it's so bright you are burning my eyes! ahhh >> see you in a few. >> feels so good to have al back a lot of other things we will get to, including that drama on capitol hill, all those new royal bombshells from prince harry's memoir. we will start with the stunning new details out of idaho. that newly unsealed affidavit that has shed a lot more light on the case. we have complete coverage. we'll start with nbc's gadi schwartz, good morning to you. >> reporter: good morning. 28-year-old bryan kohberger made his initial appearance yesterday in court that's when he was advised of his rights and read the charges against him, four counts of murder his public defender in pennsylvania says that he thinks he is going to be exonerated, intends to plead not guilty. but that unsealed affidavit, that probable cause statement, the details inside are chilling. suspect bryan kohberger making his first appearance thursday before an idaho judge.

>> all rise. >> count two alleges that you committed the felony offense of murder in the first-degree. >> reporter: also in the courtroom the family of victim kaylee goncalves, laying eyes on the suspected killer in person for the first time did you ever see him turn and look at you? >> i was hoping for that he is going to avoid me. >> reporter: authorities als releasing details about the night they think kohberger murdered goncalves and three other university of idaho students, madison mogen, xana kernodle and ethan chapin in an a off-campus home. one of the two surviving roommates telling police she came face to face with the killer waking at 4:00 a.m., one of the roommates said someone's here but didn't see anyone when she looked around. according to a newly released court document she heard crying coming from the victims' rooms and a man say something to the effect of, it's okay, i'm going to help you. she opened her door to see a man

dressed in black and wearing a mask who walked towards her and out a back door and locked herself in her room. police weren't called until noon that day for reasons still not clear. steve goncalves describing the roommate's state at the time of the 911 call. >> remember, these girls are so up-set they went outside seeing this, one passed out and the other one was so hyperventilating that the message wasn't clear enough for the operator. >> reporter: the newly unseale 18-page charging affidavit says a state forensics lab fount the suspect's dna on the button snap of a knife sheath. left laying next to one of the victim's bodies. the charging document also says the police used phone record and into footage of his hyundai elantra to place the suspect near the scene of the crime. according to law enforcement the suspect's phone was turned off for about two hours during the time the murders took place. but it turned back on at 4:4 a.m. it was traveling south of moscow back to pullman, washington, where the suspect lived, authorities allege, which is just over four hours later the

cell data places his phone back near the home and police say kohberger's phone registered in the vicinity of the victim's home 12 times in the months before the murder dating as far back as august last year kohberger expressionless as the charges against him were read. >> maximum penalty for that offense if you plead guilty or are found guilty is death and/or imprisonment for life. do you understand? >> yes >> reporter: now, this affidavit is nearly 20 pages long but there is a page that has been completely redacted. the family of kaylee goncalves, one of the victims, says they are confident investigators have much more but there are some unanswered questions what was the motive in this case and did he know the victims before these murders meanwhile, he is being held at the jail and his next court date is going to be next thursday back to you. >> gadi, thank you. >> we want to laura jarrett, she

is nbc's new senior lega correspondent. welcome to nbc. >> so good to be with you. >> what fascinating affidavit. your assessment of the strength of the case. talking about dna, cellphone tracking. does it seem like law enforcement has their man? >> the dna is super compelling juries attach a lot of value to dna. everyone has the cia effect. that's something they will want to attach to look the knife sheath is on the bed of the woman who has been killed the 99% match the jury is going to attach to that. but that's not everything, right? we have all of the surveillance video, all of this cellphone records. the cellphone is pinging at, what, a dozen times before the actual killings? that's a big fact for prosecutors because, remember, they have to show this was first-degree premeditated murder the idea of him casing, as they claim, the house ahead of time is going to be all of that together. >> can i ask a basic question? if you have someone's thumbprint on the knife sheath thing, is that just not enough

does that not put him there in the house? >> no, nowadays there could be tampering. there could be -- there are a thousand different things defense attorneys could poke holes in. dna isn't everything but it's that in combination of everything the other thing is the standard right now is much lower. we are not in a court. we are in the probable cause land all they have so show is it's likely he committed the crimes we are not in reasonable doubt land. >> in criminal cases you have building blocks for cases so we are starting to see some of the evidence one thing we don't see in these documents, because it is too early at this stage, is a motive a potential motive prosecutors don't have to prove motive, but juries sure want to understand motive. >> they want to understand why it's the question on all of our minds. what was his connection to these women and the boyfriend, if anything there may be no motive at all. meant of crimes have been committed and people prosecuted without motive you need to have intent. but juries want to know the

story. how did he find them how did he zero in on them if he is found guilty? that's something the juries want to know. >> people are asking, there was a person who was there who survived this who heard crying, said she saw a man. why would one person who could potentially be identifying the suspect be left behind? what would be the reason? >> we don't know. it's everybody's nightmare to wake up with someone in your home. put your defense attorney hat on. i will poke holes in that saying he had a face covering on. that may not be enough for a positive i.d. but it's a horrifying -- >> it's early in the case but at last we are starting to see some of the evidence police say they have. >> more to come, for sure. >> laura jarrett, thank you, and welcome to nbc. now let's move to that unprecedented standoff on capitol hill over who will be the next speaker of the house. after three days and 11 votes one of the nation's most

