you. 5:00 right now. thanks for starting your day with us. i'm laura garcia. >> and i'm marcus washington. we want to start with a look at the followings. meteorologist kari hall is tracking those temperatures. it is very cold as you get ready to head out. make sure you're wearing the layers. in the north bay we have a freeze warning up, and we'll see more frosty and freezing conditions over the next few days. at least it's clear in that spot. we have seen patchy fog as the freeze warning goes up for the north bay for these areas shaded in purple. that will be in effect through 9:00 this morning and most likely reissued for tomorrow morning as well. our temperatures at 31 in sonoma and santa rosa. it is 32 degrees in dublin and livermore as well as san martin. also freezing in palo alto. highs today, mount 50s all across the bay area. really no change throughout the week. we'll talk about that and where we may see rain. mike, you have a crash reported in san jose. i just got clarification this is off 680 so the king road

on ramp to 680 coming down through this area, the traffic will pass the crash but not be affected by it because the freeway itself is moving smoothly and clear of any incidents. no major injuries there and shouldn't be a problem for the south bay commute. an easy build for most of the bay. we have these lanes that should be opening right now northbound 680. the sensors are lighting up as well. so crews should be clearing from the overnight closures. week nights from 10:00 p.m. to 5:00, looking at a smooth build out of the altamont, the maze moves well, so does the rest of contra costa county. 5:02 right now. new data on the surge in covid, flu and respiratory viruses suggest we may be in store for a rough holiday season. >> "today in the bay's" kris sanchez is here with a look at the new warnings from health leaders and the growing debate over bringing back the mask orders, kris. i know you have heard by now some counties are asking people to mask up once again because of the increase in covid, the flu

and because rsv is still circulating in our communities. alameda county is ordering masks again in high-risk indoor settings like long-term health facilities, shelters and jails. the city of berkeley is asking people, well, telling people they'll have to mask up for upcoming council meetings. san jose state will require masking for faculty and students in all indoor spaces starting next monday. people ending up in the hospital, hospitalizations only represent the most serious cases. so because many of us are testing for covid at home, cases could be higher than they seem. not all of us go to the hospital when we're sick. that's why the level of virus in waste water is also telling. while some public health officials are recommending masking to prevent the spread of covid, flu and rsv, dr. monica gandhi from ucsf thinks it's the

wrong message at this point though people will have to decide for themselves who to believe. >> we have a lot of good evidence now that counties that put mask mandates versus those who didn't after we have vaccines in the country fared no different with cases, hospitalizations and deaths. >> i'm all for health, but i think i'm past the mask right now. i think it has to do with being careful. >> if you do get sick, you might find this at your local pharmacies. shelves are empty. they are selling out as fast as it comes in and not because pharmaceuticals aren't making it. >> they're not having a problem with manufacturing, so the shortage is driven by demand and the good news is it does mean the product is being released. >> so there is time to protect

life. among the conclusions the agency had no indication or warning about the tragedy ahead of time. investigators also conclude while co-workers did file at least five reports or complaints regarding his threatening behavior it still fell short of cause for termination or serious discipline. >> it did not issue any threats. it did not say i'm going to do something to somebody either in writing or verbally. and because of that, it's very difficult to do something. >> the vta says counseling was part of the solution and since the shooting major changes have been made to systems and security. eight of the nine families reached a financial settlement. a live look at the white house. this is the u.s. capitol. later today president biden will sign the respect for marriage act into law. congress recently passed the historic measure in a rare show of bipartisan solidarity. >> right now the white house is

urging lawmakers to take similar action to prevent a partial government shutdown. "today in the bay's" brie jackson, lawmakers are trying to hammer out a spending bill. >> reporter: the clock is ticking. good morning, laura and marcus. senate majority leader chuck schumer says lawmakers are having productive conversations and they are moving toward a deal on a spending bill that would avert a government shutdown. the two parties are about $26 billion apart on how much to spend. history will be made at the white house this afternoon when president biden signs the landmark respect for marriage act giving federal protections to same sex and interracial couples. >> the president will note there is much more work to be done to project individuals across the country. >> reporter: the bill passed congress with bipartisan support. now lawmakers must come together again this week or face a

