by. the rain will be back soon. this cool looking shot in san francisco of the moon and the fog right under the transamerica pyramid there. so it's starting out with a very cool morning and even freezing temperatures in the north bay. that freeze warning continues until 9:00. we are one degree above freezing as well as santa rosa. upper 30s elsewhere for our inland valleys but seeing really dense fog drifting around for the tri-valley and parts of the north bay. so we're watching out for that. mike, you are seeing how that impacts the roadways and it's getting foggy. >> we're over on richmond now. you talk about the north bay, across the bay from the san rafael side. a foggy situation. a bit of slowing right where it says richmond. in the westbound area. it's clear by the time you get to central. talk about the low visibility. tough for portions of the north

bay, vallejo for 37 and 101 and looking at typical patterns. the metering lights are on at the bay bridge. no drama but there is a build for the east bay. there is drama in this story. a man accused of killing another man in revenge, a revenge shooting, making his first court appearance today. investigators say one father was killed by a man who recently lost his young daughter in a traffic accident. "today in the bay's" bob redell is in dublin outside the courthouse there. this case has so many tragic elements to untangle. >> reporter: it does. good morning to you, laura. later this morning at 9:00 a judge here at the east county hall of justice behind me here in dublin will arraign this man, louie sixto lopez, on charges that he shot and killed another man named reynaldo cantu. now according to law enforcement this past friday lopez went to cantu's house in newark looking for cantu's son who used to date

lopez's daughter. the lopez family beliefs the son had something to do with his daughter's death. last october danielle lopez died after she was hit by several cars along 680 in san jose. according to police there was a confrontation between both fathers which ended when lopez allegedly shot and killed cantu in his driveway. a lopez family spokesperson believes the rage that led up to friday's shooting could have been avoided, could have been prevented if law enforcement had taken the lopez family suspicions about danielle's death seriously in the first place. >> and we wanted law enforcement to have all the evidence that danielle's family had. >> reporter: now a spokesperson from san jose police says, quote, our sincere condolences to the victim's family during this tragic sequence of events. the facts are that the young

lady, they are referring to danielle, was reported missing after the tragic collision on the highway. the california highway patrol is leading the investigation into the domestic violence and chp says that agency does not comment on investigations that are ongoing. we did reach out to the wife of reynaldo cantu, the man shot and killed this past friday. she did not want to go on camera but calls her husband's death senseless. reporting live in dublin, bob redell, "today in the bay." >> a tragic reminder for her everyone day in that driveway as well. thank you, bob. happening today former theranos president and coo sunny balwani learns his fate. jurors in july convicted him of 12 counts of criminal fraud for misleading investors. prosecutors are asking he serve 15 years in prison. i went one-on-one with legal analyst steven clark. we talked about what he believes may play out today. she received 11 years, 3 months

for her charges. so what do we think how this will impact his sentencing? >> for mr. balwani the prognosis is not good. the judge threw the book at elizabeth holmes. she got over 11 years, and her team was hoping for house arrest or a very short prison sentence. and for mr. balwani, as you pointed out, he's been convicted of more charges. so i think the court will be around that 11-year term or maybe even go higher because he was convicted of more charges in his separate trial, which is a very interesting outcome. ms. holmes was only convicted of four charges and she still got 11 years. it was because of the amount of loss in the case that i think is the big factor for the court. >> a lot of people have been following this case thinking about that holmes' defense they kept bringing up the connection between the two, the personal relationship. so you would think they would talk about everything that was going on. how do you think that's going to impact the sentencing for him? >> certainly ms. holmes accused mr. balwani in her trial of

domestic abuse and said that was a big factor in why she did what she did at theranos. that didn't play out as much in the balwani trial, but the government has portrayed them as partners in life and partners in crime, and i think they're saying they're equally responsible here even though there was a lot of finger pointing back and forth between balwani and holmes as to who was really in control at theranos. >> for his defense, what do you think their strategy will be going when it comes to sentencing for him today? >> they're going to point out mr. balwani invested a lot of money in theranos and he tombly lost a lot of money, unlike ms. holmes. they will also say he was highly invested in the technology part of this, but he left before the theranos ship went down. i think they're going to point out those two factors that it was ms. holmes that made all these misrepresentations to investors. he actually had skin in the game. he lost a lot of money here. he didn't profit. i think they're going to say it's not fair to send that man to prison for 15 years.

