meteorologist kari hall is checking what we can expect. it's been cold and it does continue today especially with the drier weather that is moving in. we do have a freeze warning in effect for parts of the north bay and as we can see these areas shaded in purple will be included in that through 9:00 today. we're also seeing some upper 30s for the inland parts of the east bay as well as the south bay. now the fog is another issue we're dealing with especially in the tri-valley and parts of the north bay. visibility dropping down to near zero, so watch out for that especially around novato. mike, you were looking at the low clouds in san rafael. >> specifically here, the lower part of the roadway. let's show you a full screen right where the lights are and looking at what kari was talking about. low visibility, that highlighted yellow, north into santa rosa. potentially petaluma area.

that can be the routine after rain. slowing speeds down below 30 in just a few spots and clearing. a crash maybe by brentwood. happening a few hours from now a man accused of killing another man in a revenge shooting makes his first court appearance. they say one father was killed by a man who recently lost his young daughter in a tragic accident. "today in the bay's" bob redell joins us live in dublin outside of the courthouse where a lot of activity will happen today. bob, this case has so many tragic events to untangle. >> reporter: it does. good morning to you, laura. later this morning a judge in the east county hall of justice behind me in dublin will arraign this man, louie lopez. he's 52 years old. this is on charges that he shot another man, reynaldo cantu, who

is 40 years old, shot and killed him. according to law enforcement lopez went to cantu's house in newark looking for cantu's son who used to date lopez's daughter. the lopez family believes the son had something to do with his daughter's death. danielle lopez died after she was hit by several cars along highway 680 in san jose. according to police there was a confrontation between both fathers which ended when lopez allegedly shot and killed cantu in his driveway at his home in newark. a spokesperson believes the rage that led up to this past friday's shooting could have been avoided, prevented if law enforcement, in their opinion, taken the family's suspicions about danielle's death seriously in the first place. >> we wanted law enforcement to have all the evidence danielle's family had.

>> reporter: a spokesperson says our sincere condolences to the victim's family during this tragic sequence of events. the fact is the young lady was reported missing after the tragic collision on the highway, referring to danielle lopez. the california highway patrol is leading the investigation into the reported domestic violence as well as the fatal traffic collision. chp says they do not comment on investigations still ongoing. we reached out to the wife of reynaldo cantu. she calls the shooting of her husband senseless. reporting live in dublin, bob redell, "today in the bay." >> and now two losses in two families. former theranos president and ceo sunny balwani learns his fate today. jurors in july convicted him on 12 counts of criminal fraud.

prosecutors are asking he serves 15 years in prison. she received 11 years, 3 months for her charges, so what do we think how this will impact his sentencing? >> for mr. balwani, the news is not good. the judge threw the book at elizabeth holmes. her team was hoping for house arrest or a short prison sentence. balwani has been convicted of more charges. the court will be around that 11 year term or higher because he was convicted of more charges in his separate trial. it was because of the amount of the loss in this case that i think is the big factor for the court. >> a lot of people have been following this case.

how do you think the relationship will impact him? >> he was accused of domestic abuse and said that was a big factor in why she did what she did but they have been portrayed as partners in life and in crime. i think they're saying they are equally responsible. as to who was really in control at theranos. >> what do you think their strategy will be when it comes to sentencing? >> they're going to point out mr. balwani invested a lot of money in theranos and he actually lost a lot of money, unlike ms. holmes and he was highly invested in the technology part of this, but he left before the theranos ship went down. i think they will point out it was ms. holmes that made all these misrepresentations to

investors. he actually had skin in the game. he lost a lot of money here. he didn't profit. it's not fair to send him to prison for 15 years and they will hope for house arrest or a short prison sentence. >> the balwani sentencing is set for 10:00 this morning. our own scott budman will be in court throughout the proceedings. give him a follow for any of the updates on today's sentencing. his handle is @scottbudman. we will bring you the verdict live as soon as it comes in. a follow-up, alameda county supervisors have reportedly postponed a decision on whether or not to ban criminal background checks when people are applying for new housing. the fair chance housing measure would be the first in the nation. good morning. the time is 5:13. i've been keeping an eye on santa rosa. parts of the north bay where we have fog but near freezing temperatures and are under a freeze warning up until 9:00. looks like our temperatures here hold steady at about 34 but then as the sun comes out, we'll have a cool but sunny day. we'll see more of what's ahead with the next round of rain. we'll talk about that in a few minutes. looking at palo alto. a clear, easy drive. smooth conditions, taillights northbound into san francisco. we may have a crash on 280 heading up into the same area. we'll talk about that coming up.

