mario and nina, his parents, they are the ideal support system. >> reporter: overnight, the positive steps looked like the vitals are returning to normal, rooney said, and they did sedate him to put in a breathing tube to help him rest easier, and both the fans here and in cincinnati and over in buffalo are really praying for him, and pulling together the support as they are focusing on the health of one of their beloved team members. >> and maura, the nfl is receiving criticism of how long it took to cancel the game, and the league officials spoke this afternoon, and did they talk about that at all? >> we did hear from the nfl
12:06 pm
officials in the last hour. they had laid out a time line of when they canceled the game, and postponed the game, excuse me. they had suspended game 20 minutes after hamlin was hit, and receiving that cpr on the field, and then it took another 45 minutes for the game to be postponed, but they are maintaining that is part of the emergency preparedness plan, and they also said that there was no indication that the team would return to the field, and you heard from the bengals representative saying that the focus was on demar's health. >> thank you for that news. and now, on capitol hill, the stalemate of who is going to be the next speaker of the house is not over yet. kevin mccarthy does not have the votes he needs, and the passing of the gavel is being held up by a small group of republicans. we have julie on capitol hill, and it is minute-by-minute, and
12:07 pm
day two of the drama, and where are we at? >> yes, day two and vote five, and tallying it now, and it is look like kevin mccarthy was not able to flip any of the 20 who voted against him to come to his side to secure the speakership, and that is where we ended off yesterday. one member victoria sparks changed her vote, and previously supported him and now voting present twice, and now the republicans are looking of the path forward and now they are looking at the supporters of representative bacon who was on with chris jansing of what is to come next, and what is going to be on with speaker. >> this is the question, right? and what if he can't get the support, what are the options? >> i spoke with kevin mccarthy, and he can't keep bringing it
12:08 pm
up, and if he is wrong about that, jeffrey, the democratic leader has all of the votes with that staying behind him, and all of that reaching 218 threshold, and they are possibly going to take one more vote, and then a six-speaker vote, and adjourn for the day, and the huddle, and adjourn for the day, and the allies of mccarthy are sticking with him still, and there a door, and bacon, s congressman said that perhaps they will peel off the votes from the democratic side, and look atther republicans like steve scalise who is also more concerned than mccarthy and how is it going from here, and there is a camera and swearing in of house members, and if so, there are congressmen elect, and there is a speaker and no functioning third branch of government. >> julie, thank you, for that report from capitol hill. and still, returning to

flooding, power outages, falling trees is basically what everyone is expecting as the next storm rolls into the san francisco bay area. meteorologist kari hall is here to tell us what to expect and when. hi, kari. >> good afternoon. we've seen some rounds of rain moving in, but we're still waiting on the brunt of the storm to get to us. look at this storm system off the coast. it's been really beautiful imagery, but we know with it comes a lot of danger here as this very powerful storm moves into the bay area. it's also tapping into some tropical moisture, so not only is it an atmospheric river but the way it intensified with the center of the storm, it's also a bomb cyclone, so we're anticipating a lot of big impacts here as waves of rain come through. we've seen it lightening up for some spots, but now we're under a flash flood watch. and we are looking at e potential of all of this rain coming on a saturated ground, causing creeks, streams and rivers to rise very quickly and
12:24 pm
could be running very fast. also street flooding a possibility, where those drains are clogged or can't keep up with all of the heavy rainfall we have coming our way. let's talk about the timeline because we're going to start to see some of the oranges and reds popping up here. the most intense rain in parts of the north bay at about 5:30 this afternoon. but it's also going to start to pick up in san francisco shortly thereafter and spreading into much of the rest of the bay area by 7:00 to 8:00. some of the really heavy rain coming down in san jose at about that time at 7:30. but we'll have several hours of this heavy rain coming down and also gusty winds. wind and rain, saturated ground not a good mix becausee see a lot of trees coming down and that could also cause more power outages. butre once again talking about the risk of flooding as we get several hours of this rain coming through. here we are now at 5:30 tomorrow morning, and there's still some waves of some heavy rain that's going to be coming through. we're going to see this rain
12:25 pm
continue off and on through at least tomorrow evening before it finally starts to taper off. in total we're looking at about 2 to 8 inches of rainfall. 40 to 60-mile-per-hour winds, and all the impacts of the floods and the mudslides that will be a possibility. looking ahead, only a few brief breaks before two more storms come in over the next seven days. chris. >> kari, thanks very much. we have a long haul ahead and so governor gavin newsom announced today a state of emergency because of the incoming storms. the declaration allows the state to respond more quickly when damage reports inevitably start rolling in. the state will better support local organizations when they respond to the damage. all hands on deck, that's how pg&e says it's getting ready for the storms. today at a news conference in fremont, the company talked about how it's getting prepared for the incoming storms. the company says it has 3,000 field workers standing by to fix any problems. but the saturated roads, downed trees and flooding will likely
12:26 pm
make it difficult to repair equipment quickly. pg&e also says there are some ways people like you can prepare too. >> if you live near any power lines, especially above ground power lines, please secure things like furniture, tarps, even garbage cans, things like that. bring them inside. anything that can blow in significant wind and potentially come in contact with power lines. keep your devices charged at all times and be ready in case the power does go out. >> charge those cell phones and tablets and whatnot right now. pg&e urges people if they see a downed power line to not touch it, move away and call 911 right away. we're still waiting for the worst of the storm but it's already done some damage around the bay area. we have new video showing damage already in walnut creek. at least two trees fell blocking sections of the westbound lanes of pleasant hill road and holland drive. the chp and crews are on scene working to clean up the mess.
