mike has a look at the roads but we start off with a look at the forecast. meteorologist kari hall has been tracking that. how are we looking? >> it's almost time to wake the kids up for school. >> almost. >> got a little bit of time left. let's check out our school day forecast for morgan hill starting out cloudy with mid-50s and then for today we see the temperatures really warming up headed for the mid 80s for the afternoon, big difference from the morning to the afternoon, so you want to make sure they're dressed appropriately for that warmup later today. we'll head for 81 in napa and 91 in livermore. san francisco will be in the upper 60s today. now mike, you were looking at something along the peninsula. >> there's not much to look at first of all on the reports. that's the good news. green sensors dominate. on the peninsula san mateo northbound 101 out of redwood city north of holly we have the crash, it may be in the middle lane. sensors have not lit up over the last five minutes so i hope that means it's moved to the shoulder. we'll track that. there's an easy drive coming through the east bay, the volume

not cause a problem for vasco. >> 6:02. there's a rally against a controversial plan in foster city to kill 100 geese. >> "today in the bay" ginger conejero saab is live in foster city with the latest on this strongly debated issue andfg has anything been decided yet? >> reporter: nothing just yet. it has been a continuing problem for the city a goose poop problem foster city is saying is a health risk for humans. the canada geese population has doubled to more than 300 in recent years. the propose toll to lethally remove them would affect about 100 gees but protesters say that number is still too high. this is video from the last protest on this issue back in july where people from both sides of the debate had much to say. one man says the problem has gotten so bad, the birds are filthy and human safety should

also be considered. but many say lethally removing the birds is inhumane, including san mateo county supervisor david canepa who is leading the protest today. in a recent tweet he said "i disagree with foster's city plan to get rid of its goose population. it's inhumane and does not solve any problem. the geese are a country-wide concern and i stand against any plan to kill them." in a video message posted from foster city councilmember sanjay gehani yesterday says culling the geese is only one solution the council is entertaining. >> be assured, we are not considering eradication nor extermination. but the lethal alternative is part of a multifaceted plan to control the canada goose population which has doubled in foster city over recent years and is projected to double again over the next few years. >> reporter: he continues on to

says the council is exploring other options, including robot technology and landscape modifications to make foster city less attractive to the geese. in the meantime, he urges the public to pick up the trash around the parks, just like this, where the protest later today is set to happen, do not do anything that's going to make the birds want to come and stay in foster city like feeding them. and if you have any suggestions, to email geese@fostercity.org. the council wants to hear your suggestions. marcus and laura? >> it will be nice if they find some solution that doesn't require them to eliminate some of those geese. ginger, thank you. 6:05 right now. in just a few hours, we are going to get a look at a redacted version of the affidavit used to adjust the fbi search of former president trump's home. the trump legal team is also being ordered to provide more details in their request for an independent special master to review the evidence it seized and determine if anything could be returned to the former

"today in the bay's" alice barr is live in washington with more on what is expected. good morning, alice. >> good morning, laura. we're just inside of three hours now to this deadline, when at least portions of the probable cause affidavit are going to be unsealed, made public, and it's getting so much attention because that document really does lay out the reasons for that highly controversial search of former president trump's home, and it contains evidence into the investigation of his handling of classified documents. new details set to emerge this morning about the unprecedented search of former president trump's mar-a-lago estate. a federal judge ordering the release by noon today of a redacted copy of the affidavit used to authorize the search that led to fbi agents seizing 11 sets of classified documents. >> these are serious, serious national security issues that have to be examined. >> reporter: the former

president and allies demanded the whole affidavit be made public. >> so people can know whether there's a serious allegation or this is more manufactured. >> reporter: the judge agreed with the justice department that some information should be blacked out, because it could identify witnesses and law enforcement and reveal strategy as well as sources and methods. still, there will be new information released. the judge describing the redactions as narrowly tailored. former president trump lashing out on his social media calling the investigation into his handling of sensitive documents politically motivated. president biden adamant he had no prior knowledge about the search. at a fund-raiser overnight he slammed maga republicans as a threat to democracy. >> they refuse to accept the will of the people. >> reporter: the trump legal team facing another deadline to better explain why they want a third party known as a special master to review evidence seized from mar-a-lago and determine if anything should be returned.