there's no law against that. but actually building it dorms or bedrooms in an office involves zoning and building permits, something the city had not issued. elon musk seemed to confirm they were building worker dorms when he tweeted so the city of sf attacked companies providing beds for tired employees instead of making sure kids are safe from fentanyl. where are your priorities, london breed? an article about a small child exposed to fentanyl at a city park. now it's early morning, so i haven't gotten a response from the family about the use of their child in an argument over zoning. today is also the deadline for musk and twitter set by a lawyer who has threatened to sue twitter for breaking its promise to workers, one of many lawsuits, at least three. in the letter an attorney warns musk, you can double down on breaking your word and screwing over your employees as they head into the holidays. if so, deposing you will be a joy. now in this particular case the

issue is twitter told its employees, hey, there will be this takeover. we need you to stay because you are very, very valuable to us. stay through the takeover because you'll be fine, then they were fired. by musk. the promise was broken and musk has to stick to the promises the company he bought made legally. that's what the lawyer is getting at. >> a lot to look at. >> thanks, scott. it is 5:16 right now. apple is reportedly tapping the brakes on plans to launch a self-driving car. 2014 silicon valley giant first started kicking the tires on what it calls the project titan. bloomberg reports the company is in the process of designing a car that includes a steering wheel and pedals and would only support total self-driving on the highway. drivers would be alerted first before switching to manual control. the earliest release date is pegged as 2026. hot off the presses "time" magazine has officially named

"time" says zelenskyy galvanized the world by using attention to bring to light the war with russia. in addition the magazine is highlighting the spirit of ukraine and the courage of ukrainians who stood up in unity against the russian invasion. you can get the whole story on the "today" show coming up at 7:00 a.m. right after "today in the bay." >> he really did let cameras inside. you don't typically see that in a time of war. >> very vocal and got out there himself. >> leading by example. 5:17. halfway through our workweek, not bad. we've had some rain, we've had some chill, continues a little bit. >> hump day, we're trying to get to the weekend so it's going to be a fairly easy day in the weather department but then tomorrow we're back to tracking more rain. as we get a look at what to expect in berkeley this morning. we are starting out with some

more clouds, temperatures in the low 40s. yes, it is another cold start but i think we've gotten used to it. the chill hit us early and continues every day with no warm-up in site. only in the low 50s going into late morning and the afternoon and headed for 57 in oakland as well as 57 in los gatos. a lot of our temperatures reaching 57 today and then as we go through the forecast it does get cooler with more clouds moving in tomorrow and spots like dublin will hit a high of about 55 degrees and the same in napa and novato reaching 55 degrees. on friday it's still very cool as we get more rain coming in. now that we're in one of our wettest months of the year it is nice to see all of this activity. we barely get anything during those dry summer months. this is when we make up for all of the rainfall deficits and try to fill our reservoirs and get that sierra snowpack going and it's going to be looking decent in terms of storm systems arriving over the next week or so.

the next one is well to the north of us. developing on the satellite moving through the gulf of alaska. soon we'll be approaching the pacific northwest and eventually making it into the bay area. so the first wave of rain comes in tomorrow afternoon. here we are at 4:00, we see the wave of heavy rain hitting us right before sunset. it's also starting to move in to san francisco and moving across the bay area fairly quickly for tomorrow evening and then a bit of a break before the next round of rain comes in late on friday. that next round will continue throughout much of the weekend with some widespread showers. there may be some breaks on sunday. early next week a couple of dry days before we track the next storm system coming in. so at least for now the models are showing some pretty hefty amounts of rainfall ahead. the potential of getting about 3 to 4 inches in the north bay and santa cruz mountains tomorrow

through sunday and even into early monday. our sierra snowpack is doing pretty well right now at 175% of its normal amount for this date, and we do see more heavy snowfall on the way up to 60 inches for some of our resorts. expect that this weekend if you are going to the sierra, travel will be very difficult. with our temperatures in the low to mid-50s. rain off and on. it will be sloppy in the bay area and cold for those mornings extending into next week. mike, you are tracking a couple of similar crashes. a car and a deer, traveling north. flashing lights. a smooth drive for much of the rest of the bay. another crash involving a deer.

