coming days. that is when they will supply more of what they will say is the evidence that led them to try to make this prosecution and bring hannah gutierrez reed but alec baldwin before a jury to determine whether they are criminal liability for the shooting in the killing of halyna hutchins. i want to let you listen to a little bit from a new interview that our correspondent miguel almaguer just completed with the special prosecutor on this case. andrea reed. because alec baldwin was more than actor here. is what prosecutors are saying in terms of his involvement. he was also a producer on this movie set here which goes to the question of everything leading up to that the actual day of the shooting and to what extent was their proper gun safety and proper protocols being followed. take a listen to the special prosecutor. >> he is a producer and he's on the set and seeing everything that is happening and you knows

that the things are happening, the misfires on set, the way the gun was handed to him, he's experienced and he understands what the proper protocol is for safety. and he was just disregarding that. >> reporter: and then this is where it is ultimately going to come down to a jury. serious charges here and clearly the special prosecutor and the district attorney will willing to bring them forward and take on alec baldwin and hannah gutierrez reed and make the case that they should be criminally liability for what happened to hutchins. >> vaughn, thank you. danny, let me bring you in here. baldwin's attorney said this decision distorts helena hutchin's tragic dem and representing a miscarriage of justice. we will fight these charges and we will win. you could help us understand where the charges are coming from. what is the thought process of the d.a. >> most of your homicide charges are out because anything requiring intentional shooting

of another person is not going to count here. nobody thinks alec baldwin intended to shoot the victim. so, you know you're in the zone of involuntary manslaughter. it was no surprise today that it was the charge. but if you look at new mexico statute, they need to prove criminal negligence, which is recklessness, a awareness and that he used the firearm and it was ordinary negligence which is just a violation of a standard. but i might argue and there are a few different arguments to this, that the firearm was not a firearm. in other words, alec baldwin was handed something that he didn't believe was a firearm. >> a prop. >> that is one of several defenses that i think he has. >> danny, thank you. appreciate it. millions of people are under threat of severe weather this hour. a storm that has dumped snow is making its way east right now. dangerous conditions led to a disruptive 21-car pile-up on

interstate 70 in colorado. parts of that interstate are still closed today and dozens of semi-trucks are still backed up as crews try to clear the roads. and in the south this is what remains of waldo, arkansas, after a possible tornado touch down there. winds up to 100 miles an hour ripped trees and power lines right out of the ground. let's bring in meteorologist angie lassman and correspondent shaquille brewster as well. shaq, we'll start with you there in wisconsin today. how are things looking right now where you are? >> well we're getting some lingering precipitation, snow and rain at times but this is the bulk of the precipitation that we've been seeing came in the overnight hours and ahead of the morning rush. and that is what led to some of the delays and cancellations here in the green bay area. but this is something that folks here are urzed to. it is winter time, they could expect up to three inches of snow. what we saw in the denver, colorado area, and there you saw the pictures of the massive

pile-up. 21-car pile-up. some drivers stranded overnight. and in nebraska, some areas dealing with up to two feet of snow and not only is there that snow concern but also the severe storm concern as well. and arkansas there was that tornado confirmed yesterday. wind speeds up to 100 miles an hour. this storm is massive and heading aeft now. fortunately we're on the back of it so things are starting to get better. >> and angie, let's go to you now. what are watching out for as these storms keep moving? >> yeah, so shaq mentioned it, there is still a severe threat today. that is the most impactful thing that i want people to hold on to as we get through the afternoon hours. still a lot of impacts with the snow in the northern parts of michigan and wisconsin and rain in chicago and washington, d.c. and into new york and boston where there is cold rain falling. but let's pinpoint the severe thunderstorm watch in effect for parts of indiana, kentucky and