and they're going to hope for the same thing that ms. holmes hoped for, house arrest or a short prison sentence. >> today's sentencing is set for 10:00 this morning. our own scott budman will be in the courtroom throughout the day's proceedings. give him a follow on twitter for the updates on today's sentencing. we will bring you that verdict live when it comes down. a follow-up for you, a decision whether or not to ban criminal background checks when people apply for new housing has been postponed. it would be the first anywhere in the nation. stay with the new york yankees. rumors yesterday were swirling the giants finalized a deal luring him away from the big apple. we were hoping he would come a little closer to home. judge is from the central valley and people believed he could be angling to play closer to home. this way he can have home wherever he wants with that much money. let's take a live look in san francisco where i'm sure a lot of people are crying, giants fans anyway. you know what? nothing to cry about here because it will be a nice day on tap. a cold one. meteorologist kari hall is tracking what we can expect. that rain will not ruin the day. today it's dry and we will see the rain returning tomorrow so as you get the kids ready for school this morning in santa rosa, make sure they're layered up. it does start out cold. temperatures in the mid-30s at drop-off time and at pickup time it's mostly sunny and 55 degrees in the north bay and we're going to see upper 50s for our microclimates this afternoon reaching 57 degrees.

cooler tomorrow as the rain moves back in. i'll have more on that. mike, a look at where we can find lower gas prices? i was hoping the lower gas prices would lure aaron judge back but i guess not. diamond gas and mart on story road in san jose $3.99. east bay, san pablo, great price and great gas just $3.69 there. in the north bay mill valley has hq fuels onshoreline highway and that is at $3.85. we're moving pretty smoothly. not a lot of surprises. lighter traffic as tends to be the case as we approach mid and late december. the east shore freeway, west 80, the slowing we saw is as a result of a crash. that holds some folks up there keeping it clear for berkeley and the backup at the bay bridge. metering lights are on but you

we'll see a high of 58 in walnut creek and 57 in oakland. temperatures in the mid to upper 50s around the bay area. 55 in half moon bay and mid-50s in san francisco as well. north bay temperatures also in the mid to upper 50s. so cool today but once again we're taking a break from the rain. december is usually one of our wetter months of the year looking at this bar chart where we see usually january is the wettest month of the year. as we take a look at a spot like santa rosa that measures more rainfall in comparison to our other microclimates, so far only about 2 inches of rain but that's still above what the normal amount is for the month of december. and then as we look out for the rest of the month and what we usually get, about 6 3/4 inches of rain so as of now it's only the 7th day of the month. we need another 4 1/2 to make what's normal and we're running

at a deficit for the water year. a lot of numbers to juggle there but we are trying to dig ourselves out of a dry hole that we had here with the next storm system approaching that will be arriving for tomorrow afternoon. so we start to see the rain moving into the north bay at about 3:00 tomorrow afternoon and then spreading quick lip across much of the rest of the bay area during the evening there will be a brief break. some spotty showers but then late on friday we see more widespread rain coming in that will continue throughout the week. a lot more rain, a soggy weekend. we may see about 3 to 4 inches. lookingality our forecast temperatures do not warm up any. it stays very chilly with low to mid-50s for highs and morning temperatures and today the only

day we see that sun icon for quite a while. you are looking at some participates of the east bay. >> this is a big delay because of a crash here west 80 out of san pablo. that is one problem. no major injuries reported. one lane blocked enough to cause that longer drive. through that stretch and down to the bay bridge. it's just that stretch through san pablo. the backup continuing to build. there's still movement. they are on the upper east shore freeway right there. looking at otherwise a typical build. the low visibility in the north bay but light traffic in the south bay. back to you. >> thanks, mike. 6:21 right now. up next on "today in the bay," nbc bay area responds. >> reporter: it might seem impossible when you're dragging first thing in the morning but medical experts say can you get better sleep each night.

