good wednesday morning. thanks for joining us. i'm kris sanchez. laura garcia has the week off. >> i'm marcus washington. you can also watch us live on roku, amazon fire, apple tv, and online. >> we're going to check in with mike, who is tracking your commute this morning, but first let's start with a look at the forecast. i snuck in the back door because i thought it was going to rain today. >> it's later tonight. so it's still today, but it's later this evening. we are seeing the storm system approaching from the north. as we go through the timeline, we are changing some of our plans because of this rain moving in. they kind of shifted the oakland a's game a little earlier. and we are seeing the north bay covered with downpours at about 5:00, and moving into san francisco, as well as parts of the east bay as we go into this evening. it's going to be off and on throughout tonight and all throughout the day tomorrow. it looks like this could be a

decent storm, and what we need before we head back into some dry weather. we're going to talk about how much rain you could see before it's all said and done and also the all-important weekend forecast coming up. >> you're talking about rain coming in toward the end of the workday and this is the end of the workday for some crews, but not yet for this crew in niles canyon. i haven't heard about delays, but the sensors still not lit up. so mission and 680 are your alternates. still clear in the south bay and peninsula. looking toward the altamont pass, the typical little build, clear by the time you get to north flynn. everything else in contra costa county to the north of that is moving at speed. >> thank you. 5:01 now and breaking news, another blow for wikileaks founder, julian assange.

the decision will go to brittain's interior minister for a final decision. the wikileaks founder still has legal avenues for appeal. assange has fought for years to avoid a trial in the u.s. on charges related to wikileaks' publication of a huge collection of classified documents more than a decade ago. and our other top story now, in district attorney in santa clara county says the suspect in that massive home depot fire in the south bay lit that fire to steal tools. investigators say 27-year-old dyllin gogue is responsible for the five-alarm fire that happened on april 9th. he has been charged now with aggregated arson. a live look now at the scene that is still an ongoing investigation scene. that fire consumed $17 million in inventory, the building also gone, as you can see from that fencing around the area. this is exclusive surveillance

video we obtained of the alleged crime spree before that home depot fire. it shows gogue allegedly stealing a pricey wig from new star beauty supply in east ridge mall, just across the street from the home depot. that happened on march 27th. investigators say he also stole from three other major retail chains this year alone. the d.a. says he started the fire at the home depot while trying to walk out with a cart full of tools. >> he was stopped by a home depot employee and fled in another person's car. later, as the home depot was burning, he continued a theft spree that extended to a macy's in the east bay. >> gogue got into a car and got away, however investigators refuse to elaborate on the get-away driver. they believe gogue was fully responsible for the fire. he is due back in court in june. in just a few hours, the

trial for sunny balwani continues, after the jury learned about his involvement with walgreens. a former walgreens executive testified yesterday that balwani was very involved in that relationship between the companies. the blood testing machines gave wrong results and largely used third-party equipment. in text messages, he told ceo elizabeth holmes that he didn't tell walgreens he switched out their machines for non-theranos tech. legal analysts say this serves as a warning for other companies. >> any large company like a walgreens better be 110% sure that any kind of technology that could impact the lives and well-being of the people who use their stores and buy their products, they better be 100% sure that these technologies work correctly. >> balwani is accused of defrauding both investors and patients. ukraine now reaching a preliminary agreement with russia to evacuate thousands of

civilians from mariupol. the establishment of the humanitarian corridor will allow women, children and older people to leave today. this comes after nearly 300 people were killed when a theatre was destroyed during a relentless bombardment of the city last month. this morning ukrainian president volodymyr zelenskyy says the attacks in the besieged city are extremely severe and is urging weapons from allies. it comes as hundreds remain holed up in a steel plant as russia demands the surrender. now, this agreement comes as russian troops are pouring into eastern ukraine as rush president vladimir putin presses forward with his new offensive. the u.s. is preparing to send more artillery and thousands more ammunition to help ukrainian forces defend themselves. nbc's brie jackson is live in washington with the latest. substantial new military aid package could be coming soon.

