look outside. it's foggy. it's foggy in spots. it's not everywhere across the bay area, you can see in the cameras we are seeing it in oakland as well as in palo alto and now as we get started with a live look outside in san francisco air quality is also an issue as we are dealing with a spare the air alert day. with some of these areas fog as well as all of the pollutants we're putting out there will stay trapped near the surface. an unhealthy amount of particulate matter in the air for the north bay as well as santa clara valley but anywhere around the bay area. if you have breathing problems you may want to limit your time outside and no wood burning today. it is a very cold start once again and we're also seeing dense fog moving around the north bay as well as the east bay and into the tri-valley. our temperatures this afternoon only reach up to about 50 in concord but we'll see some upper 50s for san jose as well as

morgan hill. we'll get a look at what's ahead but, mike, that fog is the main issue. >> that's the word for the day because chp is reporting that in their reports this morning talking about along the coast, half moon bay. we know about that. 280 at 92 further inland. really just patchy fog there not registering on the road weather index. not like off 205 and 580. near the altamont and out of stockton and tracee, floating around 580. highway 29 called out by the chp, said there was dense fog in the north bay. so far traffic is flowing. folks up there and around the delta area are kind of used to this. just know it is hanging around. back over to you. >> thanks, mike. later today a virtual town hall is set to address questions about two recent troubling incidents at an east bay refinery. >> bob redell joins us live this

morning. contra costa county also calling for an investigation here. >> reporter: correct. good morning to you, marcus and kris. contra costa health is calling for an independent investigation into an incident that took place at the martinez refinery company. this is an incident that took place on thanksgiving eve when the refinery accidentally released 20 tons of a powdery dust containing heavy metals that left cars covered in ash. the county says that was a major chemical accident or release, that's the designation, and the refinalry violated state law and policy when it failed to immediately notify the county of that incident. there was another incident earlier this month when on december 9 the martinez refinery experienced a larger than usual flaring event unsettling to many people who live in the area. the county again is investigating both. >> we are taking these events seriously and will investigate to the fullest of our ability to

completely understand the impacts that have happened in the community, and we are taking all of the steps necessary to be able to hold the refinery accountable for any regulatory standards they have violated. >> reporter: the martinez refinery company says an equipment malfunction caused that flaring and in a statement wrote, quote, the flare worked at design to safely combust excess hydro carbons efficiently and effectively. we apologize. a virtual town hall will be held tonight at 6:00 to address people's concerns about these two incidents. reporting live, bob redell, "today in the bay." >> bob, thank you. 5:04 now and today we will see the last of the january 6 committee hearings just shy of two years after the 2021 attack on the capitol. the house committee investigating the deadly day is poised to make its final public presentation of key findings.

>> the committee will release its final report before it's disbanded. this is when the republicans take control of the house in the new year. "today in the bay's" brie jackson joins us live this morning. what can we expect from today's hearing? >> reporter: good morning, marcus, kris. nbc news has learned the january 6th committee will refer criminal charges for former president trump and several republican members of congress. nbc news has learned exclusively the january 6 committee plans to issue at least three criminal referrals for president donald trump today. >> i think there is sufficient evidence to charge the president this is someone who tried to interfere with a joint session, even inciting a mob to attack the capitol. if that's not criminal, then i don't mo what is. >> reporter: the referrals carry no legal weight but they will ask the justice department

issue. >> the doj's job is different, they will have to determine whether there is admissible evidence in court that could prove any of these charges beyond a reasonable doubt. >> reporter: panel members revealed the committee plans to refer four republican members of congress who defied congressional subpoenas. the committee finalized its plans during a closed door meeting sunday and will lay out details to the public this afternoon. >> stay tuned for the hearing. are. >> we will have a vote on referrals as well as approving our overall report. >> reporter: former president trump blasted the committee on social media over the weekend calling them, quote, thugs and scoundrels. they say they will have more to say after referrals are made public. and on wednesday the january 6th committee plans to release a lengthy eight chapter report detailing their findings. marcus, kris? >> brie, thank you.

