weekend. good monday morning to you. thanks so much for starting your day with us. i'm laura garcia. >> and i'm marcus washington. we'll get a commute because that's probably affected because of what's going on with the weather. >> rain is still off and on out there this morning. if you are not seeing it right now you may be driving into it on your way in to work. and we are seeing the rain tapering off for san francisco, but it's still moving through oakland and really hitting san jose right now. as we zoom in to the east bay we can see once again quite a bit of rain moving through orinda, walnut creek and concord and over to clayton as well. the bigger picture shows we will be in and out of the rain today as the storm system spins across the region. so in martinez right now at 51 degrees, you are seeing the rain now but it will be letting up. a mix of sun and clouds today and we'll stay in the 50s. our hour by hour forecast shows a lot more sun than rain. we will get breaks in the downpours but when it does rain

it will be heavy. i'll be tracking all of that but, mike, you are still seeing that continued partial closure for the caldecott tunnel. >> bore number three is closed by a crash. your commute direction really jammed up into orinda as you head over there, only the right bore, bore number four, is only for service right now as we toin see the build. now, also, we have that rain that marcus and kari were talking about, green highlighting throughout as well. slicker roadways, typical slowing for highway 4, highway 37. the metering lights on at the bay bridge and the slower drive across that portion of the bay, 101 and 87 in south bay showing slowing sensors. new signs the flu, rsv and covid causing more illnesses across the country and right here in the bay area. >> with a lot of families set to gather for the end of year, ginger conejero saab live in san

francisco and, ginger, this already is shaping up to be one of the most severe flu seasons in some time. >> reporter: that's right, marcus and laura. one of the most severe flu seasons in some time and ramping up amid rising respiratory viruses and an uptick in covid cases led to a warning from health leaders. about increased need in care. nationwide 78,000 people have been hospitalized with the flu. 4,500 people have died. doctors say flu season will not end until early spring. we still have some time to go and they encourage everyone 10 get their flu shot. this year's spike is being blamed on decreased immunity among the general public and people in closer contact as restrictions ease. >> people are gathering closer together, not wearing masks and so they haven't been exposed to the flu in a few years and now we're starting to see it spread.

>> reporter: senator chuck shum schumer is calling for a nationwide plan that has impacted toddlers and young people most and is overloading smaller hospitals. now covid as well, like you mentioned, has not gone away. the number of cases in california have gone up in recent weeks. covid levels in the bay area, waste water, suggest a new surge is under way and it may top last summer's omicron wave and the number of people infected. newly reported cases in california have climbed to over 5,400, up 157% from a month earlier. hospitalizations are concerning and they're also up to just under 3,800 up 130% over the same time period. official counts show a sharp rise but health leaders are unable to tie down on that number because most are taking

home tests. doctors are unable to predict how bad an upcoming surge will be. as of now we are advised to mask up, wash our hands and be updated with our vaccinations. we're live in san francisco, ginger conejero saab, "today in the bay." >> whatever we can do to have a healthy holiday. thanks, ginger. we do have more details this morning, covid cases in l.a. county are surging. the infection rate there now about 165 new cases per 100,000 people. and if it continues to climb county health leaders will recommend bringing back the masking requirements. covid-related hospitalizations there are now at just under 6%. it would have to top 10% for the mask order to kick in. a live look at the state capitol where happening today east bay state senator nancy skinner plans to introduce a bill she says will solidify california's status as a safe haven for those seeking abortion or other procedures. skinner says the bill would

protect residents in other states who come to california for planned parenthood services. voters in november approved a constitutional amendment guaranteeing the right to abortion and contraceptive services. supporters say at least 13 other states have made it a felony to receive or give an abortion. protesters this morning will gather outside of san francisco city hall. this is opposing a controversial plan to allow robots to use deadly force. supervisors last week approved that plan. it will allow police officers to use armed robots in emergency circumstances. state law requires public debate on the use of military grade weapon but the mayor and sfpd violated city rules by presenting that policy to the board without proper public notice. supervisors are still set to take a final vote on that plan tomorrow. a cool new twist for the 49er faithful and hopes for a super bowl run, the latest win comes with a huge loss.

"today in the bay's" kris sanchez is here with the prognosis for jimmy g. and the niners. how is that looking? we know he is out for the season. kyle shanahan confirmed his left foot is broken and he will have to have surgery. this is the play that did it. jimmy g getting sacked by two miami dolphins. it happened during the opening drive. and while jimmy g was being evaluated the niners did go on to win 33-17, but coach shanahan new before halftime that the news was not good. >> you always hurt for guys with injuries and when it's the quarterback of your team, it affects it more, affects guys more. you look at it the way we're built to win. jimmy is a hell of a player. like i said last week we were so fortunate to have him here, but we need everybody. we have to make sure to step it up in all these areas not having

bit of a break, also drier in san francisco in comparison to where the rain is coming down quite hard in the evergreen area. that's going to continue to move off to the east over the hills but we are going to see round after round of rain today all the way up through and when this center of the storm is going to push through the bay area and that may not happen until tomorrow morning. i'll be watching all of that. a look at where we can find some lower gas prices. even lower than the last few weeks, we like this trend. over here a new name, the best in the santa clara county area, san jose, central gas is $3.99, just a shade under $4. contra costa county is the best in concord with $3.85 and marin county also holds below $4. $3.91. at the arco in mill valley, some newer names. we like these newer prices.

