welcome back. please join me in welcoming nbc news political director and moderator of "meet the press" chuck todd with a preview of today's show. hi, chuck. thanks for joining us this morning. president biden is facing a department of justice investigation after a classified documents were found at his private office. now we know even more classified documents were found this week in a second location. how could this impact the investigation and credibility of the white house? >> look, i think it does damage the credibility of the white house. i have a democratic senator on today. he said it was embarrassing at a minimum. now they were trying to draw the distinction what donald trump did was more intentional than joe biden but the fact that joe biden is out there calling what donald trump did as careless, you know, only sort of makes it easier for that to back splash
7:13 am
on him. i think politically he has more to fear than legally, at least president biden that is. but politically i think it has empowered house republicans who want to investigate anything they can involving biden. they now have something that looks perfectly legitimate to the average voter and independent. it doesn't seem like it is based on a conspiracy theory. that gives them at a time when a week ago it looked like they were the keystone cops when they couldn't even agree on a speaker. then it makes it much more difficult i think for the attorney general to prosecute donald trump for this, for what to many people is going to seem like a similar crime. and the fact is defying a subpoena is what donald trump did. joe biden didn't defy the subpoena. donald trump's attorney lied on a federal form and said they'd returned all the documents. we found out they hadn't. so it is true that what trump did was more egregious it appears on the surface than biden. but for many americans it is not going to cut it.
7:14 am
i think the justice department is worried about its ability to be seen as a fair arbiter here and why we have two special counsels. >> do you think the investigation could strengthen the divide of the nation right now before biden gives his state of the union address next month? >> i know. as if we couldn't be polarized enough. i lived through '97-'98 the lewinsky scandal if you will. that really ripped our politics apart, polarized things in washington, put everything into gridlock. i have a suspicion the next six to nine months will feel very similar to that where basically the only thing that may pass congress is an agreement to raise the debt limit and that is going to be contentious. this is going to be a game of political survivor and we'll see what each of these political figures and parties looks like at the end of the calendar year.
7:15 am
>> a lot to watch out for. thanks so much, chuck. well, be sure to join chuck for this morning's "meet the press" with an all exclusive lineup of guests including rod rose instein the former u.s. deputy attorney general and senators debby stabenow and ron johnson. tune in to "meet the press" at 8:00 a.m. right after this newscast. in about 30 minutes from now we'll talk to nbc bay area's political analyst larry gerston for our weekly segment and look more into the president's missing docket investigation and the similarity and differences from former president trump's document investigation. despite the drama surrounding the white house, it will soon be celebrating the warriors. it will be the team's first visit since the obama administration. president biden will welcome the nba champions on tuesday, january 17th. the team also won the finals back in 2017 and 2018 but didn't visit the trump white house. this is the fourth championship won by the warriors and the last

7:20 am
see the rain totals. reds, purp ls a little bit more of course over guernville, santa rosa there, but of course the santa cruz mountains, that purple bulls eye we could see 3 to 4 inches pile up with this last rain. rain and snow aside looks good for our reservoirs. we are looking at over a hundred percent capacity in marin, nearing that in east bay, and lexington is inching closer to 100%, good and bad news. notice here, we're about a foot and a half from that spillover. we've seen it almost double in the capacity since these storm systems started in december. now we're at 96% capacity. good and bad news there. we could see the los gatos creek area start to see some trouble with some flooding there. so know prepared in case you have to go. looking at the long-range outlook, yes. we are going to see some rain
7:21 am
later on into tomorrow. wednesday, we could see that storm system, although it is still staying a little bit to our north. by now we could handle the light sprinkles, but we'll see the sun return by next weekend. it is going to be gorgeous. >> everyone is waiting for the sun. we're waiting to put away our umbrellas, jackets. >> people are waiting to go to tahoe. it was a mess on the roads. >> white out conditions. >> we told you not to go. we told you. >> right. >> you can go next weekend. >> there you have it. ski season will still be up and running, get on the ski lifts. >> my gosh. if kids have the early ski week time, next weekend perfect to go. >> okay. dry out by wednesday? >> i'd say more like thursday/friday into next weekend looks gorgeous. >> then we'll see the sun. thank you so much, cynthia. >> you're welcome. there is much more ahead on "today in the bay" coming up -- head coach kyle shanahan

