climate forecast. >> it's been nice to enjoy the fall-like feel around here. finally we've got our fall colors on, kira, and the weather's definitely going to be beautiful this afternoon, great to head out to nourish our neighbors at your local safeway. we've got some cloud cover just off the coast, but notice over the bay area, we're pretty much starting out with those clear skies. your temperature trend into this afternoon quite pleasant. we're going to keep the sunshine around, it's about 43 degrees right now in san jose. notice we bump up by 12:00, 1:00 into those mid-60s, comfortable and seasonable. in san francisco, a beautiful shot of san francisco. it's about 48 degrees. we've got breezy winds going on. it's also still very gusty in some of those higher elevation areas. we'll go into more detail and a look ahead at your holiday forecast coming up. thanks. we begin this morning with elizabeth holmes headed to prison after she gives birth to herno

founder was sentenced to 11 years in prison. she was in tears and apologized in court, but it didn't sway the federal judge in san jose. here's "today in the bay's" thom jensen. >> reporter: this is one of the final chapters in this theranos legal saga, and for many a lesson about what to avoid as investors and how to make sure this doesn't happen again. holmes who was found guilty of four charges of investor fraud met a crush of cameras on her way into the courtroom. holmes got emotional as she addressed the court. our business and tech reporter scott budman was inside for it all. >> she got up there in tears, faced the judge and said, i'm sorry. i realize i made mistakes. there are many, many things i'd do over again. she made sure to apologize to her investors, to her family members, to her employees. >> reporter: after hours of back and forth between her attorneys and prosecutors, in the statement from holmes herself, the judge sentenced her to 11 years and 3 months in prison.

she has until april 27th to report. however, expect her to appeal. also taken into consideration how her pregnancy will impact it all. >> she's a young mother and then she's expecting her second child played into the judge's compassion, if you will, judges are human beings too, but the time limits were really kind of baked into this process, and the fact is no matter what happened she was just going to get enough time between sentencing and the imposition of sentence to have her second child and to raise in part her first child. >> back in the courtroom, we also heard an emotional speech from alex schultz. he's the father of former theranos employee and whistle-blower tyler schultz and the son of former theranos board member, the late george schultz. he faced holmes directly and blamed her for her policies and the rift her company caused in his family. >> we have to afford more protection for whistle-blowers and also a safe outlet where

they can go and be heard, especially for a medical device that could really threaten people's lives. >> markkula center for applied ethics has been studying the case closely. the center's executive director says investors should learn from the theranos scheme too. >> don't invest with somebody who's, you know, just persuasive and attractive and has a good spiel. actually, do the due diligence and make sure what they're trying to sell you works and there's some kind of proof that it works. we reached out to holmes and her lead attorney about that appeal, but they did not respond. thom jensen, "today in the bay.." >> and holmes is just one part of this story. what happens to her business partner and ex-boyfriend, sunny balwani. in july he also was exhibit b -- convicted of fraud. holmes said balwani lied to her about the company's financial models and abused her, which he

denies. and unlike holmes who spent zen days on the witness stand during her trial, balwani did not testify in his own defense. his sentencing a december 7th. we also spoke to john kerry, the former wall street reporter and author of "bad blood." that's the book that exposed the story about theranos and its problems in 2015. our scott budman asked him what he thinks of holmes' sentence. >> it's a stiff sentence. that said, you know, this was a brazen fraud, and it was a case where not only were investors defrauded but patients were put in harm's way. and i think that that's the most outrageous part of this whole story, even if she wasn't found technically guilty on the patient fraud counts, i think the impact on patients and the way -- the way her actions and sunny balwani's actions jeopardized the public's health were a huge part of this. >> cameras were not allowed

inside the courtroom, but our scott budman was, and he was live tweeting during the proceedings. be sure to follow him for updates on the theranos cases including balwani's sentencing on december 7th. his handle @scottbudman. new this morning, authorities are looking for the driver who crashed into a building in the east bay and ran away. it happened around 3:30 this morning on 20th street in oakland. crews say when they arrived, they found that car inside the building, but the driver was nowhere to be found. oakland police are now investigating it as a hit and run. no one was injured. now to a disturbing and heartbreaking story out of san jose. a mother arrested on charges of killing one of her twin babies and trying to kill the other. it happened back on november 4th. court documents show 29-year-old

selena juarez told police she was frustrated because her infant twins listed by the names zali and melanie were not latching while breast-feeding. investigators say that's when she pressed one of the infants against her breast for 12 minutes until the child lost consciousness. then police say juarez turned her attention to her other baby. >> and then moving to pick up zari and do the same thing. the evidence based on that shows premeditated attempted murder. >> in court yesterday juarez was ordered held without bail. the judge also issued a restraining order preventing her from seeing her surviving baby girl. we are learning new information about september's mass shooting at an oakland school. one of the gunshot victims has died. he was davis sacharai of el sor

ree toe. here's "today in the bay's" cheryl hurd. >> this shocking video of suspects running with guns draw is a key piece of evidence oakland police are using to try and track down the shooters. they were suspects wanted for a deadly assault. now they may be charged with murder. that's because one of six people hit by gunfire last september died on thursday. he has been identified as oakland unified school district building and grounds department staff member david sacarai. >> this was a shock for me. i can only imagine how his family feels and the different emotions they have going through this that they've had since that day. >> reporter: on september 28th, police say at least two people ran into the campus comprised of four schools. sacharai was there to install new countertops. >> he was here on campus this summer, and he helped us to install our public announcement system. >> reporter: bay tech principle

cesely frost showed us the speaker he helped install. ousd reacting to his death by releasing a statement saying in part, we are devastated by the loss of david, and we are heartbroken for his family and community. he will be profoundly missed. we reached out to his family. they did not want to talk. we did speak with another victim from that day, jason arbothel, he is david's co-worker who was grazed in the head by a bullet and survived. he says david's death should have never happened, especially to someone who brought smiles to everyone's face. meanwhile, frost says the shooting has been overwhelming for her students, and today brings back the trauma of that day. >> i don't know how many students know yet, so that, of course, you know, will be something that we'll respond to and we will have resources for them. >> cheryl hurd "today in the bay."

we have an update on the race for mayor in oakland. the alameda county registrar voters released updated results overnight. they show sheng thao has taken the lead over loren taylor. thao has 50.3% of the vote, just 680 vote■qs separate the two. though it's not clear how many ballots still have to be counted. thao is a current oakland city council member who graduated tr cal. she's also a domestic violence survivor and a single mom. at 7:10, we have much more ahead on "today in the bay." coming up, more resignations and more drama at twitter, including a poll about president trump started by elon musk. plus -- >> reporter: good morning, everyone. it's that time of year again. >> it sure is. we're kicking off the nourishing
