fairfield, 50 degrees. 49 in point reyes and redwood city 45 degrees. walnut creek, here is how the day looks for you. we are going to have a cool morning with sunshine, some upper 50s, but we know it's still pretty windy out there and even at 10:00 we're still seeing some of the coastal and hill wind gusts at 30 miles an hour. and then as we go into today, gradually those winds start to calm down but still a pretty breezy and cool day. we'll talk about what's ahead in our forecast in a few minutes. mike is saying right now the commute is pretty smooth. pretty calm right now. we have a lot of issues that were caused by the rains cleared up. as kari reminds us, it's not completely gone. there's still a lot of moisture in the soil. a very good chance there may be more movement. that's why we're watching highway 84 which reopened, but we have improvement like the pavement work that continues here northbound 680. that should clear up in the next few minutes. we'll track that. highway 84, that should be ace

train re-established service. they have not yet gone through for their first run and a smooth drive through contra costa county. back to you. >> thank you, mike. stunning new details are coming to light about the deranged gunman who killed ten people during lunar new year celebrations near los angeles. authorities say he targeted a second location as well but people there were able to disarm him. >> we do have team coverage this morning and will begin with jay gray who is live near the scene of that deadly attack, jay. >> reporter: it happened in the dancehall just before me. thousands were in the streets in this neighborhood closing out the first day of an annual two-day festival to ring in the lunar new year, that celebration suddenly turning horrific and leading to heartache in this community.

the spray of gunfire cuts through a packed monterey park clubhouse. >> my young officers did their job, searched for a suspect. came back and had to deal with the carnage that was inside. it was extensive. >> reporter: ten dead, tennell ten more wounded. the suspect on the run showing up at a similar ballroom in alhambra where he's confronted by people inside the club. >> and he was disarmed by two community members who i consider to be heroes. >> reporter: as he escapes witnesses get a glimpse of his vehicle. >> they have this white cargo van completely surrounded right now. >> reporter: police tracking it down 12 hours later in torrance. inside 72-year-old huu can tran, the man police say is responsible for the killing spree, dead from what appears to

be a self-inflicted gunshot wound. according to investigators evidence inside the van ties tran to both locations. what it doesn't do is help to explain how or why it happened. and it does little to ease the concerns of this frightened, grieving community. >> having this happen now is just very shocking, very sad. because you're just confirming there's no safe place anymore. >> reporter: and a little more on the suspect and what we're finding out this morning. he apparently lived in the community of hemut, 79, 80 miles away. that's where police are searching for evidence in his home and where he apparently had reported to police that his family had been trying to poison him. that investigation is continuing. marcus, kris, back to you now. >> it will never make sense. thank you so much, jay.

our team coverage does continue with "today in the bay's" pete suratos live in san francisco. pete, what's happening now to make sure people feel safe at upcoming bay area celebrations? >> reporter: we know that sfpd plans to increase their police presence for the lunar new year events. of course still heavy on the minds of folks trying to celebrate the lunar new year over the weekend. we know san francisco mayor london breed did weigh in on this during an event early in the day holding a moment of silence to remember those victims. also, law enforcement agencies not only expressing condolences across the bay area but they are going to increase their police presence for some of these lunar new year events. the president of the oakland chinatown chamber foundation says he's hearing from many community members in the aapi community. he says they're fearful to go out and celebrate some of the new year events following this tragedy in monterey park. in fact, the message that he's telling those members of the

member rappelling down to reach the two. they posted still images. both hikers were shaken up but are not seriously injured. and the 49ers are heading to philadelphia and not for those cheese steak sandwiches. >> though they sound good. >> they are super bowl berth on the line. the niners beat the cowboys, 19-12. i home up saw the game yesterday at levi's. >> it was at levi's stadium this season, the fans went home happy. >> go niners! >> after the game the parking lot was buzzing. you can see fans jumping up and down. the cameras caught an improvised fireworks display, which is not legal. the win makes it 12 in a row for the niners and a lot of them are thinking lombardi trophy. >> i'm just a niners fan right here, faithful forever. we quest for six. we're coming home with a ring, baby.