>> reporter: good morning, kris. administration officials say a new military aid package could be similar to that $800 million package announced last week and would be critical to ukraine's fight in the donbas region. from the ground and by air, russian soldiers are flooding into eastern ukraine, setting up for a full-scale assault. in response to russia's new wave of attacks, president biden is pledging even more military aid for ukraine. >> will you be sending more artillery to ukraine? >> yes. >> reporter: the pentagon says it's working to get a sense of what to include in a new package but said it would cater toward defending the donbas region. >> they're going to be tailored based on the ukrainians' needs in the moment and what they most require. >> reporter: the u.n. secretary general is calling for a four-day cease-fire this week to

allow civilian evacuations and for humanitarian aid to reach hard-hit areas like mariupol. >> the intense concentration of forces and fire power makes this inevitably more violent, bloody and destructive. >> reporter: u.s. officials warn this new phase of attacks may only be a prelude for a larger offensive putin has planned. >> he's made it clear as day and no words are going to stop his tanks at this moment. >> reporter: the u.s. vows to send weapons to meet ukraine's immediate and long-term needs as the country braces for what's next. u.s. officials say they are also working to convince allies to send more ammo and more artillery to ukraine. >> thank you very much, brie. 5:07 this morning, and now to our climate in crisis. marin county leaders are taking a first step to approve a new plan to go green and it has to do with your takeout order. so all plastic utensils and

we'll see in the north bay a mix of sun and clouds, more clouds moving in as the rain approaches. we're starting with upper 40s and heading for the lower 60s today. we may see showers moving into napa as early as 4:00 and getting heavier toward 6:00. our temperatures around the bay area reach 62 in novato, 64 in san francisco, the farther south you head we'll see warmer temperatures. upper 60s in fremont and also 71 today in fairfield. we'll be talking about that rain coming in in a few minutes. mike, heading out, we want to know where we can find some cheaper gas. >> we're looking at some of the cheaper prices we found around the air and in walnut creek this morning, $5.49 at quick serve on south california boulevard. gilroy to the south, $5.47 at mobil on monterey road. and redwood city, $5.59 at

good wednesday morning. it is 5:13. take a look at our wide view of the satellite, and we can see the storm that will be approaching the bay area. and this looks like a decent one. it's been a while since we've had this much rain and snow headed our way. we'll talk about the timeline and, also, how it shapes up for our weekend coming up in a few minutes.

>> and we're looking at fremont. 880 is picking up volume a little bit. the construction on 84 has cleared. this is a shot from the nimitz, very close to tesla, where there's never any interesting news about tesla or its founder. >> good morning, everyone, happy wednesday to you. a lot of companies here in the bay area, around the nation, will start opening their books to investors and reporters as part of these quarterly reports, and indeed, tesla is on the on deck circle this morning. it will report profits after the closing bell today. two things to watch for. first, how badly the factory shutdown in shanghai affected sales in china. now, this is ironic, musk shutting that factory down the moment chinese health authorities told him to, but here in america he tried to keep the fremont factory open, even called the alameda county health leaders fascist for ordering that shutdown. the other thing to watch for, musk in general will probably speak to analysts and reporters on the conference call about

tesla, but they'll no doubt ask him about any updates to buy twitter. bottom line, we're going to be talking about elon musk again tomorrow. the overall value of netflix is expected to fall by $40 billion as the stock market opens. the company lost subscribers for the first time in years, fewer people are using netflix now than before, according to its quarterly report. what's happening? high prices are not helping, netflix hiked rates again recently, password sharing isn't helping. if you and a friend are on the same account, netflix is missing out on somebody's payment. but the math shows the net loss of subscribers in because of this guy. netflix cut service off to russia and lost about 200,000 subscribers. that's not a lot, but combined with the other problems, the price, the passwords, it was enough to turn subscription numbers negative. as i mentioned late last week,

