the department of justice and that ongoing investigation? nbc's chief white house correspondent peter alexander has the very latest for us. peter, good morning. good morning to both of you. the justice department submitting this court filing overnight just before the midnight deadline. arguing former president trump and advisors failed to turn over highly classified documents even after receiving a subpoena and promising to complete an extensive search. and federal prosecutors go further. they suggest that mr. trump and his team misled them trying to hide papers that were top secret and sharing a photo that proves it. >> reporter: this morning the justice department revealing explosive new information in the ongoing criminal investigation into highly classified documents seized from former president trump's mar-a-lago residence. in a late night court filing, the doj contends the top secret documents were likely concealed and moved around in an effort to obstruct its investigation. adding that mr. trump

representatives claimed that all the materials were returned. the filing also includes this striking new photo showing documents with classified markings laid out on the carpet, that it says were taken from "45 office." >> those cover sheets are on the top of all classified records and so it's pretty obvious to anybody, even somebody perhaps who didn't do their homework or read the materials presented to him when he was president that this stuff is classified and has to be treated in a certain way. >> reporter: the filing discloses some of the classified documents recovered during the fbi search earlier this month were found in a desk in the former president's personal office. >> the idea that he didn't know he was holding on to classified information and they were sitting in his desk in his office, not just in the storage room, it's very hard to make the argument. >> reporter: the government noting that in a matter of hours the fbi recovered twice as many documents with classification markings as the "diligent search" the former president's team had weeks to perform. some of the recovered materials

so sensitive that fbi agents and justice department attorneys needed additional security clearances just to review them. in all, more than 100 classified documents were seized. the 36 page filing lays out the doj's opposition to mr. trump's legal request for an independent set of eyes to review the documents seized. the justice department says appointing a so-called special master is unnecessary and would significantly harm important governmental interests, including national security interests. before last night's disclosure, mr. trump spent the day posting a barrage of content and other conspiracy theories on his social media platform. meanwhile, president biden slammed republicans for criticizing the fbi in recent weeks. >> there's no place in this country, no place, for endangering the lives of law enforcement. no place. >> so, peter, that filing also

revealed new details about the former president's passports and why they were taken during that search at mar-a-lago. what did you learn about that? >> that's right. in this filing, they responded to the claim that his passports were improperly taken, by the way, they've been returned. but the government said that it seized the contents of a desk drawer in the former president's office filled with classified materials, government records, other documents that included three passports, two that were expired. the fact it was all mixed together, they say, helps make their case that mr. trump was not properly storing this information. national defense information. the former president's team has until tonight to file their rebuttal, arguing a separate set of eyes should be allowed to review the documents. mr. trump whose current legal team came under fire, fired a prominent attorney that has a reputation of being a skilled fighter and won several cases before the supreme court. so this continues. >> all right.

so it does. peter alexander, thank you. another major story, the ongoing crisis in jackson, mississippi. nearly 200,000 people have no reliable water this morning after flooding shut down the long ailing water system. it could take weeks to get it running again. we have the details. guad, good morning. >> good morning. so this is the water treatment plant. it provides most of the water for the city of jackson. it's the plant that failed triggering this emergency after the flooding. the state is working with the city to bring their experts in, assess the damage and figure out what needs to be done in order to bring clean, reliable running water to the people of jackson that are still in need.

>> reporter: this morning in jackson, mississippi, residents are already lining up for limited supplies of water. the governor declaring a new state of emergency calling in the national guard to help distribute water to 180,000 people. >> this is not a situation that's going to be solved immediately and it's not going to be solved overnight. >> reporter: if you're lucky enough to get water from the tap, it has to be boiled. this woman says her kids' schools have no water forcing the district to implement virtual learning this week. it also means showering at a relatives house and spending $100 a week for bottled water. >> we had to boil water to cook, to wash dishes. you know, pretty much to brush our teeth. so it's been hectic. >> reporter: football hall of famer deion sanders now coaching at jackson state university says his players and the other students here need to be supported. >> the city of jackson, we don't have water. so right now we're operating a

crisis mode. >> reporter: for many more residents, the wait for water could be long. what is your message to the people that have to leave empty handed today? >> we do have water in the system. we're putting it in the city distribution system. over the next 24 to 36 hours we will see significant numbers of the truckloads of clean water. >> reporter: as officials do what they can, friends and family are relying on each other. stephanie greedler spent $90 on this one grocery run to make sure her elderly parents have water. >> it is a complete shame that this is not a new thing. water challenges have been there for years. >> now president biden accepted the emergency declaration here which means there will be more resources from the federal government, fema and department of homeland security now coordinating with the city and

mikhail gorbachev, the last leader of the soviet union who paved the way for the end of the cold war nbc's chief foreign affairs correspondent andrea mitchell is taking a closer look at his legacy good morning >> good morning. mikhail gorbachev was a transformational soviet leader who saw the need for change. that vision led to historic summits with the most unlikely partner. then u.s. president ronald reagan who once called the soviet union the evil empire mikhail gorbachev was a new kind of soviet leader decades younger than his kremlin predecessors, he took a radically different approach when he and president ronald reagan first met in geneva in 1985, they somehow connected, agreeing on an historic joint statement that a nuclear war cannot be won and must not be fought but a summit i down in anger. and on a trip to berlin, a city still divided by that wall, reagan famously challenged

oakland police say they are investigating a possible freeway shooting that took place last night on eastbound 580 and park. as you can see in this video, the driver of the vehicle that was shot, that vehicle ended up crashing at 35th and brookdale, also in oakland, at least one bullet hole is visible on the vehicle. a witness tells our photographer on the scene she heard the crash, ran over to the wreck, says the woman driver was badly hurt and a child in the car had also been shot. no confirmation of this yet from opd. kari is tracking our forecast for this wednesday morning. how are we looking? >> it looked good for us in san francisco, along the coastline. we can see the clouds that are going to help keep the coastline cool, highs reaching into the upper 60s. it is starting to warm up in the interior valleys reaching into the low 90s in concord and livermore as well as san martin and santa rosa headed for 86 degrees. the big story is the high heat coming our way with triple-digit
