through pretty much every microclimate right now. we've been watching out for the potential of lightning, seeing some of that up the coastline and we'll see some off and on showers for san francisco ready to move into oakland as well though it's been steady with the rain the past couple of hours. we're seeing rain in and around the wood side area and now into sunnyvale. there will be that chance that we could see lightning in a few spots as we go hour by hour by 8:00. some of us are taking a break while other areas are still getting brief, heavy downpours and that chance will continue into the evening as well as early tomorrow morning so i'll be tracking all of that. mike, you have a reminder about those conditions. as kari said, there's still rain, scattered rain, not as

steady as over the weekend but still it's there. you see wet roadways as we travel south. still a clear drive at speed all the way down out of santa rosa. the chance for wet roadways. where there's more of a chance of wet pavement going on here. minor incident. we'll check on the lane status. no slowing on the sensors there. again, wet conditions throughout. be careful. >> good advice. new signs the flu, rsv and covid are causing more illnesses across the country and here in the bay area. with families set to gather for the end of the year holidays, hospitalizations are also growing. "today in the bay's" ginger conejero saab is live this morning. this is already shaping up to be one of the most severe flu seasons in some time. >> reporter: you are right about that, laura. flu season is under way and this comes at a time we're still battling respiratory viruses and

an uptick in covid cases which has led to health officials to increase rates and warning people about needing more care. nationwide 7,000 to 8,000 people have been hospitalized with the flu. 4,500 people have died. doctors say the flu season will not end until early spring and they encourage everyone to get their flu shot. this year's spike is being blamed on decreased immunity among the general public because people are in closer contact as covid restrictions ease. >> people are gathering closer together, not wearing masks. and so they haven't been exposed to the flu in a few years. now we're starting to see it spread. >> reporter: senator chuck schumer is calling for a nationwide plan to combat the rise in rsv cases which are impacting toddlers and young children most and overloading smaller hospitals. covid has also not gone away. as we have reported the number of cases in california has gone

up in recent weeks. covid levels suggest a new surge is under way, and it may top last summer's omicron wave and the number of people infected. take a look at some new numbers of reported cases in california which have climbed to over 5,400. that's up 157% from a month earlier. hospitalizations are just under 3,800 also up 130% over the same time period. now official covid counts show that sharp rise but a true scale can't be measured because most people are testing at home, so doctors are warning people the best thing to do is protect ourselves by being up-to-date with those vaccinations and masking up, washing our hands frequently. ginger conejero saab, "today in the bay." >> we have to remember to keep it all up. thank you, ginger. in l.a. county covid cases there are also surging. the infection rate there is

about 165 new cases per 100,000 people. county health leaders will recommend bringing back masking requirements if it continues to climb. covid-related hospitalization are just under 6%. it would have to be topping 10% for the mask order to actually kick in. nancy skinner plans to introduce a bill she says will solidify california's status as a safe haven and says her bill would protect residents in other states who come to california for planned parenthood services. voters in november approved a constitutional amendment guaranteeing the right to abortion in contraceptive services. at least 13 other states have made it a felony to receive or give an abortion. protesters will gather outside city hall opposing a controversial police plan allowing robots to use deadly force.

supervisors last week approved the plan. it will allow police to use armed robots in emergency circumstances. state law now requires public debate on the police use of military grade weapons. supervisor dean preston claims the mayor and sfpd violated rules by presenting the policy to the board without proper public notice. supervisors are still set to make a final vote on that plan tomorrow. san francisco this morning has one less facility to help addicts, the unhoused and people who suffer from mental illness. despite protests the city closed the tenderloin center created last year as an emergency temporary site to help reduce deaths and increase connections to services. supervisors voted to close it in june. the city plans to provide the same services from other local providers. a cool new twist for the 49ers faithful and the hopes for that big super bowl run, the team's latest win comes with a huge loss.