over richmond about to move into oakland and down over tri valley, heavy downpour as well on into livermore and then we move to the south bay. it is moving into these areas, willow glen, into milpitas as well. let's take it hour by hour. sunday is not completely ruined. you still might have a chance to go outside and walk the dog, go to the grocery store, but then move it hour by hour. rain over the north bay, coast line, half moon bay, peninsula, palo alto, san jose, morgan hill, and gilroy seeing some of the heavier rain by the middle of today in gilroy. everybody gets rain as we move into the evening hours. then into monday morning. 2:00 a.m. look at the time stamp. heavier pockets moving in over santa rosa, over san francisco, on into fremont and the east bay

shoreline. then we take it to the commute hours as we get you ready for school, for work. it is going to be a little bit messy. please plan ahead. of course you know the drill over the last couple days. slow down. slow and steady is the way to go. look at this color behind me. we could see the snow levels drop around livermore, mount hamilton because this is the cold storm system. so that could be a nice sight as we move through the work week. taking it ahead into the middle of the week once we get past monday's atmospheric river this is trending a little bit to the north. we could see rain pass us by wednesday, thursday, but we will be drying out as we move into the next couple days next weekend looks gorgeous. how much rain are we talking about? trace amounts with wednesday and thursday's storm. anywhere from about 0.1 inch to 0.25 inch if we're lucky. the water is looking very good. we are seeing a lot of surpluses across the board. really doing well from october until now with all of this rain we've been getting and there

saga took a dramatic twist this week when classified papers were found in two locations used by then vice president joe biden. republicans demanded the same treatment of biden that has been applied to former p democrats claim the two situations are not the same. nbc bay area political analyst larry gerston joins us now. break this all down for us. >> a lot to chew on here. there really is. this all starts november 2nd then again december 20th. the president's lawyers found classified documents in the university of pennsylvania office think tank in d.c. and then some in his garage and actually a couple days ago some in his office at home. the deal here is we're not supposed to have these things. these documents formerly when he was vice president belonged in the national archives. some of them are really sensitive. because of that, you know, they should not be out in the public. so we've got issues here.
7:49 am
it is the same thing that happened before. it happened now to president biden. it is not current. it's from the past. >> biden's critics argue the extent trump is guilty of accusing his power biden is as well. what do you make of that? hat is one way of looking at it. i think we have to dig a little deeper here. there are differences to report and understand. one has to do with the numbers. biden we're talking about 10, 15 documents now. a lot different than the 300 plus that came from former president trump. the condition, the conditions are in biden's case locked in an office, his pennsylvania office, locked in his garage. so in trump's were open, on the floor strewn for anybody to see. then i think the critical thing most of all is behavior. biden has gone right to the national archives and said here they are. i don't know how they got there. they don't belong here. please take them. trump said these are mine. you can't have them. i don't want you to have them.
7:50 am
there is a big fight to get these things. there are pretty critical differences. both are wrong but there are big differences. >> when we're talking about the differences we're also looking at the transparency of all of this. you know, president biden has been accused of not being transparent. do you agree? >> this is the classic yes and no answer. yes he was transparent. he was transparent in the sense that his lawyers went right away to the national archives. here they are. please. take them. okay? yeah. that is transparent. knowing he has not been transparent with the public. that is where the president is in some trouble. the first one, november 2nd, days before the election a little suspicious it is not public. what took them so long to make it public and that is where he has not been transparent and people have a reason i think to be upset about that, his behavior. >> a lot of people are talking about the timing of this. what happens next?
7:51 am
>> well, we've got of course a special counsel to look this through just like with trump. here is the thing with the special counsels. sometimes they take a long time, months, years to go through everything. it starts with one little thing. they have to go through all the rest. we just don't know how long it is going to take. the longer it drags on, the longer it is going to be, you know, a black eye for the president. >> thank you for breaking it all down and telling us the importance of all of this. something we are definitely keeping an eye on. >> good to be here. >> next a quick look at the top stories including more rain on the way. we are tracking the storm and road conditions with another storm moving through the area. we are tracking the rain for you. sunday not completely ruined but we are tracking more heavy rain overnight into monday morning's commute. we have an extended outlook to when we ca n
