fire, apple tv, and online. >> a good tuesday morning to you. thanks so much for allowing us to be a part of your morning. i'm marcus washington. >> and i'm laura garcia. we'll check the commute with mike in a moment. let's get a look at the forecast with meteorologist kari hall. >> good morning. yes, it's going to be another nice day. if you enjoyed yesterday afternoon, that continues for us as we get a live look in san francisco, waking up to a little bit of light, patchy fog here and there that will be rolling in later in the morning as our temperatures head for the upper 60s today, low 70s for oakland and 79 for fremont. in san jose, we're headed up for 80 degrees and 89 in livermore. it's what we've all been talking about, that high heat ahead for the labor day weekend. i'll have more on that coming up in a few minutes and mike, you've been watching a couple of issues and now you have a big update for us this morning. >> that's right, we have one of the cameras available from caltrans here. it doesn't look like a lot since it's dark but you see the flares out and they are actually blocking everything except for that one lane of eastbound 80. there's a fire truck here and

can't make out really clearly but there is a big rig as we look at the map, a big rig that is out because of a fire. that burnt out shell may be there as the sun rises. if it is, it will distract the westbound commute and that will be an issue. here on the map the shell top mall to give you a reference point, going away from the bridge and up toward the carquinez bridge, that's a slow drive develop because of that one lane open on the east shore freeway. we'll track that. no major injuries reported but it's been a problem for about three hours now. more recently we had a crash here approaching the maze but that did clear, just the last few minutes. that alert has been canceled, nothing else for the rest of the bay. back to you. >> thank you, mike. developing on the peninsula, an elderly woman is dead, two others in the hospital following an incident at an assisted living facility in san mateo. >> three of their residents were given mistakenly dish washing liquid instead of juice. as "today in the bay's" steph ye

magallon reports, it's negligence. >> reporter: it's a question of how three residents at this assisted living facility in san mateo were accidentally given dish washing liquid instead of juice, causing the death of at least one woman and sending two others to the hospital saturday. >> that should not happen. that -- that say terrible mistake. >> reporter: family members tell us the 93-year-old victim was a long time san mateo resident with nine children and they want answers. in a statement, atria park of san mateo says it's conducting its own internal investigation and the employees involved have been suspended. atria has several assisted living facilities throughout california. tonight we spoke with a local elder abuse attorney who has filed four lawsuits against atria in the last four years and two against this particular center. >> they've been from falls, wounds and things like that, all of them really with a basis of

not having enough staff, and not enough training at the facilities. >> reporter: in at least one of those cases, attorney catherine stabner says one of the residents died due to negligence and says what happened this past weekend is unusual and she believes something systematically went really wrong. >> it didn't come in a juice container, if it's poison, so i actually have a hard time believing that. >> reporter: a woman we spoke with off camera says she has a client living at this facility and wasn't surprised this happened as they are short-staffed. >> they would leave like the plates in the room and sometimes they're like stacked and nobody picks it up. so i have to clean it myself. >> reporter: police are working with the california department of social services om budsman to findous what happened here. stephanie magallon, "today in

the bay." we're learning new details on a racist tirade at a taco bell in fremont. a man facing hate crime charges after a video of his rant went viral. >> nobody comes in public like this. [ bleep ] >> we first brought to you that story last friday night, a customer recorded a man berating him with anti-hindu slurs and other insults. originally police said there wasn't enough to go on for a criminal case but fremont police department is saying they reviewed the video and the d.a.'s office has filed hate crime and civil rights charges against the suspect. he is not in custody, but is ordered to appear in court. also, in the east bay, counselors will be on hand this morning after a 13-year-old was shot and wounded at madison park academy in east oakland. police say it was a 12-year-old who pulled the trigger. an investigation is now under way as "today in the bay"'s cheryl hurd reports, the shooting comes following a

deadly weekend in oakland. >> reporter: from sky ranger above, you can see frantic parents waiting outside madison park academy in oakland, after getting word that a 13-year-old student was shot on campus. >> i left work immediately, went home, got in my car and come straight up here for my kids. this is my world. you know what i mean? come on, man, this got to stop. oakland, this got to stop. >> reporter: oakland's police chief says the department got the call around 1:30. >> officers were able to quickly and safely take the shoot near custody as well as provide medical aid to the student. we have recovered the firearm as well. >> reporter: the wounded student is in a stable condition, but relatives and parents didn't know that when they rushed to pick up their children. >> it's uncalled for, for somebody, a kid to shoot another kid, eighth grade and seventh grade? >> something's got to give. us adults older people got to do something about this y'all. i know it's hard, these kids

they're misguided, what can we do? enough is enough. >> reporter: this shooting comes following another violent weekend in oakland. chief armstrong reporting six killings in the last four days, but this shooting, the chief is calling it a parent's worst nightmare. >> no parent wants to send their kid to school in a day and then be called saying your kid's been shot. it's the worst thing that you can hear. >> reporter: oakland's mayor tweeting "let me be clear: we will hold accountable those who cause harm to oakland, and we will come together to heal from these traumatic events." councilmember triva reed feeling the pain of her district, breaking down in tears, knowing answers to calm violence won't come quick enough. >> it's a lot to take in. i don't have a lot of answers. >> reporter: the oakland unified school district put out a statement saying school will be

open and counselors will be on hand to talk to students and staff. cheryl hurd, "today in the ba." a south bay district hopes parents can offer a lesson, a lesson in compassion and help teachers make it in the bay. milpitas unified is one of several local districts that are having problems keeping teachers, because they can't afford to live where they work. the district recently sent a message to parents saying they've lost seven teachers last school year and asking if parents have a room to spare or anything they can do to rent out to educators. >> so far, we've had 34 respondents who are interested in providing a room or a small space on their properties for our educators if needed. >> the school district says it's also hoping to secure lowe interest educator and city worker home loans. they also want to lobby for workforce housing.