nbc will have live coverage of this hearing this morning. you can watch the special report live starting at 10:00. right now let's turn to decision 2022. it's been well over a month since the november election but a sunnyvale city council race that was decided by just one vote difference is not over yet. today another recount is expected to begin and it will cost an estimated $12,000 per day. murall srinivasan beat out justin wang by just one vote. the registrar's office says that trying erld an automatic recount that came back with the same result. last week wang requested a second recount. the registrar says wang and his supporters must foot the bill. moving you forward, the white house is bringing back its free covid test program. the test will be mailed out starting today and through december 19th. the procedure is the same as before and it's being revived because of the growing number of

covid cases. to request your free test go to the government's covid webpage and put in your information. each household is entitled to four free covid tests. now to a live look at sfo this morning. christmas is just six days away and the travel rush is only starting to build up. friday is expected to be the busiest travel day by air, train, or on the road. in fact, 112 million people are expected to drive more than 50 miles between friday and new year's day. almost near prepandemic levels. so the "today" show's maggie vespa breaks down what we need to know before we head out. >> reporter: marcus, welcome to the holiday travel rush this is the beginning. aaa estimating the next week and a half to two weeks roughly 113 million americans will travel about an hour or more to be with loved ones for the holiday f. that number comes to fruition, it would be a post-pandemic record. again, this rush is on and they

expect it the next couple of weeks. the vast majority will be driving so if that's you, aaa recommends hitting the road before 2:00 p.m. or after 8:00 to avoid the vast majority of the traffic and check the weather forecast along the route including at your destination to know what you're driving into. if you're flying, experts recommend you try to fly direct and in the morning and sign up for airline alert to find out about delays or cancellations as soon as they stack up. and finally we talk about peak travel days during this time of year. this holiday stretch, there doesn't, frankly, seem to be one. we asked the airlines and they named different days. december 22, 23 and 27 likely as the peak days. unitd naming january 2. you will probably see long lines throughout this entire holiday stretch. plan accordingly. marcus, we'll send it back to you.

now. a smooth drive as we look around the bay. fog registered in areas the chp calls out like the altamont pass. 580 really light traffic flow. visibility is just fine. as you take a look at our shot for palo alto, there's so much of the headlights showing. we also have moisture in the air. there are low clouds floating around. be cautious of that. we've been watching the fog drifting around as it comes through the delta as well as the tri-valley and in parts of the north bay. visibility down to a quarter of a mile in santa rosa and napa. watch out for that. those areas that are foggy there may not be much clearing but away from the fog we're headed for the upper 50s and low 60s and if you're going out to the union square menorah lighting tonight, it's going to be cloudy, and you want to make sure you're bundled up, only 48 degrees and those temperatures will drop down to the mid-40s into later this evening. we'll take a look ahead for what to expect the rest of the week

stocks are looking up to start the week. getting closer to the end of the year so it's time to talk tax strategy. some stocks people own, tesla one of the most obvious, that have just crumpled this year. epic losses for many people. now you can sell this stock for a loss and get a deduction for that loss on your taxes. we may see that in the way tesla shareholders behave over the next week or so. telling may push the price of tesla lower. not because of the problems the company is having or elon musk but because of people looking for a tax break. the same is true of cryptocurrency. last year we were warning young people who had never heard of capital gains that the big gains they made buying and selling bitcoin would mean they would pay a big tax bill this year it's the opposite. if you sell your crypto at a loss, that's a tax deduction. >> you can use those losses such

all right. let's talk about what's going on this morning, and it's a busy start as we've already seen a lot of people up and out the door having to deal with all of this fog, low visibility, down to a quarter of a mile in much of the north bay, napa and santa rosa. that fog has been moving around other parts of the bay area and what we see now is tule fog. what happens this time of year after the really big rainfall and high pressure, the sky clears and then we see all of that moisture condensing and that can reduce visibility to about 600 feet or less in the central valley but it starts to drift into the bay area through the mountain gaps. especially for the delta where you have a lot more of that fog rolling through the carquinez strait and then into the north bay as well. so in martinez, just like yesterday, those temperatures really won't warm up much. 40 degrees. it's going to take a while for us to dig out of the upper 30s

