it seems like it's been a long week. let's get started this morning, temperatures in the upper 30s in the north bay as well as the south county as you get ready to head out. some temperatures really dropping in some of the valleys but as you are making plans for today maybe in hayward you are going to get up this morning, go for a walk in the park, our temperatures start out in the upper 40s. it will be a nice warm-up heading into today. not all clear and sunny. we are going to have a slight cooldown in spots like san jose reaching 66 degrees while livermore will see a high of 73, really pleasant this afternoon. we'll talk about what's going on this weekend coming up. mike, you've been looking at the bay bridge toll plaza. >> the for real friday. it is light traffic, the metering lights are turned on. they have been turned on a little before 6:00, light traffic continues to build but no major problem, a little slowing between the toll plaza and the metering lights and then, of course, around treasure island. nothing major. highway 37, highway 4, and an

earlier incident westbound right around kirker pass road which turns to ignacio a smooth, easy drive. the interchange there, dublin interchange all clear in the south bay. a little slowing remains. the second burst will kick in at 6:40. coming in to our newsroom just about five minutes ago house speaker nancy pelosi's husband, paul pelosi, was assaulted inside their home. the assailant is in custody and the motivation for this attack is under investigation. mr. pelosi was taken to the hospital where he is receiving excellent medical care and is expected to make a full recovery. now the speaker was not in san francisco at the time. we do have a crew heading to the home. we're going to bring you live updates as soon as we get them.

we're following more breaking news coming in to our newsroom, police have made an arrest in the murder of an east bay dentist. bob redell joins us live. bob, system no information about the suspects. what do we know? >> reporter: good morning to you, ginger and marcus. we do not know the name of the two people who have been arrested in the little of lili xu last august in oakland but one of the suspects looks like, take a look at your screen. the officers walked this man, one of the suspects, to a squad car. the man refused to answer questions from a photojournalist. we expect to learn more from him and the other suspect this afternoon when oakland's police chief leronne armstrong and nancy o'malley hold a news conference. a surveillance camera captured xu's murder on august 21st. xu was in the black sedan. a white sedan pulled up.

the suspect, a suspect, got out, ran over to the passenger side of xu's car. you could hear her scream and then the sound of three gunshots. xu had just turned 60 years old, was a well-regarded dentist with offices in oakland and castro valley. community leaders protested her murder afterwards and called for an end to the ongoing violence against asian american people. reporting live, bob redell, "today in the bay." >> just so hard to hear that and how it affects people. glad they have the person responsible in custody. bob, thank you. >> we'll be finding out more answers possibly later in the day. we'll bring you the press conference bob mentioned happening at 2:30 this afternoon. make sure you stay with us for continuing coverage both on air and online at nbcbayarea.com. happening today the contra costa district attorney is expected to announce a former sheriff's deputy will not face charges in a 2001 killing of tyrell wilson. now this is body camera video by

the sheriff's department. it shows wilson with a knife in his hand. this is in danville. he has been deemed mentally unstable at the time. you could hear hall ordering him to put down the weapon. the d.a.'s office says that wilson's father, they told him they will not criminally charge that officer, the former officer, with his son's killing because they can't prove that beyond a reasonable doubt hall broke any laws. >> i understand the d.a.'s position. i don't necessarily agree with it other than i appreciate it, but i do think there was sufficient evidence that would show criminal prosecution. >> hall was convicted of assault in a deadly shooting in laudemer arboleda in danville in 2018. he's currently serving six years in san quentin for that. arboleda also had mental issues. happening also today

students at santa cruz high school return to class after a fake report of an active shooter forced the school to shut down. police say someone called 911 yesterday reporting an active shooter inside a classroom with multiple gunshot victims. students spent hours in lockdown as officers swarmed the school. it turned out to be a prank. police are working to track down the person responsible for the scare. now we brought you breaking news coverage of this frightening incident. be sure to stick with us as we continue to follow the latest developments both on air and online at nbcbayarea.com. 6:06 right now. jury deliberations begin today in the civil case against santa clara county sheriff laurie smith. the sheriff is facing corruption allegations and prosecutors claim she traded concealed carry gun permits for campaign donations and big name endorsements. smith is scheduled to leave office at the end of the year. a guilty verdict would remove her from office immediately and

prevent her from seeking any public office again. the sheriff has denied all allegations during closing arguments her attorney told jurors cases are won and lost by facts. the facts were not presented in this case. vigilance is key. san jose reaches an all-time high in pedestrian accidents. there have been 29 deaths just this year. you may remember this week there was a disturbing accident. it sent a grandmother and her 3-year-old grandson to the hospital as they were crossing a street right next to the st. victor catholic school. the suspect is still on the loose. the car is described as a gray mazda 3 hatch back similar to the 2012 model. the situation has families worried and taking extra precautions during festivities this weekend and suspects say they'll be buying their children lights and reflectors. now others will be hundreding for neighborhoods that are blocked off to incoming traffic. >> we just stand on the sidewalk, not go on the streets

it's going to be a slow warm-up today. keep that jacket on. we'll take a look ahead to your weekend forecast coming up in a few minutes. we're looking at the north bay, 101. the headlights moving south through san rafael. the volume builds but still at speed. santa rosa, novato, down to the golden gate bridge, it's a good friday but starting to be a busier friday as well. busy indeed because those markets are set for a negative open this morning. investors digest disappointing tech earnings. today investors will turn their attention to the earnings results from companies like chevron and exxon mobil. investors will be focused on key economic data like the pce price index and the federal reserve's preferred inflation gauge. in the meantime amazon shares plummeted in extended trading after the company issued a disappointing fourth quarter forecast and missed on revenue estimates. like the rest of big tech amazon has had a rocky year so far and this is as it confronts soaring inflation and rising interest

rates. those challengescoincided with shoppers returning to shopping in store. amazon results have been disappointing enough to have a double digit sell-off. according to a report by the distilled spirits council, 2021 marked the 12th year in a row that spirits have taken away market share from beer. beer, including hard seltzer, accounted for 42% of the market last year while spirits accounted for, well, 41%. although beer is shrinking in market size, sales are actually increasing. the brewers association says 2021 beer sales were up 1% year over year. rihanna is making her return

half moon bay, 62. 68 in san mateo. in san francisco downtown, 63 degrees and it's still going to be breezy and a lot of clouds passing by. we'll see that as well in the north bay but we're still going to make it up to 74 in ukiah. now take a look at that seven-day forecast. it's already up at the bottom of the screen. the good news is the rain holds off for halloween but we are going to possibly be tracking this starting on tuesday morning with some scattered showers, models have been pretty consistent in showing that we could see some rain here and snow in the sierra. while it kind of starts to break up on wednesday, thursday is looking dry, just a couple days in the forecast there. watching out for the potential of rain, but it doesn't look like a whole lot here. some of the models going back and forth, this one showing the potential of about a quarter inch of rain or less where we have the light blue. for the sierra a bigger deal.

we need to get the ski season started. here we are with 3 to 11 inches of snow, maybe even higher for those upper elevations. and temperatures have been so nice and comfortable. that continues. our mornings start out in the upper 40s and low 50s. notice next week how much cooler it will be once that system drops in and we'll be watching out for scattered rain chances on tuesday into wednesday and for san francisco mostly low 60s here but it could be as cool as the upper 50s for highs next week. big changes ahead. mike, you're still tracking a crash in san jose. >> i am and still light slowing as the crash is over on the shoulder. more build and traffic. oakland road and 880, that little slowdown. we'll see more through mountain view coming up in the next 20 minutes. looking at the rest of the bay, no problems out of dublin, san ramon, a smooth drive. a little build for 84 off where
