"today in the bay's" bob redell is diving deeper into what the plan might entail. >> first meteorologist has an update on the drought conditions. >> i wanted to show a comparison of what the drought monitor looked like last week where we see kind of a circle where you see the highest level of drought just to the south and east of the bay area over the central valley. now the update this morning, basically fills in that circle.

it increases the drought by about 5%, the exceptional drought. we're also seeing the level below that, the extreme drought expanding across the bay area. it does remain unchanged here as we're still in a severe drought as we get a closer look. so once again, the drought is expanding, getting worse, even as we are in our driest time of the year. this is possibly going to lead into what could be a very dry winter as we go into the next few months. so now let's turn to bob redell who is in contra costa county where the governor -- governor newsom is expected to address this drought. bob. >> reporter: correct. later this morning the governor is expected to announce a water supply action to deal with the hot, dry conditions like these brown hills we see here behind me in livermore. what those actions are we just don't know yet. when it comes to the environment, we do know the drought is on the top of the mind of many californians. a new survey out this week by

the non-partisan public policy institute of california finds that 68% of californiians say the water supply is a big problem where they live. that's close to the same level of concern we saw during the 2012-2016 drought. the same percentage of people don't think the government is doing enough to solve the drought, the state government. as a matter of fact, late last month a member of the california state water resources control board quit because he doesn't think the newsom administration is doing enough either. ? a resignation post, max gomber wrote in part, quote, witnessing the agency's ability to tackle big challenges nearly eviscerated by this administration has been gut-wrenching. the way some of you have simply rolled over and accepted this has also been difficult to watch. >> it's a real problem pour the governor. he's going to have to lower the boom. we can't keep going like this, but when? some wonder whether he will follow jerry brown's example

steelworkers convention. she toured mgm grand to meet with nevada lawmakers about productive rights in the wake of the supreme court overturning roe v. wade. harris is set to host a similar meeting today with state lawmakers. tomorrow we'll be in oakland for two events, one growing the fast growing commercial space industry which involves space travel and she'll also attend an events tore students. developing in palo alto palo alto, police are investigating a rape on the stanford campus reported two days ago. this is a live look from campus this morning. that's where one student says she was grabbed in a parking lot, dragged into a bathroom and then sexually assaulted. the victim also says she's seen that attacker on campus before. all of this happened around 5:00 in the evening tuesday near wilbur hall. the campus was still relatively quiet ahead of the fall term. we did talk with one grad student who was pretty rattled by this report. >> it was pretty alarming. it was crazy because it's during broad daylight.

there was even more sun than there is right now. >> stanford police say investigators are still waiting to talk with the victim. so far few other details including a suspect description have been revealed. but officers are increasing patrols in the meantime. angry oakland parents come face to face again with school leaders following last week's tense clash on the now closed campus. activists made their voices heard at last night's first school board meeting of the year. many expressed their concern about recent confrontation with district security at parker elementary school. one parent even showed up with bruises. he says he received them during the pushing and shoving. >> someone said "take him down." i went down, sustained injuries. i was put in handcuffs. >> parents are planning to file a lawsuit against the board and the city of oakland. they say they will not stop fighting until their voices are heard and the schools reopen. new overnight, chp officers are investigating a deadly

hit-and-run this is in the east bay. it happened just before 2:00 a.m. on interstate 880 near the fremont off-ramp. police found a body on the side of the road and no sign of the driver. all lanes reopened a little less than one hour ago. a new shark attack warning this morning for beachgoers and an incredibly close call in the same pacific grove spot where a great white shark nearly killed a man back in june. this happened a little before noon yesterday near the monterey bay aquarium. first responders say a man was paddle boarding out there when a shark took a chunk out of his board. you can see that chunk missing. >> he was offshore about 500 yards, had a german shepherd on the boat, had been out before. he was paddling along, 500 yards out. next thing he knew, he had a visitor. >> everyone is okay this time. back in june along the same stretch, a great white bit a man in the stomach and leg.

quick-thinking bystanders managed to save his life. one expert says this attack might have also involved a great white but two attacks in the same spot are incredibly rare. that's the gentleman who was bitten back in june. >> it's rare, but when it happens to you -- >> 100%, right? 6:08. let's move you along this morning with a live look at san francisco as we get started with the day. meteorologist kari hall has more on the weather. >> it's almost time to wake the kids up for the first day of school. we have a lot more kids heading back to school today including in dublin where we're starting out with a clear morning. such a great start to the school year and also the day on thursday as you're heading to work. as you drop the kids off for high school, it's goings to be in the upper 60s between 8:00 and 9:00. it's going to be in the low 60s. kind of a cool start. at pickup time in the low 80s today. we're still keeping the nice and mild weather we've seen in the past few days.