>> i love it. next up, the niners will take on the philadelphia eagles next sunday with kickoff time noon here on the west coast so we get to watch it again. >> i love that. a live look outside. you can see one building there, look to the right of the screen. in the niners colors celebrate that go win yesterday and a celebration for this forecast, too. but, kari, you do say we need to keep in mind there are strong winds. >> pretty windy out there and it's really hard for people who are driving high-profile vehicles crossing those bridges but it is clear and we are also having some cool temperatures. take a look at our highs for the day feeling mild with upper 50s in san jose and 57 in gilroy and for concord reaching 59 degrees and 60 today in oakland. we'll reach 59 in san mateo and palo alto as well as 59 in the mission district. in the north bay warmer with santa rosa reaching 64 and 62 in

napa. we are going to see more changes ahead. slightly warmer temperatures and then eventually more rain. we'll talk about that in a few minutes. where you can find lower gas prices. let's check out first of all in the north bay, mill valley with the best from marin county. $3.77, the top number here and the top price we have. lowering the prices, santa clara, $3.69 at diamond gas and in concord the contra costa county we have world gas on either clayton road. both of those sites have $3.59 a gallon which is a great option. on the roadways we don't have to make any choices. we have green sensors pretty much everywhere. you do choose between one of your bores. there's a crash approaching bore number two for the caldecott. the earlier traffic break has been completed but there's still activity, a little slowing on the approach.

season. the irs will start accepting your tax returns starting today. don't rush, you have until april 18th. may 15th if you live in one of california counties declared a disaster area after the rains. you're going to want to wait until you make sure you have all the forms that will save you money. the talk is many taxpayers will get smaller returns this year. smaller standard deductions for charity, a number of other reasons too complicated to get into early this morning. there were supposed to be new rules surrounding money paid to you on an app like venmo or paypal. new laws would have required these online companies to tell the irs if you made more in income processed online. the rule suspended until next year. but understand if it's legitimately income, not your friends paying you back for lunch, but actual income from hair styling, selling baseball

cards, whatever it is you do, you're supposed to report it yourself. you're breaking the law if you don't. that companies aren't required to tell on you doesn't mean you're safe from audit. speaking of serious trouble, the federal lawsuit over elon musk and his financial claims continues today in san francisco. musk wasn't telling the truth when he tweeted he had secured funding to take the company private. now a jury has to figure out what to do about that. google has a company wide meeting to talk about layoffs. google announced last week it would cut 12,000 people worldwide, about 6% of its workforce. now so far the big cuts in tech have not hit the data we watch as we try to get a handle on how the economy is doing. the latest job data showing the unemployment rate much lower than it was this time last year. we'll get nationwide gdp data here in about 15 minutes. again, this employment data is a

lagging economic indicator. it shows what happened not what is happening. some of this may not show up until later. the data i've got says things are okay. >> you do a good job trying to reassure us but spotify just announcing today. thank you for comforting us. >> doing my best. >> thanks, scott. >> you bet. director james cameron is seeing green at the box office with his land of blue humanoids. "avatar: the way of water" tops $2 billion. cameron's third movie to hit this benchmark. the other films are "titanic" and the original "avatar" movie. only three others have eclipsed the $2 billion mark and that was star wars and "avengers." "the way of water" is the sixth highest grossing film of all

time and will likely move up in the rankings as the run in theaters continues. trending this morning, something else to make you toss and turn as you try to get some sleep. >> it turns out getting a good night's rest is really a challenge for more than half of all adults in the u.s. that new study sponsored by a sleep aid company finds that americans on average only get about six hours of sleep any given night. most of us here on the "today in the bay" staff will probably chime in here if you ask them to. we'll hold off and tell you this, that study found nearly six in ten americans aspire to get eight or more hours of sleep. americans on average only wake up feeling rested an average of three mornings per week. that's less than half the time for us. yeah, i aim for eight but i only get about six, sometimes less. >> it's hard to fall asleep. you i know you wear the tracking devices. can't you tell when i didn't sleep well? do you need a computer to tell you or can you look at my face?

