"nbc news daily" starts right now. it is tuesday january 10th, 2023. breaking news, drenched and damaged. california is battered by round after round of torrential rain. evacuations and life threatening situations are currently under way. we are at the places hit harded and tracking what is to come. >> and now, the doj is looking into how classified material ended up in an office once used

by president biden, and why the administration says this is different from the trump mar-a-lago case. some companies are being sued by a school district, and why seattle school district says that media giants are poisoning children's brains. the push for more people to learn cpr after it helped to save damar hamlin when every second counted. and now, breaking news, a severe weather emergency in california. a round of rainstorms hit california and caused catastrophic damage. more than a foot hit california and led to dangerous landslides. more than a million people have been ordered to evacuate and knocking down power lines and more than 200,000 people are without power. >> a couple and their dog had to

be rescued by helicopter. and a couple had to be rescued from a sing hole, and this is the fifth storm since christmas. and now a sixth and seventh round of rain. let's get to marissa parra and bill cairns. i know that you are near santa cruz where we have seen the damage, and what are we seeing across the state? >> first, let's see what we is happening here, and this is more or less what we are seeing here as we are driving through the area, and people trying to put debris into piles, a meanwhile, they are going to be putting debris in piles as they are going to be hit by rain, and more rain coming in waves here, and more difficult for rain

here, and coming through the recovery process, and right now, in california, this stream is completely flooded, and people are not ready to come down yet, and theyare not able to come out yet, but ton towns the near the ocean are seeing a lot of this, right. floodwaters and then those closer to water, and we know that some of the water is very, very flooded streets, and very scary situation, and then you have a lot of the mountainous areas that are seeing the mudslides to catastrophic levels, and in areas, it is closing down areas of the highways when we spoke to one man who said that it is supposed to be a 45-minute drive ended up to be 2 1/2 hour, and one thing to leave you with is that it is still looking for her, and just resumed within the last couple

of hours. back to you. >> and now, we turn to bill cairns, still some more rounds of storms coming after this. >> and the worst was yesterday, and today, we have thunderstorms and flash flooding, and light rain and bigger storms scattered and some of the rivers can come down, but that is the time line, and a band of rain that is south of los angeles, and numerous showers and storms around san francisco, and the pesky storm itself is headed down to the north, and looking at the edge of the screen, and this is storm that is coming to the north of san francisco with 1 to 3" and not around los angeles, and now, santa barbara is out of the storm watch, and this is today, and get to tomorrow, and the brighter yellow is the downpours, and this is really san francisco northward this time, and that is the worst of where it will be, and the rain

totals will be the flash flooding, and maybe not a huge break until next week. >> marissa parra and bill cairns, thank you both. and some senators are headed to the southern border after they met with some other officials yesterday. gabe gutierrez is there, and we know that you spent some time as migrants were being helped into the u.s. tell us what you saw? >> hey, there, aaron, some officials were here in yuma for quite some time, and there was a vital stretch for resources here, and more than 2600% in illegal migrant crossings in the past year or so, and migrant advocates say that the deep characterization that this is chaos at the border is overblown, but they are continuing to help some of the migrants that are coming over the border, and just this
12:06 pm
morning, we saw one family from colombia with a 9-month-old boy in cold temperatures waiting to be processed by the border patrol, and i spoke with one of the migrant aid volunteers meeting with the biden administration to remain in the u.s., and provided they apply for asylum with the channels and those from other countries are expelled, and listen to what one of them had to see from the change. >> and it is overwhelming, and i think that our border patrol sector has done the best they can, and the local government is stepping up, and different ngos and community leaders are stepping up, and we will see what we can do better. >> and the bipartisan group is touring later, and amid new recalls of the immigration reform, and many on the ground
12:07 pm
are skeptical of that immigration reform that is possible. >> gabe gutierrez for us today in yuma. today, there is a meeting called the three amigos summit. we have carol lee joining us and what sells on the agenda? >> well, kate, immigration is a big topic here, and the president making that trip to the border, and announcing the new policies, but in addition to that, the leaders were expected to discuss things like climate change and the economy and trade, and they had some announcements and issues and some of the things that they are addressing is the supply trade and minerals and electric cars and so they are trying to take steps to address concerns about the supply chain there. and also making commitments on climate change, and commitment
12:08 pm
to reduce emissions by 15% at least, and by 2030, and so that is another step that they are taking to show that there is unanimity among the three countries, but at the same time brazil is a huge topic hanging over the summit. the leaders have made numerous statements saying that they will stand by the democratic nations. >> all right. carol lee is watching that for us. thank you. the top democrat on the senate intelligence committee wants to know how documents marked classified has ended up in a former office used by joe biden were found by his attorney. according to the attorneys, they alerted the national archives and the documents were recovered the next morning. top democrats defended way the finding was handled, but not so

much by the republicans. >> what we would like to know is that it was concealed to the americans, and that is wrong. it looks political. >> what president biden did was disclose this to the archives, let them know, because there a process in handling this. >> and now, ken dilanian is joining us from washington. what more do we know about the documents? >> aaron, we don't know the level of classification, and we know less than a dozen according to two sources that they were found in that office by lawyers as they were packing up some of biden's things. he used the office after he was vice president and before he began running as president in 2020, and as soon as the lawyer saw the documents marked classified, as you heard, they turned them over to the national archives who then referred the
12:10 pm
matter to justice department, and the justice department informed marek garland who was an original trump appointee to investigate if there should be criminal charges. and this is what you do when discovering classified documents in the wrong place. it is also true that they did not tell the public about this, and they discovered them six days before the midterm elections, and we are only hearing about it now. >> there is concern about the democratic leader mark warner that we expect to be briefed both on what happened at mar-a-lago and the biden office as part of the oversight, so how can these two cases be the same and different? >> they are the same, aaron, in the fact that classified documents were taken to where
12:11 pm
they shouldn't, but they are vastly different in the circumstances as to how the documents got there and how they reacted. in the case of trump, you had some 300 classified documents now found at his residence, and the grand jury had issued a subpoena, and determined that the subpoena was not complied with, and they had to get a search warrant, and convince adjudge to believe that a crime had been committed, and that is significant, and this is why criminal charges are being considered in the trump case, but in the biden case, there is nothing more than misclassification, and nonetheless, people have been in trouble for bringing classified documents to places where they should not be, but never the less, it is not the same as donald trump. >> thank you, ken dilanian. >> and now, joining us with the
