a preliminary report as well as referrals for criminal and civil prosecutions tomorrow morning. as we have been telling you in this newscast. the report will focus on the actions before, during and after january 6th 2021, which included the insurrection against congress. the referrals for prosecution will focus on those most responsible for the unprecedented attacks. nbc bay area political analyst larry gerston joins us. hi, larry. good morning. good to see you. we have talked about this earlier in the newscast. we have discussed former president trump is among those who may be charged. who else is on that list or do we even know? >> good morning, kira. you and i have been talking about this for more than a year and a half. it's to believe it's coming to fruition, but here it is. and front and center on this list is former president trump, followed perhaps by chief of staff mark meadows, maybe also couple attorneys, rudy giuliani
7:49 am
and john eastman. these are the most prominent people, if you will, who will be in the focus of the committee's tomorrow. but in addition, there could be others mentioned. we just don't know. but clearly you're looking at president trump and the others for inciting insurrection, for the obstruction of congress and for conspiracy to defraud the federal government. kira, these are serious charges. and they are unprecedented. >> really serious. no former president has ever been indicted. so, you know, from an uninformed angle, just as a viewer, does this mean the committee has proof that implicates former president trump or just whispers? >> they think they have proof. look, this committee over the last 18 months or so has interviewed more than 1,000 witnesses, has also collected
7:50 am
tens of thousands of documents representing hundreds of thousands of pages. you're not talking about just a slip shot operation here. and as a result of that, they believe, they believe, that president trump was front and center when it came to this operation. and they also believe that it's not just an allegation but that he is guilty and more than that, they point to a couple of other factors that add to their belief. for example, go back to that second impeachment of president trump. way long ago in january of 2021, just after the insurrection, he was in that impeachment charged with inciting insurrection. the senate got 57 out of the 100 senator. another point the federal judge mentioned in a related case that he believe that president trump was clearly involved and responsible for the january 6th insurrection. so, there's a lot going on here. this just isn't idle stuff,
7:51 am
isn't whimsical by any means. it's thoroughly, thoroughly vetted. that's what you're going to see the results from just tomorrow morning. >> okay. so, assuming there are referrals tomorrow, we know they don't actually hold legal weight. they're just suggestions and the doj has the final say? so can you give us a road map for what happens next? >> you're right, kira. look, it will go to the doj. we talked about that. but also the federal elections commission perhaps, other agencies, state bar associations along with that. the ethics committee and the house of representatives may get some of this. so it's going to be widespread. but yes, we're going to focus on doj. doj is most likely to take this ball and run with it. doj will probably, we don't know this for a fact, but probably put forth charges. that starts the ball rolling. if there are charges put forward, there will be trials. if there are trials, we don't know what will happen by then. but we'll have a lot of action here and a lot of evidence
7:52 am
placed before the judge and jury. one thing, kira, you know, referrals that we talked about the next president they're unprecedented. so was the insurrection. >> that's a great point, larry. it's a lot to take in and we will stay tuned tomorrow. we know you will keep us abreast of what happens. larry, thanks. good to see you. happy hanukkah, happy holidays. it is 7:52. up next, we have a quick look at the top stories we're following including millions getting ready to hit the roads and the skies with covid rebounding and the flu and rsv added to the mix. the one measure you can take to keep your family safe experts are telling us.

or nothing activity. you know, if you can't wear a mask at all times, doing activities where you're not wearing a mask, that's okay. you should still wear a mask where you can. >> california's latest data indicates a slight decline in the flu. and the state's rsv infection showing a dip since october and november. but with all three illnesses circulating, health officials do recommend you continue wearing that high quality mask. the search is on for the gunman who shot and killed a teenager in antioch. police say it happened in broad daylight at 11 yesterday morning. they got a string of calls about shots fired at williamson ranch park on lone tree way. when officers responded, they found a 16-year-old boy who had been shot. he was rushed to the hospital and died. other officers followed up on reports of another teen who ran into the nearby walmart. police detained him. he had a loaded gun. but they say he was not responsible for the shooting. police say those two teens approached a dark sedan at the park when someone inside the car
