we're starting out with really dense fog in the tri-valley as we are seeing the low visibility moving through. it's been bad in some spots but also cold. 39 in concord and 37 degrees this morning in sonoma as you get ready to head out the door. visibility down to a quarter of a mile. really dense fog and we're only headed for the low 50s today, upper 50s for the south bay. a backup at the bay bridge toll plaza. metering lights weren't even turned on until 10 or 15 minutes later than we often see. a little slowing on the sensors. to san francisco, more crowded. that's why they start to meter the traffic there. dense fog up here in the north bay, highway 29, american canyon, vallejo and just past the carquinez bridge possibly in

the fog there is a disabled vehicle. we have crews out there. over here a little build out of the altamont. a chance of fog registering throughout the county. the build a pretty standard area but mild in the south bay. we have the relief from the first burst of traffic. back to you. >> thank you, mike. later today virtual town hall meeting to address questions about two recent troubling incidents at an east bay refiny. >> bob redell joins us live. contra costa county is also calling for an investigation here? >> reporter: correct. good morning to you, marcus and kris. contra costa health is calling for an independent investigation into an incident that took place here at the martinez refinery company behind me here in martinez taking place on thanksgiving eve when the refinery accidentally released

20 tons of spent catalyst, a dust containing heavy metals that left cars covered in ash. the county says that was, quote, a major chemical accident or release. the refinery violated state law and local policy when it failed to immediately notify the county of that incident. there was another incident earlier this month when on december 9 the martinez refinery experienced a larger than usual flaring event unsettling to many people who live in the area. the county is investigating both incidents. we are taking these events seriously. we will investigate these events to the fullest of our ability to completely understand the impacts that have happened and we are taking all of the steps necessary to be able to hold the refinery accountable for any regulatory standards they have violated. >> reporter: the martinez refinery company says an equipment malfunction caused the december 9 flaring and in a

statement wrote the flare work as designed to safely combust excess hydro carbons. we apologize for impacting the community. the city of martinez will hold the virtual town hall meeting to address concerns about the two incidents. bob redell, "today in the bay." >> bob, thank you. just shy of two years after the 2021 january 6 attack on the u.s. capitol, poised to make its final presentation of its key findings later. republicans take chrome of the house in the new year. committee will refer criminal charges for former president donald trum am in congress. nbc news has learned the january 6 committee plans to issue at least three referrals for donald trump today. >> these are potential violations of law we think there is sufficient evidence to make that referral that will be what we will be deciding today. >> reporter: the referrals carry no legal weight but they will ask that the justice department refuse charges including obstructing an official proceeding, conspiracy to defraud the government and inciting or assisting an insurrection. >> doj will have to determine whether there is admissible evidence. >> reporter: the committee also plans to refer four republican members who defied congressional subpoenas. the committee finalized plans during a closed door meeting and will lay out plans this

afternoon. former president trump blasted the committee over the weekend calling them, quote, thugs and scoundrel scoundrels. they will have more to say after referrals are made public. the january 6 committee plans to have a report detailing findings and republicans say they plan to release a counter report later. >> live coverage of the hearing this morning. you can watch that special report starting at 10:00 a.m. turning now to decision 2022 and it is well over a month since the november election wrapped up. a sunnyvale rate that has still not been decided, it was decided with one vote making the difference. today another recount is expected to begin and is costing an estimated $12,000 per day.

murall srinivasan actually beat out justin wang by just one vote. the registrar's office says that triggered a recount that came back with the same result. wang requested a second recount. the registrar says wang and his supporters must pay that bill. the process is the same as before and it's being revived because of the growing number of covid cases. go to the government's page and put in your information. a live look at sfo and the travel rush is only starting to build up. friday is expected to be the busiest by air, train and on the roads. in fact, 12 million people are

expected to drive between friday and the new year. >> reporter: welcome to the holiday travel rush. roughly 113 million americans will travel about an hour or more to be with loved ones for the holiday. this rush is on and they expect it the next couple of weeks. the vast majority will be driving. if that's you, hit the roads before 2:00 p.m. or after 8:00 to avoid the vast majority of the traffic and check the weather forecast along the route including your destination to know what you're driving into. if you're flying, that's what experts recommend you try to fly direct and in the morning sign up for airline alerts.

this holiday stretch there doesn't seem to be one. the airlines named different days. they named likely peak travel days, united named january 2nd. you will probably see long lines and packed airports like this throughout this entire holiday stretch. plan accordingly. back to you. i know you've been tracking the low gas prices. it's not as bad as what maggie showed in her package. i hope people are grateful for the conditions this morning as we show the packed roads. look at the top, the best in the state. san pablo has the great gas $2.99 a balance.

