right now at 5:00, we're tracking rain, we're monitoring the time line and the chance of strong winds expected to arrive later today. it's just a continuation of the most disgusting witch hunt. >> awaiting answers from the grand jury on a possible indictment of former president donald trump. we're live in washington with trump's latest response and how other top republicans are coming to his defense. this is "today in the bay," streaming live on roku, xumo, and online. i'm marcus washington. >> and i'm laura garcia. this morning we're in another micro climate weather alert, and our team has you covered. chris sanchez is live in the south bay, and mike inouye tracking those driving conditions. >> first we want to get better timing of the storm.

vianey arana is tracking it for us. how is it looking? >> we're seeing that the system is starting to move on to, you know, away from the coast and on land. we can see where the biggest impacts of the storm, and yes it's a little bit further south. this is good news for us. unfortunate for southern california, they are going to get the brunt of the atmospheric river. we can't put our guard down because we're going to see the gusty winds move in. you can see santa cruz is about to get some of the rain moved through there. you can see it on satellite and radar. those heavier pockets of rain will intensify in the next two hours as well. catching light to moderate rain through santa rosa, san rafael, fairfield and concord as well, down through the south bay, a little bit starting to come down in san jose, and here's just off the coast, that's going to start to make its move inland. overall, here's what we can expect. the storm is moving in, but the biggest impact i'm going to be seeing from this, aside from the

rain from the santa cruz mountains is going to be the gusty winds. wind warnings will be in effect starting at 7:00 a.m. for the santa cruz mountains, and isolated flood issues. streets that have already been flooded in the past, especially through highway 17. there is a landslide potential. the reason is we've got saturated ground. any rain at this point can be problematic, and this is a little bit more of a colder system. there is a possibility of instability that could bring thunderstorms and even small hail in the area. sierra snow, winter warnings are in effect through that stretch. be mindful of that. let's get a look at how the roads are doing with mike. >> you mentioned rain and also the possibility of complications because of the wind and rain. it's already accumulated in the area. we're over here toward the trivalley. you saw damp roadways on the peninsula, and definitely ponding and puddling possible for the highway 17 and south bay area. we're looking over here toward that closure, that should be picking up.

in the last few minutes, i have seen the slow down shift. still closed up. if there is an issue for land slides and more rain, there's slip out here, and below the roadway for eastbound 580 has one lane closed. may be complications from the rain that comes in. we'll continue to track it of course. back to you. the bay area may need an extended break from the wet and windy weather. we're not getting it just yet. a lot of neighborhoods are bracing for a storm that could knock out power. that we are getting rain here. we are preparing for that. drivers should impact it to impact the morning commute as well. and folks in the santa cruz mountains, they have been preparing for another repeat of the storm that knocked out power to thousands of pg&e customers all around the bay. now, in los gatos, people were topping off their propane tanks, making sure carriers were still working. they are all stocking up on water. >> water company here is based on using a pump to deliver water to the uphill systems and that runs off a generator that reuses propane, and propane deliveries are hard to come by right now. >> reporter: now, we did talk

with pg&e. they say they are focused on the south bay. they are repairing equipment in critical areas. >> all right. we'll definitely be preparing for that rain. pg&e has workers there. on stand by, waiting to see what's going on. the rain is coming, and we want to know what it looks like where you live. tag us with pictures and video on social media. we will be watching for them on twitter, facebook and instagram. tag us @nbcbayarea. 5:04, in washington and new york city, authorities are bracing for unrest in the event of an indictment against former president trump. you can see video of police putting up barriers around the capitol building and outside of the manhattan d.a.'s office, and a grand jury debating the possible charges tied to hush money allegations. so far, there are no credible threats, and several sources tell nbc they are not expecting

to be any developments in that case. joining us live in washington, tracking it all, and brie, if the former president is, in fact, charged, he'll become the first former u.s. president indicted for a crime. >> yeah, that's right. good morning, marcus, laura, it would be an unprecedented moment, but sources do tell nbc news they do not expect an indictment today as the grand jury is expected to meet on wednesday. meanwhile, former president trump took to social media this morning and blasted the investigation. >> reporter: former president trump railing against investigators this morning. >> it's just a continuation of the most disgusting witch hunt. >> reporter: all eyes are on a new york city grand jury today after trump predicted he'd be arrested in connection to alleged hush money paid to adult film star stormy daniels ahead of the 2016 election.

