morning, and your lunch time temperature at 81 degrees. take a look at all of our highs, martinez reaching 92 degrees. 87 in napa, and we will see some mild weather near the coast, down the peninsula, and across the bay. but once you get away from the water, it's going to be hot, and we're going to see temperatures in morgan hill headed for 94 degrees. so we'll talk more about this, look at that weekend forecast, it's coming up in a few minutes. developing now in watsonville, federal investigators are trying to piece together the deadly collision involving two planes attempting to land. it happened yesterday afternoon. right now it's still unclear how many people died. also the victims have not been identified nor has the point of origin for each plane. both the faa and the ntsb are investigating. at 5:30, our kris sanchez will be live from watsonville with the very latest. the countdown is on this morning for the department of justice. a judge in florida says the doj must unseal the affidavit in the

fbi search of former president trump's florida home by next thursday. but the public will not see everything. "today in the bay's" susan mcginnis is live in washington with details on that and a high-level trump executive now his own legal trouble this morning, susan. >> yes, marcus, that's right. good morning. a judge down in florida ruling the government didn't make an argument strong enough that the entire affidavit should be unsealed and so now it's going to be redacted and some of it will be revealed. judge bruce reinhardt ready to reveal parts of the affidavit in the unprecedented search of former president trump's mar-a-lago estate, ordering the justice department to redact portions of the highly sensitive document. >> the department of justice doesn't want it out because it will undermine their investigation. >> reporter: the government argued unsealing could compromise witnesses and have national security implications. >> if you didn't know it was a former president, you would have thought it was a mob boss,

talking about how witnesses are threatened and how obstruction of justice could occur. >> reporter: the former president media outlets including nbc news and republicans have called for the complete unsealing. >> the judge giving the department of justice basically cart blanch opportunity to redact however and whatever they want. it is a concern. >> reporter: a trump spokesman tweeting "no redactions should be necessary" and five months on riker's island, five years' probation and fined. the punishment for trump organization cfo allen weisselberg pleading guilty thursday to tax fraud. 15 if el knows including avoiding taxes on lavish perks like mercedes cars, free rent and private school tuition. his plea deal requiring him to testify at the company trial in october but does not compel him to testify against former president trump. >> weisselberg decided that he would rather be a convicted felon than snitch against a former president. >> reporter: president trump

turning the negative attention into a positive, raising millions per day from donors. and a source familiar with the matter tells nbc news there are talks ongoing in trump world about whether to release surveillance footage from that fbi search, marcus? >> very interesting to see what will be revealed in all of this. susan, thank you. 5:04. new for you this morning, a san francisco man in custody accused of groping and punching a woman on a b.a.r.t. train. b.a.r.t. police soon arrested him near the richmond station on wednesday, this is a little before noon. he is facing sexual battery and assault charges. happening today, the governor's office is demanding a response from the city of oakland over its handling of a large homeless encampment. up to 300 people are living in the wood street camp located on cal trans property under a stretch of 880 in oakland. critics point out it's been the scene of several recent fires and a judge recently held up the plan to clear it out because

housing has not been made available to those living there. yesterday the governor's office sent a scathing letter to oakland city attorneys saying the city received a nearly $5 million grant for this very issue and it's shirking its responsibility. here's a response from oakland mayor libby schaaf. >> we are working hard with cal trans to utilize that grant in exactly the way that we promised and that is to help house the people at wood street. >> the state asked for a response by the end of the day today and says it's possible that grant money may be pulled. it is another day of protests for mental health care workers that are organizing a march and rally in oakland. we want to give you a live look outside of kaiser's santa clara facility. we're expecting strikers to show up a little bit later this morning, this is day five of an open-end strike involving some 2,000 workers across northern and the central valley of california. organizers plan to gather this

