here we go, wednesday morning. thank you for joining us. i'm laura garcia. >> and i'm marcus washington. we'll get a look at the commute coming up but, first, a look at the cold. another cold morning. and now we're seeing more of the freeze warnings in effect as our temperatures right now start out right at about freezing for a lot of our microclimates. we're at 31 in sonoma. dublin right now at 31 degrees and it's 32 in san martin. so as we start out with the cold temperatures, we are also going to have those freeze warnings that will be in effect through about 9:00 in the morning. the freeze warnings do include all of these areas shaded in purple and once again that will be in effect through 9:00. it's going to be a cool day and we're also watching out for patchy, dense fog. when you have freezing temperatures and a lot of moisture in the air, that can deposit ice on elevated bridges

and roadways. watching out for that around the area of novato. mike, you're starting out with two significant crashes. for the south bay here to san jose. the first crash is a deadly crash, the 62nd fatality we're told, and it occurred on capital expressway, actually right at seven trees boulevard. there's an investigation that's continuing there. you can get to monterey. center road will take you around in either direction. 101, highway 101, this is an issue as well. this crash involves a big rig and i believe it spilled diesel fuel. we do at least have one lane blocked with crews out there addressing what is now a hazmat situation. that cleanup could take a while and would affect the early drive coming into san jose on it might have folks shifting over to 85 and 87. that's a ways away until that commute builds and most of the rest of the commute is moving

smoothly. back to you. it is 4:32 right now. turning back to our chilly weather, this may be one of the coldest and priciest weather with chilly temperatures setting in. >> "today in the bay's" stephanie magallon has more on this and the possibly highest in the last ten years in cost. >> reporter: the air feels almost sharp with freeze warnings and advisories hitting the bay area. >> freezing cold, which is weird. >> winters are getting colder. >> reporter: leaving families with no choice but to turn on their heaters regardless of the bill they may get at the end of the month. >> it's crazy especially having a dog. the costs are nuts. >> reporter: according to the neada heating prices are going up 17% on average across the

nation. no matter how you heat your home, that's on top of a 17% increase the year before. >> two years ago the average cost was about $890. now it's $1,208. these are the highest prices we've seen in more than 15 years. >> reporter: in california the average cost is about $900. they are also seeing a 10% to 20% in families applying to assistance programs. >> this is the problem. there's a war in ukraine, russia cut off supplies to western europe. western european countries looking everywhere to export gas. that's resulting in much higher prices. that's driving the cost of home heating with natural gas, of course, as well as electricity. >> reporter: energy associations say if you're struggling to pay your bills don't hesitate to apply to the federal and state assistance programs. stephanie magallon for "today in the bay."

happening today a status hearing is set to get under way for scott peterson. a decision is in limbo over if he will receive a new trial for the murder of his wife lacy and their unborn son. the judge is believed to be weighing some kind of legal issue. she recently target this had friday as a deadline for issuing an order, but even that is now up in the air. peterson will not attend today's hearing in person. we'll bring you updates on the case during our midday broadcast. 4:35 for you right now. and she's not yet been sworn in as oakland mayor, and now the naacp is supporting talk of a recount. mayor-elect sheng thao won the election by a slim margin over loren taylor in the ranked choice vote election. so what's the problem? "today in the bay's" cheryl hurd explains. >> reporter: the uncertainty surrounding mayor-elect sheng thao's win over loren taylor is the reason behind the call for a recount.

>> we're saying that with ranked choice voting there are so many things that can happen. >> reporter: holland says some seniors have expressed their confusion surrounding ranked choice voting and the naacp blames the alameda county registrar's office for that confusion. the votes were certified on december 8th showing thao beating taylor by just under 700 votes. however, there is a small window of opportunity where there could be a community led recount that could cost well over $100,000. in november taylor says he would not be leading a recount effort, but he understands others are exploring that option. >> if oakland residents pursue this course of action, we should not object. >> reporter: if an individual wants to fund a recount to bring additional assurance that each and every vote was counted accurately, that is their right, and i welcome that.

good wednesday morning right now at 4:40. i'm keeping an eye on the north bay especially novato where we have fog moving around the area and temperatures are very close to freezing. we do have another day of the freeze warnings, and that's going to most likely continue after this cold start, it will be slow to warm up going into late morning into the afternoon. we'll take a look ahead coming up in a few minutes. and looking here we have the taillights going north oakland past the coliseum. it's just fine here getting into this area traveling north on the nimitz. you may find slowing because of a crash that's still in lanes. we'll talk about what's going on and as the traffic builds it may be a factor for folks coming into castro valley. let's check in with silvan a. thank you, mike. i'm silvana henao from cnbc. wall street is set to open slightly higher ahead of the big event of the day. the federal reserve interest

rate decision. stocks rising yesterday following a report showing consumer prices cooled more than expected last month. a signal that inflation may have peaked is positive for stocks as it means the fed may be closer to hitting the pause. the fed is widely expected to deliver a smaller half-point rate hike this afternoon following four straight moves of three-quarters of a percent. that's translated to higher borrowing costs for everything from mortgages to business loans. twitter has stopped paying rent on san francisco headquarters and other offices as part of an effort to cut costs following elon musk's $44 billion takeover. "the new york times" reports musk's team is trying to renegotiate the terms of leases and has instructed not paying vendors. more than 158 million consumers are expected to shop on the final saturday before christmas. the national retail federation

