facing accusations from someone who claims a massage therapist crossed the line. details on a lawsuit being filed today and the bay area location being named. this is "today in the bay" streaming live on roku, amazon fire, and online. a very good wednesday morning to you. 5:00 right now. thanks for starting your day with us. i'm laura garcia. >> i'm marcus washington. we want to get started. let's get to meteorologist kari hall with a look at the forecast. are we going to need the coats? >> yes, it's very cold. temperatures in the mid to upper 30s and napa 39 degrees. the coldest temperatures are 35 in fairfield and in santa rosa. we're 40 as you step out the door in oakland. as we take a look at santa rosa right now, upper 30s there. we are seeing our temperatures starting out very chilly, but there will be a lot more sunshine today compared to yesterday, and a slight boost in temperatures as we reach into the mid-60s for today. even upper 60s for san martin

this afternoon. we'll be tracking a warm-up in our fork and i'll let you know if there's any rain coming. mike, you were looking for flashing lights. >> we see lights stacked up traveling south across the golden gate bridge. crews are not clearing, so no traffic break just yet. from the robin williams tunnel, you see an easy drive so far getting into the san francisco. you see little blips from time to time, so there does appear to be a crew past spencer, as it still registers on the grid. same thing in the tri-valley. 680 northbound still registers and a little slowing as crews are set to clear. if you look closely, a little slowing heading into the area. they may be traffic braking for those folks. you're at speed coming into the area from south county. >> thanks, mike. attorneys plan to announce a lawsuit filed by a woman who claims she was sexually assaulted at a peninsula massage envy.

>> bob redell is live for us in burlingame. this is the same location where a similar claim was made before, right? >> reporter: yes, back in 2018 several women alleged sexual assault at several massage envy spa locations throughout the state of california, including one assault that they say took place at this location behind me here in burlingame. later this morning, the attorney for another woman will file this lawsuit that you can see on your screen. they'll be filing this in superior court. the woman, named jane epstein, is expected to speak to us during a 10:00 a.m. news conference. she alleged a male employee at this location sexually assaulted her in may of 2017. now, epstein's lawyers claim that the burlingame massage envy location knew that this man was a sexual predator who had sexually assaulted another woman back in 2013, but didn't report him to police, nor did they fire him, according to the lawsuit. and they allowed him to go into a dark, closed room with

epstein. we're waiting for massage envy to respond to the latest lawsuit. this is how they responded to the 2018 lawsuit that alleged sexual assault by an employee named brandon davis. quote, the franchise location informed us of only one inappropriate conduct incident involving brandon davis, which resulted in his termination and restriction, meaning he is not eligible to work at any massage envy franchise location. no other incidents involving mr. davis were reported to us. reporting live here in burlingame, bob redell, "today in the bay." >> certainly a popular establishment. bob, thank you. we are following some breaking news. the death toll from the massive earthquake in turkey and syria sadly keeps growing. it's hard to believe, but it's now reached over 11,000. here is a live look in turkey where thousands of search and rescue personnel are trying to scour the damage and destruction. they're looking for survivors. amid this tragedy, people here in the bay area are organizing

to try to help those victims. organizations like shelter box are moving faster than ever, packing donations, sending money, and activating emergency response teams with volunteers. the first team already en route to syria right now. the organizer of a turkish band calls songs of the future says her family and band are sending money to family members who have been displaced. >> they lost their homes, they lost hospitals, they lost everything. they lost schools. so maybe we will dedicate our efforts to build new schools for these kids. >> the band's next event has been pushed back until may, but they say they'll keep working in other ways to raise money for the devastated region. reaction is pouring in following president biden's second state of the union address. last night's speech was the president's first before a divided congress. "today in the bay's" brie jackson is live for us in

washington with more on what was said and the republican rebuttal. brie, we heard contrasting messages there. >> reporter: that's right. there was quite the contrast, marcus. good morning. well, president biden urged congress to work together and finish the job, which we heard him repeatedly say last night, finish the job on key issues like police reform. meanwhile, arkansas senator sarah huckabee sanders f blasted the policies and called president biden unfit to serve. >> mr. speaker, the president of the united states. >> reporter: president biden laying out a story of america's resilience during his second state of the union address. >> two years ago democracy faced its greatest threat and today, though bruised, our democracy remains unbroken. >> reporter: touting accomplishments since he took office -- >> 12 million new jobs. more jobs created in two years than any president has created in four years. >> reporter: the president was