i went to bed early last night. >> i did, too, and then i got up, went back to bed, got back up. >> it's hard to sleep through the night. >> you wake up at 2:30 in the morning. >> it's like when i wake up in the middle of the night, i have to sign that paper in the kids' backpack, got to make sure i do that, and this is what i have going on today, and the list starts going. >> so long. at least we don't have to worry about the forecast. it looks good for us the next few days and i'm looking forward to warmer weather. we will see that in the middle of the week. we are headed for the upper 50s for much of the bay area from san francisco over toward the east bay on southward with some low 60s in the north bay. looking good there but cold tomorrow morning. still having to crank up the heater and it will be 34 degrees when you head out tomorrow morning, the lowest temperature we'll see.

upper 30s for parts of the north bay. let's talk about our water year update. we're still at a big surplus. all of the numbers in green show you how much above what's normal we are right now. we're still at a surplus of almost 12 inches for oakland and we've measured about anywhere from 8 to 24 inches of rain so far, and we're still over more than double for spots like oakland as well as livermore for our water year. and then for the sierra we're also at a surplus there, more than double the normal amount of sierra snowpack for the central sierra and still 283% of normal for the southern sierra. now we do have a little bit of a break in the rain and will continue to see dry conditions for now, but this high pressure that's keeping it dry is going to be moving on and these lows will start to dip in once again. we will see changes by the end of the weekend with more rain and sierra snow coming in and once again we may open up that

storm door and see things changing heading into the beginning of next month. as far as what we're expecting for the weekend into early next week, about a quarter inch of rain for the north bay, but maybe as high as three-quarters of an inch of rain for oakland. of course as we get closer, we'll be fine-tuning that forecast. our outlook shows not only around the bay area but all across the west we're about to go back to an above average rainfall pattern and it looks like we're going to trend a lot wetter after this week. enjoy the sunshine and the warmer temperatures. it's about to get cold and rainy once again. and as we head towards thursday, that's our warmest day of the week. if you're loving the warmer weather, if that's your thing, well, it will be the day to get outside and then for san francisco we're still watching out for the king tides today but we are going to have some mild weather throughout the week. mike, what are the changes you are looking at in the tri-valley? first a request if we can hold off the rain until after

saturday. i have a lunar new year event. i'll post about it. great drives, though, no problems. there's wind advisories for the typical areas, higher gusts of winds and not a major issue for drivers. chp just warns about that. we've reopened niles canyon -- well, i haven't. i take credit for it, though. ace train can also come through the area. it's due in fremont about 5:45. we're tracking the progress as it approaches and comes through the area. the train will go on the tracks but before it a union pacific vehicle doing inspection along the tracks in the area, trying to use extra precaution. 84 coming into sunol is the only thing that shows a little slowing through the shift. ace train back in service, b.a.r.t., no delays for those systems. great options to stay off the road or off driving. your travel times, no problem, vasco road still at speed.

football season is starting to wind down but tax filing season is just kicking off today. >> consumer investigator chris chmura joins with us a special deadline and the fastest way to score a refund. >> reporter: good morning. today is the first day the irs is accepting and processing income tax returns from 2022. the national filing deadline is april 18th, but because of the recent storms, every bay area county qualifies for an automatic extension until may 15th. the irs told us if you file electronically, choose direct deposit and submit your return with no errors. it's aiming to get you your refund within three weeks. here is another reason to file electronically. the irs has a huge backlog of paper returns and returns with mistakes. nearly 2 million from previous years. >> we're almost through them all and moving in that direction. as we get into 2023, that's why it's so important if you do not send paper if you don't have to.