robert costello, a key witness for trump testified monday. >> michael cohen told us that he was approached by stormy daniels' lawyer, and stormy daniels had negative information that she wanted to put in a lawsuit against trump. >> reporter: cohen, trump's former fixer, alleged trump paid him $130,000 to buy daniels' silence. costello attacked his credibility, but cohen fired back. >> pretty much almost everything that bob costello will be once again proven to be inaccurate as it relates to me. >> top republicans coming to trump's defense. >> i believe it's the epitome of weaponization of the federal government. >> i think if this was a misdemeanor there would be more political consequences than legal consequences.

draft a new bill, legalizing a sanctioned red light district. assembly member matt haney shot down the idea. a new supportive housing plan to tackle the city's homeless crisis. landlords in oakland would call on the city to end the moratorium. most will end on april 28th, although berkeley's is now extended through august. landlords argue, oakland's moratorium remains open ended and allows tenants to avoid paying rent. organizers plan to hold a rally and news conference at 3:00 this afternoon, ahead of a council meeting covering the city's covid health emergency. 5:08 right now, taking a live look out in downtown san jose, looking nice and clear right now. of course the rain is coming, and vianey, we have dealt with so much rain. any breaks we're getting, even if it's light rain, i'm here for it. >> at this point, i feel like

we're storm fatigued. hopefully we're prepared because we saw this rain coming, and even though we're not going to get the brunt of the atmospheric river, it's based in central and southern california, i did put this time stamp forward to about 6:30. and you'll notice it's widespread at that point, santa rosa down through santa cruz, morgan hill and gilroy. my biggest concern out of the system aside from rainfall totals bringing down potential landslides in the santa cruz mountain areas is going to be the gusty winds. as the storm system passes through, we're going to be seeing winds really ramp up, especially starting right around, you know, the 8 and 9:00 a.m. hour as a line of showers goes through. all of the areas that you see in red are under a high wind warning. we could see gusts upwards of 60 plus miles per hour in those areas. the areas in the orange is a wind advisory. we're talking 25 to 45 miles per hour gusts, and let me show you the time stamp for some of these. if you notice, i put this forward to about 12:30 around your lunch hour. we start to see some of those

areas in purple. the areas in purple are 50 plus miles per hour wind gust potential. that includes the south bay, livermore, san jose, really that entire south bay stretch. we'll take you through the timing of how much rain we're going to get coming up. mike? >> we could potentially have issues with trees down. highway 17, one of the usual suspects. the rain, no matter what the volume of rain concerned because we have this crack that turned into a landslide. now we have a lane closure heading eastbound on 580 going away from our morning commute. if that is your commute, of course, you're down a lane, possibly two. there are signs that are lit up along 580 warning that they had to close down two lanes. bob redell is going to give us the latest update. below the roadway, i'm concerned what's going to happen with the rain coming in. it's westbound, coming toward us. that's your commute direction, and vasco road, moving very

good morning, it is 5:14, as this storm makes its move, we will see the winds kick up. a wind advisory and a high wind warning go into effect starting at 7:00 a.m. some of the locations with the strongest winds will include the santa cruz mountains and the south bay could reach 60 plus. we'll talk more about the potential impacts coming up in just a few minutes. some of that rain coming through the north bay, but not just this second at this spot in san rafael. that wind vianey talked about farther south with the commute going to kick in around the bay. we're seeing a smooth drive with highway 101 to the city. we'll show you the rest of your drive coming up. good morning, very happy tuesday to you. a high-tech company in santa clara is the latest to lay off. futures, though, calling for a positive open, maybe just maybe we have some of these bank problems solved. we've got first republic right here. head of the treasury janet