>> brie jackson in washington this morning, thank you. coming up on "today," savannah guthrie reports live from washington, d.c. with more reaction and analysis from president biden's state of the union address last night. coverage starts at 7:00 right after us here on "today in the bay," and ahead at 5:30, we will speak live with bay area congresswoman about her reaction to the speech. relief is coming for those impacted by storms in december and january. fema, along with state and county officials say they will provide employment assistance, records replacement, help for veterans and information on housing options. last month san mateo was added to the disaster declaration for california, following our recent rainy winter storms. it means homeowners can also apply for individual recovery assistance. the center will open tomorrow at the san mateo county events center. it will operate daily through

next wednesday from 9:00 in the morning until 7:00 at night. 5:07 on your wednesday morning. beautiful live look at the golden gate bridge. it's a chilly one, and, boy, if you're crossing it right now you better be in layers. throughout the bay area, a cold start. >> it is, and for that commute you may have the heater on inside the vehicle to try to keep up with these outdoor temperatures as we are starting out with a lot of upper 30s and low 40s. we're taking a look at our commute across the peninsula and we are in the low 40s. temperatures will hold steady for the next couple of hours but there will be much more sunshine. even though it's dark, you want to make sure you have those sunglasses for later today, as we are going to see our temperatures headed for the upper 50s by noon. eventually reaching 62 degrees here in san mateo. 64 in hayward and dublin, a lot of mid-60s for the tri-valley. it could be as warm as 68 degrees in san martin today and

64 in napa. our temperatures continue to get milder. we'll talk more about that, as well as changes in our air quality coming up in a few minutes. mike, stopping at the gas station, where can we find lower prices? >> it looks like things are holding steady for the number of prices i'm seeing. in the north bay, one spot, lucky service on sir francis drake under 4 bucks. better in contra costa county, a few spots to start with, the best is $3.89 in con record, the 76 on monument boulevard. the best in santa clara county is the best in the by the way, cupertino, $3.69 at great gas. thank you to our friends reporting from gasbuddy.com. let's look at the communities around the bay. we're looking toward alameda county, north 680, we saw more slowing and then everything cleared approaching and through

we're looking toward the north bay, headlights south through san rafael. a nice, easy drive. everybody can have their own lane. nice drive all the way from santa rosa to the golden gate bridge. we're looking at crews clearing. i'll show you the east bay, a little change coming up. happy wednesday to you. head of the fed, jay powell, spoke in public yesterday and said more rate hikes were coming. the fed is really struggling to slow the economy in order to slow inflation. uber reports profits today. microsoft says it will incorporate chatgpt into its bing search engine. goldman sachs say they expect prices to fall to levels not seen since the global financial crisis. that could be a reduction of as much as 25%. goldman sachs expects phoenix and austin will suffer that same fate. it's also predicting mortgage

rates will go up to 6.5% by the end of the year and warns those who bought in late '21 into 2022 will face the highest risk of delinquencies because, according to them, those buyers bought at the peak and would be under water as prices fall. now, this all sounds terrible, but do keep in mind how bad the big banks, goldman sachs in particular, were at predicting the last crisis. >> obviously, high-tech layoffs are pressuring home prices downward. zoom the latest to cut staff as many as 1,300. zoom, as everybody knows, grew exponentially during the pandemic. ceo eric young says the company overhired, grew too quickly. credit to eric there, most ceos have said exactly that. google said that. google's ceo said he bore full responsibility. but young says he's giving himself a 98% pay cut for his

mistake. >> twitter executives will face a congressional hearing today. the house oversight committee wants to know more about twitter's efforts to quash an article about hunter biden's laptop. twitter back then, pre-elon musk, wouldn't let users link to a new york link about hunter biden. twitter quickly reversed its decision. twitter still prevents some users from posting links to news stories, disabling links to a bbc documentary about indian prime minister modi, for instance. a lot of today's questions are going to cover familiar ground. twitter has talked about this before congress. they have said it's a mistake, they explained why it happened and how they rectified it. i think most congresspeople, when the tv cameras face them, are going to pretend like this has never been discussed before. >> interesting to see. it's always interesting. >> it will make good sound bites and we'll have them tomorrow. >> thanks, scott. good tv coming this weekend. the super bowl, maybe you love

to watch the game, maybe you like to sit back and watch the commercials. here's a live look at state farm stadium in arizona, where thousands of fans will watch the eagles take on the chiefs. among the fans there, two marines, they haven't talked in over 20 years. but they reconnected for an incredible life-changing reason. billy welch and john gladwell first met serving in the marines, but lost touch. in 2019, welch posted that he was sick and needed a kidney donation in philadelphia. gladwell sprang into action, placed a call to his friend that would actually change billy's life. >> i'm, like, are you sitting down? i'm, like, yeah. and he says, well, it turns out i'm a 99% match and i will be in philadelphia next week and we are going forward with the surgery, and tears of joy started leaking out of my eyes.

