a messy morning commute. more is on the way. >> could affect the travel today. plus, two big stories out of washington today. president biden breaking his silence over those classified documents and there are new questions after a lengthy investigation to identify who leaked a draft of the supreme court's abortion ruling overturning roe v. wade. we will have the latest. first, where things stand for alec baldwin. in the coming days, formal charges of involuntary manslaughter will be filed against the actor and the film's armorer over the shooting death of a cinematographer, halyna hutchins. >> we will break it down for you. starting with nbc national correspondent miguel almaguer. miguel, good morning to you. >> reporter: by the end of this month, alec baldwin and hannah gutierrez-reed are expected to be charged here in new mexico. they don't need to be here in santa fe. they could do that via video conference but they do face very serious charges that could mean

6 1/2 years in prison. >> i was the one holding the gun, yeah. >> rep rorter: fro mm actor pr r to high-profile defendant, this morning alec baldwin facing involuntary manslaughter along with a firearms charge for his role in the death of cinematographer halyna hutchins. >> he is facing charges because of both. as the actor that pulled the trigger, that's a compelling fact, but he is also facing charges as a producer because he should have known that the conditions on that set were unsafe. >> reporter: confident they can convict, prosecutors say they never believed baldwin's statement he didn't pull the trigger. >> i let go of the hammer of the gun and the gun goes off. i didn't pull the trigger. >> he said he never pulled the trigger on the handgun that fired. do you believe that? >> that's not true. and we know that from the fbi lab report. that gun would not have fired without the trigger having been pulled. we have videos of him where his hand was on the trigger. >> reporter: prosecutors also argue that baldwin had a duty to properly check the gun before using it, but baldwin's attorney

who called the decision a terrible miscarriage of justice said that baldwin relied on the professionals with whom he worked, who assured him the gun did not have live rounds. the lawyer for matthew hutchins, the victim's widower, supporting the decision to charge, writing, no one is above the law. last year hutchins with hoda. >> so do you think that the majority of the blame lays on alec baldwin? >> the idea that the person holding the gun causing it to discharge is not responsible is absurd to me. >> do you think someone should go to prison over all of the evidence you have reviewed? >> prison is not necessarily the goal. what i want is justice for halyna hutchins. >> reporter: after sorting through body camera footage, police interviews and forensic testing of the gun, the d.a. is also charging "rust" armorer hannah gutierrez-reed with involuntary manslaughter. it was her job to ensure gun

safety and to check all the bullets on set were harmless dummy rounds. >> so there is live rounds all over the set and an accident was going to happen and she should have or somebody should have noticed that at some point. >> reporter: but gutierrez-reed's attorneys call the charges the result of a very flawed investigation. meantime, a third crew member, assistant director dave halls, cut a deal with the prosecution, pleading no contest to negligent use of a deadly weapon. his attorney arguing he wasn't directly responsible for what happened. >> dave did not hand the gun to alec baldwin. >> reporter: this morning, 15 months after a deadly and tragic accident, the district attorney says 3 people who should have prevented the shooting will now all face justice. today we still don't have the answer to the critical question, how did live rounds end up on set. the d.a. says we may never have that answer.

as for the movie "rust" it is set to resume filming in january with matthew hutchins as an expect i have producer. with the charges the future remains unclear. savannah? that brings us to laura jarrett. i mean, we talked about this case. were you surprised to see the d.a. here actually charge alec baldwin, the actor? >> 100%. the prosecutors have a pretty stiff hill to climb here. part of the reason is there is not only factual disputes, but there is real legal issues here. the prosecutors whole theory is essentially that alec baldwin as an actor and producer had a duty, had a burden to check the gun in connection with the armorer and make sure there were not live rounds on the set. it was not enough for him it rely being told there were not live rounds. he says he didn't know there were live rounds. he says he didn't pull the trigger. her theory is he had an obligation to check and he failed to do it.