>> to lend some neutrality to the process, i think it makes a bit of sense. >> reporter: the trump appointed judge reviewing that request questioning key elements of its legal basis. and the judge in that special master case questioned why trump attorneys came to her instead of the judge who authorized initially the search warrant, the same one who is considering unsealing it, and this is also asking them to explain in more detail exactly what the former president is looking for, what kind of action in his request. back to you, laura. >> will be a busy morning ahead. thanks for following it for us, alice. as students head back to school, their sleeping schedule will likely change. getting enough sleep so important, because studies show that it can reduce anxiety and boost school performance. joining us now is dr. rebecca jackson, the vice president of

programs and outcome for brain balance. i love that name, brain balance. we all need a little bit of that in our lives. thank you so much, dr. jackson. let's get right to it. so let's talk about that. how do we know a kid is getting enough sleep, and how much sleep should a child get? >> you know, how much sleep is going to depend on their age and the rule of thumb is sort of more is better. for our teens, eight to ten hours is great, for kids younger elementary age 9 to 12 is ideal. gauging their mood and behaviors is a good indicator. none of us function well when we're tired. we have a harder time paying attention, making decisions and managing our frustrations and upsets. so if you see those behaviors

start to peak, i would look at sleep as a first place to start. >> i know that we've seen the studies getting enough sleep does help performance for those students but what if a child is anxious about school or something else in their life and they're not able to get to sleep to get those seven, eight, nine hours of sleep they may need. what are some tips they could do to try to help them go to sleep? >> looking to technology before bedtime is a great place to start if the child has a hard time falling asleep. spending time on a device or game before bedtime can signal to the brain it's time to be awake, not time to go to sleep. so in the hour leading up to bedtime, having it be a family goal of not engaging in technology can help to start to create that signal to the brain that it's time to go to sleep. and keeping a consistent bedtime routine. that's part of a healthy sleep hygiene process is being consistent with the time you go to bed and the time you wake up. also, being mindful about what you're consuming in hours before bedtime. caffeine will peak about an hour after you consumed it, and it can take up to six hours to clear your system, so it's not still impacting you.

company showed some really, really tough numbers to investors. t-mobile is making a deal with elon musk to provide starlink satellites to bring cell phone coverage to every spot in north america. this will take years to work out. we're trying to get into jay powell's mind this morning. the head of the fed speaking in jackson hole, wyoming. wall street's been speculaing all week. the run-up to the speech, the anticipation whipsawed the markets back and forth. here's the chief economist from bank of the west. >> we're expecting a pretty hawkish speech from jerome powell. he's really going to have to keep the focus on reducing inflation, that means continuing to raise interest rates. i suspect and markets are positioned for that announcement. >> the next interest rate meeting is in september.

we expect the fed will raise rates another three-quarter of a percent to try to slow down spending, slow down the economy. we get important consumer spending. on another note, marcus and laura, we wanted to mark the passing of an american inventor. e. bryant crutchfield, who invented the trapper keeper. >> what is that thing? >> it's my trapper from mead. >> it is a lot neater than this. >> traps my papers in so they won't fall out. >> crutchfield worked for mead and the trapper keeper was a blockbuster hit in the '70s and early '80s. he passed away at the age of 85. i mentioned this earlier to laura and marcus in our 5:00 a.m. newscast, they both had trapper keepers. laura mentioned peachy folders and marcus had no idea what she was talking about. >> look up the history of the peachy. >> i don't know what you're talking about there. >> peachy folder. >> i don't know. >> okay, we'll talk about it. >> all right, so these are peachy folders, marcus. the reason laura knows about

the country to do so and those workers say they have understaffed and overworked. in a statement, rei said "rei believes in the right of every employee to vote for or against union representation. we fully support the vote process in berkeley and will continue to support our employees going forward." both sides have five days to file objections. trending this morning, nearly three decades after the tragic death of selena, we now have a whole new album from la rena tejano. >> it's called "moonchild mixes" released overnight with brand new tracks. let's take a listen. ♪♪ >> that's a brand new track, the majority of the album songs were recorded when she was between 13

[ laughter ] dancing into the weekend. >> how is the forecast? >> you know what? it's going to be a great weekend, cooler temperatures and we are so here for it, as we take a look at our low clouds and we typically see this start out in san jose, and we know that this helps keep those temperatures from rising so quickly, and it's going to be basically very much like it was yesterday, reaching 84 in downtown san jose and 87 in east san jose. also 87 in gilroy. as we move over toward the east bay a few low 90s, up to 90 in

concord and 84 martinez. hayward today reaching 78 degrees. the seven-day forecast is coming up at the bottom of the screen in redwood city a high of 79 and low 60s in parts of san francisco. you go downtown and it will be upper 60s where you get more sunshine and napa reaching 81, clearlake headed for 96 degrees. we'll see some 60s near the coastline for bodega bay. going into the weekend, what are you doing? how about music on the square happening in redwood city. it starts at 6:00 and it's going to be at about 68 degrees. it will be cooling off quickly so bring the jacket, as you make weekend plans, if you'll be in napa valley, warm today but a little bit more comfortable for the rest of the weekend as the mornings start out in the mid-50s. along the coastline santa cruz sees highs in the mid to upper 60s, at times clouds and fog. for our inland areas we will be cooling off going into the low to mid 80s for the weekend and early next week, heating up again for the middle of next week while san francisco will

