shareholder is going to be tough as the jury already knows that he and elizabeth holmes were business and romantic partners. court resumes at 9:00 in san

jose this morning. kris sanchez, "today in the bay." >> thank you. happening today, san jose may be ready to drop its mask mandate. santa clara county lifted its mask requirements just about a month ago and that was two weeks after the state did so. san jose technically still requires masks indoors. today's move would align with the city and state and counts as well. now, the council will also debate extending virtual council meetings through next month. the omicron ba.2 subvariant is now the most dominant covid strain. cdc says that it is responsible for more than 70% of the u.s. cases right now. experts say that it will likely completely displace earlier omicron versions in the coming weeks. white house adviser and director dr. anthony fauci is now among those who do not believe another major surge will occur. it is 6:06 on your tuesday morning. taking a live look outside

overlooking san francisco. clear skies. look at what it says at the bottom, we are tracking a warm-up. kari has a look at our forecast for today. it should be mild today, but pretty hot tomorrow? >> yeah, we are going to start to see temperatures heating up for tomorrow. we'll take a live look outside at our commute through the tri-valley. we are all clear as you're heading out the door. take a look at our nice day ahead, starting out in the upper 40s. we'll be at 68 degrees at about 1:00 this afternoon. overall a beautiful, sunny day. we can see all of our microclimates and highs for this afternoon. as we go into tomorrow we start to feel temperatures heating up and more of a summer feel with napa hitting 84 degrees and 86 in san jose. san martin at about 88 degrees and reaching 93 on thursday. that could be the earliest we've ever had 90-degree temperatures in the bay area and it's going to be with us just briefly before it cools off. we'll talk more about that coming up. mike, you have a look at where

we can find cheaper gas prices. >> these prices look big because they're on the full screen. tracking cheap prices, more bay area cities. today we're starting in the north bay, vallejo, $5.65 a gallon at central gas on 2500 sonoma boulevard. berkeley, it's $5.69 a gallon, cash only, though. number one gas on 1900 martin luther king jr. way. palo alto, $5.97 at valero on 1963 el camino real. we're sampling from around the bay every day. we'll look at the traffic. we're looking at overall a pretty predictable drive. slowing in san jose kind of easing off from the first burst. the build coming over out of the altamont pass, around greenville, and also vasco. we're at about a half hour now out of discovery bay and down toward 580. slowing right here at the last bend. we get a lot more traffic toward

good tuesday morning. the time now is 6:14. heading out the door in the east bay it's going to be a really nice one. make plans to get outside, maybe even just enjoy lunch out there. in martinez at noon we're at 66 degrees and headed for the low 70s with a breezy wind and a mostly sunny sky. tomorrow is when the temperatures start to feel like summer. we're going to talk about that in the forecast coming up. >> there you go, metering lights turned on a half hour ago. now we see the backup in the camera shot. this will fill in very quickly.

we'll show you that in a few minutes and also show you the trend and anything outside the ordinary coming up. >> good morning. happy tuesday to you. breaking business news this morning. the ceo of twitter just announced elon musk will join twitter's board of directors. musk just revealed in financial filings he had purchased about 9% of twitter. that makes him the biggest single shareholder. the twitter ceo made the announcement on twitter, of course, writing he's both a passionate believer and intense critic of the service which is exactly what we need at twitter, and in the boardroom, to make us stronger in the long term. welcome, elon. now, there are any number of people who worry that musk will push to have former president trump reinstated on twitter. musk says he believes in free speech. twitter, of course, not subject to free speech for the first amendment at all. and musk and his companies have themselves quashed speech, as is

their right. they are not government. but tesla just recently fired an employee for posting a video on youtube of his own car on his own time. other news, california will hold a special election today to replace former congressman devin nunes who quit his job in congress to run donald trump's version of twitter called truth social. now, the seat in the fresno area will likely stay in republican hands for now, but will eventually cease to exist a few months from now due to redistricting. nunes' new job at truth social has not gone well at all. reports say two top technology officers, the people that write the software, have quit the company. president trump himself doesn't post to it. most people who signed up for it still haven't had their accounts activated. there's this weird holding company that is the stock for trump's truth social. it's down about 8% in premarket this morning.

