>> we're going to start with tom costello that has the latest on the inflation numbers that came out and whether or not the fed will have to raise the interest rates again. tom, good morning to you. we're happy to have good news on this economy. >> good morning, i've been talking to oil and gas analysts, they you this we'll hug the $4 mark for some time to come. now remember during the russian invasion of ukraine in march, the white house tapped the petroleum reserve, a million barrels of oil every day, that ends in october. that could send prices higher. this may be a short term reprieve. but at the moment, we do have some encouraging economic news. this morning more relief at the pump and coming below a key number, gas prices dropping below $4 a gallon for the first time since march. prices skyrocketed this summer amid inflation, supply concerns and the war in ukraine. today the national average is

$3.99. >> i'm grateful they're coming down. >> reporter: but prices are still higher than they were a year ago. today the latest economic numbers show no change with the inflation numbers month to month. good news with the overall year over year inflation number dipping slightly, down to 8.5%, still hot and still at decades high levels. >> everything is above what i paid a year ago. >> reporter: president biden hopes congress will help move the relief needle in the right direction. >> we need to pass the inflation reduction act right away. that's what congress can do -- >> reporter: but experts say the

legislation the house is set to take up tomorrow will have little effect on the more immediate factors that could help lower inflation. >> it doesn't strike me there's any legislation that's going to fix the inflation problem in the short term. >> reporter: housing and food costs continue to climb with higher prices on all the grocery store staples. the highest hike on eggs, which have nearly doubled. adding to what's already been an unprecedented and unpredictable economy. a month ago everyone was concerned about a recession, is that no longer a concern? >> recession is still a concern but if we can indeed lower the rate of price increases, lower inflation, then consumers have a fighting chance in this economy. >> tom, of course the fed is set to meet next month, will consider raising interest rates again. what are the factors, what are they looking for, how do they

thread this needle? >> the fed wants to see more economic data suggesting that hopefully inflation has peaked, it's starting to edge lower and they want to see more encouraging jobs number. we had a blow out number last week and they want to see that again. they want to see inflation hit 2%. we're 8.5% now, down to 2 will take work. everyone expects the fed to raise rates again next month, the question is how much, maybe not as much as last month if the signs are encouraging. >> thank you, tom. now to the questions surrounding former president trump. he is the focus of several investigations now and in a deposition for one of them yesterday, the former president took the fifth more than 400 times. chief white house correspondent kristen welker joins us with the latest on that and the fbi search carried out at trump's florida home earlier this week. >> reporter: former president trump is facing pressure on multiple fronts with the raid on his estate.

and reports that the bureau may have had help from an insider. and this comes as president trump sat for his own deposition. this morning new details are emerging about the latest legal challenge for former president trump. mr. trump invoked his fifth amendment right against self-incrimination more than 440 times during a deposition that lasted for hours. it's part of an investigation into his business practices. his lawyer said he answered one question, his name and read a statement accusing james and her team of a witch hunt. this after he mocked others for invoking the fifth. >> fifth amendment, fifth amendment, fifth amendment. horrible. horrible. you see the mob takes the fifth.

if you're innocent, why are you taking the fifth amendment? >> reporter: now i know the answer to that question, mr. trump said in a statement before the deposition saying his family, company, and people in his orbit were political targets. mr. trump also saying the fbi search of his mar-a-lago estate on monday in an unrelated investigation solidified his decision to take the fifth calling monday's search a surprise attack, even though the bureau was executing a court approved search warrant. that search connected to classified documents from the trump administration and this morning reports that an insider may have provided information to authorities. "the washington journal" reporting that someone familiar with the stored papers told investigators there may be more private documents at the club after the national archives retrieved 15 boxes earlier in the year, people familiar with the matter told the journal. nbc news has not confirmed that report. it comes as pressure is mounting

on the justice department to explain its actions. a current senior justice department official and a former doj official telling nbc news, multiple officials within the doj believe attorney general merrick garland should make a public statement explaining the need for the search. fbi director, christopher wray who was appointed by mr. trump was asked about the former president's baseless claims agents may have planted evidence at mar-a-lago during the search. >> that's not something i can talk about. i'd refer you to the department. >> reporter: but ray did condemn the surge in violent threats against law enforcement by some trump supporters online in the wake of monday. and that undoubtedly will continue to get more fallout. one more really interesting note that we want to point out, former president trump, in 2018 strengthened a law for how people would be punished for mishandling classified information, basically strengthening that law from a misdemeanor to a felony. it's a move he made after criticizing hillary clinton for

