>> can't get enough fritz. he's at the outside pool for the first time, he's staying close to mom but he's venturing out. this is the baby hippo we're obsessed with this summer. two major stories to begin with. in a few hours a hearing set to start on whether a judge will release the affidavit filed in support of the mar-a-lago search warrant. in the meantime, rudy giuliani questioned for six hours in front of a georgia grand jury after he was named a target in the fulton county da's election fraud. we'll start with sam brock ahead of today's hearing. good morning. >> reporter: good morning. that hearing begins at 1:00 eastern in the building right behind me and it comes with the backdrop of the doj warning that unsealing the affidavit could compromise the investigation or potentially any future witnesses. as for the document we know it likely contains key clues as to why investigators went into mar-a-lago in the first place. the pressure for the federal government to show its cards now set to come to a head in a

federal courtroom even as investigators sift through a trove of documents. the same judge who signed the warrant will hear from a wide range of groups pushing for the affidavit to be unsealed. >> we want it released. >> reporter: the legal wrangling comes after an inventory of items taken was released revealing 11 sets of classified documents, some marked top secret. "the washington post" citing people familiar with the investigation are reporting that some are related to nuclear weapons. >> if there's an ongoing criminal investigation, in other words a legitimate law enforcement purpose for keeping an affidavit sealed, most judges

would defer to that. in fact, i would say all judges would defer to that. >> reporter: the justice department argues a release could cause significant damage to the ongoing investigation. former vice president mike pence weighing in on wednesday. >> the american people have a right to know. >> reporter: but pence also pushing back on recent threats to the fbi. >> we can hold the attorney general accountable without attacking rank and file law enforcement personnel. >> reporter: the former vp also asked if he'd participate with the unrelated january 6th investigation in which some capitol attackers called for pence's hanging. >> if there's a formal invitation rendered to us we'd give it due consideration. >> reporter: following a loss in the primary, liz cheney, trump blasting her. but cheney saying she'll keep on her committee work. >> are you thinking about running for president? >> that is something i'm thinking about.

>> reporter: as for the hearing it's possible the judge tries to find a middle ground and release a portion of the affidavit, but according to legal experts it would still be filled with redactions. >> this comes as trump's chief financial officer is set to plead guilty in a separate investigation. what can you tell us? >> reporter: the expectations is he's charging guilty to 15 charges on not paying taxes on roughly $1.7 million in income. and he would cooperate with the federal government and perhaps testify against the trump organization but no indication he would cooperate in an investigation against the former president. in the meantime, president trump's former lawyer, rudy giuliani faced a grilling for six hours before a grand jury in atlanta yesterday. testifying as a target of the criminal probe looking into

possible 2020 election interference there. blayne alexander has more on that. grand juries meet in secret, do we know what giuliani testified to? >> reporter: we do not know what rudy giuliani was asked under oath and after that testimony yesterday his attorney declined to discuss any of the specifics. but we do know that it very likely centered around statements that giuliani made to georgia lawmakers back in 2020 just on the heels of the presidential election where he came forth and made a number of false claims and conspiracy theories about the election here in georgia. beforehand his attorney did give some sort of indication as to what giuliani would not talk about. he said that giuliani would not talk about any conversations he had with former president trump citing attorney/client privilege. >> heading into this, giuliani

was informed by the prosecutor that he has become the target in the probe, it's a term of art, meaning he could be indicted himself. what kind of charges potentially would that mean? >> reporter: the da here in fulton county has indicated this could lead to possible charges ranging from racketeering to possible conspiracy charges. all of this centers around an investigation into the former president's efforts to overturn the election here in georgia, to meddle in the election, specifically the phone call he made to the georgia secretary of state, brad raffensperger, asking him to find enough votes to overturn joe biden's victory here in georgia. overnight the president weighed in on the phone call calling it a perfect phone call but this is opening the president and his inner circle to criminal exposure. the da has made it clear she's not going to shy away from any charges here and this morning georgia's governor is fighting a subpoena of his own calling it politically motivated. now to america's ongoing battle with inflation.