yellen just said the government could backstop more deposits if needed. here's the problem. so many big depositors have more than 250,000 in the bank. 250,000 is the most the fdic will guarantee if the bank fails. so the big depositors have been pulling their money out to keep it safe. the government is hinting this morning, it will do what it did with silicon valley bank. it will guarantee deposits of any size, even deposits bigger than a quarter million. all to calm the banking industry down and keep money moving. we're still seeing shares in first republic in san francisco way down, even after four major banks parked some of their money there to reassure depositors. and the fed stands ready to get banks the money they need through something called the discount window. the situation here is super weird. the fed is trying to reduce the amount of cash in the economy by

raising rates, but it's also assuring banks there's plenty of money available. it's like one guy on one side of the boat is bailing water out of the boat. while the other guy on the other side of the boat is bailing water into the boat. so it's hard to say what the fed is going to do tomorrow after its two-day meeting, and that meeting, marcus, starts today. there may be another interest rate. it could be as much as a quarter percent. it will be interesting to see what the fed does. it is stuck with a problem. it has to fight inflation. >> yeah. >> but that process is damaging banks to the point where we're in some serious trouble. and we don't know what they're going to do tomorrow. and that's scary. >> and uncertainty. >> uncertainty is just not a happy place to be. >> not a good thing at all. >> right. thank you very much, scott. now to a look at the white house where a ceremony is expected to get underway today.

there's actually a judge on there. well, he calls himself a judge. in any case. >> all right. we'll continue. sorry, vianey. >> it's okay. the atmospheric river is impacting southern california the most. or is it a storm? >> no. >> it is an atmospheric river because that's where the moisture tap is. let's talk about it right here. they're getting the atmospheric river, the subtropical moisture. southern california, central california, we're getting the outer skirt of that system just a regular low pressure system storm in the way that it's going to move and impact us. so if you're heading to southern california, they've got flood advisories, flood watches, all of that down through central california. here, we don't have any flood watches, but the wind will be main impact for today. notice satellite and radar starting to pick up activity, especially for the santa cruz

mountains. that's where we're going to see some of the highest rain totals. santa rosa. san rafael, fairfield, concord, we have light to moderate rain, and you can see it's starting to move in now for the south bay. but again, those higher totals will be more focused in the south. your hourly forecast by 6:30, widespread rain, so everyone's going to get rain out of this. just not everyone is going to see the rain. this is a colder system, so there is a lot of instability, which could bring up the chance of thunderstorm activity as well into the evening and maybe even hail in some spots as well. the winds, let's talk about the timing for this. high wind warning in the red, you can see that includes the santa cruz mountains. san jose, livermore, danville, because this is more southerly focused, some of the wind gusts could reach 60 plus miles per hour. that's when we begin to see the threats for tree damage. downed trees, power outages, something we saw play out just last week, last tuesday, crazy enough. wind gusts, look at this by

12:30 lunch hour, they really start to begin. the advisory goes into effect starting at 7:00. it's going to stay windy pretty much all day today, even into early wednesday morning. so timing for that is going to be, you know, pretty much expect for that to be all day. snow estimates, winter storm advisory in effect through tomorrow. we could see gusts upwards of 70 plus. 10 to 12 inches, mainly above 7,000 feet, and here's your seven-day forecast. a spotty chance into wednesday, and then into the weekend we dry out. yes, if you look out ahead to next weekend or next monday, we are monitoring for another storm that could make its move once again into the bay area. mike, how are the roads? >>. look over here toward the south bay. that rain will be coming in, and actually south of san jose, vianey is talking about it hitting down in toward the santa cruz mountains. later on in the commute going to get intense. there's 17 as it crosses over 280 coming toward light south bay traffic. the road weather index shows

if you think cameras are totally by vacation rentals, vrbo permits cameras outside but not inside. airbnb has different rules. airbnb says we require hosts to disclose all security cameras and other recording devices in their listings. and that's the first place you should look for a camera. in the listing. look under house rules. say there's no camera listed there. message the host anyway, with a question like this, where do you use security cameras. if you get a cagey answer, let the booking company know about it. once you arrive at a property, you can take a couple of steps to scan for cameras.