wear -- i'm sorry, in your infant wear, so young. >> i've been here since 1920. >> please take it away with different numbers. it feels like 39 outside. let's take a look at our live view in dublin right now. it is already a busy start to our wednesday morning, the last few days before we make it to the weekend. we're also going to see changes in how the sky looks. it's going to start to look a little hazy because of worsening air quality. let's talk about what's going on. it's been dry for a while and typically during the winter months when we have a stretch of dry weather, we have high pressure setting up off the coach. high pressure brings in a clockwise wind flow but causes the air to sink back down, causing an inversion layer. if you have calm winds, the air is not mixing up and that stagnant air causes pollutants

to settle in the valleys and keeps it from really rising up. so whatever we're putting out there, whether you're driving or burning anything, you are creating worsening air quality. we're going to see that today, as well as in parts of the coast, the east bay and santa clara valley where we will see the worst air quality. it will continue to be moderate tomorrow but then we'll see things improving. speaking of improvement, we're taking a look at our res sore levels now at 80% of the historical average. now, these numbers have gone up significantly since we had all of that rain and now the sierra snow melt is also helping to fill up the reservoirs. the sierra snowpack, on average across the state, is still at 204% of normal. we could wrap up the season at this point at 136% of its normal sierra snowpack. there's not a lot more rain or snow in the forecast. there's a couple of very weak systems that look like they kind

of fizzle out before they get here. there will be some additional light rain, but we're not expecting much of any of that, at least for the next week. so rain chances very slight. and our temperatures will be warming up a little more for the next couple of days. but then take a look at the weekend. we're only up to about 57 on saturday with a mix of sun and clouds, and then a slight boost in temperatures for sunday, and then some low 60s for the start of next week. mike, you were looking at little changes. >> that's right. we're hoping for any signs of any problems and -- i guess we're hoping for any signs of problems before they happen. haven't seen any of those. we're looking at 37 with no slowing. that would be a normal schedule. same thing for highway 4. we have green sensors on the longer drives right now. wednesdays, we tend to see more traffic. we've seen that be the focus, tuesday and wednesday. little changes i've seen, highway 24, that's cleared up through the area. so has the area around richmond

where we had slowing as crews, i believe, started moving around. golden gate bridge cleared of any activity and east 80, we've seen the last 15 minutes show speeds slow a little bit as clears move toward the fremont side. so the spans are moving slowly, just picking up the volume a bit. we've been seeing this stick around, out of cupertino, south 85 just below the speed limit, brakes tapping. there may be some activity. it just changed to green. they just wanted some attention. the rest of the south bay, coming in out of the south county, we're hearing about a crash out of gilroy, so there's a little slowing. i'll get more detail and we'll track to make sure it doesn't affect your early drive. this is where we expect to see early slowing kick in but not for a half hour, 45 minutes. next here on "today in the bay," nbc bay area responds.

livermore, we're at 34 in santa rosa, and it is 40 in oakland. as you're making your way out the door for the commute in antioch, low 40s right now, mostly clear sky to start. as we go into today, more sunshine, with our temperatures warming up nicely for later on this afternoon. mike, you were tracking a new crash in concord. >> this is bad timing. highway 4 tends to see slowing and we see that in the upper right corner. we see typical slowing out of bay point into concord, but now more slowing where a crash has been reported, four, possibly five vehicles may be involved. no reports of injuries. still getting details. another crash may be in the area, sounds like different details around port chicago highway and that's a critical section for your morning commute. that will affect folks getting into concord but not for the interchange just south. all other points we're looking at a smooth drive, except highway 101 started slowing

already. we'll follow up on that. back to you. it is 5:32 right now and happening today, the man accused in the violent attack at former house speaker nancy pelosi's san francisco home will be back in federal court. "today in the bay's" kris sanchez joins us live this morning. this is the first court appearance since the release of that really hard-to-watch police body cam video. >> right, and this is the very first time that we will see david depape in a courtroom after that video was released. cameras will not be allowed. we will be allowed inside, however. but surely on the minds of everybody will be the video that was released the night of the attack. this video is, again, likely to be on the minds of everyone in court. it's the san francisco police body camera video of david depape answering the door with paul pelosi, shortly before refusing the order to drop a hammer and then going on to beat paul pelosi with it. this happened on october 28th of