wide-ranging temperatures from san francisco in the low 70s today to mid 80s in napa and low 80s for san jose. up to 90 today in concord. we'll check out the weekend forecast coming up. mike has an update on gas prices. >> first of all, since march, the national average for a gallon has fallen below $4. triple a reporting the same. u.s. average dropped two cents to $3.99. nationally great news. in california, the exception, average at $5.38. gas buddy still shows us under five bucks a gallon. we found some, mill valley, arco on redwood highway, gas for $4.75 a gallon. mobil on boone court in danville, $4.79. in san jose, $4.99 at the 76 on

school districts and microclimates in the forecast coming up. looking at san jose, the earlier start, about 5:30 when that first slowdown is starting here. 101 is now clear, back at speed. the next slowdown with start in about 20 minutes for this stretch of the bay shore freeway. i'll show you around the bay coming up. wall street set to open a whole lot higher extending yesterday's games. that's despite new weekly jobless numbers showing first-time claims last week rose slightly. markets rallying after inflation rose at a slower pace in july. some believes this means the federal reserve could start dialing back future interest rate hikes. netflix gets dethrowned by the mouse house. disney plus is reporting 221 million customers for the streaming service which includes espn and hulu. that surpasses netflix for the first time ever. it's all going to cost you a

out xwing. >> reporter: mission control is a one-room office in the second floor of a hangar at buchanan field. down below, technicians double-check the sensors that will allow this cessna caravan to take to the skies all by itself. planes like this one are used every day to transport cargo and people to small communities all over the united states, but there's a pilot shortage, and the engineers at xwing think an airplane that can taxi, take off, fly and land entirely by itself is a good solution. >> it's a struggle to hire and retain pilots even with pilot pay increases and so forth. there's just not enough supply. >> reporter: a safety pilot rides along for now, but entirely hands off. the computer flies, monitored by

mission control. actually flying is the easy part. it turns out the biggest challenge in automating flight is not the flight itself. after all, you've been on flights on autopilot. the challenge is talking to those guys. >> right now we're going to have somebody in the station or similar to this one talking to control, and the voice relayed to the plane. no matter where this person is sitting and where the aircraft is, we can communicate with the local air traffic control facility. >> do they know they're talking to essentially a robot airplane? >> they have no idea. they have no idea the pilot isn't located physically in the airplane. >> reporter: xwing which is absolutely named after the iconic star wars spacecraft hopes to convince the faa to certify its technology in the coming months. in concord, scott mcgrew, "today in the bay." >> times, they are a changing. >> you guys can go first.

i'll be in the b group. >> xwing, scott said, named after the star wars. so the force is with you as well. >> i'm not paying for early bird on that one. >> better than me flying, right? >> i've flown before. >> have you? >> yeah. it was only once. i don't have the hours to actually fly a plane. he was like, okay, go for it. it was fun. it was fun. >> kind of a bummer we have some drought information, the drought monitor just came out and it's not good. >> not looking good. we've seen such a crisis really developing here that continues as we lead into what's possibly expected to be another dry winter. i wanted to show you the update once again. last week we were receiving -- really pay attention where we have the darker shades of red,

drought there is. we're not only seeing it here, but especially across nevada where they've had a crisis there as well, especially with lake meade drying up. as we see the update, there's more red on the map. this continues to expand in some of our very critical farmland where a lot of farmers are really struggling right now. with the exceptional drought, seeing it now at 16% of california, an increase by about 4% coverage across the state. it hasn't changed for the bay area. we're still in a severe drought. we definitely need drastic measures immediately to take care of this and to continue to go forward as we deal with a really bad water shortage. we're looking at another clear day, of course. we're in september and don't normally see rain this time of year. as we start the kids off for school this morning in the south bay, the first day of school, and hopefully they have a really great picture for that first

day. it will be in the low 60s to start out. at pickup time in the upper 70s. headed for about 80 degrees today. notice the difference from san jose to morgan hill. it's going to be much hotter there. some of our inland areas hot, not only for today but the next few days. there won't be much of a change as far as what you'll see in your microclimate even going into the weekend. slightly hotter as wre we'll beg 95 degrees. take a look at the inland forecast. over the next several days, going from the upper 80s in the warmest spots today to mid 90s next week. there may be a few spots hittal the triple digits. keeping the temperatures in the low 70s. mike, you're tracking the impact of the metering lights. >> that's right. the metering lights have been on for about 20 minutes. that's about how long it takes for the backup to start.

