detailed on classified documents retrieved by the feds and the deadline ticking down for a request from trump's legal teams. and workers preparing to roll up their sleeves before the heat sets in and the stench sets in. the cleanup at lake merritt before everything there starts to cook. this is "today in the bay" streaming live on roku, amazon fire, apple tv and online. good morning to you on this wednesday. i'm marcus washington. >> i'm laura garcia. let's start out with a look at the forecast with meteorologist kari hall. she's tracking the arrival of some serious heat. >> yeah. lake merritt may boil or something. >> the question is, is it? >> no. it's going to be hot, though. we're looking at temperatures starting out in the upper 50s there. we see some low 60s for san jose. 56 in livermore. as we start out in santa rosa with upper 40s, it's a chilly start. as we go into the rest of today, we see a mix of sun and clouds,

definitely those clouds for the early morning hours and clearing out by late morning as our temperatures head for 86 there. napa a high of 84. 18 in san jose. not yet really hot but it's coming our way. we'll talk about that in a few minutes. mike, you have a major crash in the east bay. >> i do. this is one of the areas we had a problem yesterday. we only have this area that is the issue. but as i take you out to the east shore freeway, reports of a deadly crash happened about 3:30 this morning. a full closure for eastbound 08 at hilltop drive. rumor mill says you get off and back on using that same exit and entrance. so that will slow you down to basically one lane traveling towards the carquinez bridge. if you join on at richmond parkway or past that, you're fine getting to the carquinez bridge. no need for any other alternates right now. we're tracking that. the rest of the bay is moving smoothly. >> thanks, mike. developing this morning, two more shootings targeting cars on

busy bay area roadways. at least one of them on the freeway. that case involving an off-duty police officer. bob is live for us. this is the second shooting from last night and this one may include a child. >> correct. this one that happened late last night, oakland police say they're investigating a shooting that possibly took place on eastbound 580 and park in oakland. the driver of that vehicle that was shot ended up crashing off the freeway at 35th and brookdale, also in oakland. at least one bullet hole is visible in the vehicle. a witness told our photographer that she heard the crash, ran over to the wreck and says the woman driver was badly hurt and a child in the car had been shot. that's according to a witness. no confirmation of this yet from opd. in the south bay, law

enforcement is looking for the person who shot at an off-duty san jose police officer as he was driving into work yesterday afternoon on northbound 101 near highway 85 in san jose. fortunately, the officer was not injured. the right passenger door, you can see there's a clear bullet hole there. he told chp he didn't see a gun but he heard a pop and described the suspect vehicle as a white hatchback with no license plates. the san jose police officers association said the officer was clearly shaken up. the law enforcement community is trying to figure out if this was a random attack. >> with the rise in ambushes on law enforcement officers, obviously it enters our minds right away. you know, it's unclear at this time if this officer was targeted. >> the nbc bay area investigative unit found there

were 82 shootings in 2019, 178 until mid-december of last year. the governor's office announced a pilot program that would put 200 cameras in some of the bay area. those cameras may be soon going up in alameda and contra costa. bob redell, "today in the bay." two people are in custody this morning after a late-night chase that ended with an arrest in lafayette. that car crashed into a deputy's cruiser. lafayette police say the chase started in el sobrante. deputies there corralled the car on woodborough road. police say there are no outstanding suspects. breaking overnight, the justice department is revealing new details about classified documents seized from former president trump's florida home. it now says evidence suggests

that information was concealed and removed ahead of the fbi search. "today in the bay's" brie jackson is in washington with the latest. the justice department really waited until the 11th hour here. >> it did, indeed. in its late-night filing, the justice department said over 100 unique, classified documents were seized. some were so sensitive and classified that fbi agents and justice department attorneys needed additional security clearance to review them. >> reporter: an inside look at the evidence seized from former president trump's florida home. in this photo, included in the justice department's filing, you can see several documents clearly marked top secret. >> he wasn't supposed to have any documents under the law. >> reporter: doj's late-night filing cites efforts to obstruct its investigation saying government records were likely concealed and removed.