why? because of twitter and musk and the possibility that trump, possibility that trump could come back to twitter. >> people represented by nunes in the central valley, they were upset as well because they felt like he wasn't representing them and eventually he left. interesting to follow. thank you. san francisco transit leaders are ready to green light a new option for taxi drivers to partner with uber. today they're debating a new pilot program allowing uber to team up with the flywheel taxi app. the passengers can get a cab through uber. a similar partnership is now in place in new york city. now, the rates themselves are set by uber. sfmta will have to amend its transportation code for that program to launch. trending this morning, this is a little weird. oh, you like it? >> i'm not going to say that. >> how would you like to get a

taste of the internet? >> things that make you go hmm. >> maybe it would be metallic, i don't know. >> coca-cola believes they may have the answer for you and it's introducing a pixel flavored zero sugar cola called byte. they claim that it brings the flavor of pixels to life in a beverage transcends the digital and physical realms. they believe when we taste it, coke is teasing that this new flavor will be in fortnite virtual world. it hits stores in the real world on may 2nd. >> maybe it's juicy. i don't know. >> you would think it would be in a square can. >> you need to be on the marketing team. >> maybe. or maybe not. >> who thinks about that? i wonder what the internet tastes like. it doesn't taste like anything.

>> i've been tempted to buy that space flavor that they have, but you only can buy a case of them and i just want one. >> bring it here and i'll try it with you. >> i'll do that then. >> we'll do it on facebook live or something. >> i'm going from hot coffee to iced coffee in a couple of days. it's going to really heat up here. let's talk about our temperatures and our beautiful start we have on this tuesday morning. take a look at our sunrise over the bay bridge. our temperatures still comfortable, with some upper 40s and low 50s. and this is where we're headed. still great day to get outside. reaching 66 in san mateo and san francisco, 73 in oakland, as well as dublin and fremont in the upper 60s. then when we take a look at our highs for tomorrow afternoon, that's when it starts to warm up out there with concord reaching 89 degrees, 83 in mountain view and we'll be in the upper 70s in san francisco, scots valley at

82. then rail heating up on thursday. this is the peak of the heat, reaching possibly the earliest date we've had 90-degree temperatures on record. concord, up to 91 on thursday and napa, 86 degrees. we know it's still just early april, but it's going to be a good beach day. with people flocking to a place to try to go cool off, you do want to be careful because there's a beach hazard statement in effect. they're saying there could be 8 to 12 foot swells and we could also see the sneaker waves that come up higher on the beach than some of the previous waves. never turn your water to the back and be careful. as we deal with the extreme heat, it's only with us for a couple of days and then the high pressure moves away. we'll see a couple of blasts of cold air coming in early next week that could bring in a little bit of moisture. but what happens when we have high pressure, and the reason why these temperatures heat up, we have a clockwise wind flow around the high pressure but also the air is descending, as

as it sinks down closer to the earth it warms up. as we get the northerly wind, it moves over land, and the temperatures get even hotter. high pressure just causes the heat to continue to build. but once again, it's not here for long. looking at palo alto in our ten-day temperature trend, we're going from low 70s to low 80s to 88 degrees on thursday. we get a very weak ocean breeze that will bring temperatures down, but then the big blast of cold air, we may only make it into the low 50s on monday. i know that's crazy, we're going from air-conditioning to opening up the windows, to turning on the heat all in the course of a couple of days. our seven-day forecast for the inland areas brings in those record high temperatures on thursday, and then cooling down early next week with scattered showers. and it's going to be windy in san francisco as we go through all of these changes. mike, what is it looking like now at the bay bridge? >> a little more crowded than before. we talked about the build

happening naturally and gradually for the first half hour and now the metering lights have been on for almost 45 minutes now. finally we're seeing all of these lanes fill in past the 880 over-crossing. the sensors show the slowing and it continues through treasure island. the volume carries over to san francisco. building over here by highway 37 out of vallejo and highway 4 in contra costa count as well. so your typical spots developing for the bigger build. we're seeing san jose really start to show that slower drive. hayward, fremont, south 880, traveling south along the nimitz to the east bay. we're looking for that to start building over the next half hour or so. typically the 7:00 hour really sees the burst of traffic through silicon valley. over here we're looking at a breakdown of speeds. vasco road has seen a lot more time added on. the last one-quarter of the section between discovery bay and 580 really shows speeds

right now at 6:30, breaking news out of sacramento. a second arrest just announced in the weekend mass shooting. we're live near the scene with

the connection police say this latest suspect has to the man already in custody, and the changes gun opponents are now demanding. this is "today in the bay." good tuesday morning to you. thanks so much for joining us. i'm laura garcia. >> i'm marcus washington. well, police in sacramento released new details within the last hour. they had to piece together some clues tied to the people found shot and injured at the scene. "today in the bay" cierra johnson live for us just a few blocks from where the shooting happened. what are police saying? >> reporter: good morning, marcus. police are saying that the second suspect is 27-year-old smiley martin, located at the scene of the shooting with serious injuries. he was transported to a local hospital and it was then that smiley martin was quickly identified as a person of interest. he remained under supervision at the hospital until he was later transferred, taken into custody

by sacramento police to the ortn that developed during that investigation. the sticking point right now, smiley martin is the brother of dandre martin, the 26-year-old, the first individual arrested for his involvement in that shooting. now, right now police aren't elaborating on what exactly that involvement means, but they are saying he is in fact involved in this shooting. now, sacramento police tell our sister station they are continuing to look for additional shooters, and as martin awaits his time in court he sees a judge later this afternoon, a call for changes coming, calls to stop the violence from those who have lost loved ones and they gathered for a vigil last night. so take a look at your screen. these are the names of the men and women killed in sunday's shooting. a shooting considered the deadliest in sacramento history. three men, three women. they range in age from 21 years old to 57 years old.