we're going to see the effect of russia on all kinds of american businesses, and it's worth remembering, as this company disappoints or that company shows slower sales, ultimately they are doing the right thing, they're on the right side of history. on a happier note, "stranger things" is coming back to netflix. it is set to return to the streaming service on may 27th much it's been a while, but it will be a welcome sort of show to watch. i do enjoy it. >> you know, stations, businesses still ads sometimes to make some money. >> netflix is talking about that. hulu does that. you can pay for no ads or pay for ads. the founder of netflix hates the idea of that. >> it defeats the whole purpose. >> in the middle of a dramatic movie, you get a commercial for soap or something like that. but they're seriously looking at it because they've got to find some way to bring prices down.

we are all discovering, there are great things on hbo max, amazing things. there are great things on all of these different apps, disney, but we can't afford all of them. >> peacock. >> of course, peacock. but we can't afford all of them. so we're going to have to drop one. in many cases it's netflix. >> really? >> lately it hasn't had -- except for "bridgerton," has not had the real pull. the one i wonder about is why i'm subscribing to apple tv because there's no "ted lasso" currently, which is the only thing i actually watched. >> i only got it for one show, too. >> i got it for free. if i hadn't gotten it for free. not because i share passwords. thank you, scott. so let's talk about something new this morning. apple touting its eco-friendly efforts ahead of earth day on friday. the company says it's products were made with 50% more recycled materials last year. they say several products had at

least 20% recycled materials. apple says that it cut nearly use of all plastic in its packaging and it says it's aiming to make its product and supply chain carbon neutral by 2030. so get ready. trending this morning, when you eat cookies, do you split it apart? we're talking about oreos. >> i do sometimes. i haven't done it so much. there is some research out there. yeah, there is search out there this. m.i.t. is doingoreolgy to find the perfect way to split the cookie so the cream is distributed equally. the team found that when you twist the cookie by hand, the cream will end up on one side of the wafer, because of the adhesive between the filling and the cookie.

researchers created an oreo meter and this is a device designed to split the cookie with the perfect twist. unfortunately, it wasn't a match for the filling and it couldn't distribute it evenly. >> there's no way to do it, right? >> i guess not. if you can think of one, let's talk about it. i do have a question for you on twitter this morning. do you split it off and dunk it or eat it whole? for me, i just eat it whole. when i was a kid, i did that because you saw it on the commercials. but now i just eat them. sometimes i dunk. >> useless sanchez trivia, my dad worked for nabisco all of my childhood and he smelled like oreo filling. he got a lot of hugs. >> that's better than drakkar. >> can you twist it? >> you did it!

>> i'll be visiting m.i.t. next week to teach them. >> are you going to give a ted talk? >> oreo-ologist and a meteorologist. >> it might get a little soggy. we have rain coming our way and at least for the start of our morning, heading out the door, it is dry. take a look at this storm system coming through. we can see the rain starting to be picked up on radar as it approaches our coast, and let's go hour-by-hour, because i know you're trying to make plans for today. here we are at 5:30. we're seeing the rain covering the north bay with some light showers, and once again, they moved up the oakland a's game, so it's at 3:07 because they're trying to get ahead of the rain that looks like it's going to come in around 6:00. off and on rain throughout tonight, into the day tomorrow. may even be some brief, heavy

downpours. we're going to be watching some wet weather. today at the 4/20 festival, we're going to start to see rain coming through, going into this evening, so kind of a soggy one. especially as we go into later today. so this is the big storm system that's going to be coming in. quite significant, considering that a lot of the other ones we've had have been fairly light. then going into next week, unfortunately, it looks like the rain stays to the north of us. what we get in these next 48 hours may be it for a while, but it does look like a good soaking. looking at the runs of computer models, anywhere from 1/2 an inch in parts of the north bay to closer to 2 inches in some spots. while we get rain, the sierra gets snow and close to 2 feet in some areas like kingvale. but around 11 inches for south lake tahoe, which is also pretty decent. we're going to see rain coming