out for donors who pay more than $25. >> a good fund riser. >> from the mouths of babes. >> can i have a mermaid in my pool in the backyard. >> i didn't know marcus had a pool. >> he's like only if you come help dig it. >> that's a magical event, too. >> it is chilly out there, kari. the cold again. we've seen a lot of fog moving around parts of the bay area. a heads-up as you drive to work, the fog has been very patchy and the cold temperatures are widespread. take a look at where we are right now. it is 37 in livermore, 39 in concord, and martinez 36 degrees. so it's another cold start along with the fog that, to me, makes it feel even colder. it's so damp outside and the visibility in the north bay down to a quarter of a mile and we're seeing the fog moving through the delta as well as the tri-valley.

so here is what's going on. this happens every fall and early winter after that first big rainfall that we had, that central valley tule fog. high humidity, cool temperatures and that moisture left on the ground starts to condense and reduces 600 feet or less and then the fog for the bay area comes in through the mountain gaps into the south county and then it moves through the tri-valley as well as the delta and then it starts to drift into the north bay so that's what we are seeing this morning. it also keeps temperatures from rising as the clouds linger throughout the day. so we're only going to make it up to 50 in novato, napa, martinez, that's the high temperature in fairfield. when you compare that to some of the areas that will be sunny today like morgan hill reaching 59 degrees, much warmer there. if you do have weekend plans, holiday plans to go to the sierra, the snowpack is still looking good.

we're at 182% of normal around the tahoe area and more than double for the southern sierra. throughout the week there's not much snow coming our way, only about 1 to 3 inches but there could be more snow by next week. in total a foot of some resorts and then for the bay area a couple of scattered showers by the end of the week as well as the christmas we'll see it drifting to the north. we may see more rain by the end of next week but this week we're only looking a tenth to a quarter inch of rain in total and that's coming in around thursday into friday. christmas day is looking nice, upper 60s and sunny. our temperatures will warm up by the end of the week. mike, you were saying something about a wrongway driver. that's the report i got. i'm concerned here as i look it at the fremont camera. it was reported for northbound 880. just north of tesla no traffic interruption but there was a traffic break called potentially sourcing itself at brokaw in san

burn off. in some spots it doesn't clear out at all. with that tule fog through parts of the east bay and now the north bay as well. we've seen it not register in all of the spots if it's not right there at the airport. so we're down to a quarter mile visibility in santa rosa. one of the characteristics of tule fog it is so spotty that it is hit or miss as you drive in and out on your way to work this morning. now our temperatures are starting out cool but only headed for the upper 50s and low 60s. we'll be up to about 60 degrees in gilroy while other areas may not make it out of the 40s because of the fog and the clouds. i'm watching all of that as well as what's going on with the fog impacting the commute. this is a look at fremont. kari this is where we had the report of a potential wrongway driver. good news, no news. chp has called off whatever

break they were going to do. not the scene of any problems right now. that's a great drive here. there's some fog showing that bright yellow. it's moving around quite a bit. look at that off highway 4. a build at the bay bridge. only just now has it filled in all lanes. you see the big advantage three or more is. the january 6 committee will meet one last time later this morning. >> they call a criminal referral to be made to the justice department. we'll know more later this morning. the committee investigating the january 6 attack on the u.s. capitol will hold its final public meeting and nbc will be carrying that live gavel to gavel this morning. among the charges the committee may recommend for the former president and possibly members

of congress, object strucking the business of congress, fraud, conspiracy to commit fraud, and the big one, inciting an insurrection against the united states. congress doesn't charge people with crimes but if it recommends charges it will likely have evidence to back it up. any charges that trump may face related to january 6 will be coordinated by the new special counsel, jack smith, looking into the apparent theft of classified documents. wednesday, the committee is expected to issue its final report on the attack. important for historical purposes if nothing else. the same way the u.s. investigated what went wrong on 9/11, the kennedy assassination and the attack on pearl harbor. there is a push to do a postmortem, if you will, on how we handled coronavirus, the good, the bad. it's unlikely that will happen. the mayor of el paso has declared an emergency in that border city as we draw closer

and closer to the end of title 42. a pandemic-era rule. a federal judge ordered the biden administration to end title 42. the biden administration told the judge we are not prepared for this influx. give us time. the judge emmitt sullivan from the federal district in washington said, okay. you have until december 21st. that's this wednesday. here is the mayor of el paso. >> i said from the beginning that i would call it when i felt that either our asylum seekers and our community are not safe. they are not safe as we have hundreds and hundreds on the streets and that's not the way we want to treat people. >> i've said this before but it's an important point, people, thousands that will cross the border wednesday, that is going to be a crisis, but they're all

following american law. our law says if you want to be considered for asylum, show up at a legal point of entry and ask for it. since the judge has struck down title 42, we're going to let you in until we can adjudicate your case. congress has not made any moves to change that, not when the democrats were in charge, not when the republicans were in charge. we've enjoyed getting questions about this and comments as well. if you'd like to talk to me on facebook you'll find me at scott mcgrew tv. new developments in a carjacking and chase in the east bay. officers arrested three of the suspects. police were led on a wild pursuit from fremont to 680 in milpitas. fremont police say it started around 5:00 yesterday evening in a parking lot on stevenson boulevard in fremont not far from john f. kennedy high school. at least three people confronted a woman and stole her car. officers then spotted that car shortly after it got onto

