bit, if you notice the flag there and scary winds off here. it is spinning close to the bay area. i will tell you what's happening out there, right off the coast we have seen some thunderstorm activity on over into concord, as well. i saw that on radar at 4:45. you might have heard it, too. we have storm ranger up and running. i'm going to see where the highest rain rates are right now. if you were driving over the san mateo bridge, you got this cell making its way through. coming up in my forecast, we'll look at other parts of storm ranger and help you plan out your sunday around the bay. >> cynthia, thanks. a tree came crashing down last evening on 280 south bound on the peninsula. it caused a partial shutdown of those right hand lanes. the good news is, nobody was

hurt by the downed tree, but it caused a backup for a couple of hours before crews could clean it up. you can track the weather any time with our nbc bay area app. we will send alerts before the rain starts to fall in your neighborhood. plus, access to our exclusive mobile doppler radar. download it for free on your apple or android devices. a san jose police officer is recovering after being shot. it all started with a simple traffic stop, a shooting, and then more shooting at an east san jose home. andres brinder from our sister station has more. >> reporter: the owner let us inside to show us the bullet holes from that shooting as well as surveillance video as it went down. this san jose man says he's scared. he doesn't want us to use his name or show his face.

he says he'll never forget what happened saturday morning. he says he heard five shots, that he didn't know what was happening until he saw police. then they asked him to go outside. he showed us several bullet holes. the surveillance video shows officers in his home. it was the end to a wild night that started with a traffic stop earlier. police stopped a car, then shots were fired back and forth. you can see one of the patrol cars riddled with bullets. the suspect took off but was located at the home we just showed you. >> officers did not shoot back. one officer was struck in the leg and transported to the hospital. >> incredibly grateful to hear that the officer sustained nonlife threatening gun shout wounds. >> reporter: the suspect is facing attempted homicide

charges. san jose police will have more information about the shooting next week. andres brender, nbc bay area news. oakland police are investigating how a person became stuck inside a sewage hole and died. officers were called to broadway near broadway at 7:30 yesterday morning. when they arrived, police found someone unresponsive inside. firefighters got that person out, but it was too late. tyre nichols' mom, whom he called out for while being beaten by police, spoke in sacramento yesterday in celebration of his life. nichols grew up in sacramento and was known for his love for skateboarding. the memorial was at a skate park where 300 people gathered, including family members, his brother and mother. rovon wells expressed her pain and anger over her son's death

flying over sensitive u.s. military sites. after the giant white orb was spotted over the carolinas, senior defense leaders say an f-22 fighter jet fired a missile at the balloon, sending it into the ocean. joe biden talked about his decision to shoot it down. >> i ordered the pentagon to shoot it down as soon as possible. they decided without doing damage to anyone on the ground, they decided the best time to do that was over water. >> reporter: this triggered a stern response from china, insisting the flyover was an accident, and china reserved the right to take further actions, calling the move an obvious overreaction and serious violation of international practice. dr. nancy park, who teaches chinese history at cal state east bay, says the president didn't have a choice but to

shoot down the balloon. >> i think politically, it is the right decision, because not shooting it down would give the impression that it's okay to violate u.s. air space. >> reporter: she questions whether china's top leaders were behind the balloon. >> it doesn't seem to me that this balloon was sent by the top leadership. many experts are saying that it's a decision on the part of maybe lower level military. >> reporter: the incident has dealt a severe blow to already strained u.s.-chinese relations. it prompted secretary of state antony blinken to abruptly cancel the high-stakes beijing trip aimed at easing tensions. republicans are criticizing joe biden for not taking swift action. senator thom tillis tweeted, now that this embarrassing episode is over, we need answers from the biden administration on the

decision-making process. communist china was allowed to violate american sovereignty unimpeded for days. biden administration leaders say they're confident the balloon was seeking to monitor sensitive military sites. administration officials also say a second surveillance balloon from china was seen flying over central and south america. marianne favro, "today in the bay." we're going to come back locally and talk about the rain. despite it, the streets in san francisco were packed with people trying to catch a glimpse of the annual chinese new year parade, for what's billed at the largest lunar new year parade outside of asia. there were giant floats, musicians, lion dances and dragons. police were ready along the parade route, even in the parade, saying they had more staffing than any year in he cent memory. we spoke with visitors from all