you're going to want to hold on. strong winds are moving in triggering a wind advisory for parts of the bay area. meteorologist kari hall has details ahead. this is "today in the bay" streaming live on roku, amazon fire, apple tv and online. and it's good to have you with us on this monday morning. i'm kris sanchez. laura garcia is off. >> and i'm marcus washington. meteorologist kari hall is tracking those strong winds this morning. it's been pretty windy the past 24 hours and does continue this morning. we're feeling temperatures right now in the upper 40s and low 50s right now as you step out the door. it's 48 in concord and 52 in san francisco. as you step out in napa, wind coming out of the north at about 10 miles per hour. it's been more gusty near the coastline, and our temperature will hold steady here and then slowly start to warm up today as we head for the low 60s, upper 50s for san jose and fremont and a high expected of 59 in hayward

as well as mountain view. we will see more changes in the rest of the week's forecast. i'll have more on that in a few minutes. you have a new crash in the south bay. a bummer for the folks involved in the crash and a bummer for us because i was trying to determine if we had a new pattern since last week. talking about north 101 right arp mckey, slowing up to oakland road. there is a crash that should be on the shoulder by this point but, again, last week, last tuesday specifically, we saw a lot of slowing in the area, a big build in the south bay commute. the commute around the bay between 7:30 and 9:30 it's really kicking in. we'll see how that pattern goes today. the south bay crash is there and it may be a factor. there is a factor that continues from the flooding the last couple of weeks. 92 still with one-way traffic control. back to you. >> thanks, mike.

a live look at the state capitol where later today mourners will hold a vigil for the victims of the mass shooting in southern california. the aapi is organizing the ceremony. >> ten people died and ten other people were injured. the gunman is now dead. authorities are saying people stepped in at a similar location just a short time after the first location happened to stop a second tragedy. reporter lauren coronado with our l.a. sister station has more details from monterey park. >> reporter: today we expect to learn more about the ten who died, five men and five women, the community mourning their loss. i want to show you a makeshift memorial here at monterey park city hall. you see candles, flowers and balloons in their honor. the investigation spans three locations beginning here in monterey park saturday night, a block away from a festive lunar new year celebration. thousands in attendance. it was about 10:20 when several

shots were fired from the popular dancehall on gary and garfield. first responders say they saw dozens of people screaming and running from the building. ten people were killed, ten others were rushed to nearby hospitals, and seven are currently still hospitalized. l.a. county sheriff robert luna says the gunman drove to another dance studio about two miles away in alhambra where someone wrestled a gun away from a gunman. that man has been identified as 72-year-old huu can tran. witnesses say he got away in a white van later spotted in torrance where law enforcement stopped the man. shortly after officers heard a gunshot from the van and found the man dead. back out here you see the flags at half-staff, again, a vigil will be planned here tonight for those victims and their families. the big question now is what is the motive. we understand a search warrant was served at a home in hemut.

we are wait to go learn more about that part of the investigation as well. i'm lauren coronado. back to you. >> thank you, lauren. the mayor is speaking out on the "today" show and says investigators are starting to piece together the shooter's connection to that venue. >> we do understand that he may have had a history of visiting this dancehall and, you know, perhaps motivation some personal relationship, but that's something i think investigators are still uncovering and investigating. >> you can watch the full interview on the "today" show including the support the community is providing for victims of that shooting at 7:00 this morning right after "today in the bay." ace trains are back up and running after service was shut down because of several mud slides. >> "today in the bay's" bob redell joins us live. bob, are there any precautions in place to make sure those trains don't get hit with any