government shutdown. senate majority leader chuck schumer is pushing for swift action on a short-term fix. >> we can give appropriators more time to finish a full funding bill before the holidays. >> reporter: the two sides are at odds over how much to spend. top republicans are pushing for more military funding. >> if our democratic colleagues can't accept those realities, the option will be a short-term bipartisan funding bill into early next year. >> reporter: punting the government spending bill until january gives republicans time to take control of the house and rewrite it. the biden administration is urging congress to use their negotiating time wisely. >> we believe on the government funding there is still enough time to get that done. >> reporter: congress has until friday to reach a deal to avert a partial government shutdown. and senate leaders also want to attash provisions to the funding bill including a major overhaul

of election laws. marcus, laura? >> thank you. san francisco leaders will call for twitter's new ownership to better comply with local employee regulated rules and regulations. twitter's elon musk blind sided workers by designing fully operational bedrooms. janitors have also been calling for changes ever since being locked out earlier this month sparking protests and picketing. they are advising city attorneys to follow up with potential legal action. a live look at sfo where the new numbers are showing just how many americans plan to travel for the holidays. aaa forecasts about 113 million people will be on the move. the majority will be driving but about 7 million plan to fly. and because christmas and new year's eve fall on the weekends this year, experts say more

people will have more flexibility with their schedules. >> what it means is the busy travel time instead of immediately the day before will probably be the friday before the holiday weekend, so the friday before christmas and the friday before new year's and the busy day coming back that monday and tuesday after each holiday. >> aaa experts believe one of the busiest holiday travel seasons on record will be this one. meteorologist kari hall is here now. it's still far out there. is there chance wet weather will factor in? absolutely. there's always a chance of a storm coming through this time of year. even if the storm is not here, if it's somewhere else that could delay the planes coming into the bay area. we see some active weather here and there but nothing major as, of course, once again the storms can blow up once they get just off to our east and we'll continue to watch that. even this, fog.

we are seeing that right now developing this morning in the tri-valley. low visibility makes it difficult for people to drive, and it's freezing, so that could deposit a little bit of ice on those elevated roadways like bridges and overpasses. as we go into today, bright and sunny but we really don't warm up that much. only headed for the low 50s there. we'll see more dry weather in the forecast. we'll talk about any changes coming up in a few minutes. mike, we want to see lower gas prices at the pumps. i'm calling out any changes on this report. lnd, they have the best of santa clara county at $3.89. the rest of the county has a few shops at the same price. that's a great price point. marin county, marin gas in larkspur at $3.85.

morning at 5:15, if you're about to step out the door in napa, it is cold. below freezing right now. as you make plans for the day, it feels a lot milder around noon to 4:00 in the afternoon. we're in the low 50s but still, yes, jacket on throughout the day. and we'll see more very cold mornings and also chilly afternoons. we do keep the sunshine. we'll talk more about that coming up. i have a lot of headlights, the golden gate bridge looking smooth. a good amount of cars from the north bay. a smooth drive from santa rosa all the way to san francisco. we'll talk about what's going on in the east bay. there's a crew not yet clear from 680. critical information about inflation today. we'll have more on that in a second. a number of important executives leaving the south bay's vmware as broadcom takes it over. tesla stock hit again down 50% on the year. sam bankman-fried, the

former head of the cryptocurrency exchange ftx, has been arrested in the bahamas at the request of the u.s. department of justice. sbf, as he's known, was supposed to testify before a house committee today, and the senate committee tomorrow. under normal circumstances if any of this could be called normal, prosecutors probably would have liked to hear what he had to say, maybe let him say something he would regret. in fact, bankman-fried has given dozens of invisible interviews with the media and said a lot that can and probably will be held against him in court. the government of the bahamas said in a statement sbf's arrest followed notification from the united states it had filed criminal charges and is likely to request his extradition. about ten minutes ago the s.e.c. officially charged him with financial fraud. millions of dollars missing and alameda research has lost money