morning at 10:30 at kaiser's oakland medical center. striking worker also then march to the corporate headquarters, where a rally is set to start under way any time around noon. a new effort in the east bay to respond to our climate in crisis. water customers are being encouraged to reimagine their gardens with drought-tolerant plants. it's called the i heart my garden photo challenge. east bay mud says this is one example of what you can do. on the left the dead grass, lawn, plants that require a lot of water and on the right is the new drought-friendly area. they got rid of the grass and added plants that don't require as much water. agency says nearly 30% of drinking water is used for watering outdoor gardens. you can submit your photos to its website through september 25th. meteorologist kari hall joins me now. we got an update on the drought monitor yesterday. it's not looking very good. >> it's not looking good not only here but throughout the

region. this is the worst drought we've had in 1,200 years. some of that is in central california where we do a lot of farming as well as where a lot of our reservoirs are. as we look at our current reservoir levels across the state, these number are extremely low. most of them only about a quarter of capacity, and this is where we're getting that water to basically take care of ourselves and water our lawns and it's extremely low. here we are in august, and we still have to make it past october or november before we really start to see some rain in here, so absolutely every single drop of water helps in that conservation effort. as we take a look at how hot it's going to be in some of those inland areas, that causes those reservoirs to evaporate more quickly, headed for the mid-90s in livermore and san martin, 97 in fairfield and still in the 90s and even upper 90s for santa rosa today. we're looking at still wide-ranging temperatures going into the weekend, so it's all

about the microclimates. mike, where can we find lower gas prices? >> usually friday prices go up because well that's what happens before the demand raises as well for the weekend. today prices 30 and 40 cents cheaper than we did yesterday. cheap gas prices, we'll start in the east bay where gas is $4.69 a gallon at great gas station on round bull boulevard. we'll see what your opinion is. north bay it will be arco on redwood highway, gas there $4.73 in the middle and lapsely driving through the south bay, golden eagle gas on monterey street, gas there $4.57. that's a great price. we're looking at great speeds as well, at the speed limit, that's what we love for a great drive except here the early slowdown starts in antioch into pittsburg. right now it's getting out of antioch, a crash over on the shoulder now, blocking a couple lanes. you're clear by the time you get into your pittsburg and bay point and the rest of contra costa county moves smoothly.

automatically. you should do the same. it just makes things easier and safer. speaking of phones, we're getting a lot of the spam calls still. my car's warranty is up to date, i already have solar. i don't know about you but a government program called stir shaken was supposed to force phone companies to crack down on spam calls and it worked up 'til a point. bad guys can't spoof incoming numbers anymore. the number that appears on your phone is the bad guy's number. here is an expert on fighting spam calls. >> it's working. there are far fewer spoof calls now than there were. the problem is the bad guys got real phone numbers and stopped spoofing but still made the call. >> because one of your studies showed something like 144 million robo calls a day and that had been up, not down, from previous measurements. >> yeah, it's basically roughly where it was when stir shaken was deployed. it hasn't made a big difference. >> alex is a guest on my show

>> if they have to stand in long lines? >> we have a lot of events happening this weekend and we know you have to get to work this morning, so i'm going to show you what to expect as we check out our live view of san jose, starting out with our marine layer, our morning clouds that will clear out as we head through late morning and our temperatures starting out in the low 60s. we will head for the upper 70s at lunch time, great temperature to have lunch outdoors, only in the low 80s for the middle of the afternoon. if you're looking for something to do, maybe head to redwood city for this evening. it will be in the upper 70s for music on the square, nice and sunny, temperatures cooling down. bring a light jacket in case it gets chilly for you. we also have the a's game that will be happening at 6:40, throughout the evening those temperatures start out in the low 70s, but dip to the mid-60s, and we may see the low clouds rolling back in. it's going to be a comfortable day there, headed for 78 degrees. as you make your way east, it's going to get hotter, so concord