12:27 pm
you can see runoff from the rain pooling on the roads. we are following all of this online in realtime and we do appreciate you keeping with us here. we are seeing flooded streets in danville over the weekend, danville saw unprecedented rain levels and now they're dealing with the possibility of even more rain. almost 100% likelihood. so streets flooded there. now today those streets are flooded again. workers out there using sandbags to minimize some of the flooding and clear out the water. new video shows just how strong the wind is today. this from san jose. you can see the wind blowing those two trees. that's going to do it for this edition of the fast forward. we'll be back in 30 minutes with more news. follow us online for updates in realtime. ubrelvy y helps u fifight migrainene attacks.. u ririse to the e challenge. u wowon't clock k out. so u u bring ubrbrelvy. u wowon't clock k out. it can quiuickly stop p mige u wowon't clock k out. in itsts tracks within 2 2 hours.... ...withoutut worrying g is too o late or whwhere you ar. unlilike older m medicines, ubrelvy isis a pill ththat directctly blocks s a protn

bottom of the hour now, and here are some of the stories making headlines on "nbc news daily." >> five high school students were shot in baltimore this morning. they say that the suspect fired multiple rounds as they stood outside of a popeyes restaurant. and now, l.a. county is going to pay $20 million to the
12:31 pm
family after it was taken from the family. and now they will sell it back to the county saying that the money will be used to help the heirs recover what they have lost. mega millions jackpot will be drawn this friday night. bryan kohberger waived his rights to be extradited to idaho. investigators say they have evidence that tis him to the crime of four murdered college students. what do we know about the process of getting kohberger to idaho, and what is next for him? >> well, law enforcement is not going to release the news of his arrival for safety reasons. we know that he is not in
12:32 pm
pennsylvania, and he has left on a plane west, and we cannot confirm if bryan kohberger is on it, and once he gets to moscow, idaho, he is going to be booked into the moscow county jail, and he will get a court date. once that happens, he will not have to be transferred by vehicle, because he can walk to the courthouse, because it is one building connected. in the first initial appearance, the judge will read him his rights and the charges. and then we will learn more about a trial date. >> and what do we know about the evidence against him? >> we are not learning much about that right now, but we are hoping to learn more about what they have to link him to these murders. kate. >> and we are hoping to learn more about what he was doing before the days of the murder including interactions with the
12:33 pm
police. >> yes, he had two with indiana state police, and one the hancock sheriff's office, and he was allegedly speeding in the first one, and in the second, following too closely. as you can see in the body cam, the officer asked him where he is coming from and where is he going, and he said that he is leaving washington state university and headed to pennsylvania, and this is right before the holidays around december 15th, and we learned that friday, when he was arrested at his home in pennsylvania, and they seized the white hyundai elantra in both of the body camera videos, and so it is helping to paint the picture of where he was until he was arrested on friday. >> thank you. and the man who investigators say intentionally drove his family off of a cliff is facing charges. that car plunged 250 feet, and everybody inside survived after an incredible rescue.