casting doubts on the trump team's cooperation, stating the fbi recovered twice as many documents with classification markings as the "diligent search that the former president's counsel had weeks to perform." this overnight filing comes ahead of a court hearing on thursday. a federal judge is weighing trump's request to appoint an independent third party, known as a special master, to review the documents recovered from mar-a-lago. >> they put on a number of conditions because they understand the judge may still appoint the special master. >> reporter: justice officials argue appointing a special master would impede the government's criminal investigation. the judge in the case had signaled she's likely to rule in trump's favor. >> all of these things are calculated time delays that the trump team wants to take as they try to figure out strategy. >> reporter: in a speech on reducing gun violence, president biden condemned trump supporters threats. >> now it's sickening to see the

new attacks on the fbi. threatening the life of law enforcement agents and their families for simply carrying out the law and doing their job. >> reporter: a job the justice department says is already complete, countering a need for a second pass on sifting through documents. and if a special master is appointed, the justice department has requested that that person be given a deadline to review the seized documents. while the federal judge has signaled she's likely to apoint a special master, we could soon find out if the filing changes her mind. the hearing in the case is scheduled for thursday. >> pretty big developments today. thanks for following it all for us. happening today, oakland city workers would be out in full force trying to clean thousands of dead fish along lake merritt. the concern is that the warmer weather moving in, that could lead to a foul smell from the rotten fish. the city plans to post signs

around the lake and to update the oakland website. the heat will also likely further impact what is being called one of san francisco bay's worst ever algae bloom. >> the heat wave we're experiencing could certainly prolong this bloom and make it more intense. >> ian rinn says the bloom going on right now is unprecedented in the bay. he says no research models ever predicted a bloom of this size which could spread so fast, in this case it started with tiny red algae, now making the water toxic and leading to a massive fish dieoff. rainwater runoff is believed to be a trigger for the bay bloom. a follow-up in the stalemate

hmm. >> i don't know. >> maybe someone will want to be a meteorologist. >> you know, what does that have to do with wine? >> it doesn't matter. >> unshackled. >> we just like to bring that up in the morning. >> yeah. we've all been talking about the heat coming our way. at least today it's not hitting us. today, san jose reaching 81 degrees. 79 in fremont. 92 in concord. basically where we were yesterday. some mid 80s in napa and 77 today in oakland. then tomorrow, we start to see these temperatures coming up a few more degrees. so, instead of low 80s in san jose, it will be the upper0s. 98 in livermore. 94 in santa rosa and san francisco in the low 70s. notice how san francisco, half moon bay, they don't change. but the valley temperatures will continue to go up by the end of the week as we get more high

pressure. we're seeing not a strong ocean breeze, but our coastal areas will stay nice and mild. for southern california, the heat is hitting today. the excessive heat warning going up for all of these areas from monterey southward. for the bay area, it becomes an excessive heat warning on saturday through tuesday. that's when we could see highs well over 100 degrees. possibly up to 110. for livermore, this will be the hottest stretch of weather since august of 2020. we had seven days in a row of temperatures over 100 degrees. coming up over the next few days, we'll have about four days of temperatures over 100 degrees. we are going to have a stretch of very hot weather, while our coastal areas are looking like 70s and maybe 80 degrees for santa cruz on sunday. we'll see a big difference from the interior valleys to coastal areas.

>> right now live team coverage on the heat we've been talking about. it's expected to roll in the back half of this week. let's look at the forecast with meteorologist kari hall. >> we do have a bit more time to prepare before that big heat comes in. some of our inland valleys are headed for the low 90s today. we're comparing that to the 60s we'll see today for a high in san francisco, along the coastline, and into half moon bay. in mountain view, expect a high of about 78 degrees. we do see the temperatures warming up a few degrees tomorrow. we start to see a couple of highs over 100 degrees for fairfield. up to 100 in san martin. mid 90s mostly inland. on friday, very hot but our excessive heat warning begins on saturday. this is when we will see the hotter temperatures coming in. an increased risk of heat-related illness and plan your day around those hottest hours. on monday, we reach the peak of