throughout the morning and the fog will linger. we'll have a cold day but speaking of cold, the sierra snowpack is still doing great. if you're going there for the christmas holiday or into the new year, right now we're seeing the central sierra at 182% of its normal amount of snow. but, unfortunately, there's not a lot of snow this week. maybe 1 to 3 inches by the end of the week but much more coming by next week with the possibility of up to 15 inches. that's as we start to see a lot more storms coming into the bay area starting on thursday into friday and then it does stay to the north of us going into early next week, but we may see a couple more rounds of bay area rain and sierra snow, and the rain this week is going to be very light on thursday and friday, maybe a tenth to a quarter inch of rain and we should see more beyond that. as we take a look at our forecast, mainly dry, chilly, but should be warming up.

when you deal with tule fog, sometimes it doesn't clear out at all. not only is it foggy but it's cold. we see temperatures in the upper 30s as you get ready to head out in the north bay, santa rosa at 35 degrees. 37 in dublin and livermore as well as san jose. visibility down to a quarter mile or less in the north bay, coming through highway 4, also the very low visibility and tri-valley. not so bad for morgan hill but we'll watch the south county as well and where we do see that fog linger temperatures stay in the 40s and low 50s and we'll see that continue throughout today. and, mike, that fog in dublin also creating that low visibility. you and i have been watching this camera closely since before the show started. we've seen less visibility. it's better than it was before. 580 does move smoothly and pockets of fog will be a factor. we're looking at 580 coming off

205. brentwood, byron highway will be impacted. you see the road weather index highlighting that yellow up through contra costa county. the south bay not really a factor as far as any slowing and the drive all the way from san martin into san jose is clear for north 101. as we look to the bay bridge we see a smooth flow, patches of dense fog. american canyon the top of the screen and a couple of crashes have popped up. i think one single crash and it sounds like everything is off the shoulder. i'll track i-80. >> thanks, mike. 5:33. the january 6 committee will meet one last time this morning. >> scott mcgrew, it is expected to recommend criminal charges against donald trump. good morning. what they call a criminal referral. that will be made to the department of justice. we'll know more later this morning. the committee investigating the january 6th attack on the u.s. capitol will hold its final public meeting at 10:00 our time.

that will be carried live gavel to gavel this morning. among the charges the committee may recommend against the former president and possibly members of congress obstructing the business of congress. fraud and the conspiracy to commit fraud. congress doesn't charge people with crimes but if it recommends charges it will have the evidence to back it up like wells fargo doesn't charge with you bank robbery but do give police and prosecutors surveillance video of you holding up the bank. any charges trump might face related to january 6th will be coordinated by the new special counsel, jack smith who is also looking into the apparent theft of classified documents. on wednesday the committee is expected to issue its final report on the attack, important for historical purposes if nothing else, the same way the u.s. investigated what went wrong on 9/11, the kennedy investigation and the attack on pearl harbor. a postmortem, if you will, on

how we handled coronavirus, the good, the bad. it's unlikely that will ever happen. the mayor of el paso has declared an emergency as we draw closer to the end of title 42, a pandemic-era rule that kept immigrants seeking asylum frommening the united states. a federal judge ordered the biden administration to end the title 42. the biden administration told the judge we're not prepared for the influx. give us time. the judge, emmitt sullivan, said, fine. you have until december 21st. of course that's wednesday. here is the mayor of el paso. >> the reason why we're doing it, i said from the beginning that i would call it when i felt that either our asylum seekers are not safe as we have hundreds and hundreds on the streets and that's not the way we want to

treat people. >> i've said this before but it's an important point, people, thousands, crossing the border wednesday will be a crisis. but they're all following american law. our law says if you want to be considered for asylum, show up to a legal point of entry and ask for it. generally speaking, and especially since the judge struck down 42, we'll let you in until we can adjudicate your case. congress has not made any moves to change that, not when the democrats were in charge, not when the republicans were in charge. it's a complex issue. on twitter you can find me @scottmcgrew. thank you, scott. a carjacking and chase in the east bay. officers arrested three suspects. police were led on a wild pursuit from fremont to 6830 in milpitas. police say it started around 5:00 in a parking lot in fremont