about time for the kids to head off for school in morgan hill, starting out cloudy with mid-50s, once again watch out for the foggy spots and today it's bright and sunny as we head for the mid 80s. mike, now you have a crash in san jose? >> technically in san jose city jurisdiction but it's in the monterey report system so idiosyncrasy there. in any case it's slow, north 101 at bailey avenue, a crash it looks like it's in the middle of the roadway. it is holding some folks up, into the rest of silicon valley. we have the slowing where the arrow shows typical headed toward oakland road. the bay bridge toll plaza metering lights are on. it is still lighter for a friday. back over to you. a new legal battle involving the two main players in the vaccine rollout. moderna suing pfizer, involves claims of patent infringement tied to mrna technology each uses for its covid vax nation. in a statement moderna is not seeking removal of pfizer's

vaccine or injunction to block distribution but it will seek compensation in nations where vaccine supplies are no longer scarce. moderna announced the lawsuit within the last hour. we're still awaiting response from pfizer. 6:32 and developing now, a south bay community upset and unnerved over these flyers posted around town targeting lgbtq+ population. >> kris sanchez has more on what they may believe is a political statement. >> reporter: there were about 0 flyers posted around los gatos and they mention one particular council candidate in particular, let's take a look. i want to show you what the flyers look like. some of them had a big no symbol over messages supporting the lgbtq+ community and black lives matter movement and critical race theory. statements like no more rainbow

sidewalks and no more forced acceptance. along with the messages, the name of town council candidate rob moore. he told us that he was taken aback, but another community member told us he's not really surprised. >> i was really upset when i fir saw these flyers. i was surprised, wasn't expected to see my name plastered around downtown. >> people just want to live the way they want do without big government telling you what you can and can't do. i think it's gotten a little out of hand. >> reporter: a the lo of the signs were taken down by community members who saw them as they were going up and there is speculation about who's behind them. some people say they suspect the same group that's been harassing business owners and elected leaders before that harassment has happened out in the community, but also at the town council meetings. unknown whether or not lo gatos police will be able to do anything about it. in los gatos, kris sanchez, "today in the bay." >> interesting.

thank you, kris. developing this morning, a big break in two recent bay area freeway shootings. the first one happened in june, the other in july. in the june shooting, a bullet shattered the front windshield of a car carrying an east bay couple on interstate 580 near grand avenue. the other on interstate 680 near san ramon. no one was seriously injured but chp isn't saying how investigators obtained the evidence. a 24-year-old from san leandro is in custody for one of the shootings. a 29-year-old from pleasanton is in custody for the other shooting. the cases are not believed to be connected. now to a live look at kennedy space center in florida, where vice president kamala harris is set to attend the upcoming nasa moon launch. she'll watch artemis 1 liftoff on monday. harris will speak about the importance of the program which plans to land the first woman and the first person of color on the moon. liftoff will start at 5:30 a.m.

our time. and let's take a live look outside in san jose this morning, where you can see the conditions there are certainly foggy out there this morning and if you make weekend plans, silicon valley pride parade is back. the parade will kick off on sunday from jillian and market streets. this is going to head over to the plaza de cesar chavez park in downtown san jose, kicking off at 9:00 in the morning. nbc bay area, telemundo 48 proud sponsors of this event and some of us will be marching sunday. so make sure you come out and say hello. >> is the weather going to cooperate? >> it's going to be perfect. the parade is sunday but there are events going on downtown san jose all weekend long and so we are going to have some beautiful weather for that, lots of sunshine. temperatures starting out in the low 70s on sunday, and time for the parade, and headed up for 78 degrees and as you make weekend plans, maybe you'll kick it off tonight in oakland at the a's game. it starts out at 71 degrees but

look at how cool by the end of the game. make sure you're bundled up for the breezy winds and falling temperatures. 'cool for the chinatown autumn moon festival happening throughout the weekend. tomorrow we start out at 11:00. it will only be 63 degrees and headed up for 65. 66 degrees with the sun peeking out so make sure you're dressed in those layers. if you're going hiking in muir woods, the mornings will be in the mid-50s and we may only see a few peeks of sunshine throughout the day, as we reach into the low 60s throughout today as well as through sunday. if you want some warmer weather, head down to paso robles. it's going to be 92 today, but once that breeze picks up, those temperatures will drop on saturday and we'll start out in the morning at 51 and only head for 83. definitely cool for that area and really nice weather for tahoe this weekend, starting out with low 40s in the mornings, headed for low 80s today but we'll see upper 70s for a high for tomorrow afternoon. mike, you're looking ahead for friday.