new retail numbers are showing the toll of rising prices, including the impact on families, small businesses and big box retailers. maggie vespa joins us from outside target in chicago with the latest. good morning. >> reporter: good morning. we'll start here, the retail giant announcing it is taking a hit with second quarter profits falling 90% over the last year. this as new federal data shows how much everyday americans are stretching their budgets to try to make ends meet. from major retailers to everyday families >> i tell my kids just the stuff you need, not want. >> reporter: inflation reaching every corner of american life. targeting saying their profits plummeted nearly 90% from last year goods stuck on cargo ships during the pandemic that have now arrived, consumers grappling with their own money woes. >> we try to go store to store. >> reporter: less than 24 hours after president biden promised relief, new federal data shows

it was like two weeks ago they >> reporter: testingal amongst yourselves. >> reporter: and other recommendations. >> why is the guidance so confusing? >> thank you for the opportunity to clarify. >> reporter: the agency's external review found public guidance had been confusing and overwhelming, that cdc leaders rotated out every few months and data were released too late to inform federal decisions the changes include a new executive council, equity office and a new streamlined website. dr. rochelle walensky also plans to ask congress to grant the cdc new powers including mandating that local jurisdictions share their data. >> our government agencies weren't designed to manage a once in a century crisis like this many while performed admirably, there's no question in my mind that these agencies could have done better. >> reporter: the course correction comes as the federal officials face criticism over the monkeypox vaccine rollout and new concerns about polio, just a second instance of u.s. community spread in 43 years

the tragic death of actress anne heche has been ruled an accident she died from smoke inhalation and burns suffered after her car crashed into a house and burst into flames. she was 53 and died nine days after the accident. a federal judge ordered cvs, walmart and walgreens to pay $659 million to two ohio counties for damage caused by the opioid crisis. a jury found that pharmacies continued to dispense large quantities of opioids for years despite warning signs they were being abused they plan to appeal that decision. good news in time for football season. chicken wing prices have dropped to below prepandemic level the wholesale price is a

we want to get to your news at 8:00, a lot going on this morning. it could be a pivotal day for former president donald trump, a judge ask going to hear arguments about releasing the affidavit that led to the search of mar-a-lago. and his long time chief financial officer is expected to plead guilty in a different case. sam brock is covering it for us. >> reporter: we have breaking news on that front. the former ceo of the trump administration plead guilty to all 15 counts he was facing of tax fraud. he acknowledged he evaded paying taxes over the course of about 15 years. what does that mean as part of a larger plea agreement, he agreed to five months in jail and also to pay back about $1.99 million in penalties and taxes. now this also is interesting, hoda, in the sense that he agreed to cooperate with authorities when it comes to speaking about the trump organization in court. but there is no indication that he would testify or cooperate with an investigation into his

>> she did >> yeah. >> she's going to nursery school. >> she says cook, cook she likes to whisk flower and have it go everywhere. >> let's get busy. you have steaks you're making for us. >> we are making a steak and noodle salad this is my salad of the summer, i've made it so much we have our ginger here. a lot of people peel it i just leave the peel on. >> do you grate it or chop it? >> either. if you freeze it it grates easily or you can cut it into little slices and mince it up >> what do we do with it >> take our marinade i have avocado oil in here, vegetable oil. soy sauce. lemon juice. we have honey -- sorry that's sugar is important >> why >> it increases the flavor and helps your meat to caramelize.

you want to marinade this for a couple hours, you can do it overnight. since it cooks so quickly the sugar is going to help you get the nice char. another thing is take some paper towels and blot it dry this seems counter intuitive, but that helps you get the great crust on it. >> don't you love the sound. >> when you say it cooks quick, how quick? >> you need a couple minutes per side i like to keep it medium rare. >> so yummy. >> the ginger and garlic makes it. >> so we do a nice big salad, anybody who watches "the kitchen" knows i'm obsessed with kale i love a kale salad.
