dig in their heels. a special edition of nbc bay area news starts right now. thank you so much for joining us. i am audrey aistio. we are on early today because we have the raiders game at 5:00 we are getting a better look at the aftermath from the first day of a standoff at people's park. protesters have temporarily shut down construction of a major housing project at uc berkeley but what happens next? we have this story with today in the bay's pizza rhinos. >> reporter: there frustrated over plans to build new housing today we spoke to a man who goes by the name of ninja cat and is not a fan of new housing and calls the situation a

travesty. >> this was a symbol of freedom and resistance and the power of the people. it has never been about housing. >> reporter: they say the project is important to provide student housing but also say the plan would preserve elements of the park by keeping 60% of the green space. six arrest were made yesterday and two officers were injured and would not say when they will move forward. it all comes back to safety. >> safety for people who oppose the project and for police officers. in that regard, we are not able to broadcast and provide the details of our plan. >> reporter: their plans are fairly straightforward. they say they are not leaving anytime soon. >> we are not going anywhere

until. we have been holding this park 50 years. >> reporter: uc berkeley , pete suratos , nbc bay area news . >> thank you so much, pete. the biden administration has declared monkeypox a public health emergency . it also accelerates the vaccine distribution. in some cities, long lines have formed and we have seen ourselves 6600 cases. some have criticized the white house response and called it slow since the world health organization made a declaration last week. we know more today about an outbreak of legionnaires' disease. as we have reported, health officials traced the bacteria to a rooftop air conditioning unit at the embassy suites hotel the bacteria can contaminate up to

1 mile, causing symptoms of pneumonia. a man has died and eight others were covered. three are still hospitalized today. embassy suites said, quote, we remain diligent providing a safe environment for all and we continue to cooperate fully with health officials on the investigation. let's take a look at legionnaires' disease. approximately 25,000 people develop legionnaires' disease every year. it can be deadly if the patient has underlying health issues. >> you can see death in about 30% of cases. it is not rare. much of the bad outcomes comes with someone who is older or might be immunocompromised. early

recognition is key from the hospital point of view because you have to give different kind of antibiotics a lot of times from the ones we usually use. >> what are some of the symptoms ? according to the cdc, it is similar to other types of pneumonia. coughing, shortness of breath, fever, and headaches. symptoms begin 14 days after getting exposed. if you have the symptoms, you are urged to see a doctor immediately. one of the bay area's biggest music festivals is expected to draw hundreds of thousands to san francisco this weekend. organizers at the outside lands music festival are expecting 220,000 people to come to golden gate park.

there will not be a mask mandate or testing requirement. this has some raising a red flag and noting that we are still battling a pandemic. today the mayor came to the festival to offer her support and stressed health officials have given the green light. >> we want people to understand that covid-19 and monkeypox are still issues the department of public health at this time does not believe events like this should not continue as a result. >> the mayor and others are calling for common sense and said do not come to the show if you are feeling sick. the festival is expected to bring the city $71 million in revenue . now to the south bay we are getting a detailed look at the evidence against the men police are calling a sniper we're talking about the person san

jose police have arrested in a series of pellet gun attacks . >> reporter: the 9-year-old. >> my lungs felt like they were getting compressed. >> reporter:'s 15-year-old is another victim investigators say walks around with this for the rest of their life pittsburg police claim both of them were targeted by nicholas montoya. >> the physicians had said they were not able to remove it. >> reporter: she was actually going up the stairs at one of these apartments when she was shot from behind and her mother saw the suspect vehicle pulling out of this parking lot. she was able to get a vehicle

description. >> i had to look at my phone from a distance because i couldn't believe what i was hearing. >> reporter: the description with key to finding the suspect . there was evidence of target practice. police also say that he was very calculated as he carried out the attacks. >> these were not childish pranks. these were deliberate attacks on innocent victims. >> we have footage of him repositioning his car because he did not have a good look. >> reporter: they do question if montoya was specifically targeting women expect he could've shot at anybody but instead he shot at six females. one was a 9-year-old girl. the one male he had was with a female. >> reporter: police are asking

other possible victims to come forward as they wait for justice to be served. montoya could face 20 years in prison. stephanie garibay, nbc bay area news . strike a deadly shooting happened about a san francisco muni bus . the person killed is a 20-year-old man. a 62-year- old woman was also hurt during the shooting. up our police have not made an arrest. san francisco city attorney announced a lawsuit against the federal government today in an attempt to hold the closure of the laguna honda hospital. it was forced to close after funding was cut and they ordered long-term care patients to move out by next month. nbc bay area's christie smith explains .

>> reporter: laguna honda hospital is at the center of legal action. they said there is a closure order from the federal government. >> i have a son at laguna honda hospital >> reporter: she believes laguna honda hospital cares for himeds to have people who are familiar with him to get him to participate in the things that need to be done daily. the staff at laguna honda hospital has built up a memory with him. >> reporter: they've ordered hundreds of patients be transferred. >> we are asking for the federal government to continue funding until all patients can be safely relocated .
