arrest warrant, but it certainly is more than a subpoena, because it indicates that the government wouldn't trust somebody with a subpoena to get all the documents they want. they want to secure the documents. of course it's never a good thing to have a search warrant executed at your home or office, it means that it's likely, well, what we know for sure is that to show a judge enough evidence to get a search warrant, the fbi had to show probable cause that there is evidence of potential criminal activity at the home or the office so we know that at least the mere fact that there is a search warrant tells us that a judge has, they have met that constitutional standard with a judge, a neutral, detached magistrate, who has issued this search warrant for them to go in and seize these documents. so never a good thing for anyone, whether you're a former president or just a regular person on the street but it does not absolutely

follow that president trump, former president trump, will be indicted >> as we just heard susan touch on some republicans have already reacted with fury. house minority leader kevin mccarthy has threatened the doj and warned merrick garland to clear his calendar what's the likelihood that the doj could eventually be investigated for this decision yesterday? >> highly likely if the republicans take the house or win big in the november elections. that we would see an investigation into the department of justice. i have every reason to believe that mccarthy will follow through on that veiled threat to bring merrick garland before the house and question him however, that is not likely to slow mer rick garland down. merrick garland has to be concerned about a lot more other things among those are the fact that executing a search warrant on a former president's home is going to draw a lot of jutescrutiny nw

york city no matter what. they know that this particular search warrant may be one of the more scrutinized search warrants ever in search warrant history >> past the midterms, past that to 2024. if trump runs again there and it turns out that he did break the law, talk about that and talk about how that may cost him the presidency if, in fact, there was a crime here. >> it certainly could cost home the presidency in a very strange set of affairs, it could be that the only thing that would prevent him from running would be impeachment proceedings and not necessarily pending criminal charges. but at the same time, merrick garland and the doj have to think about that we're coming into a number of different election seasons, not just the

midterms, the 2024 election you could argue is already starting now with former president trump. so merrick garland has to consider doj's policy to not interfere with elections what does that mean? if he has to charge a crime, he has said he will do so without fear or favor. that may mean indicting a president sometime during a campaign, which arguably has already begun. not an enviable place for merrick garland as he weighs those issues and issues of presidential immunity which may or may not apply to the former president. and a number of other issues that make the path to indicting trump very difficult >> watching where this fbi search goes and if that will impact an announcement from former president trump about his future, danny, as always, great to have your insight especially at this hour, thank you.