quarterback jimmy garoppolo out for the season with a broken foot. kris sanchez is here with the prognosis. >> we know that he's out for the season. hess left foot is broken and i will require surgery. this is the play that did him in. he got sacked by two miami dolphins during the opening dive. the niners did go on to win 37-19. coach shanahan knew before halftime the news was not good. >> you always hurt for guys with injuries and when it's the quarterback of your team, it affects it more. it affects guys a little bit more. the way we're built to win, he's a hell of a player. we were so fortunate to have him here but we need everybody. we have to make sure to step it up in all these areas not having

the road. slippery conditions continue. no delays throughout the north bay but, of course, we have that build where traffic in the south bay. we'll show you that coming up. well, good morning. happy monday to you. the market ended the week in the positive. the second straight week of gains. indices are still lower for the year. the dow down about 5% on the year but the nasdaq had it really hard down 27% on the year. tech stock, we've talked about layoffs in tech, there's been tens of thousands of layoffs here in the bay area but interesting perspective. big tech, companies like facebook and google and apple have been employing so many people they were basically vacuuming up the talent. some analysts are thinking the new availability of tech talent may be an advantage to those who didn't have a chance before. governments, nonprofits, those we wouldn't think of as tech like retail finally able to attract talent. today is the first day of the russian oil price cap.

europe will not accept or buy any russian oil priced above $60 a barrel. oil is about $80 on the open market. the russians can sell their oil but will have to do so for cheap. jobs and energy prices and a host of other data will have to be taken into account as it decides the next interest rate hike next week. all of those are a factor in christmas trees. balsam hills, the largest supplier of artificial trees, less about holly and lights and more about supply chain and fed rates. >> pretty much things are back to normal and prices have come back to normal. i think that's why we're seeing inflation easing up, the fed backing off a little bit. the ocean freight prices have come way down almost, i mean, by tens of thousands of dollars in some cases. >> mac harman says the only thing they're having trouble sourcing is the shell they make

"the wall street journal" reports cbs has equipped most of its 9,000 u.s. drugstores with this new technology. it lets pharmacists review and enter information either from a central location, their home, or at stores other than where the customers pick up the prescriptions. cvs says the program will free up pharmacists to provide other vital services such as vaccinations and health screening. trending this morning all some of us really want for christmas is a little bit of sleep. mattress firm finds the worst night of sleep is christmas eve.

radar where we are seeing some of those showers moving through the north bay from marin county to napa county but i have been watching thunderstorms popping up mainly around mendocino county but may be moving to clover dale and also affecting that commute on 101 for parts of the north bay. elsewhere it's just rain as we see heavier bouts of it moving through daly city and san francisco across the bay bridge over to oakland and orinda as well as walnut creek and then for the peninsula it's really starting to pick up over the santa cruz mountains moving over to the los altos hills as well in sunnyvale. we'll see the rain rolling through in waves today and it won't be done until we see the center of the storm system move through tonight into tomorrow morning. at any point there could be some rain dropping through and not everyone seeing all the rain at the same time but the potential of some showers through this

time tomorrow morning. wednesday is looking dry, but then as we go ahead, more rain. we're trying to get caught up with our rainfall deficits, but the biggest deficit is still in the north bay where we lack 3 1/2 inches of rain to catch up to normal. and in san francisco we're missing about an inch and a half. not so bad in oakland. we may see that catch up while livermore and san jose is at a surplus we're over 100% of our normal amount of rain for this date in december. we do still once again have more rain coming in, so over the next couple of days, maybe a quarter to half an inch of rain and going to the end of the weekend several more waves coming in. it will be a soggy start of the day on saturday as well as some drying for the rest of the weekend and more rain coming in. while we get rain the sierra gets snow and there could be anywhere from 7 to 26 inches of snow for the next several days.

looking good. a nice start to our december as well leading into the holidays. it looks like wednesday is the only dry day we'll have sunshine but it doesn't warm up very much and then it's going to be very cool and soggy throughout much of the rest of the week. off-and-on showers and temperatures reaching into the mid-50s. mike, we have rain. kari's forecast applies to the roads as well so here is san jose, sparsely populated or at least good spacing between the cars. you see water on the lens, water on the roadways. that's what we're dealing with that shows up as green highlighting. once remaining incident, southbound 280, watch the off ramp there. other than that, the freeway moves smoothly. not yet kicking in. let's check behind me. this is 101 right around oakland roadway. we'll see a little slowing probably in 15 or 20 minutes. we see blips here and there like right here eastbound on the high

