a good morning to you on this wednesday. i'm marcus washington. >> and i'm laura garcia. first the wednesday forecast with kari. it starts out cold. we have another freeze warning for parts of the north bay where we are going to see those temperatures dipping into the upper 20s and low 30s and we can see for all those areas shaded in purple included in that freeze warning through 9:00. right now we're at 35 degrees in sonoma as well as santa rosa. 39 in oakland and 40 in san jose. 36 degrees in dublin and in livermore. fog drifting around parts of the tri-valley. very dense in the north bay. we've seen visibility near zero in novato and half mile visibility for napa and santa rosa. allow extra time to get to work. later today we have sunshine and temperatures headed for upper 50s and we do have more rain coming our way for tomorrow. i'll talk more about that. you have a traffic break going on in oakland?

it may have just cleared. starting to slow more than just a couple minutes ago. westbound 580 approaching the maze. it sounds like they're relocating a vehicle, one vehicle unable to move. we are looking at recovery i believe coming into the maze off 580 and the smooth drive here this is what kari is talking about, fog, highway 37 through novato and watch out for that coming down. the sensors are smooth. back to you. thanks, mike. happening today former they are nose president and ceo sunny balwani learns his face. jurors convicted him of 12 counts of criminal fraud for misleading investors. prosecutors are asking he serve 15 years in prison. i went one-on-one with steven clark about what he believes may help out today. she leafed 11 years, 3 months for her charges, so what do we think how this will impact his

sentencing? >> for mr. balwani, the prognosis is not good. the judge threw the book at elizabeth holmes, 11 years. her team was hoping for house arrest or a short prison sentence. for mr. balwani, he's been convicted of more charges. i think the court will be around that 11-year term or even higher because he was convicted of more charges in his separate trial which is a very interesting outcome. ms. holmes was only convicted of four charges and still got 11 years, and it was because of the amount of the loss in this case that i think is a big factor for the court. >> a lot of people have been following this case thinking about that holmes' defense, bringing up the connection between the two, the personal relation ship. so you would think they would talk about everything that was going on. how do you think that's going to impact the sentencing for him? >> certainly ms. holmes accused mr. balwani of domestic abuse and said that was a big factor in why she did what she did at theranos. that didn't play out as much in

the balwani trial. the government portrayed them as partners in life and partners in crime. i think they're saying they're equally responsible even though there was a lot of finger pointing as to who was really in control at theranos. >> for his defense, what do you think their strategy will be when it comes to sentencing? >> they're going to point out mr. balwani invested a lot of money in theranos and he actually lost a lot of money unlike ms. holmes and he was highly invested in the technology part of this. but he left before the theranos ship went down. so i think they will point out those two factors. it was ms. holmes who made all these misrepresentations to investors. he actually had skin in the game. he lost a lot of money here. he didn't profit. i think they're going to say it's not fair to send that man to prison for 15 years. and they're going to hope for the same thing ms. holmes hoped for, house arrest or a short prison sentence.

"today in the bay's" cheryl hurd untangles what is believed to be a twisted family drama. >> this tragic incident on friday could have been prevented. >> reporter: lopez family spokesperson margaret petra says danielle lopez's death on the 680 freeway could have been prevented if police would have been willing to listen. >> and we wanted law enforcement to have all the evidence that danielle's family had.

>> reporter: that evidence, they believe, would have helped police figure out how danielle ended up being hit and killed by cars on highway 680 in san jose in october. and they believe that may have prevented this man, louie lopez, from allegedly being involved in a revenge killing where reynaldo cantu was killed in his own driveway in newark. investigators believe the gunman was danielle's father. investigators believe lopez killed cantu because he believed cantu's son, who dated danielle for two years killed his daughter. >> the suspect confronted the victim about who he was and was looking for another family member, and ultimately shot the victim in the driveway. >> reporter: a spokesperson from the san jose police department says our sincere condolences to the victim's family during this tragic sequence of events.