theranos president sunny balwani. his attorneys are asking for no prison time. >> this all comes just weeks after theranos founder elizabeth holmes was sentenced to more than 11 years in prison. kris sanchez live outside of the federal courthouse in san jose. kris, what's the strategy taking shape here today? >> reporter: he should be allowed to serve probation rather than prison time. it comes down to money. the fact that he invested $5 million of his own funds into theranos and that he never used theranos to try to get fame or fortune. balwani and the blood testing machine could diagnose more than 200 diseases from a single drop of blood. the founder elizabeth holmes was convicted on four felony counts, wire fraud and conspiracy to commit wire fraud. in contrast to balwani, he's

been punished enough losing money and his ability to work. federal lawyers are asking for 15 years behind bars. just last month his former business and romantic partner elizabeth holmes was sentenced to more than 11 years, a sentence that shocked some people in its length. she will surrender in april after she gives birth and has time to bond with the baby she is expecting. holmes dropped out of stanford to join theranos. balwani joined her later. they were romantically involved, a relationship holmes described as controlling at her trial. he stepped down after federal regulators started investigating. prosecutors are calling for restitution asking for balwani to pay $800 million. we will be in the courtroom as he arrives. >> thank you, kris. the sentencing hearing is

set for 10:00 this morning. give scott budman a follow on today's sentencing and his handle right there and, of course, we will bring you that verdict live when it comes in. new details this morning on a shooting in the south bay. it happened last night along the san jose bike trail in north willow glen. police updated the condition of the victim they now say his injuries are not life threatening. there's still no word about a motive or possible suspects. south bay authorities have announced an arrest in connection with a deadly fentanyl overdose. deputies say manuel rodriguez will face murder charges. he is accused of selling a lethal amount of fentanyl to a 61-year-old sunnyvale man who died in april. investigators say they spent months collecting evidence to learn rodriguez was the alleged dealer. this level of prosecution doesn't happen often. our investigative unit took a

look at how district attorneys are shifting strategies and charging drug dealers with murder to fight the fentanyl crisis. we spoke to santa clara county d.a. jeff rosen about the issue. you can find the full story on our website. growing concern over a tamiflu shortage, this as influenza cases rise. according to data from goodrx prescriptions are at the highest level. the problem can't be fixed anytime soon and may remain in short supply through early next yankee. all of that is bad news according to the former director of the cdc. he tells "today" more people put off flu shots this year and that's leading to more severe infections. >> the vaccination coverage rates for adults right now for this time of year are about half of what they were prepandemic this time of year. and i don't know if it's because people are putting it off, no one wants to think about

respiratory infections, everyone is tired of getting shots because of covid, but it's the wrong decision to make. >> you can watch that full interview coming up on the "today" show at 7:00 right after us here on "today in the bay." 6:35 for you this morning. take a live look outside at christmas in the park and downtown san jose cesar chavez. no rain in sight. that cold weather is still present. meteorologist kari hall is tracking that for us this morning. i've been keeping an eye on the north bay, this beautiful sunrise about to come over the hills in san rafael where we can see the fog in the distance there. you may be driving in and out of the fog on your way to work. in santa rosa temperatures are just a couple degrees above freezing. as you are getting the kids ready for school make sure they are bundled up at drop-off time and a jacket on at pickup time. zooming in to the south bay we're headed for 57 in los gatos and 59 in gilroy. for the east bay 59 in antioch, oakland and heyward reaching 57.

and mid-50s for daly city. redwood city will see a high of 57. also 57 in downtown san francisco and about 57 in novato and santa rosa as well. we'll talk about the rain coming back but, mike, you were getting reports of a crash in san rafael. >> right here, kari, northbound traffic very light right here where our camera is. north san pedro road to the south there right where the low clouds are crossing. there is a crash reported in that stretch. it's opposite your main commute which is southbound and that moves smoothly. that will be an issue traveling up in toward that fog and low visibility in novato as well. now across the richmond bridge a little build. folks held up by a crash west 80 at carlson. judging by the speed sensors and the update from chp all lanes are now clear but still on scene. the speed sensors starting to improve. many more cars heading south down in toward berkeley westbound on 80 toward the