last year at the pelosi home in pacific heights. depape is now facing federal charges and state charges in connection with this alleged attack and he has pleaded not guilty to those charges. just last night paul pelosi attended the state of the union address, where he got a standing ovation. the president saying that depape was unhinged by the big lie, using the very same language that insurrectionists who stalked the halls of the capitol were chanting on january 6th. those are the president's words. now, the 82-year-old underwent surgery to repair a skull fracture and injuries to his right arm and his hand, following that incident. he was seen in the chambers wearing a hat. david depape is due in court for the hearing at 10:00 today. in san francisco, kris sanchez, "today in the bay." >> thank you, kris. 5:34 this morning. president biden delivered his state of the union last night. his first before a divided

congress. >> my republican friends, we worked together the last congress, there's no reason we can't work together and find consensus in this congress as well. [ applause ] >> the president pushing for unity. the key focus of the speech, police reform, the economy and climate change. >> congresswoman anna eshew and her guest were in attendance. she's the head of the charity that's helping victims of last month's mass shooting that sadly left seven dead. they both join us live from washington, d.c. this morning. thanks so much for joining us. i want to start out with you, representative. what do you think was a key moment from biden's speech that really stuck out to you? >> his call for bipartisanship, because it is something that my constituents talk to me about. they want to see congress unified to produce good things for people across our country.

and i think it's a hallmark of president biden, both when he served in the congress and now as president. some of his last words were, the state of our union is strong, and it's strong because of the historic legislation, much of it bipartisan, that was passed in the last congress. all achievements to improve people's lives. so it's really an extraordinary record of bipartisanship on infrastructure, so much of the legislation that has not only improved our economy, where what needs to be up is up, what needs to be down is down, inflation is going down, the price of gasoline has gone down, unemployment is at a record low,

and his plans for the future to keep building on what has been achieved. so i think that it was -- it was a speech that was celebratory, because there's much to celebrate, but there's much to build on. and i think as the republicans, i think, misbehaved, let me just use that word, he really rope a doped them because we know their plan to cut social security and medicare, when the spotlight was on, they didn't like it. so he said, well, i think that's settled now. so joe biden is the average joe in this country, and so his priorities are directed to the middle class, to those that aspire to it, the unfinished agenda in our country, and the

possibility. so it was, once again, it was really a privilege to be in the chamber, to hear him, to see him, and to think of what we can do in the future. >> the president certainly talked about a lot of things, and dr. hernandez, i want to ask you a question. i know we heard from you yesterday before that speech. you said that you wanted the president to recognize the polite of farmworkers in the u.s. that was not a huge focus of the speech last night. what are your thoughts on what he had to say and what do you think he missed? >> well, i love that he talked about the promise of tomorrow and that working together we can come to make change. he did mention the immigration reform that is needed for farmworkers. i'm very happy about that. but i do think that with the focus that he added about mental health, the call for mental health, that we can apply that

to farmworkers. the call for medical, more medical insurance for everyone, that we can continue to apply that to farmworkers. when he called for gun control that we have to, unfortunately, consider that here in our own hometown of half moon bay. so i think as advocates and as a community, we need to continue to spotlight the need to build human rights for farmworkers and to care for them, really advocating. but i think what the president talked about, his message applies to everyone. and especially as he talked about the fabric of america, those are our farmworkers, and the backbone of our economy. >> thank you, ladies, both. >> thank you. it is 5:39 for you right now. let's take a live look. we're looking at san jose this morning as we get started dark and early.

those temperatures are cold for us this morning. meteorologist kari hall is tracking that for us. 39, it says right there. >> reporter: coldest morning, we've seen a lot of these. we have more ahead. as you're heading out the door, we're all clear in comparison to yesterday where we had high clouds. as you're starting out the door, you do need layers for the start of the day. foster city is going to be in the low 40s and then we'll reach into the mid-50s. it's going to be very pleasant this afternoon and some spots will be slightly warmer compared to yesterday. san martin is headed for 68 degrees. that's one of the warmer spots, compared to 62 in san mateo. we'll get a look at our microclimates coming up. mike, you're tracking a crash in the east bay. >> one crash instead of two. it was right around the 242 area, you can tell by the speed sensors. you see speed sensors starting to improve, four or five

vehicles reportedly involved in this initially, but it may be fewer and there may be less activity on the shoulder. we still have the backup coming through bay point and into concord. the build for highway 37 has kicked in over the last couple of minutes. a build for richmond as well. this is your typical pattern as we show more traffic toward the bay bridge toll plaza. the metering lights should be turned on any second. the north bay, there's some vegetation work going on south 101 coming through marin county from about 10:00 until 3:00. and over the weekend, a full closure for north 680 for this stretch, the entire weekend and the following weekend. so three weekends, including president's day weekend, it will be closed through sunol and you'll use 84. in the south bay we have early slowing in san jose, been starting the slowdown about 5:30, more folks hitting the roadway earlier. fewer folks getting through because of the crash coming into san martin.