way. it's been off and on throughout the morning. this storm system is moving very slowly and right now as we take a look at the radar we are seeing that parts of the bay area dealing with showers and even the potential of some thunderstorms. i'm watching out for that today and not all of us will see the rain at the same time but it's going to be hit or miss and if you have the nbc bay area app you will get alerts as the rain approaches your location. here we are at 5:30 seeing parts of the north bay getting some rain. it may be bright and sunny in the south bay but then the rain moves in shortly thereafter. tomorrow morning we're seeing rain moving through the east bay in san francisco at about 4:00 or 5:00 in the morning so we are going to continue to see the storm system linger longer. mike, you have a crash inside the caldecott tunnel? folks will be dry, that's the only benefit. out of the rainfall but inside the caldecott tunnel, i don't

know which bore. we do see slowing, one lane blocked by a crash involving four vehicles, no major injuries. it's already showing that slower drive out of orinda. highway 37 but the conditions out there continue to be wet in many parts of your drive. back to you. kari mentioned it but make sure to download our free nbc bay area app. it provides exclusive access to our doppler radar. you can type in your zip code and get alerts before the rain moves into your neighborhood. 5:32. a live look at the state capitol where governor newsom will hold a special session to talk about gas prices. he's accusing oil companies of intentionally ripping off californians and he's trying to make big oil pay the price. bob, i understand the governor is actually calling for a special legislative session.

>> reporter: correct. good morning to you, laura. after newly elected members are sworn in today, governor newsom will call for the special legislative session. this is to approve penalties on companies' excess profits, the first time he has called for a special session since taking office. if you are not familiar, they allow bills to take effect faster than if they were passed in regular session. he has accused companies of gouging californians after gas prices spiked between september and october to $6.40 on average per gallon to the point where californians were paying about $2.60 more than the rest of the country. the state has never seen a gap that big before. >> it would be a penalty on the oil companies that would only be dedicated back to rebates for consumers. it could force them to have to

modulate prices and come back down to a reasonable fair market value. we recognize there will be more renewable energies brought online. until we get to the point where that can handle what we need in the state, the affordable, reliable energy we provide has to be a part of the mix. demonizing our industry does no good. >> reporter: that was a spokesperson for the trade association representing the five biggest oil companies in the western united states. he calls today's special session a political stunt, but he says the association is open to meaningful discussion. the price of gas has dropped over the past month especially. you can see the latest numbers overnight from aaa. oakland, san francisco, san jose, they're averaging between $4.75 and $4.85 a gallon. that is a lot of money but is still a drop of about 75 to 80

investigators believe two cars were racing. one of the two cars struck the truck that crashed into the center divide. investigators believe another car picked up the speeding driver who was involved in the crash and then sped off. 5:36 right now. a live look at interstate 80 all quiet near donner summit. drivers this morning will still have to take extra care. chain controls remain in effect there for both directions of highway 50 as well. the latest storm a welcome sight to skiers and snowboarders. here is how it looked at heavenly where about one-third of the resort is open. more than a foot of fresh snow had fallen. the weather storm warning remains in effect through this afternoon. have to look for your opportunity to head out. we are seeing another burst of rain changing over to snow as it moves into the sierra right now.

it's going to be really difficult to get to some of those areas around tahoe. as we get these waves of rain and snow coming in and we're also looking at additional snowfall as we go into the next several days. the possibility of 7 to 26 more inches of snow even after the several feet we've already measured over the past couple of days. as far as what we'll see here today, the showers hit or miss especially for parts of the north bay. at 8:30 most of us will get a break from the rainfall but then still seeing brief, heavy downpours. still a chance of rain mostly in the north bay but we'll see it moving into the south bay and east "today in the bay" early tomorrow morning. there will be some breaks but there will be the potential of getting in on some wet weather through at least tomorrow morning's commute and then we see drier conditions moving in. i'll have more on what's ahead in a few minutes and, mike, you

are looking ahead for the roads and rails. we have a change right now. we had chp change category issuing an alert for westbound 24. bore number three. that will be the left bore as you approach. bore number four is to the right that is affected by a crash. no major injuries but a slot of slowing expected if they don't clear the four vehicles from that tunnel quickly. we're looking at a slowdown from orinda heading over to oakland, impacted by a crash there. we have wet roadways impacting the rest of contra costa county. typical there. the same thing for the bay bridge. wet roadways continue throughout as kari has been talking about. tonight another activity the warriors play a home game so there will be crowds and perhaps more congestion on 280 north heading into the city as you get to game time which is 7:00 p.m. tonight. a note one week from today or the 12th through the -- well, from the 12th some lanes will be

