d.c.'s beltway later today still, americans deciding you can't put a price on holiday fun. one piece of good news, aaa says that car rentals are 34% cheaper this year than last year, if you can get one, and in terms of the best times to go back, sunday and monday are expected to have low congestion all day, but of course savannah, that's the holiday. back to you. >> that's cookout day, sam, but good advice, thank you very much >> the situation on the roads, let's take you to the air now. holiday rush at the airports we've talked about it for weeks now, cancellations and delays wreaking absolute havoc on travelers all over the country, and with more than 3.5 million people planning to fly this weekend, a lot of folks are asking, will they get to their destinations on time nbc's tom costello covers aviation for us. he's at reagan national there. so tom, what say you what's the outlook any glimmer of hope for those

who are brave enough to fly? >> reporter: yeah, i think the glimmer of hope is that the weather right now looks pretty good we've got blue skies across much of the country, and as you know, the weather is always the big variable we've also had cancellations on blue sky days. here's the number right now that we're looking at from flight aware. they've got 333 flight cancellations nationwide right now. we've got about 485 delays listen, that's on top of 640 flight cancellations yesterday the most affected airports this morning, newark airport in the new york area, and if you're flying into or out of toronto, toronto is delayed this morning, american airlines and delta are the u.s. carriers right now with the most delays. you know, if you look at the entire length of the travel period today through monday, then we're up to about 11 million people traveling, so we are very close to 2019 levels. 2019 levels at post-pandemic highs, but the problem is the

airlines simply don't have the seats they used to have, and that's why people are getting those cancellation notices at the very last minute the crews are out of position because some flight gets missed, if you will, some crew can't get to the right flight, and so that explains to some extent why these are last minute cancellations. i got to tell you guys i've had a lot of people tell me don't bother trying to call the airline because it takes so long to get a real live person on the phone. >> so capacity's an issue. you've talked about the pilot shortages for weeks now. what can folks do, tom, to at least reduce the risk of facing a canceled or a delayed flight >> reporter: so i actually came up with a list for you this morning just based on not just traveling this weekend but if you're going to be taking the kids on a summer holiday vacation over the next couple of weeks. i think this really applies. so here's my list. first of all, if you can, depart in the morning because as you know, the weather starts to

create a real problem through the day, and that creates delays and cancellations. on top of that, we would also recommend trying to add pad time to both ends of your flights in other words a few hours before your flight is supposed to leave, get there early, and plan on pad time on the back side if your flight is canceled, reschedule yourself on the airline app. again, you can't always get somebody on the phone. have several backup plans, a, b, and c in case things go bad and then sign up for tsa precheck for the next trip because that can help speed you through the check point. airline cancels the flight back to the pad point, pad your schedule, get there early, pad time on the back side. don't plan on landing in orlando and being at disney world an hour later for example because you're asking for trouble, right? pad time is going to be key on any travel this summer. >> all right, tom costello with tom's travel tips there. thank you. >> i like that, no tech connections either

election. >> why was he furious? >> reporter: overnight a key figure in the january 6th investigation responding to pressure from the committee after that bombshell hearing this week. the committee slapping former trump white house counsel pat cipollone with a subpoena late wednesday. with a specific interest in evidence that mr. cipollone repeatedly raised legal and other concerns about mr. trump's activities leading up to and on january 6th. after former trump white house aide cassidy hutchinson testified about cipollone's effort to stop the former president's original plan to join his supporters as they advanced on the capitol. >> mr. cipollone said something

to the effect of please make sure we don't go up to the capitol. we're going to get charged with every crime imaginable if we make that movement happen. >> reporter: overnight, a lawyer familiar with cipollone's deliberations telling nbc news that cipollone needed that subpoena before considering transcribed, not public testimony. now they say cipollone's evaluating what he might tell the committee based on executive privilege. in her first public comments since hutchinson's testimony, the committee's top republican liz cheney praised the 25-year-old's courage as other trump allies have refused to testify. >> her superiors, men many years older, a number of them, are hiding behind executive privilege, anonymity, and intimidation these days for the most part, it is really not going that well >> reporter: others are disputing portions of hutchinson's sworn testimony a spokesman for her former boss, trump chief of staff mark meadows says meadows never sought a presidential pardon, but meadows has not testified under oath declining to cooperate with the committee citing executive privilege others pushing back against her testimony that mr. trump got physical with his lead secret service agent inside the

presidential suv, and the secret service now saying its agents are available to testify under oath hutchinson's lawyers say she stands by all of the testimony she provided under oath. cheney warning republicans cannot be loyal to both donald trump and the constitution >> we are confronting a domestic threat that we have never faced before and that is a former president who is attempting to unravel the foundations of our constitutional republic. >> reporter: as for pat cipollone he's been in discussions with the january 6th committee. he met for an informal interview with them back in april. if cipollone agrees to cooperate, there are many things that legal experts say he can speak about that are not privileged, and as for the former president, he remains the most powerful person in his party, but as testimony piles up, there are new questions this morning about whether these

