"nbc news daily" starts right now. today, tuesday, january 31st, 2023. awaiting charges. any minute now prosecutors are set to file charges against alec baldwin in the "rust shooting." deadly response, a half moon bay shooting that killed seven people may have been prompted by a $100 repair bill. now the suspect is speaking in an exclusive ibt view. drying up, for the second time in six months, states that

need water from the colorado river failed to reach an agreement to share it. what that could mean for millions of people. and hollywood drama. why a best actress oscar nomination for a small film is drawing a ton of controversy. rvelgts. we begin with the latest out of new mexico. >> we expect a district attorney to file charges against alec baldwin and the armorer on the set of "rust." the two are accused of being involved in the shooting death of the cinematographer. >> time behind bars is a serious possibility for those involved. let's bring in our correspondents. what are we expecting to happen today? >> well, once the involuntary manslaughter charges are put against alec baldwin and hannah gutierrez-reid, the d.a. says we can expect the charging documents as well as the plea agreements to be released.

and those will have the facts and findings that led to these charges for the first time. we'll also get the plea agreement. he is the assistant director that law enforcement documents say told baldwin the gun was cold and that is safe before it went off killing cinematographer he had lana helena hutchison. >> so once the charges are made official and filed with the court, walk us through what happens next. >> i think the defense needs to be pro active. i think they reach out. they find an expert. and just in formally talking to folks and maybe you have too, i found that experts in the movie industry come down on each side of this. something baldwin is responsible for, others think no way he's not responsible. so that tells me that the defense should be able to secure an expert in the movie industry whether it is an armorer or stunt expert that will testify

that what alec baldwin did was proper. he didn't do anything negligent grossly negligent f that happens, then they have a battle of the experts. and battles of the experts in trials end up being coin flips. juries tend to go with whoever they like and whoever explains things better for them. >> how long is all this expected to take? do we know? >> i expect it will take some time. because i don't know that the defense will want to waive a speedy trial. they could. there is a constitutional requirement that prosecution bring the case to the trial within a particular period of time. but the defense may want to waive that in order to have more time to prepare. >> thank you both. memphis is preparing to say a final good-bye to tyre nichols. his funeral is held tomorrow morning. we learned that george floyd's brother and breonna taylor's mother will both ab tending. the preparations come as we learned seven officers have now either been relieved of duty or fired in connection to the traffic stop that led to nichols' death.

three emergency medical workers are also fired. our reporter is our reporter from memphis. you've been talking to people across the city there in the time that you've been there. what are they saying about the impact that tyre nichols' death had on the community? >> yeah, he really lived in memphis all that long in the scheme of life. he had been here about two years. he lived in sacramento before here. one thing that is interesting going to some of the vigils and talking to people in the community is how many people feel like even if they didn't know him before this, they know him now. and he's an integral part of this community and their lives. we were at a state shop yesterday evening and talking to the people who work at this state park. it's a shop and park inside. he left the state. he said since this happened, they had people coming in looking at skateboards for their children because they're interested in skateboarding because they heard that tyre nichols liked it. this is a man with a huge impact

on this community and as this community prepares to lay him to rest, to celebrate his life on wednesday, they are also hoping that people don't forget why everyone knows his name right now. and they hope that it leads to change. let's listen to what we heard. >> yeah. it's because of what the country is saying the other night. but that was there something that brought this down? >> i'm afraid. the you know, i don't know if i want to pull over or keep going or what. i don't want to have wrong intentions on my behalf. right now i'm terrified. >> there is a mix of emotion here right now. there are people dealing with the reality of what they feel like is a situation where there are so many systemic issues in policing they don't feel safe moving about anywhere then community. at the same time, they're trying to celebrate who this man was and that his death leads to some

bigger change for them and their children. >> i want to ask about the three medical responders that we learned were fired. what were their roles in all of this? >> so now our understanding is that one of them who had a basic level of emt training, the lieutenant stayed in the fire apparatus when they got to the scene where tyre nichols was. the other two emts went out but didn't conduct a full assessment on their own. instead, they relied on information they had from the officers at the scene. and the initial phone call saying the person was pep -- pepper sprayed. there was 15-minute period where he didn't receive adequate medical attention. intensifying ice storm is cancelling flights making roadways extremely dangerous from new mexico up through west virginia. >> texas has been among the hardest hit states so far. say a look at this road in the dallas-ft. worth area. drivers just could not control