right near john f. kennedy high school. at least three people confronted a woman and stole her car. officers spotted the car shortly after getting on southbound 680 and that's when the chase began. it ended in milpitas. a man in that car was ejected. paramedics rushed him to the hospital. we don't know this morning how he's doing but officers did arrest the three carjacking suspects. this morning just six days until christmas and shoppers are out in full force getting those last-minute gifts and the shopping done. in san francisco shoppers and visitors are saying efforts from law enforcement continue to make them feel safe this comes after last year's holiday season was plagued with mass looting. shopping procrastination. i was out trying to get last-minute things done and i did feel and notice that police presence, the presence of community ambassadors, i'm sure something local authorities want other shoppers and visitors in the downtown to feel, and that's what they're focusing on again this morning. the fire department and sheriff's office once again will be out there at 10:00 a.m. they will share tips to keep them feeling safe. reminders of safety comes as the downtown area remains on alert to organized theft and mass lootings. you will remember the viral videos from 2021 showing luxury stores in the area were targeted but this year a different feel to downtown. last night was a busy night in union square. plenty of shoppers with some families coming in to see the first night of hanukkah celebrated in the heart of san francisco. san francisco pd assistant chief noticing the crowds at union square reaching bigger numbers and he believes the turnout

shows police presence is working. >> what that has done is prevented any of the major looting to take place. >> reporter: visitors and shoppers agree saying they feel safer with sfpd and the community ambassadors around. it's not just the police but ambassadors patrolling the area. stores in san francisco's downtown are on extended holiday hours. the ice skating rink is open. you can book sessions up until 10:00 p.m. and if you celebrated hanukkah, you can catch the menorah lighting every night at 5:00 p.m. there are a lot of things to do in that area. nice to hear that people are feeling safe so far. back to you. >> and in years past it was a little disheartening to see all the looting out there. looks like police officers say, hey, we're here. don't you come. shoppers do come. shoppers come out, looters, no. >> you come. you don't come. >> it looks like a lot of fun,

ginger. thank you. palisades-tahoe opens its new base-to-base gondola lift. it opened over the weekend after two years of construction and more than a decade of back and forth legal battles. the lift stretching about 2 1/2 miles connecting 33 towers between palisades and alpine meadows and it now makes palisades the largest ski resort in california and the third largest in the nation. a live look, no new snow on the horizon but there is a lot of snowpack. meteorologist kari hall is here with cold temperatures certainly helping to keep that snowpack. it is very cold but is still sticking. the ability to make some snow as well as not much coming from the sky. it is beautiful out there. we take a look at some of our live cameras we have at

palisades, you can see the snow is coating the trees there and it's all lit up with that steam coming off the pool and it's only 1 degree there. it is frigid this morning starting out. and then as we take a look at the sierra snowpack it's still 182% of its normal amount for the central sierra. once again there's not going to be much snow this week but snow beyond this week with the possibility of some light snow showers before we head into the new year. mike, you are seeing some activity near the carquinez bridge. you mentioned fog. highway 29 called out by chp. i'm not saying fog contributed to the crashes but there are two reported here, i-80 around willow. the eastbound has cleared.

good monday morning. as we look outside in san rafael checking out the ess curve where it is clear here. the fog has been moving through the north bay. a mostly cloudy day and it will be very chilly. we do have a spare the air alert, more on that coming up. there's a little globe not affecting the flow for traffic on 101 itself. cal trains has finished this phase of the electrification project. a little more availability. developing right now more than 3 dozen injured passengers are recovering after their flight to honolulu experienced severe turbulence. this happened on hawaiian

airline flight from phoenix to honolulu. that turbulence hit as the plane neared oahu and sent people flying out of their seats. one person smacked their head into the ceiling leaving a small hole. paramedics treated 36 passengers from cases ranging from cuts to nausea. 20 people were taken to the hospital. their ages rained from a 14-month-old to adults. everyone is expected to be okay. we spoke with a college student who shot this video onboard. >> we were in the air for a really quick period of time but during that time that's when i was thinking we were going to crash or -- the aircraft was, like, damaged, on the inside bags everywhere, personal items were everywhere. a thrilling story of argentina's world cup victory.