will reach 96 degrees. we'll see a high of 84 in san jose and also you can see how much of a difference it's going to make even with the short drive across the bay area. you're in napa it's 87 but if you go up to santa rosa, it's 97. and we're still looking at temperatures that are going to remain hot inland tomorrow, but on sunday, it starts to cool off all across the bay area, especially near the coastline, with some upper 60s in the forecast. so take a look at our inland highs, reaching into the low 90s today for many spots, and then upper 90s tomorrow as we get a slight uptick in those temperatures, but those outdoor activities on sunday especially for the valleys, it's going to be so much more comfortable and it's a nice start to the week before it heats up, while san francisco will see low 70s for the next couple of days, but overall, much more comfortable than compared to what we'll have in the valleys. mike, you're tracking two crashes in the east bay. >> i am. looking at mostly green sensors. by the bay bridge, quickly in the chp report a crash near

powell popped up there, a little sensor slowing that, crash got quickly filed to like they did with the business for chp, so that likely means no lanes are impacted but there may be a distraction on the shoulder. we'll continue to follow that critical point in the east bay. the bay bridge toll plaza is clear. highway 4 is still slow coming out of antioch, right around summersville we have a crash, there may have been two separate crashes involving a total of four vehicles so this will be a distraction as crews arrived, flashing lights. slower drive to summersville and clear passing toward pittsburg, bay point and the concord area. slower drive should be developing in san jose, we see here north 101 around oakland road. we'll track that. back to you. >> thank you very much, mike. 5:21 this morning. coming up next on "today in the bay," "nbc bay area responds." >> thousands of kids are going back to class, ready to learn, thanks to many of you.

weather you'll experience. in fremont, as you're heading off for work, it's going to be mostly cloudy and we'll see the cloudslinger from 9:00, reaching into the low 80s for a high. dublin will see a high of 88 degrees. you can see the difference a short drive makes, even in the tri-valley going from dublin to livermore, where it's going to reach 94 degrees and it's up to 97 today in fairfield. santa rosa reaching 97 degrees. but we're still in the low 70s in san francisco. we are going to also see the temperatures stay cool in half moon bay and not so bad for san jose, reaching 84 degrees. very comfortable this afternoon. we'll check out that weekend forecast, we'll talk about some events going on. right now, mike, you're looking at two crashes. >> look what jerry in our operations center found, this was the crash near the bay bridge, the berkeley curve jammed up, look how solid this traffic is on the map, it's backed up there, just around powell, all the way to about the

approach to the bay bridge toll plaza. just out of our other camera's aview. that is an issue, working on other updates from chp to see how long it will take to clear. no major injuries reported there. that's one critical backup getting to the bay bridge out of the berkeley and albany area. over here, this is getting out of antioch, another crash, actually two crashes earlier this morning, still have one lane blocked west highway 4 around summersville, causing more backup and then in san jose, we have one more crash i'm tracking north of our camera, 101 at about oakland road in the northbound direction. back to you. >> thanks, mike >> it is 5:32 and developing this morning in watsonville, investigators are already on site after a deadly midair crash. >> this happened yesterday in the middle of the afternoon. one of those planes exploded in a fireball. "today in the bay's" kris sanchez is live near the airport. are investigators close to getting some answers here? >> reporter: you know, this is still so early in the

investigation, so there are a lot of unknowns. we don't know who was on those planes, nor where they were coming from at this point. if investigators know that, they have not yet told us. what we do know is investigators from the faa and the ntsb are here on location trying to get answers. it was late last night that first responders surrounded one of the wreckage to extricate at least one person from the two planes that crashed into each other that then crashed to the ground as both were attempting to land at the watsonville municipal airport. >> i saw in the blink of an eye another plane there, and they hit each other and it was almost as if the faster plane had gone right through the smaller plane. >> now both planes are cessnas. one had one person on board, as we understand it. the other had two people on board. it's too early to say what went wrong but we do know the

watsonville airport is a small, uncontrolled airport, meaning there is no control tower, so it's up to the pilots themselves to clear for landing. now we've only within able to see one of the two planes here on the ground, but we do know that it landed right up against the neighborhood. in fact 20 feet away from a home, so very close to people and their homes. in watsonville, kris sanchez, "today in the bay." >> very tragic, thank you, kris. 5:34 for you this morning. a few tense moments in one palo alto neighborhood for someone cleaning out their deceased family member's house, found a possibly live grenade, this is from world war ii, along with military shells. this was yesterday on south court and old palo alto, nearby homes were evacuated. a bomb squad was called in to safely detonate that grenade. moving you forward on covidest itting and your at-home