hearings will have an effect on his grip on the gop. craig. >> our chief white house correspondent peter alexander for us, thank you. the supreme court hands down the final decisions of its term today, a milestone that will also bring major changes to the composition of the court nbc's justice correspondent pete williams is with us. pete, this was a historic term to say the least in terms of the decisions that were made today will also be one for the history books. walk us through what we expect >> reporter: well, first we're waiting for rulings in the last two cases of the term, that's how much authority the epa has to fight climate change and on president biden's efforts to shut down a trump era immigration restriction, and then at the stroke of noon, one justice leaves and another takes his place. stephen breyer will step down as he said he would when he told the president in january that he intended to retire that will end his 28-year career on the court and before that he served 14 years as an appeals court judge in boston. he's the supreme court's oldest men. he'll turn 86 in august, and the first thing he'll do upon retiring is take part in the

swearing in of one of his former clerks, ketanji brown jackson who will take his place on the bench. she was confirmed in april, and she will be the first black woman to serve on the supreme court, and she will also be one of the youngest justices >> the conservatives obviously hold the ideological sway on the court right now 6-3. what kind of issues are expected to come up next term >> well, justice jackson will dive right into some hot button issues that are already on the docket for the term that starts this fall. there's a challenge to affirmative action and college admissions, okay'd it twice before, but doubtful it will survive the court's new conservative supermajority there's the question whether religious freedom gives business owners the right to serve same-sex weddings, and how much protection federal law provides to minority voters when states draw political boundaries. justice jackson will have all summer to get ready for those. >> thank you very much. now to that breaking news overnight here in new york, a young mother shot and killed

while she was pushing her baby down the street in a stroller. nbc's emilie ikeda has the latest on this good morning to you. >> reporter: there is growing pressure on officials here to address the wave of crime that's plagued new york city for the past two years police now hunting for the man they say shot a woman before fleeing on foot leaving behind a baby who will now grow up without a mother overnight, a young mother killed in an unthinkable crime. police say the 20-year-old was pushing her 3-month-old baby in a stroller on manhattan's upper east side when the gunman approached her from behind, shot her once in the head and fled. police say the infant was thankfully unharmed. >> unattended baby infant. >> what's the location >> same location >> reporter: the victim has not been publicly identified by police overnight authorities were asked whether this could be a case of

domestic violence. >> hearing that it is domestic, possibly the father of the baby? >> we can't confirm that at this time it's under investigation. >> reporter: local residents including children nearby mistaking the gunfire for fireworks. >> and it really frightened me because i was right there at the park playing. >> reporter: new york city's mayor eric adams calling gun violence a national problem. >> there is just no fear in using these guns on innocent new yorkers. and this is the result of that >> reporter: and police say the gunman was dressed in all black including a hooded sweatshirt. sources telling our nbc station in new york a single shell casing was recovered at the scene. back to you. >> thank you. now to the latest on that deadly human smuggling case from san antonio. the man accused of driving the 18-wheeler involved in that case is now in custody. homero zamorano jr. was arrested yesterday charged with human smuggling resulting in death authorities used surveillance video to help identify the

new information to tell you about in that deadly amtrak crash in missouri. according to the ntsb the train was traveling just under the speed limit when it collided with a donald trump truck. four people were killed, more than 100 others were injured in that accident, which happened monday. r&b superstar r. kelly was sentenced yesterday to 30 years in prison. the multiplatinum artist was convicted on nine counts of sex-related crimes last september of decades of allegation of sexual misconduct. kelly did not address the court at his sentencing yesterday, and he did not react when his accusers addressed him directly about his crimes. the singer still faces additional charges in chicago. all right, it's happened to all of us, a random delivery shows up on your doorstep, but it turns out it was really meant for someone else. well, that happened to a denver couple this week, and you'll never believe what was inside.

stunned. >> miguel almaguer has got the details for us, good morning to you. >> park officials say the man who was attacked was with his family. video taken nearby capturing the tail end of the incident with a massive bison charging as the victim appears to be trying to protect a small child. even from a distance, witnesses could clearly see the agitated bison charging. the attack unfolding this week at yellowstone national park leaving a 34-year-old man with injuries to his arms after he was gored. the massive bull bison first closing in on two adults and a child when a third man rushes in to help. the bison, which could weigh up to 2,000 pounds briefly lifting him off the ground before the man and child could run to safety. >> if you saw bull on a ranch, you probably wouldn't walk right into the pen and take a photo, and you see a bull bison in a national park, you probably shouldn't walk up and take a photo. you want to give it deference and respect and the space it

needs. >> reporter: the injured man who's from colorado springs was treated for his wounds at a local hospital. the dangerous encounter happening near the geyser old faithful, one of the park's biggest draws. while bison bears, moose, and coyotes freely roam the park, attacks are rare but do happen. in 2019 a 9-year-old boy was flung through the air by a bison and somehow not seriously injured. and just this week, a 25-year-old woman was also gored by a bison at yellowstone. park rangers asking the public to stay at least 25 yards away from large animals that can easily outrun humans and 100 yards away from predators like bears. >> never approach wildlife to take a picture. >> reporter: psas reminding park visitors these animals are wild.