disgraced theranos president sunny balwani. his attorneys are asking for no prison time. >> this all comes weeks after theranos founder elizabeth holmes was sentenced to more than 11 years in prison. kris sanchez is live outside of the federal courthouse and what's the strategy this morning. how will it take shape here? >> reporter: balwani's team says the reason they believe that he should be allowed to serve probation rather than prison time comes down to money. he never used theranos for fame or for fortune or for recognition. he was found guilty on 12 counts of wire fraud and conspiracy based on the fraudulent claim blood testing machines could diagnose 200 or more decembers from a single drop of blood. you see there theranos founder elizabeth holmes was convicted on four felony counts of wire fraud and conspiracy to commit wire fraud. in contrast to balwani's lawyers

asking for probation saying that he's been punished enough by losing his money, his reputation and ability to work, federal lawyers are asking for 15 years behind bars. just last month his former business and romantic partner elizabeth holmes was sentenced to more than 11 years in prison, it shocked a lot of people in its length. she will surrender in april after she gives birth and bond with the baby she is now expected. balwani joined her several years later helping to raise nearly a billion dollars from investors. they were romantically involved, a relationship holmes described as controlling in her trial. they are asking for $800 million in restitution. sunny balwani due in a courtroom later this morning. in san jose, kris sanchez,

doesn't happen often. a look at how d.a.s are shifting strategies and charging drug dealers with murder to fight the fentanyl crisis. we spoke to santa clara district attorney jeff rosen on this issue. you can find it on nbcbayarea.com/fightingfentanyl. growing concern over a tamiflu shortage. this as influenza cases are on the rise. prescriptions are at its highest fall level since 2013. the national pharmacy group says this problem can't be fixed anytime soon and it may remain in short supply through early next year. all of that is bad news according to a former director of the cdc. he tells "today" that more people put off flu shots this year. that's leading to more severe infections. >> the vaccination coverage rates for adults right now for this time of year are about half of what they were prepandemic this time of year. and i don't know if it's because

people are putting it off, everyone is tired of getting shots because of covid, but it's the wrong decision to make. >> you can watch that full interview coming up on the "today" show. that's at 7:00 right after us here on "today in the bay." and it is 5:36 for you this morning. let's take a live look out at christmas in the park in san jose. a beautiful start to the morning there but it is cold out there. meteorologist kari hall has been tracking those temps and, kari, are we going to see a little warm-up today? >> not much as we compare to what we've had recently. it will still only reach into the 50s but is starting out cold. watching the fog and the tri-valley, visibility there in dublin. at times clear at street level but then at times you may be driving in to that fog. watch out for that. we're headed for those temperatures in the upper 50s today for the south bay. a high of 58 today in walnut creek and 57 in oakland, still very cool with san mateo reaching 57 today and upper 50s in san francisco.

>> sure. so it's really an opportunity to reimagine downtown san francisco post lockdown. last year's event brought in $2.2 million in economic impact for district spending here in the financial district. we saw 40,000 attendees. it looks like folks are spending even more which is exactly what we're wanting to see. >> reporter: that's great. and it's a lot of hard work that goes into putting something like that. talk to us about how much hard work you have done. >> absolutely. it's several months of content development by 16 different artists, collectives and musicians to make these pieces. there are four, like you said, 30,000 lumen projectors.

the december normal for the month we usually get about 6 3/4 inches of rain for the whole month of december and just keeping in mind this is only the 7th day of the month so we need another 4 1/2 to catch up to normal and since october 1st we are running a deficit overall. but we've surpassed it in the sierra. and there's more snow in the forecast going into the end of the week. two, three, even four feet of snow in the sierra. the rain begins in the forecast for tomorrow afternoon. we do see it continue into friday as well as the rest of the weekend with the possibility of getting about 3 to 4 inches of rain and so it's going to be very soggy after today going into the weekend. i'll be tracking that with more updates and, mike, you're

looking for car-free space on weekend. supervisors have approved a plan to keep diverting traffic from one portion of the great highway along ocean beach and the outer sunset. now this is something the city first started doing when the pandemic took hold. the ordinance called for an area to remain car free for at least through 2025. shelters have a crisis on their hands because authorities say more people are abandoning their pets. according to pleasanton police the number of abandoned pets has been growing. officers are responding to more calls. they attribute the problem in part to more people returning to the office or perhaps less time and money to care for their animals. >> these animals are disoriented and scared and far more likely to run away from those trying to rescue them, that coupled with inclement weather and the danger of being struck by vehicles --