the facts are that the young lady was reported missing after the tragic collision on the highway. the california highway patrol is leading the investigation into the reported domestic violence as well as the fatal traffic collision. the chp says the agency does not comment on investigations that are still ongoing. cantu's wife did not want to go on camera but called the shooting senseless. >> both families are suffering. >> reporter: cheryl hurd, "today in the bay." 4:37 right now. a decision this morning in georgia's senate run-off. nbc news is projecting democratic incumbent raphael warnock as the winner over herschel walker. >> warnock celebrated late last night walking out to a crowd chanting six more years. warnock is promising to enthusiastically deliver. >> it is my honor to honor the four most powerful words ever

wednesday morning, here we go. look at that 50-year-old beauty right there. the transamerica pyramid celebrated a birthday yesterday, 50 years. and we're still talking about that rain in the bay area. not so much today. >> not today. you can leave the umbrella at home. you want to make sure you're adding on extra layers because it's cold and i'm seeing fog drifting around. let me show you this camera in dublin looking at 580. headlights heading westbound and we are seeing low visibility in spots. that's been the case for parts of the north bay but, yes, this is a break from the rain so

let's talk about our rainy season. this is one of the wettest months of the year. you can see how it compares to the spike that we see in january and then in february as well just about as much as we typically get during the month of december and it's been pretty good to us especially with sierra snow. right now we're at double the normal amount of snowfall for the southern sierra and at 166% of normal the statewide average is at 175% of the normal amount but, unfortunately, we've had a lot of starts like this with climate change and warmer temperatures two out of the ten past years we've only ended the season with our normal amount of snowfall. hopefully this does continue. we do see more snow in the forecast with the potential of getting anywhere from 29 inches of snow in south lake tahoe up to 61, and it's going to be nice to see that falling over the course of the next several days. this is the next storm system that's going to bring that in and we're going to start to see

the waves of the rain developing by tomorrow evening. once again we're dry today. i'm going to stop it right here at 3:00 tomorrow afternoon with the north bay covered with rain and it starts to move into san francisco and approaching the east "today in the bay" tomorrow afternoon into the evening for the south bay. while it does start to clear up for the north bay, the next round will be right behind that going into late friday. the weekend is looking pretty wet, and we'll see wave after wave of storms moving in with heavy rain. very cold temperatures. as we go to the middle of next week we'll see what happens but it looks like that storm stays just off the coast. rainfall totals could continue to get a pretty big boost here with the potential of getting about 3 to 4 inches of rain in parts of the north bay, about 1 to 2 inches of rain for the east bay. so you can see how much wet weather is going to be coming in over the next few days, and we see the sun for today. it's the last day we'll have a

completely dry day because as we head for thursday afternoon and then again late friday as well as the weekend it's going to be raining off and on. mike, how is it looking in the santa cruz mountains? >> we have a call from chp. a good landmark for folks to the northbound side where there may be a traffic break. word a deer was hit and now is possibly in the slow lane on the right side. that could be a factor. shouting that out. north 101 that earlier crash around oakland road is still on the blotter but no lanes are affected. the rest of the bay a nice easy drive. kari did show you that dublin camera so be advised low clouds hover just above the deck. back to you. >> thank you very much, mike. police are investigating a new threat against scott wiener that led to officers scouring his

home. early yesterday morning he says he received an email listing his home address and mentioning a bomb. they suggested they would shoot up his office at the state capitol but he believes the latest threat may be linked to a recent twitter exchange he had with representative marjorie taylor greene and charlie kirk. >> these are homophobic attacks and they're attacking me because i authored legislation to support the equality of transgender people. >> he says he's been the target of threats for months. earlier this year east bay authorities convicted a man for threatening to kill him. cases of flu continue to rise nationwide. according to data from goodrx prescriptions for tamiflu have reached their highest fall level since 2013. it is used to treat both

children and adults. national pharmacy groups say this problem can't be fixed anytime soon and it may be through early next year. flu cases, of course, not the only concern for doctors during the holidays. santa clara county health leaders say levels of covid detected in waste water are skyrocketing and it now actually surpasses the omicron peak back in january. because waste water data is often a bellwether, dr. sara cody says she's seen more cases and potentially more hospitalizations over the next few weeks from covid, flu and rsv. >> a winter of viral soup. and our health care system is stretched and health care workers who have been working so hard to take care all of us for three years now. and it's happening again and
