more. >> reporter: the officer's name is preston hemphill. he's been employed by the memphis police department since 2018. he was relieved of duty with the other five officers shortly after the january 7th traffic stop involving tyre nichols. they say this officer's name was not originally released to the public because he was not fired. the attorney for tyre nichols' family they're reacting to this saying the fact this officer hasn't been fired and they're just now learning his name, or the public is learning about his name, is extremely disappointing. here's more of what attorney ben crump had to say. >> several people contacted me directly, as well as people on social media saying mr. wells, tyre's father, said from day one

who is this guy? why hasn't he been terminated? why hasn't he been arrested? he was assaulting his son. >> reporter: we also have this new statement from an attorney representing this officer, officer preston hemphill. quote, as per departmental regulations this officer activated his body cam. he was never present at the second scene and is cooperating with officials. according to that attorney, the first body camera footage that was released by the police department on friday evening, body cam one, that was this officer's body camera footage. this is a named individual who has been identified in social media circles as someone who had been mentioned in early affidavits. there were questions about why they hadn't heard anything about this officer's status.

when asked by nbc news if this officer is on paid or unpaid leave, a spokesperson for the police department didn't get into any details, but said when they have additional information, they'll make it public. kate? >> thank you. prosecutors in the alex murdaugh trial are focusing on the weapons found near the crime scene of a double murder. murdaugh is charged with killing his wife maggie and their adult son paul in 2021. blayne alexander is following this case for us. can you walk us through the prosecution's arguments today and how the defense is responding? >> reporter: it made for an interesting moment in court this afternoon. you talked about the weapons found in the home. what's notable is the prosecution is not saying that these were the weapons that were used in the murders. rather saying they were weapons

recovered, that were processed. it made for an interesting back and forth between the prosecution and murdaugh's defense attorneys who said that introducing long guns in court was unnecessarily prejudicial especially in the defense attorney's words because they couldn't make a connection to the murders with them. what we saw was an interesting back and forth where an agent on the stand was actually either describing or showing guns that were taken and processed. here's a little bit of the back and forth between the prosecution and defense. >> they have photos of the guns which is sufficient information for the jury. but sending weapon after weapon back into the jury room we think is unfairly prejudicial. >> the state in response to that is we're entitled to show the extent of the examinations done

and examining the firearms found on scene. this agent gathered 12 gauge weapons for a reason. admission of those we believe is relevant and not overly prejudicial. >> reporter: aaron, that was just a little bit of what we heard this afternoon. that was the second law enforcement agent to take the stand. he's back up there again after lunch. this is a case drawing national attention because of the person on trial for murder. >> i understand there's body camera video that investigators are talking about now. what can you tell us there? >> reporter: we saw this from agent kroft on the stand. what we can see in that body cam video is investigators putting on gloves and going through the gun cabinet there at the murdaugh home an recovering those weapons. you see them walking around

picking up shotgun casings. that was the bulk of his testimony. right now he's facing direct questioning. the defense will have a chance to cross examine. >> blayne alexander, thank you. secretary of state antony blinken is wrapping up his visit to the middle east. the trip comes after a new wave of violence between israelis and palestinians. nbc news chief international correspondent keir simmons joins us now. this is the secretary of state's first meeting with prime minister netanyahu. what did he say about those talks? >> reporter: he's arriving at a crucial moment. prime minister netanyahu's government is considered to be

the most far right and religious in israeli history. thursday was the deadly day for palestinians in the occupied west bank in nearly two years. friday night there was a shooting near the jewish synagogue which israel said is its worst terror attack in recent years. just trying to smooth things over, secretary of state. take a look. >> we continue to believe the best way to achieve it is preserving and realizing two states. another away from that vision is detrimental to israel's long-term security. >> reporter: the idea of a two-state solution, we're a long way from that. it underscores how much work there is to do. >> you mentioned the attacks in the last few days.

over the weekend things were bad. what are things like today? >> reporter: they really were and got worse and worse over the last weeks. that's because of the israeli/palestinian tension. it's also because there's this growing tension with iran. we saw that attack on a drone factory in iran that is being credited to the israelis despite them not taking responsibility for that. there are differences between the u.s. and israel over iran and clearly they both face that same challenge. just shows what a chess board this is for washington. >> keir simmons, thank you. 35 million people from texas to west virginia under winter weather alerts. one of the biggest concerns is an ice storm getting stronger.