remain on and off all day long. we're in the middle of it now. so, you know, about 10:00 a.m. is when the winds start to ramp up. you can see here on satellite and radar, we are going to get rain out of this, but as you mentioned, the brunt of the storm is going to be more focused into central and southern california. rain is starting to push in to santa cruz now, san jose, in through gilroy as well. a lot of this will be based. santa rosa getting light rain through there, san rafael, and in through livermore, now the hourly forecast does show by 7:00 a.m., everyone is going to be seeing rain. actually by 6:00 at that point, that could be light to moderate, heavier pockets through santa cruz. this continues through about 8:30. we do yellow on the map. that means heavier downpours at times, and right as the line passes through, that's when the winds will come into play. right around 10:00 a.m., 30, 40, 50 plus, 60 plus potentially for higher peeks you see in red. that's where the high wind

warnings are. let's check in with mike. >> we're going to show the camera i just showed a few minutes ago. a little bit of water on the lens, mist and drizzle, 280 moves through 17. that is the south bay, what we're talking about, the activity coming in through the area. more blue shows up 84. highway 9 and across the santa cruz mountains, for highway 17. that will be a factor for much of our drive. remember, it's still darker in the drive. that rain on the windshield will make an issue for visibility as well. they should be clear from north 680. i'm concerned about this over here, coming in out of the altamont pass, westbound. that's your morning commute. similar damp and wet roadways, and eastbound, we have one lane closed at least. and that's because of a slip. i want to let you cover that. that's a whole story unto itself. i'll send it over to you. >> with all of this going on, you need to stay with us.

down the adjacent till hillside. this started as a crack in the road, then worsened as the grass and the soil that's been saturated by all of this rain finally gave away. now, as a result, the far right lane is shut down. this is in the reverse direction for the morning commute. so it's not impacting drivers trying to get into the bay area for work but could be an issue tonight as commuters return to the central valley, if caltrans is not finished by then, there is no estimated time when this work behind me will be done. we know, as you saw in the video, this is something they were working on yesterday during the daylight hours. it's continued overnight, and we know it will continue once the sun comes up. reporting live here on the altamont pass, bob redell, "today in the bay." thank you very much, bob. let's get the latest right now this morning. the possibility indictment of former president donald trump. >> yeah, scott mcgrew joining us now. the former president said he would be arrested today.

>> he is saying that. it's only the former president who says today is the day. prosecutors in manhattan have been mum about what's going to happen next. we don't know if the manhattan grand jury will indict trump at all. we do know law enforcement has been prepping in both new york city and washington, but again, individual officers don't know anything more than we do. only that an indictment may be coming and trump has called for protests. the case in new york, of course, involved trump's payments to his lawyer paying him back for paying off adult film star stormy daniels. and falsifying legal documents is against the law. now, do americans think this is serious? it depends how and who you ask. an economist ugov poll asked is it a crime for a candidate to pay someone to remain silent about something that could

affect the election? 72% of americans say, yes, it's a crime. 11% say, no, the rest are undecided. but when pollsters point out that's what trump is accused of, just 45% of republicans say it's a serious or somewhat serious issue. now, keep in mind, the thing in new york might be the first indictment, but it may not be the most serious. there's also a prosecutor in atlanta looking into phone calls that trump made to try to influence the vote count there all on tape. >> i just want to find 11,780 votes. >> and then another prosecutor jack smith who's looking into trump's role in the attack january 6th and the documents found at trump's mar-a-lago home. and more importantly, how trump reacted. did it add up to obstruction.