ohio here. including places like columbus, cincinnati, we see the rain working in. but we do have that potential to see some strong storms with this. so wind gusts up to 60, as high as 80 miles per hour. so we could see downed trees and power lined and a brief tornado and damaging hail and this goes through the afternoon hours. 17 million people still impacted and as shaq mentioned, this will continue to move east. as so we go through the rest of the day today, that cold rain that is falling from buffalo to washington, d.c. and into new york, will eventually transition over to snow for parts of the northeast as we get into tomorrow. we'll still be dealing with the lingering snow showers in places like maine, guys. >> angie lassman for us. shaq brewster in wisconsin, thank you both. well president biden is in california to tour the damage there from nearly three weeks of destructive severe weather. a staggering ten storms rocked that state since christmas. at least 22 people died as a result of that severe weather. the recovery process now really

getting underway. estimates of the cost to rebuild are in the billions with a "b." let' bring in gadi schwartz in capitola, california, south of san jose. when you talk to folks out there, what are they looking for from the president? what kind of help would they like? >> reporter: well here in capitola, it is a rebuilding some of the infrastructure that was lost. and so whether that is fema and federal assistance or whether it comes from california, is still yet to be seen. let me show you some of the damage. this is the capitola pier and if you look further down, half of that peer right in the middle is missing. that is cut off some businesses at the far end of the pier. there is a restaurant and bait and tackle shop and those are not accessible by the people that come here. it is a big tourist draw for this whole area. and if we pull back out, what we understand is during some of the storms, part of this pier ras ripped apart and then it made its way, the waves were pushing

into the building behinds me. so this is where we expect the president to be visited with the fema and the governor of california. but i go the to say, when people go through this again and again, the first time it is like, we have to rebuild. the second time it is how do we harden california to be able to prevent this type of damage in the future. so that is something that they'll be talking about later today. back to you. >> gaudy, thank you. the treasury department is now taking, quote, extraordinary measures to pay its bills. that move comes after the u.s. officially hit the debt limit this morning. now it is up to congress to raise that limit. house republicans want spending cuts as part of a deal. but the white house said that is not an option. >> we need to keep that economic progress going and not have the spector of doing something unthinkable. of defaulting or the united states not honoring obligations get in the way of this economic progress. >> nbc news business and data reporter brian chung joins us

now. so brian, let's start with the beginning here at the beginning, i should say. explain to us what the debt limit is. >> it has enormous consequences. it is a cap on how much the government could borrow to pay its bills and there is a lot borrowing. $31 trillion is how much the u.s. government has in debt. now, exceeding the limit puts the united states at aisk of default and we exceeded the limit as of today. so what does that mean? does t haphans right now? no. and the reason why is because the treasury said it has extraordinary measures that they could use to get through early june, to keep the lights on for the government. it is things like tapping into certain funds, not reinvesting and allowing us to not to go into default. congress has helped us avoid a default in this we can't pay our bills 78 times since 1960. we have never defaulted before. let's hope that this number could go up to 79 times this

time around. >> well. >> brian, june 5th is the dead ryan to take action. help regular folks understand why we should care about this. >> that june 5th date is so important, because after that time, that is just an estimate. but after that time, government could be at risk of having to dep pleat funds that would have been used for say example, social security payments and food stamp programs and medicare, veterans disability, those are all things that could potentially be at risk if they cannot resolve the debt ceiling. but again, has it happened before and we avoid that 78 times so hopefully congress feels that pressure to resolve this before we reach that deadline of june 5th. >> brian chung for us today, thank you. good explainer. the new ceo of ftx is considering restarting the crypto exchange and uber is teaming up with automakers. >> contessa brewer joins us now.

police in ohio have released body cam footage involving an officer who had an altercation with a woman outside of a mcdonald in dayton. now this incident is said to have started over missing cheese on a big mac. lawyers for the victim saying that the situation escalated to a point where a butler township police officer punched their client several times in the face. nbc news reporter miap eagle is following the story. so walk us through how that all started. >> latina hancock ordered a burger and when she realized it was incorrect she went back into the restaurant to complain. the employees confronted her the