>> morning sleet making a mess on oklahoma roads and power outages are a major concern in the days ahead as the storm heads to the east. >> meteorologist bill karins is tracking it all. bill, bring us up to speed here. >> the cold air is moving in. we'll see bands of precipitation. it's not going to be one storm. it's going to be three little ones and there will be a cumulative effect that has the issue of power outages. ice storm warnings from little rock to memphis. winter storm warnings towards the southern portions of missouri and dallas down to austin. just outside of san antonio too winter storm warnings. they'll have a mixture of sleet and freezing rain. areas with the best chance of freezing rain is little rock to memphis. that's the higher ice accumulations. tuesday morning, this is all freezing rain and sleet around

students are returning to school in virginia for the first time since a 6-year-old allegedly shot his teacher. it's been nearly a month since that incident. the school is re-opening with major shakeups in staff and protocols. walk us through the specific changes that are being put in place. >> reporter: there will be a few differences starting with backpacks. every student was given a transparent backpack they'll be required to carry. any classroom that didn't have a door now has one.

security officers have been employed at the school. therapists and school social workers will be on campus this week. finally there are major changes in the leadership of the school. the principal and vice-principal has resigned. aaron? >> sounds like a lot of big changes there and significant ones. how are students and parents feeling on this first day back? >> reporter: kids are excited to be back. it's been a traumatic experience. a lot of them are wanting to get back to school. there were lots of smiles and waves from family as they arrived. one mother said as terrible as it's been she's thankful for the progress it's inspiring. >> unfortunately a teacher had to be our sacrificial lamb to bring this to light.

good afternoon. live here in the nbc bay area news room. today marks one week since a mass shooting in half moon bay. people are paying transcript to the victims and many are calling for gun reform. >> members of this community and others are pushing for tighter gun laws so there's no need for memorials like this one behind me here in half moon bay. this past weekend, there was another vigil outside san jose city hall to remember the seven people shot and killed last monday here. tribute to one person murdered last week in oakland and the 11 shot and killed in monterey park just a few days before that. then this past weekend, sadly there was another mass shooting west of beverly hills that left three dead and four wounded. a number of people want lawmakers to make it harder for bad people to get their hands on a gun. >> i think that we need to have better, secured storage laws. we need to work towards having

legislation that increases background checks and i think we need to stand up for regulation of guns that are high capacity magazines. >> we wanted to mobilize and make sure our community in san jose had a space to grieve and particularly that a lot of community members are grieving those of asian descent and given there's a large community in san jose, we wanted to provide that forum. >> there's another candle light memorial for victims of the half moon bay mass shooting. city and county leaders are inviting the public to take part in the walk tomorrow night. it will start on kelly avenue, go past the plaza memorial where i'm at, continue down main street and end at the hall. after, people are invited to be

with community. amtrak service is trying to get back on track after a train struck a car at a crossing. the collision happened around three miles south of jack lond car, the high street crossing. you can see what that did to the car. a witness told us that a person was inside the car at the time of the collision. we're still working to confirm that. no one on board the train we're told was injured by service was delayed about two hours. here's some other stories. new details about a deadly collision in the east bay this morning. many rez dernts looking for a new place to stay after an apartment fire last night. first, the worker accused of elder abuse in walnut creek is set to make her first court appearance. she is charged in the death. the family said the 94-year-old drank a cleaning chemical that a worker left out. the company insisted for month that is the death was a reaction to food. namely flaming hot cheetos.

however, a coroner's report said the cleaning fluid caused the death. she is expected to be in court this afternoon for an arraignment. we'll have more in our afternoon newscast. and 15 people need new housing after an apartment fire in san jose. flames gutted several units last night. the fire destroyed cars in an adjacent carport. a woman was killed this woman on the highway 238 interchange to 580. chp say it is 28-year-old got out of her car then another car struck her. chp says the victim's family members were with her at the time. the reason she got out is unclear. the driver that struck her staying and is now, working with investigators. you should prepare for cold weather. the temperature might dip into freezing in some places. let's head over to kari hall for more. >> it's still a breezy but sunny day across the bay area and

california, honored brandon tsay. he wrestled the firearm from the suspected shooting in monterey, california. bart strong has died. he sang the song "money" and collaborated on "i heard it through the grapevine." barrett strong was 81. police in oregon are searching for a man who they said is extremely dangerous. they said he could be using dating apps for victims. benjamin foster has been convicted for similar crimes in nevada. what are police saying now? >> reporter: foster is wanted for attempted murder, kidnapping

and assault. a woman was found beaten so brutally, this was last week, and she's still in critical condition. investigators conducted a search warrant and found the suspect's car. police say he likely received assistance from a 68-year-old woman. she was arrested and booked for hindering prosecution. the search has become more dire because they say the suspect is still using dating apps to contact individuals who may help the suspect escape or become victims. the police chief said he's disgusted by what happened. >> it was a brutal assault on one of our residents that we take extremely serious. we won't rest until we capture this individual. >> reporter: a $2,500 reward is being offered for information.