just into our news room, twitter announcing brand new policies ahead of the november elections, the bay area social media giant made that announcement within the last few minutes via its blog. it says it is going forward with tweets with misleading claims or false information about the election, and they will be abld with links to credible information or helpful context. twitter has faced criticism for not doing enough to curb false information from spreading during the previous election. it's 6:24 right now.

courthouse behind me, the push scott peterson's team is making for a retrial after being convicted of murdering his wife and their unborn son. why some are saying this is his last best chance. stay with large out-of-state corporations have set their sights on california. they've written prop 27, to allow online sports betting. they tell us it will fund programs for the homeless. but read prop 27's fine print. 90% of profits go to out-of-state corporations, leaving almost nothing for the homeless. no real jobs are created here. but the promise between our state and our sovereign tribes would be broken forever. these out-of-state corporations don't care about california. but we do. stand with us.

pictures. the cabrillo school district starting out today, cloudy this morning, low 60s. we'll get the sun peeking out at pickup time with upper 60s for today. as we look at our microclimates, we also have kids going back to school in skroes and sonoma as well as dublin, san jose. there are so many schools coming back today for the first day. we are going to see another nice day, pretty much like what you've seen the past few days. we'll talk ab the weekend coming up. mike, you're looking for the crowd to grow. >> as the schools come back online, we sometimes have disruption for weeks at a time as folks get used to the new morning schedule. i have a little head fake, too. this camera i expected to show more traffic because where the arrow is i saw slowing sensors, then they cleared up. 101, oakland road, starting to slow again. it is happening in the san jose area, but a little different than we might have anticipated or that i anticipated. slower drive for highway 4 holding steady for 37 and the bay bridge toll plaza, no head fake here.

we have the backup that continues to build because the metering lights are on. happening today, one of california's most notorious killers returns to the court hoping to get a new trial. jurors convicted scott peterson nearly 20 years ago in the case that captivated the bay area and much of the nation. >> "today in the bay's" ginger is liveout side the courthouse in redwood city. ginger, let's talk about what's in play in today's hearing. >> good morning, chris and marcus. there's a lot in play today. it will be a high-profile, high-stakes hearing here in redwood city. scott peterson's defense team is expected to make the case that he did not receive a fair trial almost 20 years ago because of a juror who may have identified too closely to laci peterson, the victim, who was also his wife, as well as their unborn son who was also murdered. back then peterson was sentenced to death by lethal injection. the death penalty was overturned

in 2020, but peterson's sentence to life in prison was upheld. we're told this is now the peterson team's last best chance for a new trial. there will be an oral argument that will be followed up by a detailed evidentiary hearing that will start at 10:00 a.m. the defense team is expected to argue that one of the jurors misrepresented herself during the jury selection process. that juror, the defense argues, was pregnant at the time and a victim of domestic violence. this, they say, affected her impartiality. you will remember laci peterson was pregnant when she was murdered. the prosecution will argue while there may have been innocent recollections that this juror did not disclose, they in no way affected her decision in that jury room. as legal expert stephen clark tells us, the job of the defense team today is clear. >> the burden isn't to show she committed perjury, but they

didn't get the information they needed to make a fair process of jury selection. i think that's what's key for the court. >> reporter: now, what happens if the judge decides in favor of the peterson team? let's take a listen. >> if peterson gets a new trial, you will see a whole new defense strategy. they have been going for 20 years in investigating this case, and you will likely see a very different trial than you saw 20 years ago. it's going to be a challenge for the prosecution because they have to dust off a 20-year-old murder case and try to find witnesses and get the experts lined up again. >> reporter: today's decision will be pivotal in whether or not this case is finally put to rest or if it will see another day in court. all of that begins in a few hours at 10:00 a.m. we'll be watching closely and update you back in the studio. marcus and kris. >> we know people will be

watching to see what happens. thank you, ginger. >> our coverage continues on this not only on air or online. download our app. it's free. you can find it in your local app store. of course, you can always find the coverage online at nbcbayarea.com. authorities in placer county are sharing new images trying to jog people's memories and try to help locate 16-year-old missing teen kiely rodni. she disappeared early saturday morning from a large outdoor party at the proffer family campground outside truckee. search and rescue teams are still combing the area looking for any sign of her. one of the images show this sweatshirt here. they believe she may have been wearing it when she was seen last. deputies say somebody lent it to her the day before she disappeared. the other image is of her car which is a silver 2013 honda crv like this one which is also missing. investigators are pleading with anyone with information to do the right thing and come forward. they say they have checked her cell phone but it's been out of service ever since the party.