parking lot and the officers did not properly de-escalate the situation and instead assaulted hancock leaving her with several injuries. >> sergeant stanley deserves to be fired and charged with assault for his outrageous overreaction. the way he handled miss hancock was despicable. he wasn't human to here. >> a lot of frustration as this unfolds. >> so what are police saying about this altercation. >> police are investigating the incident and they have placed the officer involved on leave but they are not discussing this case with the media until all of the videos are processed and reviewed and the naacp has stepped in and is also asking for the officers' involves to step down and be charged. >> and do we know how hancock is doing. how is her recovery going. >> to according to her lawyer,

she spent the night in a hospital after the altercation and she suffered from an internal head injury and a busted lip and loose teeth after the incident. she has been released from the hospital and is still limping and has a back injury. >> i almost lost my life. the reason why i said i'm going to be quiet now. i'm going to stand up. i'm not going to be george floyd. they're not going to get my on the ground. they're not going to attack me. >> so we'll be keep an eye on all of these developments. >> mia, thank you. there is a concerning trend in massachusetts, there are active searches for four missing women right now. the most high-profile case of course involved ana walshe. her husband is now facing murder charges. but advocates are concerns that other similar incidents aren't getting aenough attention. >> police expanded their search in a small massachusetts town looking for any sign of brittany tee, last seen a week ago, her family more distraught every

day. >> she would not just -- >> it is just so out of the norm for her and that is what scares us. i just don't know. >> reporter: tee's family isn't alone. she was one of four women who have disappeared in massachusetts since thanksgiving. renna morales, anyone 41, and a mother of two last seen getting into a vehicle november 26th in a suburb of boston. lori baxter, 45, last seen december 28th. and ana walshe whose husband has now been charged with her murder. >> i was stunned to see so many women go missing in massachusetts alone. in such a short period of time. i've been doing this work for a long time and it is just unprecedented to see these numbers. >> windy murphy runs a center for women and children. a quarter of a million women and girls are reported missing each year according to fbi data. but most of them get very little attention. if any at all. >> let's talk about the other

women as well. because the marginalized women, of lower socioeconomic status, the women of color, they disappear at higher rates than wealthy white women. >> like morales who two children are in el salvador. the station spoke with her sister who said she communicated with them every day until the day she went missing. in the case of brittany tee, she was reported missing two days after she wasn't found. >> this is a crime scene right now. we're looking at a missing person but obviously we're open to wherever the tips take us. >> call if you have any information. >> and ron allen joins me now. it begs the question, are police considering the possibility that these cases might be related? >> the big concern is that they are all cases involving women and advocates are concerned that many of these cases, as you well

the bay area. this is video of air force one at moffett field where president biden landed just about a half hour ago. governor newsom, senator alex padilla and representatives jimmy panetta and anna eschu all met him on the tarmac. the president quickly got on marine one and is taking a tour of all of the damage from storms. what they will be is heartbreaking. flooded businesses, the pier in capitola broken in two, damage to the uss palo alto. the capitola wharf is expected to be out of commission at least a year and some of the $100 million in damage to the infrastructure. president biden is expected to speak around 2:00 p.m. when that happens, we will bring that to you live on air as well as online at nbc bay area.com. happening now in the east bay, a different type of storm cleanup. this one cleaning up a popular shoreline that's been impacted

by weeks of rain. >> reporter: we're here in oakland for a different type of storm cleanup as a number of volunteers chip in their time to clean up the debris and trash left behind here in oakland from the storms. i did speak with an east bay regional park spokesperson who said with all the heavy rainfall we've seen over the past few weeks that the watershed, the creeks, all of them are washing out garbage into this estuary. as that garbage washes into the bay, you have the tide pushing it back here to the shoreline so there's a lot of cleanup ahead. volunteers felt it was important to chip in this morning to clean up as much as they can. roughly a dozen volunteers chipped in today but there will be more cleanups, including this saturday and right now they tell me they are looking for more volunteers. >> thank you, pete. here's some other stories you need to know about at this hour. police have now arrested the man

who was seen in a viral video spraying an unhoused person in the face with a power hose. and a chase ends with a car plunging off a hillside in san francisco, but first a 3.8 magnitude earthquake shook near san juan batista. no reports of any damage so far. the shaking happened just before 9:30 this morning. the quake struck about seven miles just outside of hollister. a police chase ends in a car plunging off a hillside in san francisco. this is new video of the aftermath. you can see the car ended up on its side on top of a parked car. this is in the twin peaks area. according to our photographer at the scene, the chase wound through the city a little before midnight. the suspect was taken to the hospital. their condition is unknown but police are saying the suspect was already wanted for dui and possible burglaries. san francisco gallery owner