the suspect's arrest record includes an arrest in las vegas. he was accused of holding his girlfriend captive and beating her, including breaking her ribs. >> dana griffin, thank you. the search is under way in los angeles for a shooter who killed three people and injured four others. this happened in an upscale neighborhood near beverly hills. all three people killed were black women. this is the seventh mass shooting in california since the start of 2023. kathy park is following that story for us. what else do we know about the shooting and what are police saying about their search effort? >> reporter: this happened early saturday morning north of beverly hills in a relatively up scare neighborhood. police say the shooting happened at a short-term rental property where folks gathered. it's unclear what triggered the violence. authorities have not made any

arrests. >> when officers arrived to the scene they found five victims suffering from gunshot wounds. three were deceased at the scene. there's no suspect information right now. that's what we're interviewing these witnesses and occupants of this gathering or whatever it was here. >> reporter: we know that all those killed in this shooting were women with some sort of connection to the chicago area. law enforcement sources are looking at the possibility this may have been targeted. aaron? >> kathy park, thank you. former president and now candidate donald trump is hitting the campaign trail with stops in two key early voting states, new hampshire and south carolina. nbc news vaughn hillyard joins us from south carolina. you've been covering the former president. this is the first time on the campaign trail since announcing his presidential bid. what is he saying and what are

you hearing from voters? >> reporter: he's laying the foundation with those stops in new hampshire and south carolina. even though nobody else is in the race, it's just donald trump, he is already taking shots, sending signals if you're getting into the race, expect a tough year. we're talking about one year out from voting. in the case of ron desantis, his biggest gripe was that the florida governor he said was disloyal. he said he wouldn't have been governor if he wouldn't have gone out there to hold a rally. in 2018 ron desantis won by just over 22,000 votes. donald trump called him disloyal. he was criticizing the closure of florida in donald trump's words during the 2020 covid pandemic. in the case of also the likes of nikki haley he suggested he wants her to jump into the race claiming she's not a threat. she's the former governor of

south carolina, but also his u.n. ambassador. i want to let you hear from the voters we talked to over the weekend. >> is there a chance you would vote for a republican is not trump next year? >> there is a chance. it's a short list though. >> who is on the list? >> maybe desantis. strong conservative, constitutional candidate who is putting america first. >> reporter: it was lindsey graham the senator from south carolina who endorsed trump over the weekend and said south carolina picks winners. in 2016 it was donald trump who won the south carolina primary and joe biden won the democratic primary in 2020. laying that groundwork is important and we're one year away and looking at other

republicans jumping into the race. >> january 2023 and it's starting already. vaughn hillyard, thank you. we're about a year from the start of the 2024 primary and while we don't know the candidates running just yet, one state is sure to be a factor and that's pennsylvania. that's where we find dasha burns. what are you hearing from voters there today? how do they feel about the state of politics? >> reporter: aaron, campaign season is heating up when you find me in a diner talking to voters. we're here in a county that used to be a democratic strong hold and trump turned it red in 2016. the pessimism we're hearing very much reflected here.

this is a county that's not a high income county. a lot of middle class voters, folks living paycheck to paycheck. when you see inflation rise, when you see high gas prices, when you see groceries going through the roof, folks here feel that. there's a lot of frustration with the current administration, not surprising in a largely republican county, but the reasons why are really important to listen to. i want you to hear from a small business owner. take a listen. >> everything this administration is doing is killing me. they took away all our incentives, even tax incentives for me to get everything going. it's tough. there's no out look in the future that i can see it gets any better either.

>> reporter: the future outlook, that is a tough one for a lot of voters we've been talking to. allen told me about a small business loan he wants to take out but he's afraid because of interest rates. these are issues here that people are worried about. >> what do voters want to see from a republican-controlled house? >> reporter: voters here are pretty excited that republicans won the house. this is a pretty red county. they want to see the gop work across the aisle with their democratic counterparts in the house and senate and with this administration. many of them don't necessarily love president biden, they dislike the stalemate even more. they want to see something get done because they really feel like there's not a lot of hope right now, aaron. >> dasha burns for us in the cleanest diner in all of

battery of different symptoms and questions up to 13. if they answered 2 out of the first 11 positively and also expressed distress based on their junk food eating, they were basically labeled as having potential for being addicted. what were the three most common symptoms? it was having cravings at least one time per week. it was trying to cut down on junk food and not being able to. third, withdrawal symptoms. a lot of the symptoms we normally associate with tobacco and alcohol use or abuse, but the same kinds of symptoms can occur with these really highly processed foods, aaron. >> i had to kick my cupcake issue a while back and i was not nice to be around when that happened. let me ask your science brain this, what is it about junk food that makes it so hard to put

down? >> so what are the characteristics of highly processed foods. we have processed and highly processed. they go through this refining process so many times and what ends up happening is they number one, get stripped of all their nutritional value, but particularly their water and fiber content. the reason that's important is when you eat them, you digest them quickly and they hit the blood stream very quickly and this triggers this response in the brain, very similar to what we see in other situations. that's really the theory as to why. it's basically, like i said, will trigger this pleasure system just the way tobacco and alcohol can. >> just a few seconds left. are their certain types of people who are more likely to become addicted to food? >> they found in their research