former air force sergeant linked to an extremist movement is expected to be sentenced for killing a sheriff's sergeant. last june 33-year-old steven carillo pleaded guilty to killing damon gutsweiler. he faces life in prison without the possibility of parole. in june of 2020 prosecutors say he ambushed the sheriffs deputies responding to a report of a van containing firearms and bomb-making materials. gutweiler was killed and several other officials wounded. he was also convicted in the 2020 killing of a federal security officer in oakland. 6:43 right now. the gloves are off and president biden using harsh words to describe the state of the republican party. >> scott mcgrew, this is really what some democrats wanted. >> some, not all, right, but yeah, the idea this is the opposite of what michelle obama said about when they go low, we go high. that many democrats say did not work. now we don't have tape of this next thing because our tv cameras weren't there but according to the pool reporter

complained it was unfair for some students to have $10,000 in loans forgiven. the white house then tweeting out greene took a ppp loan worth $183,000 and it was forgiven. the former baseball great curt schilling tweeted out those students were "lazy, unaccountable, uneducated children being covered by hard-working debt-paying americans." now the white house didn't point it out but many twitter users did that schilling founded a video game company that took a $75 million loan from the state of rhode island, only to default on it. the lawsuit filed later ended with a settlement that was less than the total. of course we're waiting on the release of that fbi affidavit in florida regarding the probable cause and suspicions that crimes were committed at mar-a-lago. the judge in the case received a redacted copy from the government, showing what the government would like to keep out, and then will decide before

we're starting out with some clouds this morning. a live look in oakland, wow, look how busy it is. there's already a lot of people on the roadways. we're starting out with temperatures in the low 60s and we'll see our trend heading upward, a little bit more sunshine by late morning into the afternoon. those clouds that we've seen to start out the day helped to keep our temperatures down and this is basically a repeat of yesterday. we're back up to 84 degrees downtown. 87 in east san jose and 86 in los gatos this afternoon with some low 90s for concord and danville, while martinez will see a high of 84 there, 82 in fremont and 72 in oakland. near the coast up to 60 as the fog continues today. heads up if you will be going from the interior valleys to the coastline, it's going to be chilly as well as kind of cloudy, sun may peek out throughout the day. but it's going to keep those temperatures down in san francisco as well as we head for 68 degrees downtown. north bay highs 70 in mill valley and 96 in clearlake.

santa rosa reaching 83 degrees. there's so much going on this weekend, including the palo alto festival of the arts. that both saturday and sunday, and each day no matter which day you pick is going to be really pleasant out there, with highs only topping out at about 76 degrees at 3:00, rising and falling fairly quickly but a lot of sunshine. may not be as much sun near the coastline. santa cruz staying in the 60s this weekend, and we may see the sun peeking out for a couple of hours throughout the day, but as we take a look at overall our inland temperatures going down after today so we did have some 90s in spots like livermore and concord, but i don't think we'll see that tomorrow. we're going to reach into the low to mid 80s but it will heat up again for the middle of next week while san francisco will get a breezy wind and highs only reaching into the mid-60s, so bundle up there. and mike, you're seeing things getting better out there. >> at least for key spots, where we had problems, the traffic break and the disabled vehicle cleared from west 80, your

commute through berkeley. the iconic university overpass and the slowing we expect on the east shore freeway improving back to what we expect for friday, a lighter, easier drive, slow past the golden gate field. everything else include cloud cover county the north bay and the bay bridge moving lighter than the previous four days this week. more traffic is kicking in. later on in the commute we expect more slowing for 880 and 850 oakland toward the bay bridge. the south bay we had an issue north 101 at bailey, there was a crash in the middle of the roadway. that cleared to the shoulder by the distraction, along with the build coming out of morgan hill, maybe enough to keep that slower drive for a while. however, north of 85 and 101, everything's great for silicon valley. >> good to know. we'll move you forward with a look at top stories here on "today in the bay." >> starting with breaking news. new legal battle involving the two main players in america's covid vaccine rollout. moderna is suing pfizer. the suit involves claims of patent infringement tied to mrna technology. each used for its covid vaccinations. in a statement, moderna says it is not seeking removal of pfizer's vaccine or an injunction to block distribution, but it will seek compensation in nations where vaccine supplies are no longer scarce. moderna announced the lawsuit within the last hour. we are still awaiting a response from pfizer. chp saying two people are under arrest tied to the two recent bay area freeway shootings that happened in june when a bullet shattered the front wynd windshield of a car car i aring an east bay couple on interstate 580. the other interstate 680 near san ramon. one hercules councilmember believes an expanding network of cameras can only help investigators.