mishandling sensitive information in her emails. >> thank you. crews in southwest indiana are searching for more victims of a deadly house explosion, the blast caught on camera. it was so powerful it damaged dozens of surrounding homes, some are too unstable to enter now. jesse kirsch joins us from the scene, good morning. >> reporter: good morning. you can see debris scattered across the road behind me. even though we're kept back from the police line i can tell one of these buildings is blown out, standing but not safe. and just moments ago the mayor told me some of the buildings are so dangerous rescuers aren't able to go in and search for people. that's one of the reasons we don't know how many people might still be missing. the blast caught on camera just before 1:00 p.m. on wednesday.

good morning. >> reporter: good morning. you may remember last year a judge decided to reduce scott peterson's sentence from death to life without parole now his do you have team is hoping for the case to be retried entirely claiming there's proof of juror misconduct this morning convicted killer scott peterson is back in court. his legal team set for oral arguments one more time before a judge decides if he should get a new trial for the murder of his wife lacy and their unborn child. >> scott is hopeful he'll get a new trial. it's been a very long journey. >> reporter: the push comes after the defense found out that a juror may have lied on a pretrial questionnaire she failed to let the court know she was herself a victim of domestic violence when she was pregnant and she filed a restraining order in which she said she fears for her unborn child. with her history unknown she

went on to serve as juror number 7. and helped convict scott peterson earlier this year nice testified she didn't disclose her past because she did not consider herself to be a victim of domestic abuse still peterson's defense team said her history led to bias >> if she had been a victim or not, whether or not she perceived herself to be, that would have been relevant information to know. >> reporter: in a court hearing last december, lacy's mother addressed peterson directly, telling him two things that will never change lacy and connor will always be dead and you will always be their murderer nearly two decades ago the months long search for lacy captivated the nation. peterson's arrest came after lacy's remains washed on shore miles from where he claimed to be fishing when she went missing.

now after spending the last 18 years in prison, scott peterson may be tried once again for the murder he claims he did not commit the judge has 90 days to decide if scott peterson should get a new trial. if that happens, his family tells us they are confident he will not be convicted again. savannah we're joined by legal analyst lisa green good morning to you. >> good morning. first of all this is a high bar. it's hard to get a new trial how likely do you think this is? >> it's a very high bar. it's not enough to point out that a juror made a mistake on the form, which happened in this case the juror should have disclosed more about her personal life it has to have been intentional on her part and then that would have had to affect the outcome, the verdict in this case, you see how high a bar it is when you isolate one juror and ask shouldn't she have filled out the form more completely. >> they're getting into that issue, whether or not this was unintentional by the juror and the other question of whether or not she was bias. >> jurors come to jury rooms

with a lot of human experience if you cut that out we wouldn't have juries. so the issue isn't just was her life experience relevant but once seated on the jury in that closed room, was her bias, if she had a bias one that affected the outcome of the jury, did she influence jurors in an unfair way to scott peterson. >> you just mentioned it, even if she were bias, the judge said okay you intensionally left off this information, there's that final hurdle you have to cost, that made the difference in the case but for that he would have been acquitted. >> back we go to the evidence the judge has access to and you look to the totally that got scott convicted, high bar, totally within his rights. we'll have to see if the judge buys his story. >> and the judge has 90 days. >> 90 days. >> to issue a ruling >> thank you

inflation might be easing slightly tom costello is tracking it all. tom, good morning. >> reporter: good morning, we emphasize slightly you're right on the gas prices at $3.99 a gallon right now. that is down from $5.01 a gallon in june. we've seen many weeks now of gas prices declining the news on gas, though, we are probably going to hug the $4 a gallon mark for a while. most analysts expect that could be the mark we straddle as we await the government which will no longer be tapping the strategic petroleum reserve in october. year over year on gas prices we are still up 44% so while this is good news in the short term, it feeds into the bigger inflation number. month over month inflation did not move from june to july year over year it dipped slightly but still up 8.5% year over year.