today, a republican on the house intelligence committee, had tweeted he was worried the administration was not taking it seriously enough. but now that they have done something, it's resulted in a tense exchange between the two nations. what is the bigger concern here, the balloon or the relations? >> i think the relations are the bigger concern, if you will, but the balloon, i think it's symbolic, and i think you will hear that from mike turner today, he believe there is is a lack of urgency of acknowledging that the military threat from china may be more near term than we appreciate. you know, i think if you were to try to split and decipher the sort of become and forth and concerns about china, i would say democrats are more concerned about the economic threat that is china, and americans are more concerned about the military threat that is china, but they agree that china is a threat to

sort of america's ability to lead the world in one way or the other. and i think what you are hearing from turner is that line of republican criticism, they feel as if he's just not tough enough on the military front. he believes this balloon was speaking information on how we command and control our nuclear arsenal. if you look at where he says this balloon was going over, it's pretty obvious that's what they were -- they were doing there. i think the biden administration would argue that -- and i think what they are trying to say -- we were able to jam their signals. we'll get more out of this getting the way we got it than if we shot it down in the front end. i think a lot of it we will have to wait and see what we learned from this balloon, and i don't think we'll get a briefing from what they learned from this balloon. >> i suspect you're right about

that. we'll stay in the dark, so to speak. quickly, before i let you go, looking ahead to tuesday's state of the union, joe biden's approval ratings remain low. biden has a large slate of achievements. now he has a january jobs report that crushed estimates, unemployment hitting a low since 1969. how does he change the narrative, or is it just that everyone is still focused on inflation? how should he position himself going into tuesday? >> look, i think that on the economy, you know, perception always matters more than reality. that's not fair sometimes, but that is how people feel about the economy, not necessarily -- sometimes it's about having a job or not. this is not one of those times where access to jobs are how people are judging this economy. they're judging it more about how much can they spend?

so inflation has hit that hard, and we're feeling insteady post pandemic. until we feel that stability, i think that's going to have some delay in some of this accruing to joe biden's benefit. but i think the other issue here is, we're so polarized and we're so, i think, scarred still from all things donald trump and biden versus trump. i think biden is dragged down by the negative ratings of trump, as well. and i think there's an exhaustion for both of them and it doesn't help biden's numbers. >> we aired "meet the press" before the show this morning and i saw that interesting conversation about nikki haley. thanks, chuck. good to see you. about an east bay man whose body was found near pebble beach. the remains of 27-year-old zachary nelson washed ashore at sand shell. last sunday four people went diving, but only three went back. nelson was from newark, his friends tell nbc bay area that he helped launch an academy to empower jewish youth and known for going above and beyond. his family and friends are heart broken. more than 2,000 people came to his memorial earlier this week. an institution in the beauty business is closing its doors in oakland for good. yesterday was the last day for the universal beauty supply on telegraph avenue. it's been serving the community for 50 years. the store specialized in health and beauty products for black men and women. the owner hoped to pass the

the first full week of february with some clearing out. let's take it to the storm ranger, and remember, you can see storm ranger on your phone, see when the rain is going to move into your neighborhood. neighborhood by neighborhood right now at 7:22. we see rain moving in over the marin county coastline out there, pushing into san rafael. and then look at this bad boy about to push into san francisco. where you see those pockets of orange and yellow, that's where there's a little more intensity with this rainfall. right now, currently has moved over half moon bay, moving into areas of san mateo and redwood city, moving over livermore over the next couple of minutes. if you are driving in any bay area roadways, be careful of this rain. we could see some down bursts with slick roads left over from the system last night. closer into morgan hill and

good morning. it is sunday, february 5th, just shy of 7:30 on a stunning morning. wow, glowing skies and rainy skies over san francisco and crashing waves, as we look out on a windy and chilly morning. thank you so much for starting it with us. hopefully you're warm and safe inside. cinthia pimentel joins us with a quick look at your microclimate forecast. you say this is just the beginning, we have the potential of thunderstorms? >> red in the morning, sailors take warning. we see the sun rise over the bay area, and right here in our studio, we just heard some thunder. so if you hear thunder roar, go indoors. as this storm exits the bay area, that's what we can see in the forecast today. we'll see a chance of thunderstorm activity, and we can see some heavier pockets of

earlier along king and story roads where san jose police stopped a car, then shots were fired back and forth. the suspect took off but was later found. >> the suspect shot at the officers. officers did not shoot back. one officer was struck in the leg and transported to the hospital. >> the suspect was arrested and is now facing attempted homicide charges. san jose police say they'll have more information about the shooting in the coming days. happening today, oakland police chief laron armstrong will hold a press conference regarding his request to be reinstated to the police department. last month, he was placed on temporary administrative leave following a report from a law firm that determined he mission handled two internal investigations. the report suggests opd failed to hold an officer accountable in two incidents.