berkeley curve. we're looking to the metering lights. that should ease traffic going for your commute northbound 680. ten new metering lights activated so that may slow you down getting onto the freeway if traffic flows enough they will activate the metering lights but no change for the time being. the south bay with mild change and a new crash for north 101. i don't think lanes are blocked but we'll track that. caltrain starting monday through the 18th they have reduced service slightly because of the electrification process. back to you. baseball star slugger signs a grand slam of a new contract. ahead on "today in the bay," breaking news. we now know where star slugger aaron judge will be playing next year. details on the multiyear mega deal. >> reporter: ♪ let it glow.

mentioning a bomb. the senator also suggested they would shoot up his office at the state capitol. no explosives were found but wiener believes the latest may be linked to a recent twitter exchange he had with representative marjory taylor greene and conservative pundit charlie kirk. wiener says he's been the target of threats for months. authorities convict add man for threatening to kill him. a little more breathing room in the senate. >> by one person at least. a little bit of room. one senator could hold out on any bill he wanted to. democrats' advantage is up to 51 in the senate.

be mindful to take a coat. >> it will be cold tonight. this may be one of the few completely dry days we have in a while. the san francisco forecast for the evening is only 52 degrees at sunset. falling into the upper 40s the later we get into the evening. now that we are looking at drier conditions we're looking like, okay, how are we doing here with our rain totals so far? and we know that december is in january. heading into a lot of wet weather that we've seen recently but we're still at a deficit in some spots that typically does measure a lot more rain compared to the rest of the bay area. as far as the whole month of december we usually get about 6 3/4 inches of rain.

they make our normal amount for the month and then for october, since october 1st, we are at a rainfall deficit there. as far as the sierra snowpack we are well above normal here. 175% of normal and there's additional snowfall on the way. really tough to get there because we could see anywhere from 29 to 61 inches of snow. that's over the course of a few days. this is the storm system that's approaching. late tomorrow evening approaching the north bay moving through the rest of the bay area by tomorrow night. the rain is more widespread. in the east bay over the course of thursday through sunday and then the storm system will be wrapping up on monday.

no warm-up here. we're going to stay cold. keep the layers and the umbrella, too. at least for today you can leave that umbrella at home. now, mike, you have three crashes to update? >> i do. over here san rafael, that crash seems to be clear from the area right around north san pedro. looking over here to the east shore freeway, west 80, that crash cleared from the roadway. slowing and traffic now heading to the bay bridge. this third crash is a new one since the last report and it is at a critical place, vasco road. both directions blocked. only one lane at a time. slowing heading south down out of byron and heading for 580. travel time building up over 40 minutes. that is an issue. chp should be on scene shortly. 6:52 right now and happening

welcome back. it's 6:57 on your wednesday morning. we're moving you forward with a look at the top stories on "today in the bay" including a man accused of killing another man in a revenge shooting. he's making his first court appearance. >> "today in the bay's" bob redell live outside of the courthouse in dublin. there's a lot to untangle here. it all amounts to heartbreak from two families. >> reporter: correct. good morning to you, marcus and laura. outside the east county hall of justice in dublin where in a couple of hours from now roughly a judge will arraign this man, louie sixto lopez. and he's accused of shooting and killing another man, reynaldo cantu. according to law enforcement this past friday lopez went to cantu's house in newark looking for cantu's son who used to date

lopez's daughter. the lopez family believes the son had something to do with their daughter's death. last october danielle lopez died after she was hit by several cars along highway 680 in san jose. according to police this past friday there was a confrontation between both fathers which ended when lopez allegedly shot and killed cantu in his driveway. reporting live here in dublin, bob redell, "today in the bay." >> thank you, bob. 6:58 right now. disgraced former theranos president sunny balwani will be sentenced today. jurors convicted him on 12 counts of defrauding theranos investors. prosecutors are asking he serve 15 years in prison. attorneys are requesting no jail time. cameras will not be allowed inside the courtroom. scott budman will be there and live tweeting just as he did during the holmes sentencing. you can follow him on twitter @scottbudman. we will bring you live coverage once that verdict comes in