debris again? >> reporter: there is. good morning to you, marcus and kris. union pacific, which owns these rails, will be doing a run ahead of the ace train taking off for regular service this morning to make sure the tracks that run through niles canyon are clear of any debris. you'll recall last week's storms sent two mud slides onto the tracks through niles canyon. there was one on tuesday, a second on wednesday. one train had to stop for some time until the debris was cleared. ace canceled service for the rest of the week. full service resumes today. the first train took off 4:40 from stockton heading towards fremont. we're expecting a train to pull in here in about ten minutes. reporting live, bob redell, "today in the bay." >> bob, thank you. our investigative unit is looking into why ace train continued running last week. what they uncovered by watching the full story at nbcbayarea.com, click on the

investigations tab. happening today a competency hearing for a man accused in a gruesome killing last year on the peninsula. investigators say jose rafael solano landaeta use add samurai sword to kill the mother of his young daughter. it happened in front of shocked bystanders outside the woman's home. shortly after officers did arrest the suspect and in a preliminary hearing at the time, his defense attorney requested a psychiatric evaluation to determine if he is fit to stand trial. now to a live look at the golden gate bridge where transportation secretary pete buttigieg will join former house speaker nancy pelosi later today. now they're celebrating the recent approval of funding for the fourth and final phase of a major bridge earthquake retrofit. $400 million in federal grant money will finance the project. when it's finished engineers say the bridge will be able to withstand what's considered to be even the strongest of potential earthquakes. and let's head down to san

jose as we take a live look out dark and early. meteorologist kari hall has a look at what we can expect throughout the day. right now it's pretty cold. >> a little chilly. we have upper 40s in san jose and still a breezy wind. i think that makes it feel a lot colder and our temperatures will dip another few degrees as we go into the next couple of hours. but then take a look at the trend by late morning starting to warm up but still pretty windy along the coastline to start out this morning especially and also for the hills where we see wind gusts at 40 to 50 miles an hour. here we are at 10:30 and we still have wind gusts in san francisco. going into the evening the wind will start to calm down and it's looking much calmer for tonight into the next couple of days, but then our temperatures will be warming up. so today we're still in the upper 50s, low 60s for much of the bay area and then into the next few days. it will reach into the new 60s. we'll talk about when that

happens. mike, you have a new crash? the same crash but more backup and slowing in the area as we look to mostly green sensors. the wind advisory will affect the drivers as well. no major problems from chp. we're looking at north 101, a little more slowing from the crash right around mckey up to oakland road which is past the crash and that's where we typically see the build. it's holding steady. tuesday we saw it build back to capital expressway early. this is not bad for the south bay. looking at southbound 680 and that is slowing right now as the commute builds, we also have 84 coming into the same area towards sunol, both building with that commute to the tri-valley. more traffic volume. remember, they're doing that pavement work once again starting week nights about 10:00 p.m., lasting until 5:00 a.m. today picked up right on time. great news for the same area, ace train, as bob just told you, back in service. we're waiting for the 5:45

arrival at fremont. we know it will be nine or ten minutes late. i don't know why, just a delay loading and unloading the trains. we do have that coming into the area. we're still waiting for it to get through the niles area. we're looking at 92, the san mateo bridge. on the peninsula and highway 35 all the way we have that one-way traffic control. we're building up to the bay bridge toll plaza. coming up, over the weekend more confidential documents found at biden's personal home. and the shark tank taking on a new look this week. we will preview the competition ramping up to determine the best of the best in figure skating. plus -- the final play, prescott and that will do it. the 49ers back to the championship game!