71-year-old faces a charge of misdemeanor battery. the district attorney announced charges and his arrest yesterday. many are divided over the district attorney's decision. homeless advocates think the charge should have come sooner. the district attorney called it unacceptable and in a statement said the vandalism at the gallery is also completely unacceptable and must stop. two wrongs don't make a right. the rain is out of the bay area for now but we'll be dealing with some frigid temperatures without the cloud cover. let's go to meteorologist kari hall with your forecast. >> the last little bit of rain is moving well away from the bay area into southern california, but we are left with cold temperatures behind that front and we'll only reach into the low 50s for today. up to 50 in dublin and livermore, but 57 in santa rosa and san jose. we'll see a high of about 53 degrees. now look at these temperatures for the overnight and starting out the day on friday.

bottom of the hour now, here are some of the stories making headlines. >> a san francisco art gallery owner has been arrested after a video showing him spraying a homeless woman with a hose went viral. the 71-year-old was charged with misdemeanor battery and he faced up to six months in prison and a $2,000 fine. he apologized calling his actionsin defensible. >> attorneys for the former texas police officer found guilty in the 2019 death of atatiana jefferson are requesting a new trial. aaron dean shot the black woman in her home and was convicted of

manslaughter last year. well now dean's legal team said that the verdict is, quote, contradictory to the law and evidence, they are requesting that he be released on bond. protesters in france taking to the streets over a proposal to raise the country's retirement age to 64. the current anyone of retirement is 62. nationwide strikes have disrupted transportation and public service and schools. the french president has said the country will move ahead with the changes. we're getting new details about the evidence in the murders of four clench students in idaho. newly unsealed court documents list some of the items that investigators seized when they searched the suspect's apartment in washington. among those items, a stained pillow and a disposable glove. nbc news correspondent aaron mclaughlin is joining us now. aaron, what more are we learning from the documents? >> reporter: hey, there, kate, well authorities seizing a number of items from 28-year-old

bryan kohberger's apartment including as you mentioned a pillow with reddish-brown strain and a mattress cover and a dark red spot. now according to authorities, those items have -- are now going tor testing. the particular court documents that have been released not including the results of that testing, authorities according to the documents also found a disposable black glove as well as strands of hair. including a strand of animal hair which is potentially significant because one of the victims had a dog that was inside of the home at the time of the murder. now in addition to bryan kohberger's aapartment, they also searched his office at washington state university, although these court documents did not disclose the outcomes of that particular search. >> erin, thank you. there are growing questions over a california lawyer who died while celebrating his

wedding anniversary in mexico. mexican authorities say 33-year-old elliott blair fell from his third floor hotel room but his family thinking that he was a victim of a brutal crime. kristen dahlgren is following that story and joins us now. elliott blair's family and law enforcement seem to be at odds. what are we learning about the investigation into his death? >> reporter: yeah, absolutely. aaron, you have this 33-year-old public defender from orange county, his family said that he wasn't intoxicate and he had been at that resort before so he knew the layout. they're not buying into this idea. what officials were saying it was a fall from a third floor walkway. that resulted in his death. his friends also suspicious, here is what one of them had to say. >> when i heard that the authorities were strongly recommending that they cremate elliott's remains, i mean that

sets up all kinds of red flags. his body will have injuries that some pathologist will be able to determine a reasonable cause of death hopefully. >> reporter: and that what his family would like. they're calling for their own investigation. so still a lot of questions about this investigation. >> thank you. the search continues for a british actor julian sands. the 65-year-old actor has been missing after going for a hike on mt. baldy in southern california. he has appeared in over 150 films an tv shows including warlock and arack gnaw phobia. joining us now is cory coughlin. crews are trying to find him. >> search and rescue began looking for him last friday night. but they did have to pause the search on saturday because of trail conditions and increased