their cars there. first responders in that state report more than 100 crashes since the system moved in. nbc news meteorologist bill karins is tracking temperatures. let's begin with our reporter in memphis, tennessee. what are the conditions like out there? >> aaron, i don't know if you can see it. we have sleet coming down. it is sleeting here in nnessee. we heard about this in dallas first. we had some freezing rain and some of the sleet which creates the dangerous conditions. now here in memphis, the alert was that we have about a quarter inch of ice. i'm going to show you. this is what that looks like. this is a branch from one of the trees. everything is completely frozen. you can see back here. everything is frozen. this leaf falls on the surface. and this is -- this feels like an ice skating rink. you can slide right off of that. on the sidewalks, they're like this. this is what we've been seeing a lot of the roads are dangerous.

bridges. so they're asking people to stay home. that warning of the ice storm is in effect until noon. this is what it is like here in west tennessee. >> all right. thank you. let's go to bill. you can see it there in his shot. the second round of ice under way. you told tuesday there say third round tomorrow? >> that second round is over memphis right now. it is 28 degrees. will we'll take sleet all day. sleet is 100 times better than freezing rain. but it's going back and forth between periods of freezing rain and sleet. the bulk of this is through arkansas. this is where we had 14-mile backup because of car crashes. that is being cleared up. the roads are treacherous there. now we're getting a little bit of a break around dallas. still light freezing drizzle. tomorrow will be the last round. that looks to be the most significant too. especially in central texas. icestorms warnings from little rock to memphis. and we keep inching more to the south.

even shreveport, louisiana, is under a winter weather advisory. but here's the area tomorrow where most concerned with ice. san angelo into areas right around ft. worth and north of dallas here that, of course, was happening now around little rock and areas of memphis. and then by the time we move to the weekend, the ice storm is over. but how about the temperatures in northern new england? record lows and dangerous wind chills. minus 70 in maine. >> all right. bill? >> minus 70? >> it's going to be run. thank you both. secretary of state anthony blinken is on his way back to washington, d.c., after a two day visit to the middle east. the trip coming amid rising tensions between israelis and palestinians. met with the palestinian president during his final stop this morning. he met with israeli leaders yesterday. our foreign correspondent is in jerusalem for us. secretary blinken spoke with reporters before heading back to d.c. what did he say about next steps for potential peace talks?

>> that's right. he focused on a familiar theme. he talked about the need to deescalate the need for both sides to take steps in that direction. they talked about the two state solution reaffirming the u.s.'s support for palestinian statehood as the end goal and also said that there were positive signs that both sides had ideas on how to deescalate. take a listen to a little bit what he had to say before he left. >> restoring calm is our task. over the longer term, we have to do more than lower tensions. we're committed to working on the goal to ensure that palestinians and israelis receive freedom, security, opportunity, justice and dignity. >> the question is, of course, what's next? the secretary of state did say he was leaving members of his

team behind here in israel to work with both sides on these ideas for calming tensions. you wouldn't go into specifics on what the ideas were. but did appear, kate, to try to end his trip on a more positive note despite deep, deep skepticism here on the ground. kate? >> all right. kelly, thank you. >> breaking news out of washington now. nbc news learned about a previously undisclosed fbi search of president biden's former office in d.c. that search happened in mid november after the president's lawyers first discovered classified documents. two senior law enforcement officials say the lawyers who operated and no warrants were issued. nbc news does not know whether the fbi found any classified documents or person documents touring that search. more layoffs are coming to big tech and pfizer sales are decreasing. we have our cnbc money minute now.

day four in the testimony of alex murdaugh. he now disbarred attorney from the south carolina country is accused of murdering his wife maggie and son paul back in june of 2021. nbc news katie beck is following the trial for us.