test kits. may want to take a second look before you throw away expired kits. it is extending the expiration date for ten at-home kits. the fda has a web page listing all authorized at-home test kits to check a test to see if it's still usable, all you need is the lot number that is printed on the box. also developing this morning, bay area research needs your help in learning more about long covid. uc san francisco and the san francisco health department and san mateo county health are trying to work to better understand long-term covid and what even causes it. they're reaching out to people in san mateo and san francisco counties from all backgrounds who have had covid at least three months ago. they especially want to hear from black, latino and pacific islander communities, all of which saw more infections and hospitalizations. the study will last up to four years. let's take a live look outside for you this morning,

downtown san jose, shining bright with the lights in downtown, but how will they shape up for the rest of the day? meteorologist kari hall has a look at what we can expect headed into the weekend. >> it's going to be a great weekend around the bay area and there's a lot going on. this is an event i told you about on tuesday, the environmental justice summit happening in san francisco at the main parade lawn. if you're headed out there, perfect weather. you can find the details on my facebook page as well as our climate in crisis page where we talk about the coloring the green movement. we're going to see temperatures in the upper 60s throughout the middle of the day, and it will cool off as we will head down to the low 60s. now the giants will be on the road, but if you're watching it on tv today, we're watching very closely in denver, because there may be a rain delay due to a chance of thunderstorms. so of course we'll be keeping a close eye on that. here at home, we have the fog india day parade and fair happening tomorrow and sunday in fremont. it's going to be really nice but warm during the middle of the

afternoon. you may want to get there early or later in the evening and you definitely bring the sunscreen for all of that sunshine. if you do have beach plans for the weekend, it's going to be at about 71 for stinson beach and a little bit warmer on saturday but with more fog rolling in on sunday, we'll be cooler, and in santa cruz a cooldown from the mid-70s today to mid-60s on sunday in monterey, in the upper 60s all throughout the weekend. napa valley is going to be a hot destination, warm temperatures, we're up to 88 degrees today and just slightly hotter tomorrow, at least we have the nice, cool mornings. we'll see a mix of sun and clouds and on sunday, we're up to about 80 degrees. for tahoe this weekend, it will reach into the mid 80s. sunshine each and every day. we are now done with the risk of thunderstorms so that's some great news especially if you'll be out on the lake. mike, you're giving us an update on that crash near the been been. >> kari, folks, i need you to look at the screen and i need you to listen if you try to save

time because you got a carpool, a big advantage, not right now. this is the traffic at the berkeley curve getting over to the bay bridge, the flashing lights still there. the hov lane the connector ramp is impacted by the crash blocking that critical lane but the distraction and the fact you can't will have the carpoolers take the lighter route, now jammed in with the rest of the traffic backing you up from powell and building as you get toward the bay bridge, coming out of berkeley, and emeryville and heading over in toward the bay bridge toll plaza. that will impact the east shore freeway back here as well. it will continue to build. chp doesn't really have a time when they have it cleared but they don't have any major injuries reported earlier. that's the less bad news i guess. over here the two crashes that continue to be a distraction getting out of antioch toward summersville. once you pass summersville you're at speed but pittsburg and bay point. in the south bay, we do see that pronounced slowing typical where

francisco. here is citizen app video from the crime scene. it happened early saturday morning at a home on ingerson avenue in the bay view. police arrested a man they say shot and killed his father and stepmother in front of his young step sister. a report in "the chronicle" indicates the suspect live streamed the afterpath on facebook. that suspect is due in court next week. 5:44 this morning. president biden remains at his home in delaware this morning, part of a preplanned vacation. >> scott mcgrew, the first lady is still in south carolina? >> she's recovering, she's there after testing positive for coronavirus. she's still isolating at the home they began their vacation, but the white house says she is working, setting up her classes. she's going to teach in northern virginia. we haven't heard or seen much from the president since tuesday, when he briefly returned to the white house to sign that landmark legislation. he is on vacation and presidents get vacation more or less.