risk of avalanche. today both ground and area patrols are continuing the search but the local sheriff's department has warned that conditions are still dangerous and that people should avoid the area. >> we strongly urge the community to just stay out of that area because even the most skilled hiker like mr. sands will find themselves in trouble just because it is just too icy and the weather plays a big factor on whether or not we could deploy resources to the area. >> reporter: now heavy rain and snow has been causing problem in the san gabriel mountains where this happened. he is one of two hikers that crews are searching for. the other one is a 61-year-old man reported missing last friday. over the past four weeks, search and rescue crews have launched 14 missions for hikers in the area. two have died after falling and injuring themselves, kate. >> and we heard that he was an avid hiker. but this wasn't his first

dangerous trek, right? >> yes. sand he was known to be an avid hiker. in an interview with the guardian a couple of years ago he said he feels happiest when he's close to a mountain summit. he talks about hiking when you could lose yourself and connect with environment. he has hiked across north america and europe as you say, he's been in dangerous situations before. in the early 1990s in fact, he was caught in a storm at high altitude in the andes and he said that nearby hikers perished and he was lucky to make it out alive. fans are hoping years of experience will help sands as he finds his way home. >> let's hop. thank you. we're following break news out of the capitol. the supreme court has released findings of an investigation into what the court calls one of the worst breaches of trust in its history. we're talking about the leaked draft decision to over turn roe v. wade. investigators say they can't

figure out the person who leaked that draft opinion to news outlets politico. p correspondent kelly o'donnell also covers the supreme court and joins us now. what are the top line findings here. >> reporter: well it is a whodonit and that is a big surprise in some ways because they've had months to investigate and this is a situation where the supreme court, who said this is a deep betrayal of the judicial process and the court itself by having that leaked draft opinion go public back in may. weeks before the ultimate decision of the court overturned the right to the constitutional right to an abortion in the united states. and the court unanimously asked the u.s. marshals to conduct an investigation. they interviewed about 100 employees of the court. they did some forensic work including analyzing fingerprints, doing checks of equipment like printers and doing analysis of the digital copy of the draft opinion that was ultimately published.

and all of that review was then submitted to an outside group, the chertoff group, led my michael dhertoff who was the secretary of homeland security. and the outcome is they have some evidence but none of it rises to a point where there could be a preponderance of the evidence. 51% suggest that there is a finding that they know who is responsible. they also indicate that they found no evidence of an outside hack into the court and so they leave open the door that there could have been an inadvertent leak, meaning someone might have left a hard copy of the draft opinion somewhere or it could have been intentional. but they don't know who that is. at the same time, they leave open the door to ongoing investigations. but this may be very disappointing to people who believe that this incident was a real breach of the court, not only of security but of trust in the court as well. they talk about the fact that after all of this scrutiny, they

looked at all of the people who would have had access to these highly sensitive documents, those who work in the chambers of each of the justices and so forth, and they've done that careful scrutiny, review and they just don't have an answer for us. aaron. >> kelly o'donnell in our d.c. bureau today, thank you. and there is more controversy surrounding george santos. he's already admitted and apologized for embellishing his background including his job and his education. well now he's facing questions about claims he made during his campaign that his mother was a 9/11 survivor. and about his time in brazil where he reportedly performed as a drag queen. i want to bring in nbc news capitol hill correspondent ryan nobles with us now. your team spoke with a navy veteran who accused santos of pocketing money from his dying dog's gofundme campaign. we heard this yesterday. is there any response from the congressman? >> yeah, the congressman is responding to these allegations,