she joins me now from virginia. katie, what have we heard so far in court today? sympathy. >> well, kate, the day started without some back and forth over what the jury saw in the courtroom yesterday. a huge collection of guns that were displayed before the jury. the defense strenuously objecting to these guns being brought in saying they had nothing to do with the actual murder. these were part of the hunting collection of the family. this was a hunting property. there was something that alex murdaugh said to investigators while being questioned. he basically said, i did him so badly. that is -- that's the phrase in question this morning. it could be they did him so badly? is it did him so badly? and what exactly was meant by

that phrase? that is under debate this morning. the cross-examination defense and prosecution both sparring over what was meant, what was intended. >> you testified that alex said on the video captured by audio that it was so bad, i did him so bad. that's what you testified to yesterday. >> yes, sir, that is what i testified to. >> now, are you 100% confident that alex said, i did him so bad? rather than they did him so bad? >> i am 100% confident in what i heard and i interpreted him as saying. now, kate, court just resumed after a lunch break. before that break, they were getting some cell phone video. they were laying the groundwork for what we're about to hear, what was discovered on paul's

cell phone. so that evidence is going to be very interesting. we'll hear more this afternoon. kate? >> the son's cell phone. thank you. the man charged with killing seven people last week in northern california says he was motivated by a repair bill from his employer. the suspect sat down with our reporter from our san francisco station in an exclusive jailhouse interview. >> reporter: our one-on-one visit was scheduled and the only thing i was allowed to bring into the jail was my driver's license. to check my identity. no pen, no paper, no cell phone, no recording devices. my conversation with the man was in mandarin. he does not speak english. i told him who i am, who i worked to and he agreed to sit down and speak with me. our conference was only xenled for 15 minutes. during that time we spoke about the day of the murders. i told him i heard from law enforcement sources that he told them his colleagues treated him poorly for years. he said that was true. he said he was forced to work long hours from early morning to

sometimes 9:00 at night. he was paid for the extra hours but when he voiced complaints about the long days at the farm, he says his supervisor ignored him. i also asked about the gun. he told me he has a green card and that he bought the gun a while back, probably in 2021. and again, no problem, he had no problem buying the gun at a store. as for his arrest, he said he drove to the sheriff's station in half moon bay to turn himself in right after the shootings. he said he looked in the front lobby but no one was there. the he waited in his car for about two hours before someone he believed was police started milling around his car looking and taking pictures of his license plate. and he told me he sat there thinking, yes, that's me. please arrest me already. after more time passed, the car was surrounded by law enforcement who pulled him out of the car and took him into custody. i asked if he had any regrets for the killings. he said, yes. he said he believes he has meantal illness. and that he's been struggling

this morning, the san mateo supervisors held a moment of silence during their first board meeting since the mass shooting. the community is working toward healing. many are looking at how to fix farm worker housing. kris sanchez found many people who believe something must change. >> reporter: at this first meeting, the county executive said he would ask for $1 million to make sure that these community members can stay where they are where they have connections, where children are in school and where they are needed to do the farm work. they started their meeting with the names of the five men and two women killed a week and a day ago. they were reflective about what they need to work toward in terms of gun violence, farmer conditions and affordable housing. the county executive talked about what the county is doing right now. they are providing shelter for 18 families.

that's 26 adults and 11 children in hotels. they have provided between $1,000 and $2,000 in lost wages depending on the family size. the county is connecting those families with food, transportation, government services and the county executive is going to be asking for that million dollars for more short-term housing for about a year. the owner of one of the two farms where people died announced they are going to build permanent housing for the farm workers who work and live there. there are about 18 farms that are permitted to house up to five people. they know there are more shadow communities, as he called them, where there are workers living without any supervision or regulation. kris sanchez, nbc bay area news. here are other stories we want to share with you. jennifer siebel is visiting a

college. mayor breed talked about the village sf, a development for the mission district. supporters say it will be centered in an area at the heart of the indigenous population. it will be a multi-purpose cultural center. a gym, medical and dental clinic plus a farm for traditional food and medicine. it's scheduled to open in 2025. a new bid by elon musk to throw out a lawsuit that angry twitter shareholders filed. they claim he disclaimed his disclosure of a large stake in the company. some sold stock at low prices. reuters reports his filing argues investors have no right to obtain damages. the filing claims failures to disclose information on his part were inadvertent.