the culmination of a journey that started 19 years ago. robert heitz was 22-year-old when he was on board a boat in 2003 in lake michigan. unfamiliar with the area, he dove head first into a sandbar and was rendered a quadriplegic. these are x-rays of his injuries. three years after his accident and a lot of physical therapy late, he was able to regain function of all four of his limbs. he was back at school studying biomedical engineer. he was driving and he was fully functional. fast forward to today, heitz takes on a new feat, in a couple of hours he'll swim from alcatraz island all across the san francisco bay. he says he's always been a strong swimmer and today he's claiming his place in the water where his injury happened, he's doing to to raise awareness for the paralysis foundation, an organization he founded after his injury he trained since

january of last year. as you can imagine, today's journey is deeply personal. >> it's going to feel like the culmination and a real recognition that, rob, you did it. you went from quadriplegia, you felt you never were going to get out of and really believed your life was over to now doing something really amazing. >> reporter: now today i just want to add is a very special, especially to robert, who says that it's 19 years almost to the day since his injury. he's trained for this day for 19 months, and 19 has always been a special number for him, so today is really that culmination that he speaks about and lastly, he says he chose alcatraz island because of the imagery and symbolism, when he was paraplegic. he felt like he was a prisoner in his own body. today he is escaping. we're live in san francisco, ginger conejero saab, "today in the bay."

the mid-60s but overall a really nice evening. but it will still be hot for some of our inland areas. if you're in fairfield, you're still under a heat advisory, that continues through tomorrow, and it also extends over toward the sacramento and san joaquin valley as we are dealing with some of the hot temperatures reaching into the upper 90s there today, and it's going to top out at about 97 degrees. we will see the same in santa rosa, even hotter farther to the north up in ukiah, and we're looking at temperatures for much of the inner bay in the upper 70s and low 80s. look at how hot it's going to be tomorrow with some triple digits starting to appear on the map and widespread 90s for the east bay as well as san jose down to the south county, even in the north bay, we're looking at high temperatures mostly in the 90s but about a ten-degree temperature drop on sunday. this is going to be the better of the two days this weekend to enjoy some time outdoors. take a look at our seven-day forecast. upper 90s today and into the day

tomorrow. sunday upper 80s and we start out our work week with more of the same temperatures. mostly sunny afternoon but of course the mornings start out with our marine layer and the low clouds. san francisco starts out with clouds but we'll get some sunshine with highs up to about 70 degrees today. and mike, that incident at the bay bridge now more serious. >> kari, the crash itself was causing a problem, but now we hear there was a loss of life, someone died as a result of this crash. that does mean a longer, more extensive investigation. i just got word, west 80, the hov flyover coming off of the east shore freeway, off of the berkeley curve will remain closed until they complete the investigation and the coroner has just been notified so i'm thinking this may last throughout the 6:00 hour into 7:00. we're looking at flashing lights, because we lost the hov lanes they flared off these and even if you're not going to use that express lane, the flares distract and slow people as they're supposed to, use caution through the area. traffic is jammed up from here the berkeley curve all the way

back past university now, and building toward golden gate field. that kicked in about doubled in size in the last 15 minutes, so that is a big backup, a lot of folks head down out of richmond and down this area. san pablo avenue is a big surface street through the area but it does have the signals, be careful as you drive out of the area through berkeley and into emeryville. there's also frontage road which is jammed up now so that is not a place to try to fly through the area. that will not be safe to drive. you got to watch it there. everything else is looking smooth. a lighter friday flow overall but traffic held up in antioch because of the crash at summersville, this one in contra costa county. everything past summersville is clear, coming out of antioch is slow and anywhere south of here is moving smoothly. back to you. >> thanks, mike. happening now for you, plans to build a costco gas station in novato are on hold. the city must conduct a more thorough study on environmental and health impacts of the project. this decision comes more than a year after the city council approved the project.