through. the rain tapers off on friday morning. friday afternoon it's looking nice, highs in the mid-60s and highs in the 70s for saturday, upper 70s on sunday and early next week, while san francisco, once again, sees rain come in later today. tomorrow is looking pretty wet, but then friday it's moving out in time for a great weekend. and, mike, the drive looks pretty clear, too. >> it does, right now. but there will be changes throughout the day. in san francisco we'll have a little moisture in the air and it will move down toward the south bay after the evening commute. a smooth drive right now with clouds in the background. this is emeryville toward san francisco. a smooth drive from the golden gate bridge in the north bay. same thing across san rafael from richmond. west is your commute right here. that's where a disabled vehicle may be impacting highway 4, right near the connecter there's

it is 5:25 this morning. developing now, the battle between florida's governor and disney world continues today. a special legislative session on redistricting the theme park gets under way. >> if you haven't been following this, the issue is whether disney can continue to govern itself as it has done for decades. nbc's kerry sanders has more on why critics say the proposed termination of that policy is all a source of political payback. >> reporter: this on the surface appears like florida governor ron desantis, a republican, is trying to level the playing field. why should a private company, even the largest single site employer in the state, disney world, have its own self-government? shouldn't they be like everybody else? critics say this is really about political payback because disney so publicly opposed what the

get started. a little 4/20 joke. i'm marcus washington. >> not in that kind of way. >> we're excited this morning. >> you do you, right? i'm kris sanchez. laura garcia has the week off. if you have a smart tv, a reminder you can watch us live on roku, amazon fire, apple tv, and online. >> let's take a live look outside. whoa, look at this. that's not what i was expecting when i said take a live look outside. this is palisades tahoe resort and this incoming storm is expected to bring up to 2 feet of snow in the sierra. that's pretty cool for a lot of people who want to go skiing. >> absolutely, and we know it was a little rainy yesterday. it's going to be rainy today, too, just not right now. >> not right now, and we are getting ready for a significant storm system to come in. this is possibly the best we've seen in quite a while, as it arrives later this afternoon into the evening. as we go through that timeline, we are moving up the game for the oakland a's to get ahead of the rain. take a look at our hour-by-hour forecast for oakland.

at 3:00, now at first pitch, it's going to be windy, but still dry, as temperatures will be in the mid-60s. as we go into the evening you can see how the rain moves in around 6:00 to 6:30, and then getting heavier as we head toward 7:00. as we look at what to expect across the bay area, rain in the north bay by 4:00 to 5:00, approaching san francisco, and then spreading into the south bay late tonight, into the east bay as well. and we could see pockets of some heavy rain and it pretty much continues off and on throughout the day tomorrow and even a chance of thunderstorms before it tapers off on friday. so a lot of active weather here. we'll be tracking that. mike, you've been watching how the commute is rolling. >> it's rolling a little more slowly over here in the south bay. now, this is san martin coming into morgan hill, so pretty far south for our viewers. they'll be coming into the south bay, where 101 in san jose, just about 680, there it is, the sensors just changed from green to yellow.

that builds up into san jose. there's our first burst, and it will really kick in over the next five to ten minutes. the dublin interchange moving smoothly. the build is pretty out of the altamont pass. going toward hayward, a little bit of slowing toward union city. we'll track the nimitz, but so far no major concerns. a disabled vehicle reported around the toll plaza for the bay bridge. i'll give more detail in a few. results are now in for the special election for the state assembly seat for san francisco. this is district 17. it has been an exciting race between supervisor matt haney and former city supervisor, david campos. this morning haney is declaring victory. campos is conceding. the latest count shows haney leads with 63%, campos at 36%. last night haney held a victory party in the city. one of the main topics

throughout his campaign was building more affordable housing. mayor breed endorsed haney. she will now choose his replacement for the board of supervisors. campos was endorsed any district attorney chesa boudin and his chief of staff. chesa boudin's recall election is set for june 7th. well, an annual favorite in san francisco is back. for years hippie hill and golden gate park has been a meeting spot for cannabis enthusiasts, and today those festivities continue. but there are some new rules to tell you about. "today in the bay's" cierra johnson live for us this morning from golden gate park. san francisco known to have a lot of fog, but i can imagine later today it will not be carl. >> reporter: exactly, not carl or carla because today is an unofficial holiday for many san franciscans. we are inside golden gate park, but a little early for those taking part in the holiday. there are a lot of trucks and vendors making their way in.