kate. not with any degrees of specificity. but this story from this disabled navy veteran who was homeless at the time, had a therapy dog who he absolutely loved, considered a member of his family and was in desperate need of cancer treatment for the dog and had reached out to santos through a charity asking for help. santos had launch the that gofundme and raised $3,000 and but he never saw the money. listen to what he told us yesterday. >> i was so live ird that i realized that this guy is now a serving congressman. he doesn't deserve that job. it's hor end usa that he could lie and steal and cheat his way through life and now he's somebody that we're supposed to trust. it is disgusting. it is horrible. he should be ashamed of himself but he doesn't have shame. he's a psychopath. >> reporter: and santos tweeted a response to this interview and the claims. he only said that it was shocking and insane. didn't mention anything about the money or where the money went or where the gofundme

account or denied that he was involved. so just another in this long list of accusations against george santos who is now a sitting congressman. >> speaking of a long list. i have to ask about the new reporting about brazil as a teenager. what is the situation with that? >> yeah, so our team at nbc spoke with a drag queen in brazil who described herself as the mentor of george santos and his short-lived career as a performer, a drag queen in brazil. she has pictures that were of santos performing at time. he has not denied but he is denying this. in a tweet he said, that this is an obsession by the media claiming that he was a drag queen. said that it is categorically false. there is nothing wrong with being a drag queen. but santos is someone who is opposed laws in support of the lgbtq community or laws that lgbtq members feel would violate their rights.

and, so, this is just another inconsistencies in his background that just you could add to the list. kate. >> ryan nobles reporting, thank you. turning now to an nbc news exclusive. according to three department of homeland security officials, the agency is investigating whether dozens children found cleaning slaughterhouses in the midwest were the victims of human trafficking. nbc news homeland security correspondent julia ainsley is joining us now. what could you tell us about the investigation here? who exactly are the feds looking into and what started all of this? >> so, dhs has been interviewing the children. it is an ongoing investigation and in coordination with department of labor. after they found that 50 children, at least 50 minors between the ages of 13 and 17 were working the graveyard shift to clean the kill floors in slaughterhouses. this new information is that now the feds are asking questions about whether or not these children may have been trafficked. there are no indications that the company itself would have

container. >> the good news is the power of the pathogens is greatly diminished after they've been on a surface. but put them no hot soapy water or wipe them down with a wipe. it is just to put them on your radar, remember you touched this. >> you talk about watching things. what about the kitchen sink. where are the nastiness hiding in the sink. >> you think about the sink and the faucet and it was the soap dispenser because your hands are the dirtiest. two solutions, there are cheap automatic soap dispensers you just have to ink cha the battery so you don't have to touch the battery at all and give it a wash when your washing your hands. the recommendation is to clean your sink every night with hot soapy water and use one to two tablespoons of bleach and a gallon of water and don't forget about the handle. >> what about dish towels. i hear that made the list. >> i don't think you should change it out every night. >> that is a lot of laundry.

>> i don't have dish towels. i have paper towels. >> that is okay. it is wasteful and it is costly. >> it is more cleanly. >> it is fine. we've all been using dish towels and we're still here and we're alive. but make sure your items dry out overnight and replace them frequently and separation is helpful. have a different towel for cleaning your hands than your counters. >> i'm also a batch that doesn't cook. so very little usage in my kitchen. >> my mom does that separate towels for separate things and when she comes to my house, which ones are for which. she doesn't sound like that. sorry. >> there is another thing on the list. cutting boards. >> whether it is a wooden or a plastic cutting board, every time your knife hits that board it creates groove or bacteria. and so watch it with soap and water and then toss it in the dishwasher. that is hard to do with wood. but you just want to make sure it dries completely before you put it away.

touring storm damage south of the bay area. we want to show you video. the president landed around 11:45 this morning at moffett field. governor newsom, senator alex padilla, jimmy panetta and anna eschu met him on the tarmac. he got on marine 1 taking a tour of the damage. the president just landed in watsonville about ten minutes ago. the team will drive down to capitola where the president will speak with business owners and residents. president biden has already declared it a federal disaster area and is expected to announce more federal help for storm victims. we are tracking cold temperatures as the rain moves out of the bay area. here's meteorologist kari hall with your extended forecast. >> nothing but sunshine throughout the next seven days, but we are going to have a very big chill here that's not going