12:34 pm
gabe gutierrez is joining us and we saw the images of the rescue, and amazing that nobody there was hurt. the four people survived. what more are we learning about the driver? >> yes, aaron. as you can see, and if you are looking right there, it is remarkable that all four people inside of that tesla managed to survive. the children were taken away with less serious injuries. the adults were hoisted away by a helicopter crew as well. now, we are learning more about the driver of that tesla. police say that the 41 dinesh patel is facing charges including attempted murder and child abuse. his wife and two children ages 7 and 4 were in the car with him. at this point, the investigators have not said why he allegedly would have driven that car off of the cliff, but it is just an incredible story of a heroic
12:35 pm
rescue, and daring rescue after such a horrible turn. >> and you are hearing from somebody who lives near the family, and what is he saying? >> yes, this crash happened near san francisco, but the family is from pasadena, california. and patel is actually a doctor in radiology. his community there, one neighbor says that the family had lived there for five year or so, and they were well known in the community, and they are stunned by what happened. take a listen. >> they moved in five years ago, and the sweetest couple, and the greatest two little kids. a daughter and a son. am stunned by it, because you don't really think of what could happen on a day-to-day basis of what could happen with family and friends and this is shocking. >> police say that he going to be booked into the county jail as soon as he is released from
12:36 pm
the hospital, and no motive in this tragic case. >> gabe gutierrez, thank you. and president biden is going back to washington after holding the first official event of the new year, and he is holding the infrastructure bill achievement alongside senate minority leader mitch mcconnell. and kelly o'donnell is joining us. what is president biden saying about the impact this year, and the relationship between the president and mitch mcconnell. >> we have been separately watching the discord and dysfunction of the house gop where they have not been able to choose a new speak e and here the president is focus on the bipartisanship and focusing on
12:37 pm
the relationship with mitch mcconnell and other republicans to find where the president is stressing commonground on things like infrastructure where a bridge is going to be built, and bring jobs and connectivity and enhance the community in kentucky and ohio in that area, and politically what stood out today is how the president, clearly a democrat, coming into this time where he is going to be working with divided government stressed the relationship with mitch mcconnell. here is an example of that. >> leader mcconnell and i don't agree on a lot of thing, and in fact, we disagree on a lot of things. but here is what matters, he is a man of his word. when he gives you his word, you can take it to the bank. and he is willing to find commonground with it. thank you, mitch. >> and a group of reporters asked him about what has been happening with the speaker vote.
12:38 pm
he calls it embarrassing, and it is a contrast that the white house is going to set up here, and talk about an important bipartisan achievement, and the vice president, and the cabinet officials are out in the cabinet to talk about some of the projects coming from the law, but the president is showing governing at a time when the republicans are going to be controlling the house to find trouble organized. kate. >> kelly, there is news that the president is going to be visiting the u.s./mexican border this afternoon? what else did you learn? >> that came out with the reporters on the tarmac, that he is planning to go to the north american summit next week which includes the leaders of mexico and canada and maybe going to the border which is something that he has not done and facing a great deal of criticism since he has taken office, and he said that it is his intention to do that, and so they are looking to work out the details.
12:39 pm
we will follow up with details. >> kelly o'donnell, thank you. >> access to abortion pills is about to get easier. the fda finalized a rule change to offer retail pharmacies to offer these pills for the first time. >> states have restricted access to the procedure after the supreme court overturning roe v. wade. chloe atkins is joining us. chloe, talk about the abortion pill that is approved and how soon can people pickt up at the local pharmacy? >> kate, in the last 24 hour, the fda took a major step to loosening the restrictions on the first pill of the two-pill regimen of abortion. and so it is unclear when somebody can go to the pharmacy and fill a prescription, and get those abortion pill, and this is because cvs and walgreen's have to go through a process to be
12:40 pm
accredited to dispense these pills to patient, and also, we have not heard from cvs or walgreen's on whether or not they want to do so, and maybe it is going to take a while to hear from them as far as they want to make up their mind to take those steps and if they want to do it, and the fda move does matter, because a ma joer toy of the abortions happen via medication abortion, and majority are terminated using the medication abortion, and that could change the landscape of access. >> and how does this change the impact of people living in states that have curbed the abortion access, and does that change the laws on the books? >> aaron, it does not change much. if abortn is banned in the state, it includes medication abortion. it is a regulatory action and not a federal law, and so it does not override state law, but it could help folks who live in states who ban abortion, but

schoolchildren in this post covid era, and the nation's report card is showing that 26% of eighth graders were proficient in math, and that is down eight points from 2019, and just 40% proficient in reading and that is alarming parents about learning loss. with the walton family foundation, i had a chance to sit down with a panel of experts to pose questions from real parents to the panel. this is part of our conversation. >> is there something that parents can be doing to foster catching up academically? >> we need to allow ourselves some grace during this time, and when we are thinking of the learning loss, we think that we have to catch up, and the testing scores were low, and so we have to allow ourselves spending time, and cooking and
12:45 pm
hobbies and extracurricular hobbies to release some of the pressure is going to allow us, and children in the classroom to accelerate faster. >> when charlene says that we need some grace, one of the questions that i am thinking about is if everybody is behind to some degree, why don't we reset the norms. why do we keep hammering away at failure, failure, failure, and it is not one or two kids that we are talking about, and it is all of the kids. >> the last question is from abbey from new jersey, and she is a high school teacher and parent, and she had a specific question about a skill that she sees everyday in the classroom, and she is wondering how we are getting the kids' writing skills up after missing so many classes with writing skills? >> the schools can create projects around things that are of interest to kids, and so they