upper 40s in belmont and sunshine into the rest of today as our temperatures stay on the cool side with breezy wind and we do have warmer air in the forecast and eventually rain. we'll talk about all of those changes ahead coming up in a few minutes. the changes right now, look at this, our shot of the bay bridge from emeryville. a lot more spacing between these taillights. that means folks are entering the bridgeway a lot slower or at least a little slower because the metering lights have just been activated and we see folks tapping their brakes. slower on the approach. more spacing on the bridge just in case anything happens and that's exactly the way it's designed. this morning president biden is facing more scrutiny after we learned more classified documents showed up in searches of his delaware home over the week. >> this time scott mcgrew, the documents were discovered by the fbi agents. >> fbi agents in president biden's home. former president trump has been

complaining for weeks the fbi hadn't been at biden's home. well, now they have been at biden's invitation. that's the key thing. the white house wants to make sure you understand biden's team asked the justice department to search and, yeah, they found more documents. according to biden's personal lawyer they say they found six more classified documents on friday during a search that lasted 13 hours at his wilmington home. here is what sunday morning's "meet the press" looked like. >> an fbi search said it was coordinated with the fbi but the fbi searched former president trump and now a search into president biden's residence. what's your assessment of how the president has handled this situation? >> it's just hard to believe that in the united states of america we have a former president and a current president basically in the same situation. how has this happened? >> there are critical differences between the discovery of documents in biden's home and trump's home, but neither should have

winds. the temperatures tend to drop quickly and we'll see frosty conditions to start out tomorrow. so let's check in with our water year now that we are continuing to enjoy our dry weather, we will see in some spots still that big deficit -- or big surplus, rather, continue with 24 inches of rainfall measured in santa rosa. that's over 7 1/2 inches above what's normal. and when we look at how that compares with our water year, we're still more than double for oakland as well as livermore and san francisco at 191% of normal. and the sierra snowpack still really high at 246% of normal around the central sierra and then for the southern sierra at 248%. now we are going to see still a lot of dry weather throughout the week. we have high pressure blocking it. it is on the move. what will happen here they will see the lows coming in starting on sunday. that means rain and sierra snow

will be back, and we could see it continue into next week. several storm systems moving in behind that, so we are going to see some big changes ahead starting on sunday and at least for now it's showing some light amounts of rainfall. we could see a half inch of rain start to cause more problems with mud slides especially in the hills, and the outlook going into early february does show that we could go back to an above average rainfall pattern and that could continue into at least the second week of february. still enjoying the dry weather because once again things will be changing and we'll see temperatures warming up into the mid-60s for the inland areas. and, mike, you are saying that the metering lights are on. yes, and so does this picture. the metering lights turned on about ten minutes ago and we're already seeing backups to about the end of the parking lot. that's a pretty quick build compared to what we've seen for months.

a really big bump in the traffic flow and since then that morning commute really slow down between 7:30 and 9:30 in the morning. over here early slowing south 680 through walnut creek to the interchange. there's a crash reported there and possibly blocking the slow lane. this is a bad time because a lot of folks speeding down off highway 4, so we'll track that for contra costa county. alameda county moving smoothly. the south bay, santa clara county still shows slowing. that crash still registered on the shoulder. happening now for you, teams from caltrans are now organizing resupply convoys to help monterey county homeowners still stranded by the recent storm related to landslides. convoys will travel to lime creek in that area around big surwhere there's no safe access. residents are asked to wait there in their driveways if they

5:57. welcome back to you. so water access remains cut off for some people living in the santa cruz mountains, two weeks after they lost it. this year's new year's eve storm caused heavy damage in boulder creek sending that roadway in a nearby creek just outside of one mobile home park. as of last week, that hole was about 35 feet wide, 25 feet deep. according to those residents it

is still growing. one couple says they had to take a 45-minute detour into town to get water and supplies. while a neighbor has set up a zip line to help in that situation, the lack of running water is changing everyone's way of life. >> it's extremely inconvenient, using rainwater to flush our toilets. it's not safe to stand there right now. >> our affiliate in salinas reached out to the utility provider, big basin water company, to see when the water would be restored. so far no response. meanwhile, in santa cruz, the city of santa cruz here, look at this, emergency crews there are set up to begin a long west cliff drive. this is the road that was severely damaged by the storms earlier this month. teams will place 200 tons of boulders. this is that new fabric material to protect the -- excuse me, to protect the exposed cliff side