>> what about that interview? it struck me he said in an interview he did, i pulled the hammer back but not the trigger. >> it's a factual dispute. the prosecutor says we have evidence that he did pull the trigger. she says she doesn't believe him. they have the fbi report to look into it. she believes she can bolster that in court. for alec baldwin you would almost think it doesn't matter because if he believes that there isn't a live round in there, if he pulled the trigger or not, shouldn't matter. to have him on camera say that, if she can show that's a lie, that's a problem in front of the jury. >> for folks who aren't watching court tv all day long, this is a criminal negligence case. no one is saying this wasn't an accident. no one is saying anyone did this intentionally. the argument here is that it is negligence that is so severe it amounts to recklessness. it's criminal negligence. >> the best way to think about it is extreme carelessness. right? think about somebody who is texting while driving and as a part of looking down hits somebody and kills that person. no one thinks that's intentional.

nobody thinks that you wanted to, but you should have been on notice that what you were doing was reckless. that's the type of case they are trying to build here. her theory is that he was required to look at the gun, even though he says he was told he didn't think there were live rounds in there. >> let's talk about this third individual, dave halls. he's assistant director. he cut a deal. got a plea deal and is expected to testify. how important is that? >> it's key. the prosecutor says she will have him testify about the atmospherics on the set. the prosecutor's whole theory is that it was sloppy and everybody knew that there were shortcomings when it came to safety and that could go to baldwin's culpability. if dave halls can say that. >> potential witnesses who may say we did see the trigger pulled. potential video. evidence if it is there. alluded to. so lots to get to here. it will be a fascinating case. thank you. president biden arrives back in the nation's capital overnight after touring storm damage in california.

while he was there, he broke days of silence about the classified documents controversy that surrounds him. nbc's chief white house correspondent kristen welker joins us now. >> reporter: the fact that president biden is speaking out highlights his level of concern that this controversy is overshadowing his presidency. this happened while he was visiting storm ravaged california yesterday, the president making his first public comment since a special counsel was appointed to investigate his handling of classified material from the obama administration. to remind everyone, the president's attorneys found those classified documents at his private office right here in d.c. and his wilmington home. here's what he had to say. take a listen. >> we found a handful of documents were failed -- filed in the wrong place. we immediately turned them over to the archives and the justice department. we are fully cooperating. looking forward to getting this resolved quickly. i think you are going to find

there is nothing there. >> reporter: the president adding he has no regrets. in response to scrutiny over leaving key questions unanswered the white house insists they are trying not to say anything that might complicate the doj investigation. sources familiar with the matter tell nbc news the investigation will not affect the president's potential re-election plans, and that is looming over all of this. that could come after thinks state of the union address next month. >> all right. major news in that supreme court investigation that was looking into that unprecedented leak of a draft opinion overturning the roe v. wade abortion decision. what was found? >> reporter: this is stunning. after an eight-month internal investigation, not a whole lot was found. the supreme court revealing they still don't know who was behind that bombshell leak that overturned roe v. wade. the report did suggest it's unlikely the leak was a result of a hack, but perhaps came from the nearly 100 employees who had access to the draft opinion.

this is really interesting, as well. some of the people interviewed admitted to investigators they told their partner about the draft opinion. it's unclear whether the nine justices were interviewed. the justices called this one of the worst breaches in the trust of the court's history. investigators did recommend a couple of things. stiffer security and a smaller distribution list. >> all right. kristen welker at the white house, thank you. another big story out of washington. >> good morning to you. congressman george santos speaking out amid the growing calls for his resignation, under fire for misrepresenting his resume. yesterday santos addressed a new report that he performed in drag. nbc's senior capitol hill correspondent garrett haake has this story. garrett, good morning to you. >> good morning. congressman santos has already admitted to lying about his work history and if he went to college and he has been caught in lies about religion and other parts of his background. he's had little to say publicly

about it. now he is pushing back on latest scrutiny of his past. >> reporter: under investigation and under fire for a growing sea of scandals, new york congressman george santos taking to twitter to defend himself and to deny reports he performed in drag in brazil in the late 2000s. two brazilian sources tell nbc news this is santos, then using the drag name kitara, being interviewed at a gay pride parade in a suburb of rio de janeiro in 2007. santos, the first openly gay house republican, tweeting any claims are a, quote, media obsession and categorically false. santos also pushing back against reporting that he walked away with $3,000 raised on a gofundme to pay for surgery for a disabled veteran's service dog sapphire. that veteran telling nbc news that santos' charity set up the donation website.