there's now a $50,000 reward for information leading to her safe return. hayward police want to know if you know this man right here. take a look at this sketch. it's the person of interest in a deadly shooting from back in april. believed to be 5'10", dark brown hair, brown eyes. if you know who this might be or have any information, you're asked to call the department. an oakland break-in caught on camera. that business there, the owner fed up. he says he had to watch more than $100,000 worth of goods stolen from his repair shop. jose torres says last month he actually woke up to security video of those people climbing through the roof. those thieves actually stuffed stolen merchandise into customers' cars which they then drove away with. oakland police are investigating a similar burglary two weeks ago in nearby little saigon and

looking for a connection there. torres is just frustrated and says more needs to be done. >> what i found was all my life in the trash. they need to do something about it. the business, they're the ones that support the whole city. it's kind of hard because if something like that happen again, i'm going to have to move from the city. >> oakland city council recently approved more than $100,000 for safety improvements in that area including a new substation. this confirmed within the last hour. the u.s. now surpassing 10,000 monkeypox cases. meanwhile, a san francisco clinic including the one at san francisco general are in the process of distributing hundreds of vaccinations daily. this morning one bay area company is touting its blood testing method. traditional testing involves swabbing an active lesion that could expose health care workers to active infections.

one bay area company uses microbial cell-free dna blood testing technology developed at stanford six years ago to identify infections earlier and more comfortably for the patients. >> we actually identify infections by finding small fragments of dna in someone's bloodstream. in a lot of cases we don't have to actually go to where the infection is. >> diagnosing someone earlier could mean not developing the lesions altogether. it could allow for earlier isolation and theresa may and maybe even help identify other infections the person might have. right now kareas testing is in use in bay area hospitals including kaiser permanente's and the teaching hospitals here. the company hopes to expand those tests into the public sector. let's take a live look this morning at san jose. setting up for a look at the weekend. >> i like it. kari, we see the tech museum

there in the distance. lots of things going on. >> the jazz festival happening in san jose this weekend. if you're looking for something to do with the family on saturday morning, we have the keep the ocean beach clean event. there will be a lot of cleanup events around the bay area. meet up at the ocean beach cafe at 10:00 in the morning. it's going to be in the low 60s. make sure you're wearing those layers. if your weekend plans take you to south lake tahoe, it's going to be a great weekend. the mornings start out in the mid forlts on friday but head for 81 degrees. we'll see low 80s throughout the weekend and a lot of sunshine. in big sir this weekend, we'll see a high temperature of 78 on friday, warmer on saturday, but more fog and cooler temperatures on sunday. muir woods will also be a great destination for enjoying outdoor time going hiking. it will be in the low 70s as we go toward friday and saturday, reaching into the upper 60s on sunday. mike is helping you plan for

some delays. >> everybody can plan for the delay at the bay bridge toll plaza. it's relatively mild for this time on thursday. 6:39, and we still have a little spacing at the toll plaza. we do have the build at the richmond side heading toward san rafael. we have more slowing than we often see for highway 37, approaching 101. watching for that. no surprises for highway 4. 680 south approaching the wk interchange, a little slow toward 24. here is westbound 84. that's moving smoothly. tonight there will be that closure again as we've seen for the last night and tonight as well into tomorrow. that's the connector on southbound 680. it will be open by 3:00 a.m. your morning commute will have no problem. this is an early warning for tomorrow. tomorrow at 5:30, levi's stadium will be packed, hopefully with 9ers, but packers fans as well.

>> donald trump probably does have a snitch in his midst. there has to be somebody that was an insider that basically directed the fbi agents. >> some members of trump's inner circle are apparently still pushing him to formally announce a 2024 presidential campaign, and to do so sooner rather than later. you may not have realized this, but today is national safe digging day. for pg&e, they say it's a good time to remind everybody about notifying the utility when you plan to dig on your property. you just have to call 811. pg&e will send out someone at no cost to mark those underground electrical and gas lines. so far this year pg&e says 267 commercial and residential strikes on underground utility lines happened, typically because nobody called ahead to the 811 number. alameda and marin counties have the most. napa and san francisco the least.

without preparing right, the utility says even shallow digs could lead to big trouble. >> you'd be surprised that over time with the earth shifting, with the drought and the ground shrinking and movement and erosion of the soil, you'd be surprised that sometime those lines can really reach up close to the surface. >> striking an underground gas line isn't cheap. if it happens, pg&e says it could cost you $3,500 for repairs, maybe more. a live look at the capitol this morning. this is the state capitol where state senators today debate a bill some say would better empower fast food workers. the fast food accountability and recovery act would create a state council to do work on behalf of the workers. it would apply to fast food chains with more than 30 locations nationally. the council would help work with the industry to hash out the issues including low wages, wage theft and unsafe working conditions. opponents argue what's really needed is better enforcement of existing labor laws. it's being heard by the senate appropriations committee.