one just scooted past us right as i was getting ready to talk. they are preparing to set up and preparing for some of those big crowds that will be coming into this park. now, earlier this week mayor london breed laid out what we could expect. the event will run from noon to 5:00 and officials expect as many as 25,000 people. she did emphasize the city does plan to enforce the 21 and up age restrictions for the first time and attendees will be required to show an i.d., as well as a vaccination card for access to the fenced-in portion of the park. city officials also recommended that attendees take public transportation, walk, scoot, ride their bikes to the event because parking is limited and there will be some road closures, some of which i've already seen coming into the park. take a listen to mayor london breed discuss safety at this annual event. >> well, we have had some challenges with 4/20 as it relates to community and public safety in the past, and so with

any large-scale event, making sure that the right resources are available to ensure safety. >> reporter: so we will be out here all morning as those crowds make their way in. we are live inside of golden gate park. cierra johnson for "today in the bay." >> take it easy out there. i'll see you back here later today. 5:36 now, as many of us know, san francisco is no stranger to cannabis. it was a big part of the city's summer of love and so many historical events. the history of marijuana is on display at the san francisco public library. it is one of several events planned during the city's first annual evergreen san francisco week, which is sponsored by the chamber of commerce and ten other agencies. we spoke with an author whose family owned one of the first edible marijuana companies in san francisco. she explains how this all started in the 1970s. >> moving through the aid crisis

and the dawn of medical cannabis, so right now at the san francisco public library there's a display of the original hand drawn packaging that my parents, who are both artists, created every week to distribute brownies by the dozen. and people collected these bags like an underground comic. >> wow, look at that. the display includes more than 30 different bags and other original art. this is located beside the history center at the library, if you want to check it out. now, this week also includes several other events, including hikes and installations and book signings and volz will be signing copies of her book "home baked marijuana and the stoning of san francisco" at fisherman's whatever plaza from 2:00 to 4:00. you can find an entire list and more information on the new rules on the website. head to nbcbayarea.com.

>> i think we're done with 4/20 right now. now to our climate in crisis, as california struggles to combat drought levels, one city in the bay area is looking to go more green using infrastructure. cities like san francisco, theory trying to create green infrastructure instead of storm water going into gutters and then flowing to water treatment plants, green infrastructure will filter and absorb storm water where it falls. in san francisco the city has a new project that creates what they call a living levy, which funnels storm water from the streets and sidewalks straight into gardens. this project is expected to help stop flooding as well. >> you can have an engineered sea wall, which is just a flat face that provides a wall that will protect, and the living levy element is really trying to adapt this to these more natural settings.

rosa. as we take a look at napa and our temperature trend for today, as we start out with some sunshine, clear skies, we'll start to see more clouds moving in. we only reach into the low 60s this afternoon before that rain gets here. and it just gets heavier as we go into tonight. we can see this rain continue as least up until friday. we'll talk more about that in the forecast coming up. and, mike, you're starting with a look at how our roads are moving. >> that's right, looking in the east bay, because we had a hazard reported near the toll plaza. it's south 880, transitioning onto the toll plaza area and it's just some debris that was dropping off the back of a truck. it was debris and someone was concerned about that. all lanes are open, all traffic is flowing smoothly. no real slowing through contra costa county, but highway 7 shows the sensors just changing a bit. it's not just a bit of a change, the bigger change kari has been talking about, the a's said yesterday because the rain is coming in this evening, they're going to push the game time