but when it came time for the surgery, he says santos refused to hand over the money. he was forced to put sapphire down instead. >> it's disgusting. horrible. he should be ashamed of himself. he doesn't have shame. he is a psychopath. >> reporter: santos calling reports he would let a dog die quote shocking and sin sane. adding these allegations won't stop me. but santos faces five different investigations, some by law enforcement, that might. any criminal indictment or action by the house ethics committee could force santos off his newly assigned committees. and if santos stays in congress long enough to face voters next year, democrats say they won't be fooled again by his falsehoods. >> the election of a complete charlatan like george santos, who is almost a caricature unto himself, should be a shock and jolt to the system, a wake-up call for the democratic party in new york state. >> one of those sources in brazil who recognized and

let's begin with the 7:30 headlines. we start with frightening moments in a southern indiana walmart store. a gunman opening fire before 10:00 last night in evansville a person was wounded, later rushed to the hospital the gunman exchanged fire with police before he was shot and killed by officers so far his motive is not known also no word this morning on the condition of the victim. meanwhile, in newport news, virginia, the teacher shot alleged by a 6-year-old student has been released from the hospital abby zwerner is continuing her recovery as an outpatient for the first time we are hearing from the parents of the boy accused in the shooting the family calls it an unimaginable tragedy, offers prayers to the teacher and all of those impacted and the family goes on to say that their son suffers from, quote, an acute disability and was under a care plan at the school. wireless carrier t-mobile says an intruder breached its network in late november and stole data on 37 million customers. the breach was only discovered a

remember it, it was ten years, and i remember to this day she left it behind after i admired them once and it stays with you. >> exactly sometimes we forget the impact we have on people. when you compliment somebody about their shoes or say i like your cupcakes or dress, it improves your confidence and the likelihood they will give you a negative reaction is low and you may have made a new friend. >> a lot of times, especially if you have a friend or family member struggling with depression and anxiety, the last thing you want to do is burden them but you might be helping them if you said, hey, could you watch my kids for an hour or do you mind doing the pickup today or something. it actually might be something that is helpful to them. >> i think it's very helpful it shows them that they are needed and help goes a long way. you can start off with small practical things, even if you are somebody who you are depressed and not able to get out of bed, call somebody, send them a message, you know, leave a nice voice recording just to make their spirits feel a little bit better. >> we try to teach our kids this

because being kind to someone is great. you, obviously, were raised by someone who is kind. what are the best ways -- i know it's probably show your kids and don't tell them. what are the best ways to help our kids follow this >> i think it's important to teach your kids the importance of being kind to people whether it's holding a door open for somebody i would do that when i was a kid. my mom acted like i won the super bowl she made a big deal. and i remember that. and i try to, if i am leaving the gym, hold the door for somebody, people may have things in their hands, and that could make their day it doesn't have to be the biggest thing. having kids who are kind to other people brings the kindness back to you. >> it's funny. you read this and say, okay, if i decide to do something kind because i am trying to get something or get some feeling for myself, you know, that may not sit right with everybody

josh capon, the fly fish club co-founder the giants are playing philly. two killer sandwiches and 3 1/2 minutes. let's dive in. >> the best weekend of football of the year. >> agree. >> we may not agree on who we are rooting for. just cook some good food the cubano roast the pork shoulder. citrus, olive oil, fresh herbs, garlic, cumin and chili peppers. mix that together. then you got the pork shoulder in the bag get all that stuff in there. you want to take a knife and pierce that pork shoulder so all that marinade gets in there. in the refrigerator for two hours, hopefully, overnight. then slow roast it i am talking six hours in the oven three hours covered, three hours uncovered. literally it falls off the bone. come on! i love you guys over there