as well. ftx collapsed about a month ago. quick comparison, you remember elizabeth holmes, the theranos rip-off was about $700 million. ftx we still don't know but investor losses are probably $4 billion. we'll get a key reading on inflation today. consumer price index. gas prices are lower. food prices up. this as the fed starts its two-day interest rate meeting with a decision on rates tomorrow about 11:00 a.m. our time. we'll bring that you live in our midday news tomorrow. we have our eye on twitter. the former head of trust and safety is in hiding according to reports after death threats from twitter users. musk has disbanded the current trust and safety board as well. things happen there so fast it's almost impossible to cover it. i can't tell you how this ends but it ends in catastrophe somehow. each day brings a new sort of shocker. >> it does. it really does.

future husband three years later and dropped out. only after moving into a retirement home she decided to resume pursuing her degree, and she calls this accomplishment a true blessing. >> i love that she never gave up. >> i think she is a great-grandmother. >> took time off, got married, raised the kids. >> the zoom with kids from home or the retirement home. >> exactly. >> technology. a look at that forecast this morning? >> it starts out cold and then as we go into the day, sunny but still chilly. after all of that rain that we had it's time for a water year update. we are still in a deficit for the north bay despite all of that rain so far we're still not to where we normally see our rainfall totals. and also a slight deficit for san francisco after getting so far this year since october 1 about 4 inches of rain.

we are doing better for oakland and san jose at a surplus of the amount of rainfall we typically see by this date, but we're about 70% of normal for santa rosa. oakland, 109% and 141% of normal for san jose. now it's just cold and we have this freeze warning in effect for the north bay. we are seeing freezing temperatures elsewhere. that's the focus for temperatures dipping into the upper 20s. 32 in livermore and dublin and palo alto and san martin. that coming along with some dense fog that's been moving around the north bay may make those roads a little bit more icy for bridges and overpasses. so be really careful as you are driving to work this morning, the lower visibility in parts of the tri-valley. you want to make sure you're dressing in layers and a hat is really good for keeping your body warm especially if you'll be working outside.

keep those pets inside and also checking on those plants. not only this morning but the next several days and if you do have any exposed pipes, make sure they're protected and also that car tire light may be coming on in this cold weather. we're only headed for the mid-50s for today and dropping into the freezing temperatures once again as we are going to see a lot of our inland valleys at 30 degrees or below. going into the next several days once again we're looking ahead to see what is going to be happening, a busy travel time through christmas week and for us we only see a couple of very weak storms moving through but could see more significant storms moving through elsewhere across the country. as far as temperatures, low to mid-50s for highs and freezing every morning into the weekend. it does stay mostly dry with the storm system to the north or the south kind of missing us in the bay area. mike, you have an overnight closure in sunol? i'm checking the grid, my

layer, layer, layer up. it's cold. it's been at least a month since we've had temperatures like this, and a lot of our mornings have been cooler than normal, and it's another one where we're starting out with a freeze warning in parts of the north bay until 9:00 and our temperatures at 30 in santa rosa may drop into the upper 20s and we'll see also freezing temperatures for the tri-valley, even parts of the peninsula. palo alto at 32 and 32 also for san martin. it's a cold start but it will be foggy in some areas and we've seen visibility down to zero in novato. mike, some folks appear to be working overtime. >> in the cold. north 680, kari, we talked about the closure that was supposed to be clear at 5:00. you have slowing north 680 approaching the area. opposite your main commute but folks appear to be going on to 84. we'll say north 680 is still closed north of 84 but then

fusion reaction that creates energy. it is literally referred to as the fusion dream trying to replicate how the sun produces energy and governments have spent billions of dollars trying to make this happen. researchers say it provides clean, cheap power without radioactive waste or fossil fuel emissions. >> this is a moment that will create stable and reliable power 24/7. >> reporter: while it's unlikely fusion could be used in cars, scientists say once fully developed it could power entire cities and the batteries inside our cars. but as one professor explains that could take a decade or more. >> if we had fusion we could drop fossil fuels immediateliage