a very good, cold wednesday morning. taking a live look outside, a very clear look in san francisco this morning. we are certainly tracking those cold temperatures. you notice them as you walk out the door. >> i just got a report of ice. >> you did? >> that's in the traffic report. >> that's really important to know because it is so cold out there. >> it is cold and you think, too, about pets as well as people who are unhoused and

these kinds of temperatures as well as people who don't have heat or it's really hard to turn on the heat and have to think about the bill later. as we take a live look outside we are looking at a mainly clear sky and the temperatures are dropping fairly quickly all around the bay area. with the clear sky we have the opportunity to look up for a little while. we are seeing the geminids meteor shower. you can watch between now and dawn. you just want to take your time if you are able to just relax and let your eyes adjust. we could see possibly 150 meteors per hour, one of the better ones of the year. right now, of course, you're trying to stay warm and our temperature is at 31 degrees in sonoma. 32 in palo alto and also 32 in scotts valley. we've also seen freezing temperatures or near freezing in parts of the south county, even at 37 degrees or below. you could have frost developing on a lot of your plants. looking at brentwood as you head

off for work this morning, it's one where you have to blast the heater in the vehicle down to 32 degrees at sunrise and then starting to see those temperatures slowly warming up. it will be a sunny day but will only make it up to the mid-50s this afternoon and we'll see about the same tomorrow, mid-50s once again. we do have more of these really cold temperatures that will continue at least for the morning. the afternoons do get slightly milder. still no rain all the way up until next tuesday. that's when it looks like we will have a chance of some rain and sierra snow and another storm system possibly behind that and i know that's right in time for a lot of people to travel heading into christmas. we could be dealing with some wet weather. we're putting that in the extended forecast. in the near term it's clear, it's cold. look at these mornings. we will see freezing temperatures from now through at least monday and then on tuesday is when the clouds move in. for san francisco it's only in the low 50s today. even there we're dropping into

the upper 30s. mike, what's that heads-up about the ice? we had a traffic break in san jose, southbound 101. our friend and colleague called in because he was stuck in a traffic break. south 101, reports of ice on the roadway, probably a busted sprinkler. that's how cold it is outside. that could pop up in many spots around the bay. we'll track that. that should clear shortly as they address the ice at brokaw, and then we have this continued problem, this continued slowdown where there's an earlier crash, a number of updates through the area. it's a single crash, big rig and a diesel fuel spill. that's for san jose. we still have this closure going on. hopefully they'll clear at 5:00. yesterday it was extended until 6:00. over here this crash at 880 northbound, two right lanes are still blocked by a crash there but there's five lanes.

three are still available and not a lot of slowing. back to you. >> thank you very much. this morning there is a renewed push to help keep supervised drug injection sites open in san francisco. they have been shot down by governor newsom and operators of those proposed sites got word the city was pulling the plug on the plan. now several supervisors want to know why. people were allowed to inject drugs in a supervised environment. this is being done in an effort to reduce overdose deaths and other issues. mayor breed told the supervisor she still supports the site but legal concerns are holding them up. >> i know the city attorney's office has walked you through the federal legal issues related to this kind of operation including the potential criminal liability for city employees including the possibility of people losing their medical licenses. >> the biden administration has not engaged in prosecuting anyone. i think when life and death are at stake, i think we have to

take risk sometimes. now is the time to take that risk. >> mayor breed declined to give any time line for opening the site. in an effort to be more transparent the city of san jose and the councilmembers gave the green light to test transferring police department's misconduct investigations to the city's independent police auditor's office. "today in the bay's" audrey asistio breaks down what this all means for us. >> reporter: this move allows a team within the ipa service to probe complaints independently. the police department investigates its own complaints. now it is important to note this is a trial period and is expected to last a few years. they say it's time the police union says it's an overreach. after two and a half years of pushing one of outgoing mayor sam liccardo's pledges is moving forward. the city council unanimously approved his proposal to begin exploring and creating a tentative model that would

transfer the misconduct investigations away from officers and to the city's independent police auditor's office. >> what the city council did today was a long time coming. >> reporter: judge kordell was the ipa for the city of san jose from 2010 to 2015. >> if you want the public to have faith and trust in the process of investigating officer misconduct, you don't have the officers investigating themselves, and that has always been the case in san jose's police department. >> reporter: the police department's own internal affairs division handles its public misconduct investigations. the ipa's office has limited access but can appeal if it finds the department's investigation is unfair or incomplete. proponents say the change is standard police accountability, allows transparency and is granted by 2020's measure g. the san jose police officers association says they're mistaken and this is an overreach.

in a statement police chief anthony motta questions the need for a change that reads in part, quote, we do not believe a dramatic departure from a system that is working is needed without further discussion. this is a complex situation, one with many legal and policy issues to resolve. >> i hope the chief will get onboard. this is very important, it's a big step. i hope he will support it. other policeefng i in other cit around the country. >> reporter: if created the investigative team would include a supervisor and two investigators. they would have full access to investigate misconduct complaints. it would be the first time since the ipa was created nearly 30 years ago. now it will be a process. the city council's public safety committee will discuss the next steps in april. audrey asistio, "today in the bay." this morning jay leno is speaking out in his first broadcast interview since he was burned in a garage.