powerful positions still remains unfilled amid fierce republican infighting. this morning there is new hope that a deal could be within reach. nbc's senior capitol hill correspondent garrett haake has the latest. good morning. >> reporter: good morning. it was a marathon session on the hill last night with republican leader kevin mccarthy losing vote after vote in his quest to become speaker. behind the scones off the floor there were secretive negotiations that could be moving the house and the country closer to a resolution. this morning the u.s. house dead locked and divide, leaving the nation's business in limbo. >> a speaker has not been elected. >> reporter: an historic 11 votes have now failed to produce a speaker. republican leader kevin mccarthy struggling to lock down 20 gop votes. still confident late thursday. >> i feel very positive yesterday. i feel more positive today. i think we have good discussion. >> reporter: his allies

scrambling to reach a deal to satisfy the holdouts. offering prime committee seats, votes on bills like term limits, and perhaps most significantly a rule change that would allow any single republican to force a vote on the speaker at any time. mccarthy seen himself lobbying opponents on the house floor. >> i wouldn't be betting on my vote for kevin mccarthy under almost any circumstance. >> reporter: congress can't do anything else members pick a speaker. no committee meetings or votes on bills. new staff can't even access emails. democratic minority leader hakeem jeffries urging them to quote stop the back stabbing. >> we are asking house republicans to get along with each other. so we can get about the business of the american people. >> reporter: with mccarthy pledging never to drop out, lawmakers are preparing for a long struggle with only one solution. >> we got to get more votes. that's what's in the way. >> garrett, i mean, i feel like we have been here every day

probably because we have. again, we are hearing there have been concessions, a potential deal. could today be the day? >> reporter: there is something of a groundhog day feel to it. but republicans seem to believe it could move some of those 20 holdouts to mccarthy. if they can't move all of them that means we are going into another day of politics and pressure to try to move the votes before we head into the weekend. >> garrett haake, thank you very much. 7:13. an update on damar hamlin. a lot of people have been hoping for this news and today they are getting it. >> good morning. good morning to you, as well. the young buffalo bills safety is now awake, communicating, even holding hands with his family. in the words of the team, hamlin is showing, quote, remarkable improvement following his collapse on the field during monday night's game. nbc's maggie vespa once again for us at the university of cincinnati medical center.

maggie, good morning to you. >> reporter: craig, good morning to you. just a massive collective sigh of relief for more. even knowing of course damar hamlin still has a long way to go. he is still in critical condition, still on a breathing machine. he is not talking but communicating with pen and paper. importantly his doctors say he is showing no signs of neurological damage. so incredible news for so many, including his team, the buffalo bills, who say on sunday they are ready to play for 3. this morning buffalo bills safety damar hamlin is awake, responsive, and his first question, whether his team pulled out a win. >> he asked did we win. the answer is yes, demar, you won the game of life. >> reporter: 72 hours after the 24-year-old suffered a cardiac arrest and collapsed during monday's game against the bengals hamlin remains in critical condition on a

[voicece vibratingng] and good morning. it's 7:26. i'm scott mcgrew. here are today's top stories. a new look this morning at the damage to capitola wharf as seen from a drone overhead. you can see a huge chunk simply torn away by the heavy surf. huge waves, some approaching 40 feet, flooded the historic area yesterday. here is how it looked when the waves were most intense this is from inside zelda's, the popular restaurant, it just got wiped out. many other homes and businesses facing major cleanup. there are concerns the surf may cause more damage at high tide, about two hours away.

kari, that high surf advisory still in effect. and we're still seeing those waves being pushed up by yet again another storm that's coming in off the coast. and we're continuing to see it strengthen as it moves in. right now some of the moisture being pumped into the bay area with a lot of clouds. some spots getting in on light showers even this hour as most of the rest of the bay area gets a chance to let the previous rain soak into the ground. so we're really concerned about the potential of flooding over the next couple of days. as the next storm comes in, it's going to become widespread across the bay area tomorrow. and then as it wraps up on sunday there may be a few isolated thunderstorms. and then again on monday a stronger storm system will be coming in. another atmospheric river, temperatures reaching into the mid-50s. so the cool weather continues as the rain will be off and on through the forecast into next week. we're looking at the possibility of about 2 to possibly even up to 5 inches of rainfall this weekend, and we're also going to see more flooding especially on

>> my sister flew in from cincinnati my brother, christmas. and you guys you know you were part of that rock but what deborah did the most for me was i had no idea how bad off i was. i thought i was doing pretty good this is good. >> it's funny. we watched al go through tons of surgeries. every time you come back, you are skipping you had prostate cancer, you skipped in knee replacement, hey, everybody. so this one was different. how did you navigate what did you know about what was going on >> look, i had two complicating things i had blood clots that they think came up after i had covid in september then i had this internal bleeding i lost half my blood and they were trying to figure out where it was they went in, did the surgery and it ended up two bleeding ulcers, had to resection the colon, take out my gallbladder, redo my duodenum i went in for one operation, i got four free.

and good morning to you. it is 7:56. i'm scott mcgrew. here's a look at what's happening now. >> reporter: i'm bob redell in fremont at canyon heights in pickering in the morse canyon part of fremont. as you can see the hillside behind me, those dark shadows, those are areas where the hill has actually started to slide down and send mud into the street below. a viewer sent us this video in the daylight to give you a better sense of what's going on. several places where the grass and soil have started to slide away from the rest of the hill because of recent storms. keep in mind this could get worse because another atmospheric river is expected to dump on the bay area soon. not clear how much of a threat these mud slides pose to those homes. let's check in with kari. what can they expect today? this is a storm that will be coming in.