up. the president is promising to do more to help americans with student loans. >> no broad relief just yet, but at least washington is working to live up to its previous promise. >> we talk all the time about problems with student debt, how it affects household budgets, how tuition has skyrocketed, all of the issues. on top of that, even the programs that were put into place that are supposed to help really don't work. we don't just have problems, we've got bad solutions. the white house says it will try to fix one of those broken solutions, the income driven repayment system, that adjusts payments based on how much money the borrower made and forgive the loan after roughly 20 years of payments. the government lends the money but farms out the collection to private companies and they were not properly tracking those payments in many cases. the national consumer law center says millions of americans qualify for the program we're talking about, but the number of

borrowers who actually had their debt totally canceled was 32. the president will meet with top american leaders at 1:00 p.m. california time to discuss the situation in ukraine. the secretary of defense, the deputy secretary of defense, the joint chiefs of staff, various combatant commanders and announce another tranche of military aid to ukraine, as much as $800 million, on top of the $800 million we sent last week. as time goes on the weapons we're sending are getting more and more powerful. >> artillery, the radar systems, the coastal defense unmanned systems that we're talking about, as well as, again, continued deliveries of small arms and ammunition. >> we've already sent armored personnel carriers and helicopters. ukrainian president zelenskyy keeps asking for more. he says the west asks what he needs and zelenskyy says, i need a moment to calm myself because i've already told them the week

before. it's groundhog day, he says. i feel like bill murray. as for the situation on the ground, the russians continue to crawl forward in donbas. keep in mind, russia and ukraine have been at war in this area for years, and in mariupol, down here, it still hasn't fallen, but it's close. civilians and soldiers holed up in a steel plant. the commander posting an appeal on his facebook account for western countries to come get them out, and that is almost certainly not going to happen. we'll be watching what's happening and talking about it on social media. on twitter you'll find me @scottmcgrew. and many more. the 14th annual outside lands is on the 5th through the 7th. >> it's always a fun event. i've been before. >> you know what that image is for, the big windmill? i still think mini golf. that's where my brain is. >> outside land, speaking of outside, our forecast for today, how is it looking? >> it looks a little soggy later today. we've got the big 4/20 festival happening in san francisco. a lot of people outside as the rain arrives. as we get a look at the storm system, it's a pretty large one and the most significant one we've seen in quite a while. let's go hour-by-hour, as we start to see the rain moving into the north bay in time for the evening commute. here we are at 6:00, we see some spotty showers moving in. you can also track it with the nbc bay area app and get alerts as the rain approaches your location. by 10:00 to 11:00 tonight, we're seeing it spreading down the

peninsula into the east bay, as well as into the san jose area. we are going to see rain off and on throughout the day tomorrow and maybe even some pockets of some heavy rain. and there will also be a chance of thunderstorms going into tomorrow afternoon into the evening. all of this starts to wrap up on friday. but then after that, we're looking at dry conditions for the weekend, early next week high pressure building once again, driving the storm track farther to the north. every chance of rain that gets close, it looks like it misses us. so whatever we get within the next couple of days is going to be basically all we get for quite a while. it's possible we could see anywhere from 1/2 inch of rain to closer to 2 inches of rain in spots where some of those pockets of heavier rain sets up. we're anywhere from 10 to possibly 23 inches of snow in the sierra between now and friday, when the storm system wraps up. if you're going there this weekend, the weather is looking good across the bay area and we're looking at sunshine. highs in the low 70s on

saturday, upper 70s on sunday. for san francisco, off and on rain starting this evening, once again around the evening commute. mike, you're starting to see a slowdown in san jose. >> we saw that on the live camera, north 101. things were stacked up. it's hard to tell from the glow, but things are moving better. there are no incidents going on. the camera right here looking north toward alum rock avenue. nothing really unusual about that portion of the south bay. it just happened to be the timing. over here we had debris, but the maze is moving smoothly. the metering lights likely on. we see slowing for highway 4 and 37. pretty typical there. the benicia bridge has been calm. >> thanks, mike. happening now, thousands of nurses across the sutter health care system are locked out of their job following their