there were some things you didn't see coming. >> the shouting from the floor, i thought about putting that in our list of things to watch for yesterday but i didn't because i didn't want to pre-judge anyone. we have been building towards this. a republican congressman yelled "you lie" at president obama during his speech. that congressman condemned by the entire house for his actions. and speaker of the house nancy pelosi tearing up the speech while sitting behind the president in 2020. this speech started out with a bipartisan spirit. the president shaking hands with the new speaker of the house, kevin mccarthy. then right at the top recognizing mccarthy's new position. >> i'll start tonight by congratulating the 118th congress and the new speaker of the house, kevin mccarthy. [ cheers and applause ] >> mr. biden also recognized the

congresswoman from san francisco out in the crowd, calling nancy pelosi the best in u.s. history. our kris sanchez has been reporting that aspect of the story for you. president biden eliciting quite a reaction when he said some republicans, he said, were talking about limiting social security, and sort of got a promise that they wouldn't. >> so, folks, as we all apparently agree, social security and medicare is off the books now, right? [ cheers and applause ] >> all right. >> as we fact checked the speech, we had no issues with most of the president's claims. at worst, he exaggerated or left out context. take this one, for instance. >> in the last two years my administration has cut the deficit by more than $1.7 trillion. the largest deficit reduction in

american history. under the previous administration, the american deficit went up four years in a row. >> now, what the president didn't say is spending came down and thus the deficit came down as pandemic-era emergency spending came to an end. the pandemic factors into his job claims, too. the president quite rightly saying america added 12 million jobs in the first two years of his presidency. that's remarkable, but, again, you've got to factor in the pandemic. president biden became president as the pandemic was ending. he also claimed america added more jobs in the first two years of his presidency than the first four years of any other presidency. technically true as a total number. but as the percentage, several presidents beat him. there are more americans now compared to then. what did you think of the speech? what were you looking for? what didn't you hear? you can contact me on social media.

was a need for more innovative programs, specifically among our socially isolated seniors. and so just over the years i've been able to increase access to medical care, to healing education, community resources, social connectedness in a way that is culturally tailored and accessible for our socially isolated seniors. when i talk about socially isolated seniors, i'm talking about seniors that live in senior housing sites, low income senior housing sites, that do not leave their apartment, don't leave their building, and it causes issues around getting access to medications, healthy food, social connectedness, like i said. so a lot of the programs that we design are to address those issues. >> britney and i talked about so much more, including how the organization is helping get healthy food to those in need and how you can volunteer to help out. you can watch the full interview

the wintertime when it's dry, it's sunny, and high pressure sets up off the coast. we could start to see some issues with our air quality, so let's talk about what's going on here. this high pressure causes a clockwise wind flow, but it also causes the air to sink down. as it does so, it creates this inversion layer where we don't see the winds mixing out of the very low area where all of that air is being pushed down. so the pollutants settle into the valleys. that just means that with the lack of wind mixing out, whatever we're putting out there, from car exhaust to burning wood or anything that's causing pollutants, it doesn't have a chance to mix out. so our air quality will be slightly worse today. moderate air quality for the coast and the bay, as well as the east bay and santa clara valley. so just keep in mind that we are going to see a little bit more haze in the sky and it's not quite healthy for people who have breathing problems. we're going to see a system

that's going to help improve air quality on friday. it does look like it gets very close with showers, but overall we're staying mostly dry and we do have a dry forecast going into the weekend and possibly through next week as well, as the high pressure remains. a look at our seven-day forecast shows we are going to see temperatures going up and down. so we're in the mid-60s for highs today and then upper 60s tomorrow and then a little cooler once again on friday as the cold front dips in. we'll have breezy winds on saturday, clearing out for sunday, and a touch warmer for the start of next week. mike, you were looking at delays through contra costa county. >> first, let's talk about highway 4. we talked about this crash, still going on and maybe another half hour until they can get the last of the tow trucks on scene. west highway 4 jamming up into concord. that is an issue because traffic is starting to back up. folks will hit willow pass road, and bailey road, those can get