shot and killed in august in oakland's little saigon. surveillance video shows a gunman pull up in a white sedan and fire into the car driven by her boyfriend who later took his own life just hours after being arrested. police eventually arrested 33-year-old hasheem bason. investigators believe the boyfriend hired bason so he could live off her $12 million estate. 5:36 right now. the managers of the bay area restaurant chain are talking about being hit by burglars at two separate locations in two days. thieves targeted the curry up now restaurant in san jose on saturday and then sunday in the observing location. managers expressed frustration saying in both cases they smashed windows and broke into the cash registers and even cut into a space in the san jose location pocketing an undisclosed amount of money. >> you are working very well, doing your best to give everything to the community, and

curry up name is like a family restaurant to everyone. the reaction is very heartbroken. >> the chain owner posted his frustration on social media as well. the managers say because the cash registers are broken they're asking customers to order online and pay online. we're still awaiting a comment from police on that investigation. today san jose leaders will receive new direction on how to handle misconduct investigations. two years ago the city council hired a consultant to evaluate internal affairs and oversight options. the council is considering transferring more responsibility from sworn police personnel to an outside committee. in recent months the department has taken heat for a string of controversies but the department recently launched a new web portal to track misconduct complaints. a follow yum on the peninsula where after a heated late night debate the city of san mateo has a new leader. councilmembers chose lee as the city's new mayor, the first

mayor of asian american and jewish descent. her appointment follows days of controversy tied to ongoing delays and unsubstantiated accusations. the seat will be filled by rich. road crews surveying conditions as people are stocking up on supplies. it will affect millions. >> "today in the bay's" maggie vespa sets the scene for us in minneapolis. >> reporter: the calm literally before the storm. mountains of sand and salt ready to be spread as the system that, as you know, wreaked havoc out west now heads east toward us, the same system that dumped four feet of snow in california's sierra nevada mountains. a blizzard warning, only the second in two years in colorado.

in utah the roads got so bad there was a massive bus crash, a bus flipping onto its side with 20 people hospitalized and two in critical condition. this storm nationwide wreaking havoc when it comes to air travel because of those delays and cancellations ripple effects. 3,900 flights delayed yesterday. hundreds canceled and we're seeing those numbers stacking up once again. from the dakotas down to texas, governors and state officials activating their emergency response resources pleading with people to take this one seriously and be prepared to hunker down at home. marcus and laura, i will send it back to you. >> that storm packing a punch. where is the system now? >> it's moving through parts of the plains states and upper midwest. as we still continue to track that storm moving off to the east, it is going to make its way all the way to the east coast as well as encountering much colder temperatures. you can see where it's snowing rapid city and moving toward

minneapolis where they have a lot of blizzard warnings in effect and they're also going to most likely see near zero visibility as heavy snowfalls. it's triggering a lot of severe weather for parts of the south and so there's a lot of tornado watches and warnings going up for us. it was a huge rainmaker and helped to fill our reservoirs. the east bay mud reservoir is at 81% of capacity and some of the reservoirs in the south bay only at about a quarter of the capacity or less is now doing much better so it did bring us a lot of rain but statewide the average is only about 26.5% of the total capacity. for the sierra we had a huge boost. now we're at more than double the amount we see for this time of year. we'll be tracking that and what's ahelped for us in a few minutes. mike, you're still tracking sunol. we knew it would be there

overnight. it has not cleared north 680. crews are still working on that project. the first night of the project and slowing coming out of fremont and in towards sunol. it looks like the traffic pattern diverts folks as we would expect over to 84. with the build even the counter commute slowing by the distraction and the build coming down through pleasanton as well. north 680 still registered as closed as you travel north into sunol. the commute direction coming into the area are standard. an easy drive and predictable slowing. another prediction more crowds as folks head to support the sharks. there is a game at s.a.p. center. we call that out because it would be folks walking back and forth as folks leave work in downtown san jose. a smooth drive, highway 437 and the bay bridge. coming up on "today in the bay," a long road decades in the