that obstruction case, if there is obstruction is way way more worrisome for a defendant than the case in manhattan. we'll continue to watch this and see if anything does happen today. >> scott, thank you. 5:37 right now, and happening now, the state department investigating weekend vandalism. this is during a protest at an indian consulate. demonstrators shattered glass there. this has been a chaotic protest, that left some embassy workers slightly injured. i want to show you video of when this happened. protests say the situation escalated when embassy workers got into a confrontation over flags placed in the entrance. they are expressing anger over recent actions taken in india against a separatist leader. san francisco police and other department leaders will host a town hall tonight to address public safety concerns and ongoing staffing issues. he's hoping to cover many of the

challenges the city faces. the meeting takes place tonight in the mission district. it starts at 5:30 p.m. happening now, the nation's second largest school district is cancelling classes as workers starting a three-day strike. here's a live look at los angeles unified school. the closure will affect more than 400,000 students in the district. workers are protesting after failing to reach an agreement over pay with the superintendent of the district. teachers represented by separate unions say they will also strike with the school workers. the superintendent says that he is still willing to negotiate. it is 5:38 on your tuesday morning. taking a live look outside. this time at the san mateo bridge. mike is monitoring the traffic picking up across the bay area this morningment. he'll be up in moments to help you through the morning commute. rain expected today. vianey. >> that's right, and if you live in areas north of the golden gate bridge, you're going to see

the lesser of this storm versus those who live in the santa cruz mountain area. you can see it here on satellite and radar. i'm going to zoom this in, a specific storm system is starting to now come down. you can see some of the stronger cells with the yellow and the orange. moving in some rain through gilroy to san jose area as well. meanwhile, up to the north, a very light rain, santa rosa, san rafael, light rain over fairfield, san francisco, and we are expecting to continue to see this light to moderate rain with heavy downpours at times, pretty much through the entire day. on and off i mentioned through about 7:00 a.m., more widespread. notice at 9:00 a.m., we see some heavier pockets begin to move through, and then it becomes a little bit more scattered. by 1:00, notice rain shadows, san jose, palo alto, half moon bay. it's not going to be a complete washout of a day. the periods of on and off rain, will ramp up, late tomorrow into 10:00. you'll notice a lot of rain is more moderate down through santa cruz.

it's a little bit heavier as well, and that's going to continue even with some scattered possibilities into wednesday morning's commute. notice that's at 7:00 a.m. very light rain totals for most of the bay area. we'll talk about where we see the highest totals. let's check in with mike. >> the south bay and the north bay, we're looking here towards the peninsula. there's light rain on the lens as well. it is traveling around as vianey said right through the area. the green shows you that you'll have wet roadways along the peninsula. no major issues, but more rain coming in, the bridges, the dunbarton, and san mateo bridges move smoothly. westbound 580, critical toward the dublin interchange. we have a crash that should be moving toward the shoulder, slowing for a distraction, we'll watch to see if that develops for your westbound commute. that's coming in out of the altamont pass. it's just fine. we're still about 30 miles per hour just after things start to open up. it is eastbound that bob just told you about. at least one lane closed as you

morning. 25-year-old abigail zwerner is sitting down with savannah guthrie detailing the challenges she's faced. in january, a boy took his gun from his home and put it in his backpack and brought it to school. he then shot zwerner, since then she has underwent four surgeries and says the memories are still fresh. >> how do you make sense of something like this? >> you can't. i'm not sure when the shock will go away because of just how surreal it was, and you know, the vivid memories that i have of that day, you know, i think about it daily. sometimes i have nightmares. >> you can watch the full interview. it's coming up on the "today" show. it's 5:46, and we know wedding planning is hard, at least some of us do. trending for you this morning, one bride is going viral for thanking the person who made her big day possible.