southbound 680. that's when the chase began. it ended when the suspects crashed into another car near landis avenue in milpitas and a man in that second car was ejected. paramedics rushed him to the hospital. we don't yet know his condition this morning but officers did arrest the three carjacking suspects. it's hard to believe but just six days away from christmas and shoppers are out in full force getting the last-minute shopping done. in san francisco efforts from law enforcement really helping people feel safer out there. this comes after last year's holiday season was plagued with mass looting. "today in the bay's" ginger conejero saab joins with us a closer look at that. ginger? >> reporter: marcus, i have to admit i am guilty of that procrastination. i was out there this weekend and did feel the presence of san francisco pd and community ambassadors. it's something i'm sure local

authorities hope other shoppers and visitors downtown will feel and that's what they're focusing their efforts on again this morning. at 10:00 a.m. san francisco's fire department and sheriff's office will meet shoppers outside macy's union square to share some tips to keep them feeling safe this holiday shopping season. reminders of safety come as the downtown area remains alert to organized theft and mass lootings. you will remember the viral videos from 2021 showing luxury stores in the area targeted to theft. this year already a different feel so far. last night was a busy night in union square. plenty of shoppers with some families coming in to see the first night of hanukkah celebrated in the heart of san francisco. san francisco pd's assistant chief noticing the square reaching bigger numbers, and he believes the turnout shows police presence is working. >> what that has done is prevented any of the major looting to take place.

>> reporter: visitors and shoppers agree with the assistant chief saying they feel safer with sfpd around but not just police. also an increased number of community ambassadors patrolling the area. stores in downtown san francisco have extended holiday hours now, so you will see people around a little bit later. that ice rink over at union square until 10:00 p.m. if you celebrate hanukkah, you can come for the menorah lighting every night at 5:00 p.m. a lot of things to do in downtown san francisco. good news people are feeling safe enough to do so. marcus? >> folks need to get last-minute things done, that's the place to go it seems like. >> so many last-minute things. two lake tahoe ski resorts celebrating a $25 million opening years in the making as palisades tahoe opens its new base-to-base gondola lift.

more than a decade of back-and-forth legal battles. the lift stretches about 2 1/2 miles connecting 33 towers between palisades and neighboring alpine meadows and makes palisades the largest ski resort in california and the third largest in the nation. here is a live look at what it looks like now at palisades. no new snow on the horizon, kari tells us. at least before christmas weekend. but there is a lot of snowpack. >> that's a good thing. >> they can continue to make snow if they want to. it's been very cold. as we take another live look at the palisades, the upper mountain part of the resort has a camera, too, as the sun gets ready to come up over the hills. in some spots temperatures are in the single digits. the sierra snowpack is doing well at 182% of what's normal this time in december and the

southern sierra more than double the normal amount of snow and although there won't be much additional snow, only light snowfall totals of about 1 to 3 inches there could be some more before we make it to the new year in total about another foot of snow. we'll see rain coming in starting on wednesday into thursday, possibly moving out by friday and then as we go into next week there may be more rain coming in. at 6:40 a.m. when things are getting lighter, a problem on the east shore freeway. we don't have anything unusual. a mild build coming past the golden gate field.

overall we're going to see a lighter earlier commute, late morning and into midday, a lot more traffic. the warning, remember, it wasn't a one-week closure. they will have the closures. everything moving smoothly through the tri-valley. coming through san martin, it's a lighter build or better speeds than we see usually indicating lighter morning traffic. that's one note from the south county. we have caltrain which starts out of gilroy. rocked by severe turbulence, a scare in the air for one packed flight headed to hawaii.

airlines flight from phoenix to honolulu. that turbulence hit as the plane near oahu sent some people flying out of their seats. one person actually smacked their head into the ceiling leaving a small hole. look at that. after the pilot safely landed the plane, the paramedics treated 36 passengers for cases ranging from cuts to nausea. ages range from 14 months old to adult. everyone is expected to be okay. we spoke with one college student who shot video. >> we were in the air for a quick period of time but during that time that's when i was thinking are we going to crash or keep falling? the aircraft was damaged on the inside, there were bags everywhere all over. >> the faa and ntsb are both investigating.

continue today in the north bay and santa clara valley. trying to keep warm because it's been so damp and cold as well. with our visibility down to about a quarter of a mile in parts of the north bay, we've also seen some really dense fog moving through the delta. that tule fog happens after the first big rainfalls of the fall and early winter and now that we have a clear sky overhead, high humidity as well as cool temperatures, all that moisture in the ground is condensing into dense fog. visibility can be 600 feet or less. coming into the southern south county from the central valley as well as the tri-valley and through the carquinez strait and moving into the north bay. so that's what we are seeing this morning looking at martinez. the fog will linger and most likely we won't see any sunshine here. it will be a very cold morning in the upper 30s and only make