12 other people were hurt in the shooting. >> i said the second mass shooting we've had in sacramento. what are we going to do about that, city? our voices can no longer be silenced. >> reporter: again, this is the second mass shooting in just a number of weeks for this community. the last happened last month, an individual killed his three daughters and then later killed their chaperone inside of a church before killing himself. but back out here live, the community continues to mourn that situation. this, as investigators make another arrest, the 27-year-old brother, smiley martin, the brother of the first suspect -- or person of interest, rather, dandre martin, in sunday's shooting. we will remain here in downtown sacramento gathering information on the latest information. we're live in sacramento, cierra johnson for "today in the bay." >> tough for that entire

community. hopefully they find all of those responsible. thank you. many state lawmakers are calling for stronger gun control measures in the wake of the shooting. joining us now live in south bay, state senator joining us this morning. this tragedy hitting so many families so hard. i'm sure you've got words you would like to say to some of these family members and to the victims. >> first and foremost, you know, the tragedy is, frankly, it's an overall depression, if you will, on sacramento. it's very, very difficult, of course, to go about your business, for people to do the things they do in an otherwise vibrant city like this. so condolences to the families. whatever we're experiencing, obviously they're experiencing grief and pain at an altogether different level and our hearts go out to them. >> what do you say to a public that says, here we go again,

here we are again? >> well, you know, each one of these situations seems a little bit different. i responded, as did so many others, to the tragedy in my own county so recently with the mass shooting at bta, which was a set of circumstances all its own, perhaps mental issues driving a disgruntled employee and you've got this kind of a shooting. in sacramento we don't know the exact facts, we don't know exactly what happened over on j street, but we know that -- we think we know a stolen weapon was involved. some of the things that you see in this set of facts that is starting to unveil itself are things that we need to work on here, and they're not the usual -- they're not the usual

things. sacramento and california have some of the more stringent gun laws in the country. president biden responded to this shooting, rightfully so, saying we need more regulation, we need background checks, we need bans on high capacity magazines. most everything that he said applies to the rest of the country. it doesn't apply here because we're already doing it. so what do we do? and i think when you start looking at what appear to be the facts, a stolen weapon, we think these weapons shouldn't have been in the hands of the folks who had them at all. this isn't a case of law-abiding registered gun owners going out on a hunting trip, obviously. we know that ghost guns, we know that stolen guns, we know that guns in the hands of felons are probably the last really big frontier, if you will, in terms of dealing with or attacking gun

violence here in california. we need to get those guns out of the hands of people who have them and just make sure that folks who have bad intentions don't have their hands on a gun in the first place. >> i know for than estimated 4.2 million californians, adults own a gun. but every case is unique in some way or another. this one quite possibly involved a stolen gun, as you mentioned, the vta tragedy. we definitely had mental health issues there. but with all these different types of gun violence that are continuously happening in our communities across the nation, for our state of california, what else do you think can be done to try to prevent them at all? as you mentioned, we have some of the strictest gun control laws in the city already. >> clearly we're not doing a very good job of getting guns out of the hands of folks that don't have them in the first

place. i don't have those exact statistics at hand this morning, but i will tell you that it is appalling how many guns are out on the street in the hands of folks who literally are not supposed to have them for one reason or another. we have red flag laws here, we have a linkage between mental health issues and the right to have a gun. we have background checks. yet we still have, statistically speaking, an enormous amount of guns in the hands of felons and we're not doing a very good job of tracking stolen guns. legislation has been passed here in california that requires individuals to report a stolen gun. what happens then? are those firearms being tracked? are detectives on that? are we getting them out of the hands of whoever stole them or whoever sold them to somebody else? those transactions have to be passed down and they have nothing to do with law-abiding begun owners or regulations on