new. that's helpful. >> tiktokers that was too long ago. >> the espresso, that we can do. it will be cold as you get out the door this morning. rain has been off and on and we've seen a lot more of the rain on through the overnight hours. now starting to see some breaks in the rain. no rain as of right now, just some spotty, light showers. heavier rain moving through oakland. getting in on some heavier rain and the rain continues for danville and san ramon with some breaks here and there. it is really coming down in san jose right now for east san jose around the evergreen area. that will be letting up in a bit as we see this coming in off and on for today.

it's all because of the storm system that is still well off the coast and even as we look further out in the pacific there are more storms out there that are going to be coming in. as we get ready for the day in milpitas, mostly cloudy. puddles on the roadways as well as the sidewalk. you may not need the umbrella as we'll see a mix of sun and clouds. overall a cool day. as we look at 9:30, most of us are getting a break except for the spotty showers moving through the north bay. there may even be some sunshine in the mix today. then at any point there could be some showers passing by, even tomorrow morning we see the rain moving through san francisco and parts of the east bay and then even for the morning commute all the way up until the afternoon when it clears out, looks like wednesday is the only dry day we have here so we're trying to get caught up with our water year now and we are still at a deficit of about 3 1/2 inches for santa rosa. san francisco about an inch and a half. i think with one heavy downpour we could make up for the deficit

in oakland while livermore and san jose is at a surplus over 100% of the normal amount of rain to this date but we are not even half of the normal amount of rainfall for santa rosa. we do have additional more light rain on the way, a quarter to half an inch with the next round of rain coming in and then on thursday and friday more showers, widespread rain early on saturday so you can see it will stay busy here, even going into next week. over the next week we could see about 7 to 28 inches of snow for the sierra so that also looks great for the resorts that have gotten feet of snow over the past several days. and once again it's going to stay quite wet at times, not raining the whole time but you'll just need to make sure you keep looking up and also have the umbrella close by. wednesday the only dry day we have in the forecast. mike, you are tracking crashes slowing the most important east bay routes. a couple of them.

the crashes, though, i believe both have cleared. this was the second of the crashes slowing down the east shore freeway. west 80 past san pablo and traffic down to richmond. highway 24 also cleared in the caldecott tunnel. speeds are improving. a slower drive because the volume continues to build out of walnut creek, concord, so that means all these folks from these two routes can now meet over at the bay bridge where the backup is suddenly forming in the last few minutes and we will see that continue to build. rain still traveling around the bay. north 87 a new crash moving to the shoulder. back to you. 6:21. up next on "today in the bay," nbc bay area responds. >> reporter: if you're unhappy with a purchase, you might be able to get up credit card to

the hills right now but it was really pouring in. that will be the trend so you'll have a chance to get out the door and not have to deal with such heavy rain. even into early tomorrow before we're done with this storm system and the next one. mike, you are seeing wet roads. more water and more traffic because that's the timing. north 101 water on the lens kicking up. we have less than a backup, north 87, that crash we talked about has been moved to the shoulder. distraction still slowing. it may start a couple miles back. the blue means puddling and ponding quite likely on the surface streets. slowed down into sunol out of pleasanton.

castro valley slowing on north 238. the bay bridge backup slower to build after two crashes cleared. a lot of people idling there. a special session with lawmakers talking about gas prices. he is accusing oil companies of intentionally ripping off californians and trying to make big oil pay the price. bob redell in the east bay and, bob, the governor is actually calling for a special legislative session. >> reporter: today after legislators are sworn in governor gavin newsom will call for this special session to call for penalties for excess prices. special sessions allow bills to take effect faster than if they

were passed in regular session. this is after gas prices spiked between september and october to roughly $6.40 on average. $2.60 more on average than the rest of the country. >> it would be a penalty on the oil companies that would only be dedicated back to rebates for consumers. it could actually force them to have to modulate the prices and come back down to a reasonable fair market value. >> we recognize there will be more renewables brought online in california. our member companies are involved. until we get to the point that can happen in the state, it has to be participate of the mix. banning us, mandating us out of

police in antioch are investigating the third deadly crash of the year along the same stretch of roadway. the latest crash happened yesterday morning on james donlon boulevard and silverado drive. a truck flipped over killing the man who was ejected inside and killing two others. the person who died has not yet been identified. a follow yum for you that morning, still no word of arrests in a weekend crash that killed a big rig driver transporting u.s. mail. it happened early saturday on interstate 880 in oakland. investigators believe two cars were racing. they crashed into the center divide, rolled over and caught fire. the driver of the truck became trapped. they believe another car picked up the speeding driver and then sped off. not a lot of traffic out there but a lot of snow at donner summit.