the heat. it may not set an all-time record temperature, but very hot and dangerous to spend a lot of time outside. because of these temperatures, cal iso said they may issue a flex alert over the next couple of days. ginger has more on that. >> reporter: cal iso said starting today they are issuing a restricted power notice. they will be delaying operations that may make some equipment go offline. as you mentioned, cal iso says expect more flex alerts in the next several days as we anticipate the heat waves, all of this to prevent rolling blackouts and interrupted consumer use as we expect the hotter temperatures. what does this all mean? you're asked to ease off your air conditioning. set your thermostat to 78 degrees or higher. you can avoid using large

appliances like your dishwashers and washers and dryers, avoid charging your electric vehicles, all of this during 4:00 to 9:00 p.m. that's usually when energy use typically soars. energy experts say this heat wave is potentially troublesome. the state relies on importing electricity supplies from other western states, and if they are dealing with limited or interrupted supply, that could be a problem for us here. >> on a typical summer afternoon, the average usage in california is about 30,000 megawatts. and on a really hot day, it goes up to about 50,000 megawatts. and that difference is all air conditioning. >> now, a shortage of supply back in 2020 meant rolling blackouts for us here in california. now, this is also going to

big there. this was video posted on citizen app. this is on fitzgerald avenue, a few blocks from brett hart elementary school. so far no reports of injuries. moving forward this morning on the summer covid surge. experts telling the chronicle it may be waning. the bay area has a seven-day average of 18 covid infections per 100,000 people. this is below the state average of 21. that number is down from 37 three weeks ago. statewide positivity rate is now at 8.7%, though the numbers are probably a lot more fuzzy because so many more people are taking those at-home tests. as for the new covid vaccine booster shot, the fda is expected to give emergency use authorization any day now. this one will target the newest omicron subvariant and may roll out as soon as next week will also be the first covid

vaccination distribution without results from human trials because the white house is pushing for a fall booster campaign, pfizer and moderna only had time to test this specific booster on mice. as we wait for that new booster, nbc got an exclusive look inside pfizer's facility that makes the vaccine. we got access to the formation room and the filtration room where that shot is being prepared. the tanks may look like breweries, but they are mixing up the vaccine formula that targets the omicron variant. vials are being stocked in freezers ready to be shipped out. state lawmakers are opening the door to allowing more all-gender bathroom stalls. the senate and assembly passed a bill allowing cities if they choose to design gender-neutral bathrooms with multiple stalls. supporters say it makes restrooms more accessible to

everyone including trans people, families or people who rely on caretakers. some cities and public entities are ahead of the curve on this including san jose unified schools which made some of its campus restrooms gender neutral in 2017. happening today, the financial push to approve new state legislation. state lawmakers up against a midnight deadline for the end of the session with a number of bills really still hanging in the balance. >> we want to go to kris sanchez for us this morning. we're talking about everything from nuclear energy to vaccines for young people. >> if you thought my desk was cluttered, you should see governor newsom's desk right now. he could sign a whole slate of bills into law. some of them may not come as a surprise. the governor is expected to sign senate bill 1020 which would require 100% of electricity to be renewable by 2045. there are benchmarks for the years leading up to that as well. there are two bills that could boost housing construction in commercial areas.

there's a bill that would make it easier for the california medical board to punish doctors who spread covid disinformation. speaking of covid, a bill allowing teens 15 and older to get vaccinated without their parent's consent is also on the governor's desk. this would apply to vaccines other than covid as well. there's also a number of bills related to abortion access from protecting people from prosecution to allowing nurse practitioners to perform the procedures without a doctor's supervision and covering costs for californians who are uninsured or underinsured. there is also a bill to expand california's power grid by keeping the diablo canyon power plant open beyond the planned closing date of 2025. and the bill to raise the pay of cal fire firefighters is also on the governor's desk. that would provide for shorter shifts as well and a monthly stipend for health insurance

costs. one thing not on the governor's desk is a bill to strengthen california's conceal carry law. that's because lawmakers are still working on it now. they may take it to another vote, but the governor has been pushing for this. so if they can change some of the language, perhaps that passes. if not, it won't be on his desk by the end of the day. >> that's a lot. >> he'll have a hand cramp by the end of the day. with oakland mayor libby schaaf getting termed out, eight hopefuls last night got the chance to convince a captive audience they should be the one to replace her. last night's debate at laney college comes as oakland this week reels from a 13-year-old shot and injured at school by a suspect police say was just 12 years old. for the second time this summer, a deadly shooting and apparent robbery in little saigon. with so many big-city problems, most candidates agree public