bottom of the hour now. much. >> dallas police now have a person of interest in that missing monkey case at the dallas zoo. officials there believe two monkeys were stolen after the habitat was intentionally compromised. this follows a strong of other bizarre incidents at the zoo including the disappearance of a leopard and a death of a vulture. >> and a california man drove his wife and children over a cliff in a tesla with attempted murder. he was behind the wheel when the car went off a devil's slide as it is called at the 250 foot

cliff earlier this month. everyone inside the car survived. police say he has not spoken to investigators since the january 2nd crash. >> cindy williams who starred in laverne and shirley died. she played shirley in the "happy days" spinoff. she also starred in "american graffiti" and "the conversation." cindy williams was 75 years old. we're learning new details about the criminal past of an oregon bhanted on kidnapping and attempted murder charges. pleats are looking for benjamin foster. he is accused of torturing a woman he held captive for days. that woman was rescued by police a week ago. she remains unconscious. nbc news correspondent steve patterson is following this story. there are new questions about the time that he spent behind bars. what have you learned? >> troubling story about all

this. troubling to hear about the criminal past and the sentence he was supposed to serve, kate. we know he was scheduled to stay in prison for an extended amount of time for the last time this happened. he reportedly strangled will his ex-girlfriend in 2017. served time for that. got off early for that because of a plea-bargain. the same thing happened in 2019. he was supposeded to serve time, about 2 1/2 years, only served maybe a few days if that because of a plae plea-bargain and time served while awaiting a sentence to remind you of that case, police say they found a woman who had seven broken ribs, two black eyes and abrasions on her wrist because tied down for weeks. so police don't want to repeat that. they say this man is armed. he is dangerous. people should stay away. but also they're asking for the public to help track him down. >> what are police saying about the state of the search effort today? >> right now, it is focused squarely on oregon.

police believe he has connections there. he may have a network of friends that may be helping him. they already have a 68-year-old woman in custody for aiding and abetting and also destroying evidence. running a car, his car off a cliff during the investigation to hide part of the evidence businesses they were collecting. now again, they're focused on this day and the connections. but they're also focused on the social media profiles, the dating profiles, the okay cupid, bumble, tinder, they're telling everybody to keep an eye out for this man. look for the eyes and bone structure because he may change his appearance. scary stuff. >> steve patterson, thank you. a washington, d.c. city employee is under arrest at this hour charged with the murder of 13-year-old blake who was killed more than three weeks ago. nbc news reporter is tracking this story from other d.c. bureau. bring ups to speed. >> the 13-year-old was shot and

killed here in washington, d.c., back on january 7. today more than three weeks later the suspect jason lewis turned himself into d.c. police. the former d.c. parks and recreation employee was rained this afternoon and charged with second-degree murder. this all ghana cording to court documents when he heard noises outside his home and saw someone who appeared to be tampering with a vehicle. lewis told police he went outside and yelled, what are y'all doing before firing multiple rounds. some of which hit blake. and others called a get away vehicle. police said today surveillance video which has yet to be released to the public proved integral to the investigation and captured others breaking into cars in the area ahead of the shooting. along with the shooting itself. now the video reportedly shows blake yelling, i'm only a kid. i'm sorry. i'm only 12 according to police chief. and in a press conference this morning, he talked about the impact the shooting has had on

his community. >> this young man shouldn't be dead but he is. and now again, we have to go through the course of judicial process, something that would never bring him back but deal with the family, deal with, you know, koran's relatives and school mates. a lot to unpack. when you add to that a video information that we were able to glean from the investigation personally, you know, i'm a father. it impacts me. >> now lewis who legally owns the firearm he used is claiming self-defense here. he said corian blake was running towards him. lewis is being held without bond at a d.c. jail. aaron? >> gary, thank you. seven western states have missed a federal deadline set for today to address a colorado river water crisis. that river provides water to 40 million americans and has been suffering from drought for nearly two decades now.

here's nbc news' senior correspondent with more. stretching from the rocky mountains to the gulf of california, the colorado river gives fresh watter to people across seven states. but drought, climate change and a growing population has sh rufrpg the river's water flow to the lowest levels ever. the deadline today for states that rely on the river to figure out how to share that limited water supply. if they don't, the federal government will step in to do it for them. this all started back in 1922. the colorado river compact was signed. dividing the river's water use by something called acre feet. what is that? it's how much water you need to cover an acre of land in a foot of water. the upper basin states, colorado, new mexico, utah, wyoming, were supposed to share something like 7 1/2 million of the acre feet of water every year. and the lower basin states, california, nevada, arizona, alotted about 8 1/2 million per year. mexico, where the river meets the sea, got 1.5 million.

okay, fine. a lot of numbers. here's what you need to know. the math worked as long as the river provided about 17 million acre feet a year. but that number has been going down. and fast. in the last three years, the river's water levels are so low that those original locations are impossible. the states affect ready trying to figure out what the new map should be themselves but so far no luck. everybody's got a reason too. the upper basin states say they cut half the alotment. nevada cut by a third. arizona which receives the least amount of water from the river says more people and agreements with native-american tribes prevent them from making any cuts at all. and california which gets the most amount of water from the river points to its big agricultural industry as one reason why they can't cut back either. without a simple solution and with a water crisis growing, the federal government now set to step in and force these states to cut back quite a bit.