chain controls remain in effect. and not only there but for both directions of highway 50. the latest storm certainly a welcome sight for skiers and snowboarders. about one-third of the resort is now open. more than a foot of fresh snow had fallen since the start of the weekend. the winter storm warning remains in effect through this afternoon. meteorologist kari hall monitoring all of that and more rain heading that way. >> and sierra tahoe open. all that fresh powder. still coming down. 50 is clear but i do think that snow will be coming down there soon. 8 to possibly 28 inches of snow by the end of the week and we're

going to give some additional rainfall. it becomes more scattered for the rest of the day. much of the bay area seeing peeks of sunshine at least. even into the evening commute we could see rain returning in the overnight hours. early tomorrow morning by sunrise. we'll talk about what's ahead for the rest of the week and, mike, you have a look at the roadways. wet roadways so that's one potential delay. the pattern, the distribution relatively expected. in toward orinda, an earlier crash blocked one of the bores but it has been cleared.

"today" reveals "time's" person

of the year on wednesday. 6:43. there is one day left in the last race for senate. >> scott mcgrew joins us now. it won't change the balance of power. >> not in the senate. it might affect the turnout. the democrats held on to the senate after that red wave turned into more of a ripple. so the race for the senate in georgia between the democrat and the republican will not control -- will not change, rather, who controls the senate. certainly could change the tone of the senate, though. neither herschel walker, the republican candidate, or the current georgia senator raphael warnock were able to get a majority in the november election. now some of the vote in the general election, a very small portion, was funneled away by a libertarian candidate. it is generally logical to say if libertarians are given the choice between a republican or a democrat they will pick the republican, so advantage walker. early voting has set all-time records in georgia. the turnout is extraordinary.

turnout again generally speaking favors democrats. there are more democrats in the world but republicans vote. bigger than expected turnout hints a democrat advantage. democrats in congress have a long way to go, a short time to get there. they want to pass election reform and critically budgets before republicans can take over the house. >> we do not want to leave that to the hands of the gop who are already threatening to take down our economy and hold our budget hostage. and so we have work to do in the remaining weeks of the session, and we plan on getting it done. and lastly, the supreme court will hear a case about a colorado business person who does not want to do business with gay people getting married. if you think, wait a minute, we've already had that case. we have. there was a case about a colorado baker who did not want to bake cakes for same-sex marriages because of his religious beliefs, and it was a

conundrum. do you protect the baker's religious rights or the couple's rights not to be discriminated against and the court basically punted. they ruled against the baker on what could be considered a technicality. the case is back except this time it's a website designer who doesn't want to make websites for same-sex marriages which is a much better free speech case and conservatives who have a majority on the court feel pretty confident about winning. we'll talk about it on social media. you'll find me on facebook at scott mcgrew tv. this morning there are new efforts under way to help some people make it in the bay. california launching its first guaranteed income program. that new program includes more than $25 million in funding which will be distributed to seven guaranteed projects across the state. joining me to talk about that is senator dave cortese. senator, thank you for joining us. now this new program was modeled

after the guaranteed income program that was launched in santa clara county, correct? >> that's right. our county has been a leader on any number of things nationally and a couple years ago when i was still on the board of supervisors before joining the state senate. >> how much money can we expect those people who are able to qualify receive? >> typically it's $1,000 a month. the state program has recommended that. it's been pushed down, as you mentioned, to seven different pilot programs. almost everything licensed is new, over one to three years to prove that it works and secondly because the state budget, as big as it is and as great as it is at times with us being the fifth largest in the world, we don't

we've had the wet weather continue. as of now we're getting a break in parts of the north bay as we are zooming in to 101 where we've seen the showers off and on from ukiah down to marin county starting to back off for san francisco but seeing the rain getting lighter. you may have a break to get out the door without having to deal with the rain pouring but it has been pretty steady for morgan hill to gilroy and san martin. that rain coming off the santa cruz mountains and we're still looking at some of the showers at least for the next couple of hours but before we get a lot more of a break. if you are on your way out the door taking the kids to school in milpitas, mostly cloudy, temperatures in the low 50s but we stay in the 50s today so make sure they're wearing extra layers because there are a lot of microclimates will only hit 59 degrees. as far as the rain we start to see it tapering off with the potential of it continuing for parts of the north bay into the

afternoon and then here we are at 7:00, the rain returns for marin county and into san francisco and then moving through the peninsula event lip into the east bay before sunrise tomorrow as we see the rain kind of spinning around, that's the center of the low pressure and once that moves away, we do have a break which will happen throughout the day on wednesday. we're trying to get caught up on the water deficits. santa rosa, we're still lacking three and a half inches am we may make it up very soon in oakland while we're at a surplus for livermore and san jose getting over 100% of our normal amount of rainfall. santa rosa hasn't even made half of its normal amount of rainfall. there will be additional rain on the way, about a quarter to half an inch of rain between now and the middle of the week before the next storm system comes in. weapon see a quick wave on