current georgia senator raphael warnock, were able to get a majority in the november elections. some of the vote in the election a very small portion was funneled away by libertarian candidates. given a choice between republican or democrat they will pick the republicans. advantage walker in all of this. early voting has set all-time records in georgia, the turnout is amazing. turnout again generally speaking favors democrats. there are more democrats in the world but republicans vote bigger than expected turnout, kind of indicates they may have the advantage there. meantime democrats in congress have a long way to go, a short time to get there. they want to pass election reform in the budget before republicans take over. >> we do not want to leave that to the hands of the gop who are already threatening to take down our economy and hold our budget hostage. and so we have work to do in the remaining weeks of this session

and we plan on getting it done. >> the supreme court will hear a case about a colorado business person who doesn't want to do business with gay people getting married. if you think to yourself, wait a minute, we've already had that case. there was a case about a colorado baker who didn't want to bake cakes for same sex marriage because of his religious beliefs and it was a conundrum. do you protect the bakers right not to be discriminated against and the court basically punted. ruled against the baker on what was kind after technicality. this case is back except it's a website designer who doesn't want to make websites for same sex marriage which is a much better free speech case and conservative who is have a majority on the court feel pretty good about winning. that case will be heard today. we'll probably talk about it on social media. on twitter you can find me at scott mcgrew. this morning there are new efforts under way to help some people make it in the bay. california launching its first

guaranteed income program. that new program includes more than $25 million in funding which will be distributed to seven guaranteed pilot projects across the state. joining me to talk about that is senator dave cortese. thank you for joining us. now this new program was modeled after the guaranteed income program that was launched in santa clara county, correct? >> yeah, that's absolutely right. our county has been the leader on any number of things nationally. a couple years ago when i was still on the boorpd of supervisors before joining the state senate. >> how much money can we expect those people who are able to qualify receive? >> typically it's $1,000 a month. the state program has recommended that, has been pushed down as you mentioned to seven different pilot programs in the state of california. almost everything new set up as a pilot program over one to

three years to prove that it works for one thing and secondly the state budget, as big as it is and as great as it is at times with us being the fifth largest economy in the world, we don't always have money to keep funding things. >> now that we are able to get that money, how do you apply for it and make sure those who need it really do get it? >> yeah, it's a great question. we've made sure with the state program and the locals who have done the same thing to put very few conditions -- really, no conditions or standards other than the basic demographic requirement. if you are a foster youth or coming up on emancipation diet. you would fill out a very simple application saying your name, your address, that you are coming up on your emancipation date and would like to have the monthly stipend. >> now state senator cortese and

rain. i'm really looking forward to being able to see the sierra snow soon and we are going to have off-and-on rain that continues today. also, we need the vegetation to turn back green, too. we are seeing some heavier rain starting to move in to san jose right now. i've been watching the north bay. a couple of lightning strikes moving north of clover dale and we've seen the rain picking up there as well. for san francisco it's about to let up for a few minutes, if you will be heading out the door a little window of dry weather. but still raining in oakland across the bay as well in parts of the east bay with walnut creek and concord seeing light showers continue and then for the peninsula it's just about to let up in sunnyvale but the rain is picking up in san jose. we'll see wave after rain of rain like this. a lot of it happening throughout the morning but then we'll see still some more rain on the way even as we open up the picture and see there are more storm systems in the pacific that will

be coming through this week. as we look at today it's still going to be the potential of off-and-on showers but some breaks in between as well. we are looking all clear while santa rosa may be getting in on heavy rain and the potential of more of those scattered showers overnight and into early tomorrow. wednesday is the only completely dry day we have in our forecast before more rain comes in. so how are we doing with our water year? well, we're still at a deficit for santa rosa, san francisco and oakland. now observing, i think we can make up today. for livermore and san jose we're at a surplus over 100% of our normal amount of rainfall. but we have some work to do in santa rosa and there's the possibility that we could see some of that rain coming in over the next couple of days before more storms come in later this week. so there's going to be another cold front passing on thursday as well as friday and then more