>> yesterday six of the seven states gave the federal government a last minute proposal outlining possible water cuts. water officials say the plan is not an official agreement but a framework. california uses the largest share of the river was not included in that proposal. nearly two years after the attack on the u.s. capitol, a final report was released by the house committee created to investigate the events of january 6. now a team of former federal agents and prosecutors are suggesting that there are major findings that were left out of that financial report. we have more on this nbc news exclusive. the team spent a year investigating the response of various government agos to january 6. talk about what stood out to you. what were the most surprising findings? >> it actually wasn't terribly surprising aaron. private searchers and law makesers have come to the same conclusion. but it's significant that the

most comprehensive investigation into the january 6 attack found that while donald trump was the proximate cause of the riot by giving that speech and urging people to go to the capitol, law enforcement bears some share of the blame because according to this analysis, law enforcement failed to act on reams of available intelligence warning that people were coming to the capitol to do violence. and, therefore, there wasn't a secure perimeter. the capitol was not protected and overrun by a mob. >> so we have the group of people, the investigators who were agents and prosecutors at some point in their careers. why did they think the findings were omitted from the final report? >> we're told by people familiar with the committee's work is that the key lawmakers on the committee including liz cheney and the chairman bennie thompson did not want to detract from the focus on donald trump. they wanted to send a message that was apparent in all the hearings and in the final report that donald trump caused this. and they felt that in order to

focus on law enforcement intelligence mishaps and failures, it would give trump's defenders a talking point, a way to say it wasn't all his fault. the people that spent the year of their lives looking into this are not saying what that conclusion s they feel their findings deserve a chance tore aired, aaron. >> ken, thank you. you can see more of ken's reporting to night on nbc "nightly news." after weeks of defiance, george santos is making his first concession since it was revealed he lied about portions of his background announcing to day he is step ago way from committee roles in the house, quote, until i am cleared. it comes as a new poll shows the majority of voters in his district want him to resign. nbc news capitol hill correspondent joins me now. this is the first concession he made to this point. why not? >> that's right. it appears as though george santos does not want to be a

distraction. at least that's what he said in a statement today. he did make it clear when pressed by reporters to day that he has no plans to step away from his position in congress. >> you hear him saying no he is not planning on resigning. in fact, said in that statement he expects to be cleared. this is not him resigning from the committees. he is just stepping back while the investigations into him continue. he hopes that once all these investigations run their course that he'll be able to be full participant as a member of congress. kate? >> and last night santos met with house speaker kevin mccarthy, fellow republican. does that meeting, did the speaker play any role in this decision today? >> yeah. i don't think there is any doubt that kevin mccarthy played a big role in all of. this you know, santos made it clear he was making this decision on his own. he was voluntarily recusing

himself if the positions. but we're told that kevin mccarthy did suggest this as an option for santos. and, you know, this is a way for kevin mccarthy to have it both ways. show that he is taking some level of action against santos with all these investigations that are swirling around him. but it does still allow kevin mccarthy to have santos' vote on the floor of the house of representatives. he'll still get that vote. and that's important because republicans only enjoy a four seat majority right now in the congress. so mccarthy needs every single vote he can get. santos has proven himself to be very loyal to mccarthy throughout this entire process. so it's not a surprise that when mccarthy made this suggestion that santos agreed to take this step. of course, it could take some time for all these investigations to run their course. there is an ethics committee investigation here in washington. will investigations at the state and federal level back in his district in long island. before all those get resolved though, santos will remain a

let's talk about housing. according to recent data from the website zillow, home values have decreased in the bay area. home values have increased in sonoma county. >> the home values and amenities of living in the north bay, including sonoma, marin county, are mostly tied to the lifestyle amenities. >> let's talk about where prices are down. many factors in the housing market are better for buyers, especially here in the bay area. better for buyers than in the past two years. specifically, more homes on the market and for a longer period. buyers aren't stuck in yesterday's bidding wars. they might today pay less than the asking price. what a concept. on the flip side, most home buyers need a mortgage. those are still incredibly expensive.