say. >> it's those small details that sometimes go unnoticed: she knows the details. >> that's the key. >> and to be honest, in every day life, too, beyond that, there's small details we need to know about timing wise, wind wise, rain wise, most of the bay area is going to be okay. if you live in the mountains, you have to hold on to this one because the snow is saturated, potential for debris flow going to be a possibility. as we see the system moving through, we definitely start to notice that the rain is beginning to pick up in santa cruz. you can see it right there. some of those heavier pockets of rain and up through storm ranger, we can see santa rosa, san rafael. it's lighter in the stretch. through livermore, san jose as well, and in your hourly forecast, you know, we're in kind of the thick of it right now as far as the rain moving through, but we've got heavier pockets. so not in the clear, just within the frame of what we were expecting the rain originally. this is going to linger, notice

through about 9:00 a.m., santa rosa, san rafael, we get a bit of a wintry mix right up top. there's a lot of instability with the system, which means we could also see some hail chances and thunderstorm activity as well. i took this through about 1:00. you can see it's less organized through the south bay. it will become more of a scattered event, and we'll see the rain begin to kind of move in around 10:00, 11:00. scattered through your wednesday morning commute. periods of on and off again rain. you see the pink color pop up on radar, that's when we could see the wintry mix. let's look at rain estimates. this is going all the way through wednesday. you'll notice where the red zones are. 1 to 2 inches in the north bay, santa cruz, where the purple color is, could still see the pocket of 2 to 3 inches. i think the typically rain is going to see less than that in san jose, however, the storm is more south bay focused. if it does stall out. a lot of that rain will go to

the santa cruz mountains. wind wise, about 1:00, you'll notice it's still pretty gusty. 30, 40, 50 plus for some of the higher peaks, and it's going to stay gusty all day long. as that storm system moves through, which is the reason why there is a wind advisory that will be in place for the santa cruz mountains in red, you can see high wind warnings. for the orange areas. livermore, fremont, you can see the wind inventories will be in place. now, let's talk about what we're seeing because just as a recap in january and february of 2022, it was known as one of the top ten driest on record. we saw trace amounts in santa rosa, and now we're seeing a surplus because of all of the atmospheric rivers we got. we've seen over 30 atmospheric rivers since october of 2022. some are weaker, some are stronger. since the start of january we have seen over 12.

the water update for santa rosa is at 80% to date, in oakland, 96, san francisco, 96%, and even a typical call rain shadowed south bay is at 58%. seven-day forecast, scattered showers through wednesday morning, dry out for thursday and friday. leading us to the weekend. we are monitoring the arrival of a potential system moving through. how are the roads doing? a little bit of rain here in fremont now. you've seen them travel around our cameras. we will blur moisture on the lens, and that will be the issue for drivers as well. that rain is pushing across right on time here coming through portions of the south bay, getting toward the east bay. that will be a factor for folks coming into silicon valley or through the peninsula area as well. we're looking at west 580. the crash registered on the chp report. i think we might have gotten things moved to the shoulder, right before you get to the dublin interchange, because of the repair work that slides

below eastbound 580. westbound shows more slowing, so does vas coe, that's your morning commute, and dalton area. we look over here toward highway 4 with a build into contra costa county. no surprises for the bay bridge. we have the backup which continues to slowly build, and we'll get more packed up over the next few minutes as folks really start to arrive at 6:00. back to you. >> thanks, mike. happening now, the oakland zoo is closing due to the storm moving through parts of the bay area. the zoo says customers who purchase tickets will be refunded in the next three to four weeks. the oakland zoo has shut its doors several times due to the wet weather and storm damage. this included the sinkhole that forced the zoo to close for 35 days straight. a not so sweet possibility for america's most colorful candy. the product may soon be illegal to sell. the proposed candy ban working through sacramento, and the key ingredient supporters argue may be harmful.