safety is at the top of everyone's list. the winner of this mayor's race will clearly be taking on an embattled city. all ten candidates are in the running. taking a live look at the golden gate bridge. a few cars on the road, but what is that forecast looking like for us? meteorologist kari hall is tracking that. how will it shape up for us today? >> it depends on where you are around the bay area. in the south bay and san jose, we're still feeling some mild weather, headed for the low 80s. it will start to warm up for morgan hill and gilroy into the low 90s, even mid 90s as you move over towards antioch. oakland stays in the mid 70s today. along the coastline, 65 the high temperature. redwood city reaching 79. in san francisco, still some 60s here. in the north bay, headed for 99 degrees. in mill valley, 78 degrees.

the soul of the nation. nbc will carry that speech live. an update on the mar-a-lago search. the justice department filed this new paperwork that says government documents they were looking for at the president's home were moved, concealed or hidden. evidence, it says, someone was trying to obstruct the investigation. the new filing says there was "evidence the government records were likely concealed and removed from the storage room and that efforts were likely taken to obstruct the government's investigation." the filing also provided a single picture of what the fbi says at least is some of what it found at mar-a-lago. you can see there are folders marked top secret and secret. documents the trump team said it didn't have. in fact, a trump lawyer signed a legal filing to the courts saying they had none of this. attorney general merrick garland instructed political

come up several more degrees. we'll hit 100 in san martin as well as 102 in fairfield. still in the low 80s for oakland and 77 for san mateo. on friday, a repeat. then the dangerous heat really starts to ramp up for the weekend with an excessive heat warning going up on saturday starting at 11:00 in the morning. that continues through tuesday evening with a possibility through the next several days of reaching over 100 degrees for our interior areas. looking at ukiah, here's the ten-day forecast. yes. it's going to be hot several days on end. make sure you're prepared now for the possibility that we could have those blackouts or dealing with the excessive heat. the coastal areas, look at this, in the 70s and hitting about 80 degrees on sunday in santa cruz. our seven-day forecast for the inland areas, labor day holiday, reaching over 100 degrees.

monday looks to be the hottest day. san francisco will see temperatures reaching into the low 80s. here's where we catch a break from the heat. mike, you're tracking those changes as the commute builds. >> the volume is building now. the bay bridge saw the slowing into san francisco with the metering lights turned on. same thing for 37 and for highway 4 behind me. the big deal is this closure still for eastbound 80. we have slowing from el portal all the way to the scene. that is a bigger backup. traffic is routed off and then back on past the deadly crash that's been going on since 3:30 in the morning. a distraction for the westbound commute, starting to add a couple minutes on to the drive. not great heading towards the san mateo bridge. very slow towards the 5 vehicle crash south 880 at 92. happening now for you, california could soon ensure people who smoke marijuana while outside of work won't lose their jobs.

a follow up in san mateo where police are investigating the accidental poisoning of three residents at an assisted living facility. a worker at the atria park senior center says it happened at the memory care ward. a 93-year-old woman died. two others were sent to the hospital. it is now believed on sunday

night, the three were served a red liquid. one staff member believed it was juice. the facility initially described it as dish washing liquid. we've since learned it was an industrial bathroom cleaner. one attorney who specializes in elder abuse law believes this qualifies as negligence. >> under california law, the definition of neglect of a senior citizen is failing to protect them from safety hazards. not only here did they fail to protect them from a safety hazard, they created a safety hazard. >> we also spoke to the san mateo county district attorney. at this point his office is not involved specifically because there's no indication that the poisoning was criminal or intentional. the care home has suspended the employees involved while the incident is being investigated. the man accused of planting hidden cameras inside of a restroom at a walnut creek starbucks made his first court appearance yesterday. authorities arrested steven novelli last week. he's accused of installing hidden cameras inside a unisex