obamacare, that brought medical insurance to mills of people who did not have it before. the proposed change today involves families. under current rules, the families of people who can get affordable medical insurance for themselves through their employer don't qualify for aca, and you can see a situation where your employer charges you very little for your insurance, but charges some huge amount for your children. under the current rules, you can't afford to ensure them through your employer, but they also don't qualify for aca either. they're going to try to change that. the vote on the nomination of ketanji brown jackson for supreme court justice ended in a tie in the senate judiciary committee. it will still move forward to the full senate floor, where it is expected to pass. republican mitt romney says he will support jackson's nomination. now, what is strange is romney voted no when jackson was up for

the federal court of appeals just a few years ago. now he's a yes. south carolina's lindsey graham voted yes for jackson on the appellate court. now he's a no. ukrainian president zelenskyy will address the u.n. security council today. russia has veto power over anything the council does, so it won't be doing much. moments ago, the european union announced even more sanctions against russia, including the banning of the purchase of russian coal. back here in the bay area, moments ago, twitter announced it had appointed billionaire e ln musk to the board of directors. musk recently purchased about 9% of the company. there are any number of people who worry musk will push to have former president trump reinstated on twitter. musk says he believes in free speech. twitter, of course, not subject to free speech or the first amendment at all. twitter said trump was permanently banned for inciting violence and the glorification of violence. this just in as well, three

separate sources tell nbc trump's daughter ivanka will testify before the house select committee investigating the attacks on the u.s. today. her husband, jared kushner, testified for more than six hours last week. obviously we're watching everything that's happening and there is a lot of it. we're talking about it on social media, on twitter i'm @scott mcgrew. >> thank you so much. when it comes to making it in the bay, the middle class now having a much harder time just buying a new house. >> "today in the bay's" bob redell is live in pleasanton this morning with results of an eye-opening study, bob. >> reporter: good morning to you. yes, this is a new study from the uc berkeley turner center for housing innovation and it finds that, unfortunately, more and more homes in the bay area are becoming out of reach for the middle class. the middle class is defined as anyone making between $80 and $165,000 in the bay area. this is your standard trfeet, f

bedrooms. it is not a mansion now it is listed for $1.95 million. the turner center report says in san francisco in 2010 47% of homes were affordable to the middle class. in 2019 that dropped down to 24%. you need to make around $200,000 just to afford what is supposed to be a starter home. in alameda and santa clara counties the decline is steeper. in 2010 about 64% could afrd a home and in 2019 it's down to 30%. >> we have seen wage growth of 23% roughly over the last ten years but that pales in comparison to the appreciation in home prices, which is 180%. there's a few reasons for this. but chief among them is the fact that we haven't built enough homes. >> it might be time to start thinking about something else, potentially, just if i ever want

is going to see highs in the mid-80s. it gets even hotter from there. the spike in the peak of those temperatures will hit us on thursday, reaching 87 in moraga, los gatos 91 degrees. these 90-degree temperatures may be the earliest we've ever had weather this hot this early in the season. and i know a lot of people are going to try to find somewhere to cool off, but you do have to be really careful near the coastline. we can see sneaker waves and swells reaching up to about 12 feet. high pressure with us just briefly, ramping up those temperatures across california, and then once it moves out we have a couple of cold front that will be sweeping through, possibly even a chance of rain next week. unfortunately, it's not a lot of rain. models have been backing off on how much we could see. but possibly up to a tenth of an inch of rain, but most of us getting less than that for next monday into tuesday. and sierra snow may only reach about 1 to 3 inches. it would be nice to see a lot more than that.

look at the trend over the next few days with concord going from the 70s to the 90s and then back down to the 70s by the end of the weekend. and monday only reaching 58 degrees. that will be the high temperature. so we're going through this huge whiplash as we see our trend all over the place. you want to make sure you keep checking back in for updates. just remember in the near term the heat hits us from wednesday through friday. mike, you were looking at the roads. how is it looking out there now? >> getting more crowded, more congested. we're looking at the south bay with the changes that typically happen about this time of morning. we've seen more traffic on 101, but also 87 building. and we talked about google asking folks to come back to campus a few days a week and we see 101 right around shoreline showing little blips here and there. overall we might see lighter traffic because there are spring breaks for colleges and grade schools throughout the next few weeks and of course, those who are doing college visits know

welcome back. we are following breaking news out of sacramento. word in the last hour of a second arrest tied to the weekend mass shooting. >> "today in the bay's" cierra johnson live for us this morning a few blocks from where the shooting happened. what are police saying this morning? >> reporter: good morning. well, they're saying the second suspect's name is smiley martin. he's the 27-year-old brother of the first suspect that was arrested, 26-year-old dandre martin. smiley, the 27-year-old, the most recent arrest, was located at the scene with serious injuries from the gunfire, was then transported to a local hospital. it was then he was quickly identified as a person of interest, remained under supervision before he was transported by sacramento police to the county jail. now, his brother, 26-year-old
