wednesday morning. thanks for starting your day with us. i'm laura garcia. >> and i'm marcus washington. first we're going to get a look at that forecast, tracking that incoming rain, kari. it's coming back. it's coming back and we'll see it later on this evening. if you're heading out most likely you'll be home before all of that rain comes through as we get a live look outside in san jose it is a mostly clear but also very chilly start. and then we'll start to see more clouds moving in. here we are at 5:30. we start to see the rain moving into parts of the north bay. it does get heavier as we go to after sunset, the hours late in the evening. and then at 9:30 it's really picking up and approaching san francisco. and then at 10:00 to 11:00 it's moving into the south bay. by about 1:00 to 2:00 in the morning we're seeing the last of it moving on out. now this will bring us about a quarter to possibly a half inch of rain and then we're back to

the dry weather for a longer period of time. we're going to talk more about this and what to expect. mike, you said crews are working hard. i can see them here working on the golden gate bridge. many parts of the bay returning to some as kari showed you, that rain traveling through, traveling across both directions of the golden gate bridge moving nicely. north of there, highway 37 still your right lane westbound coming in the commute direction out of vallejo into novato we still have that right lane closed from atherton to highway 101. yesterday we saw slowing -- in fact, yesterday morning from about 7:30 to about 9:30 we saw the entire bay with a typical build. more than perhaps months. looking over here we don't see this traffic flowing on 84 that is still closed through the niles canyon area, but we do have restoration of the ace train service since the long wait alongside those tracks for

ace. looking at north 680 where that crew is back, details of flashing lights and that should clear by 5:00 but they haven't been able to do that work for quite some time. your alternate is 84 and into the city streets, cutting back over on 580. back to you. this morning ace train is resuming its regular schedule after a mudslide hit a train in sunol. the train was headed to fremont. a tree fell near the train along with a lot of mud. fortunately no one was hurt. more than 200 passengers were stranded for hours. one of the passengers described what happened. >> we are going through niles canyon, it was reduced speed, we hit a bump and the train jittered and came to a spot and they said we hit a tree. a bun of dirt came down with it. >> passengers were moved into

the eyes of the world are turning to the bay area, a trial under way with billions of dollars at stake. >> the defendant is elon musk and his tweets, whether they promoted stock that fooled investors. to scott budman for more. >> reporter: musk is on trial not so much because of something he said about tesla's stock but specifically because of something he tweeted about tesla stock and that's what makes this trial unique. the tweet saying he's considering taking tesla private at $420 a share, funding secured, sending tesla stock flying as investors jumped in. >> this is just straight up simple stock price manipulation by elon musk. >> reporter: then the deal fizzled and tesla stock fell. investors say they were taken for a ride.
4:37 am
>> it's more than making a public statement. it's a really loudly amplified statement. >> reporter: one potentially seen by tens of millions of people, some of whom are now suing saying musk owes them money. also on trial, musk's use of twitter. >> how much of musk's own personality, personal history, and style of management and company owner, we're going to be able to discover throughout this trial. >> reporter: and whether or not those who control vast sums of investor money should be firing off tweets that make that money move. >> nothing as much about stock manipulation but restraint and how we all need it when it comes to social media and people in positions like elon musk need it even more. >> reporter: so far on day one, jury selection. scott budman, "today in the

wednesday morning here we are. take a live look out at san francisco this morning, nice and clear now but the rain. it was nice to see the sunshine yesterday, rain coming back tonight. we're not going to have to deal with it if you are with us this morning. we are dealing with this. it is very cold in the upper 30s. napa 37 degrees. a little bit more chilly in the south county with morgan hill right now at 36 degrees. and we're mostly clear right now. we'll start to see more clouds moving in as we head into today. so even though we're right now at 38 as we go into the late
4:47 am
morning hours into the upper 40s and low 50s making up to 57 degrees today. oakland reaching 55 and 55 in san francisco, 53 in santa rosa and along the coastline we do still have the coastal flood advisory and the waves are at about 12 feet for some parts like half moon bay down to santa cruz, but we're also seeing the coastal flooding due to run-off, so even low-lying areas still dealing with that. then over the next several days we'll have king tides that starts tomorrow morning, and this happens when we get the sun at its closest point to the earth and the gravitational pull of the moon is also going to pull those waves up higher, make that water come farther inland. but we also have extremely low tides during the afternoon hours but we do see the coastal flooding and the high tides come in by late morning, so expect

that. we'll see one more system coming through. we can see the rain enter into the far western corner of california. the atmospheric river takes a dive to the south away from baja, california. as we go into this evening, we're getting ready for this quick round of rain coming in. it will be racing through and reinforcing the cold air once it moves out of here but it does bring in for most of us some rain between 6:00 to about midnight across the bay area. and then we're back to the clouds and eventually it will clear up. but looking at how much rain we could see, most of us will see about a tenth to a quarter inch of rain, maybe higher further to the north in ukiah. once that clears out, it is dry and we have the longest period of dry weather this year. and, i know, it's only the middle of the month and we're going to see more of that dry weather extending into next week. so we're going to see the

scattered rain moving in this afternoon. tomorrow it starts out chilly. below freezing heading into the week. if you have sensitive plants, taking care of animals that are outside as well. it's going to be cold not only for tomorrow morning but also into early next week. and, mike, you're still seeing some of those storm related issues on the highways. what you talked about is a concern for the roadways as well, run-off. that's the reason we had a problem for highway 84 that continues. oakland closed again. issues with ace train from the road. so we do have that going on still with more rain coming in this evening we'll continue to watch that. and over here, 92. not 84 through niles but 92 across through the san mateo hills still restricted traffic flow. you can't use the westbound lanes. that sinkhole is still there. we don't know when they will be able to fix that, repair that

4:52 am
>> if it was an accident why not come forward and say this is what happened? >> reporter: what exactly happened? he says the answer to that question is the closure he needs because he's already lost so much. >> everything, my son is my world, my best friendship now he's no longer here. it hurts to the bone. >> reporter: we did speak with chp. they tell us his injuries were consistent with being hit by a car but couldn't provide further information as the case is under investigation. they are searching for a vehicle they believe hit lazenby. if you have any information you are urged to call chp. audrey asistio, "today in the bay." well, this morning dozens of dogs are safe thanks to martinez firefighters for helping them get out of this home. yesterday morning fire crews arrived at the house fire to find 70 pomeranians inside that home.