at 59 degrees. it's a nice, cool morning. we will have a slow warmup today with a mostly sunny sky, especially as we head toward noon and overall, it's going to be a comfortable day but we are just all talking about the high heat ahead in the labor day weekend forecast. we'll talk about that coming up in a few minutes. a live look at san rafael, this is highway 101, the headlights are coming toward us apparently having gone through the area that i'm concerned with. i'm told there are 1,000 pounds of chains across all lanes on north 101. we'll track that, because that would theory stop the traffic flow. i'll try to sort things out. sorting out the business front, let's check in with silvana. >> good morning, i'm silvana henao from cnbc. wall street is set to open higher after stocks fell for a second straight session yesterday. the dow losing 184 points and the s&p 500 fell more than half a percent and the nasdaq dropped by 1% been the markets have given back most of their summer gains following comments by fed

good morning folks. a pleasant welcome with green sensors around almost all of the bay area. we'll take you to two alerts, one i've told you about already. we're going to follow up, this is eastbound getting getting away from the bay bridge headed toward the carquinez bridge, we have just one lane open, eastbound 80 at el portal a big

rig fire is still there in lanes. the fire is not going on. it's dark but there are crews there, only one lane open. we've been watching three hours of that progress or lack of progress. hopefully we'll have some more information coming up soon. across the richmond-san rafael bridge, north 101 just off the merge with the westbound 580, we have maybe all lanes, we have one lane open now. there's a thousand pounds of chain across the freeway. i don't know how it got there because it's a single car crash reported by chp that an issue. i see traffic headed north up lincoln. live camera shows it's not a major problem. things are moving lightly. kari, these folks are able to get across the bridge. if it's just this volume it travels north through san rafael. there's more coming up from san francisco. >> let's get a look at our live view in san francisco, and we're starting out clear but it's going to be heating up for the next few days, at least we do

keep the cool weather now, and it's going to be mild for a lot of our inland areas, and we do still keep the hazy sky. some light drifts of smoke coming in but shouldn't have a major impact on our air quality. by the end of the week, we're going to start to see temperatures heating up and by the weekend, it's going to be dangerous to spend long periods of time outside. as we are once again enjoying the cooler weather now, we're only headed up for 82 degrees in san jose. 85 in east san jose, a little bit warmer for morgan hill, up to 880 degrees. look at the seven-day forecast up at the bottom of of the screen with vallejo hitting 7. walnut creek will see a high of 87 degrees and 78 in hayward. for the coastline 60s. you head into the inner bay in the upper 70s and san francisco is also going to be nice and cool, 60s there, low 70s from mill valley and 97 for ukiah. as we go toward the end of the week we see this intense area of high pressure building and

that's going to really ramp up our temperatures over the next few days. it does hit southern california a little bit earlier, starting on wednesday, but it continues through tuesday with some of those valleys as hot as 115 degrees. that heat arrives in the bay area starting on saturday morning, with this heat watch that will most likely turn into an excessive heat warning as we go toward the weekend and into early next week. as we take a look at some of the numbers where we're expecting for gilroy on sunday it will reach 107 degrees, the hottest temperature we've ever measured in that spot is 115 degrees. as we look at a lot of these other numbers, it's going to be not as an all-time record but definitely a daily record for some of these spots, as we are headed for the triple digits that we'll see continue into labor day, but for san francisco, as of now, it doesn't look like we'll see any records there. that fog keeps those temperatures a little bit cooler for some of our coastal areas.

now let's turn to our climate in crisis from mega droughts to potential mega floods, our changing climate continues this show a growing trend in both the intensity and frequency of such events and becoming one of the most common disasters in the united states, scientists recently revealed that a mega flood could impact california in the next 40 years. and you might remember the 100-year flood that closed freeways and forced the evacuation of thousands of residents in san jose, it happened in 2017, but there is also a one in a thousand-year flood potential, just like the one in 100-year flood. it does not mean it will happen once every 100 years or a thousand years. it actually means that there is a one in one thousand potential that could happen within any given year. current trends though 1,000-year floods happen more often.

climate reporter from klx news looks at how often. >> reporter: over the past 20 years, floods have become the most common disaster, happening three times more often than 2000. that's not that long ago and even if we look at the year 2022, going through the first half of the year, natural disasters like floods have caused nearly $30 billion of damage in the united states and actually half of all the damage from natural disasters in the world so far this year is happening in the united states. >> so why is this happening in our warming planet has something to do with it. as it gets warmer, it holds more moisture which impacts how sudden and intense the water can come down too much at once and the soil can no longer soak in that water as the ground becomes nearly impervious, which means it cannot soak in the water, similar to concrete or hard surfaces when the water has nowhere to go, you get floods. in drought conditions, that also means the ground is too dry and