president biden will sign the respect for marriage act today affirming the legality of interracial and same-sex marriage. >> scott mcgrew joining us now. both fell into question after the supreme court reversed itself on roe v. wade. what else might the court reverse itself on? same-sex marriage became legal because of the supreme court ruling. a bipartisan effort to put the legality in writing to codify it begins today with the president signing the respect for marriage act into law. this is the end of a very long road. it was not that long ago, a different president, president clinton, was signing a different bill, the respect for marriage act that defined marriage as one man, one woman. even after that, president obama was opposed to same-sex marriage, at least in the early years of his presidency. obama's vice president, joe

biden, disagreed. biden breaking from his boss on the issue of same-sex marriage. here is that moment just ten years ago. >> is that what you believe now? >> that's what i believe. >> you're comfortable with same-sex marriage now? >> look, i am vice president of the united states of america. the president sets the policy. i am absolutely comfortable with the fact that men marrying men, women marrying women, and heterosexual men and women, are entitled to the same rights, all the civil rights, all the civil liberties and, quite frankly, i don't see much of a distinction beyond that. >> in a second term will this administration come out behind same-sex marriage, the institution of marriage? >> i can't speak to that. >> obama eventually changed his mind. as for the supreme court legal experts do worry it still could change its mind again on griswold which guaranteed americans the right to make their own decisions about birth

control. we'll see if congress takes that up. we'll be covering all of this today as the president signs that historic legislation. we'll talk about it on social media. on twitter you can find me @scottmcgrew. new this morning word out of stanford about a potentially groundbreaking new treatment for parkinson's patients. researchers have developed a vibrating glove aimed at increasing patients' mobility in a matter of weeks. the instrument has allowed some patients to drastically reduce their medications. one man formerly bound to a wheelchair says the gloves gave him a new lease on life allowing him to complete the new york city marathon three months following his first treatment and later his first triathlon. >> it feels great. i still can't believe it this is really possible. >> when you look at the glove, what do you think? >> it's totally changed my life.

i like doing that sometimes, too. and we can keep the decorations up right now. it's dry. they won't get blown around the yard. there's no more rain coming for a while. it is very cold so there may be icicles hanging off the house even with some of the dry conditions that we have. we're at 31 in sonoma as well as santa rosa and definitely feels like it's almost christmastime as our temperatures dim near freezing in palo alto and we're at 32 in livermore as well as san martin, but that very cold air coming with some dense fog moving around the tri-valley. sometimes when you get temperatures below freezing and fog, that can deposit some ice on those bridges and overpasses. so you do have to be really careful driving especially if you see the thermometer dropping below 32. and in novato we're down to about a quarter mile visibility but then the high temperature reaching into the mid-50s is what we'll see across the bay area. again tonight we'll have frost

advisories and freeze warnings and we'll s see that on repeat throughout the week ass the ststorms stay away from the bay area. there will be another chance of rain but as of right now it looks like it's staying just to our south. may have to deal with it if you head to the l.a. area and then early next week we could see another very weak storm coming through on tuesday, but it doesn't look to bring us much rain. so we may be dry through at least christmas and expecting those cold temperatures to continue. a mix of sun and clouds, temperatures in the low to mid-50s. near freezing each day inland and even for san francisco we'll start out in the upper 30s with a high of about 53 today. that will continue into the weekend. and, mike, you have a couple of backups forming. how quickly the backup forms here filled in with the metering lights on. i don't see a problem but lane shifts for a couple of minutes for some of the left lanes. we're tracking that smooth, easy drive.

the build for 37. unexpectedly slow the crew registering on the grid from fremont into sunol. caltrans crews have 680 closed. we're almost an hour later than expected. happening now santa clara county is crediting new state law for providing nearly 2,500 tons of food for those in need. that law requires all grocery stores and other businesses to donate surplus items in part to decrease excess food in landfills. during the first half of the year it helped santa clara county prevent the release of 300 tons of methane. that will include restaurants,