surprisingly, a lot of families will be declined because fraudsters filed in their name first. if that happens to you, you need to act fast. and here's how. >> reporter: here's how it happens. a bad guy files a phony federal tax return with your social security number on it, which they can get easily on the dark web. then you file for real and your return is rejected because the irs sees a duplicate. the irs says the first step is to fill out a form. of course there's a form, it's the irs. it's form 140039. download it, print it and fill it out. next, print out your return on paper. once there's an identity theft issue, you can't file electronically. then attach the form to your return and mail them according to the instruction. next, the irs will send you a

letter acknowledging it got your affidavit. then your case will be researched. what happens after the investigation? the irs says you will receive notification that your case has been resolved. after closed, you might be enrolled in the identity protection pin program. you will get a new pin each year to file, and ideally, the bad guys won't get their hands on that number. >> christopher always with the great information. thanks. it would appear that the chinese surveillance balloon floating over the united states was anything but an innocent venture that studied the weather. the department of defense noted its data gathering capabilities. but what does it mean for the u.s. and the relationship with china? and what about attitudes of china here at home?

larry gursten joins us. i touched on this briefly with chuck todd. can you paint a general picture how we got here? >> china has become a rival new york question about it. they're a huge economic and now military power. three issues come to mind. first, they are an economic power in australia, in africa, where they are investing billions of dollars to withdraw minerals, precious minerals that we use for electric batteries and other things like that. secondly, of course, there's the relationship that they have in the south pacific. the south pacific is very important. it's a major shipping channel. because it is a major shipping channel, the chinese presence -- they constructed an artificial island for military planes. and then there's taiwan, the relationship, taiwan is 100 miles away. the chinese have said since the chinese left to go to taiwan

after world war ii, that this is theirs. and the taiwanese government feels differently, and there's a tension there. you put those three things together, and we have a lot of issues with china. they have only become more explosive with this balloon. >> okay. so australia, the south pacific, taiwan. that's a lot. so what about the impact of the development of our relations with them at home? >> right. asian americans have had a hard time in this country in recent years. president trump talked about the chinese virus. that animosity toward asian americans that some people have was always bubbling below the surface has come out. we have seen hate crimes soar in san francisco, the bay area. we have also seen hate crimes soar throughout southern california. i noticed a article about gun

purchases for asian. it's something to watch for. >> that's really scary and unfortunate that they feel attacked or unsafe. what do you think we can expect in the coming days? chuck todd touched on perhaps we will never know what was in that balloon or what it gathered. >> that's a military intelligence issue that i think will work itself out one way or another. and chuck is right, we probably won't know very much. just a topic thing. i think closer to home, we've got to be careful about what happens here in the coming days, weeks, and months with respect to hate, civil liberties, for chinese americans and asian americans in general. this is tough. and the country and the government, particularly the police, need to be diligent on this. and we need to think about these relationships and perhaps think twice about the kinds of issues going on. and be careful in terms of the

taint for all ages from 9:00 a.m. to 5:00 p.m. right there in chinatown. happening today, oakland police chief laron armstrong will hold a press conference regarding his request to be reinstated. last month, he was placed on temporary administrative leave following a new report from a san francisco law firm which determined he mishandled two internal investigations. the report suggests opd failed to hold an officer accountable in two separate incidents. according to sources within the police department, we learned the officer was tied to a hit and run in san francisco, and later that same officer allegedly misfired a weapon inside a police station service elevator. chief armstrong will speak today at a full gospel church at 1:00 p.m. more rain on the roof right now. cinthia has one last look at the forecast. what a beautiful look at

pacifica behind us. >> not as beautiful as you. >> potential of thunderstorms? >> yeah, if you're on the coast, please be careful. i was looking at storm ranger, and we might see that off the coast to push on through. right now over the city, we talked about it. we were seeing some high rain rates that has also moved into parts of san jose. we heard the hail a couple of minutes ago. then you can see storm ranger scanning the skies further to the south bay and we can see some rain here, as well. to the seven-day forecast, moving inland, we will see a breezy day todd as the last of this storm system exits the bay area. so that's going to leave our temperatures running pretty chilly today, on into tomorrow morning. but then as we move through the workweek, seeing much-needed drying ahead. look at thursday and friday. some gorgeous days around the bay area, inching close to 70 degrees.
