he said that michael cohen can't be trusted, the jury shouldn't believe his story. but trump's lawyers are not in the room for this questioning to try to go back and forth with him. >> let's talk about the charges here we don't know exactly how it will be charged. but fair to say this is a legally and politically controversial prosecution if this happens >> yeah. it is a tough case you hear about it being politically motivated. that's not a legal argument. the legal argument you can expect to see the president's lawyers make, if he's indicted there's no intent to defraud here that's what the statute actually requires under new york law. at least we think the falsification of business records in case, it actually requires that intent to defraud, and it is just not clear given that trump is, in fact, the trump organization where was the intent to defraud? he will say in all cases done to protect his family, not about the campaign so it is just not at all clear that this is a legal open and shut case that can be easily made and, of course, other people

last night, he hopes this strike quickly comes to an end. savannah >> thank you very much lots nor get this tuesday morning, including t sounding off on what it's calling an urgent public health threat a highly drug-resistance fungus that's spreading an alarming rate from four states in 2016 to more than half of the united states in 2022 while scientists do not believe the fungus is a threat to people who are otherwise healthy, it can be dangerous and deadly tot. dr. john torres is here. first of all, dr. john, where did this fungus come from? and how concerned should we be >> first and foremost, this is not ocalypse, but it nes to be looked into. like you mentioned it has increased since 2016 many, many fold and has spread throughout the country the world health organization says this is a global threat as well

the problem is it's resistance to anti-fungal drugs it is difficult to identify because it is inside the body and the symptoms mimic a lot of other symptoms, and it is causing these outbreaks in long care facilities. as far as how concerned we should be overall, this is one of those things that seems to be spreading because we think of global warming the fungus usually doesn't get in our bodies because it can't stand the warm temperatures. but they think fungi in general are adapting to warmer temperatures because of global warming, they'll be able to get in our bodies >> thank you for clarifying this isn't a plot line from the -- because i don't think i can handle a zombie apocalypse on top of everything as well. if you have a loved one in your family who's immunocompromised and in a long term health care facility. how do you protect them? >> stay healthy yourself because your immune system is the biggest battle against this.

weather moves into the by area. "today in the bay" is live in the south bay this morning, one area that's already seeing its fair share of rain this year coming down right now, chris. >> it is starting to come down, and it's been steadily picking up through the morning. but we know the biggest issue in this system is going to be the wind. so we asked pg&e what they were doing to prepare. they say they are really focusing in on the south bay and the peninsula, which is super hard hit during the last windy storm, and bringing in extra equipment, staging it in critical areas, they are also bringing in more crews. folks in the santa cruz mountains are also preparing. they have been without power, so far this year. a number of times they're topping up propane tanks, making sure generators are working, and some of them are preparing to not have water because one of the water systems uses propane to operate the pumps that pump the water up hill.

>> it's been overwhelming. >> one of the things that we talked about, why you wanted to tell your story, what it means to you to get to tell your own story. >> i think just because it's coming from me you know, i'm the person who has gone through this experience and has been through the trauma and it's my story. >> reporter: it's a story that left the world in disbelief. >> i have a report of a teacher shot >> reporter: 25-year-old abigail zwerner shot by her first grade student at richneck elementary school in newport news virginia on january 6th. let's talk first about just how you're doing how is your recovery going >> i have been doing okay. i have gone through a lot of obstacles and challenges some days are not so good days where i can't get up out of bed. some days are better than others where i'm able to get out of bed and make it to my appointments but, you know, for going through what i've gone through, i try to stay positive, you know, try to

have a positive outlook on what's happened and where my future is heading. >> you just had a surgery on your hand. what are the physical injuries >> the initial gunshot went through my left hand and ruptured the middle bone, as well as the index finger and the thumb. the gunshot then went into my chest up here where it still remains. so i have the scar up here and i still have some bullet fragments up here. >> so part of that bullet is still there? >> yes >> do you think it will always be there or do you think they will remove it some day? >> i think it will always be there. >> i asked you a lot about the wounds that we can see there are wounds that we can't see. >> yes >> how are you doing >> it's -- at first it really shook me up. they were open wounds that i could see and seeing an open wound on your body and remembering how you got it is pretty traumatizing in itself.

i think it's been helpful now that they have scarred over. but it's still a reminder that, hey, this happened to you. this is what your body has been through. >> so it was january 6th of this year >> uh-huh. >> what do you remember about that day >> i remember a lot. the morning it felt like just a regular school day, but i started hearing things and things started happening that made my fear grow. as the day went on, it grew more my fear grew more. i remember him pointing the gun at me. i remember the look on his face. i remember the gun going off i remember feeling something it was a pretty scary day. >> in that moment, what's going through your mind? >> i was terrified in that moment, my initial

reaction was your kids need to get out of here. you know, this is not a safe classroom anymore and that you need to go find help for yourself it was pretty shocking you know, once -- once the firearm went off and then i felt something, that shock itself that i had been shot >> you knew you had been shot? >> uh-huh, yeah. that was pretty shocking itself. but i just wanted to get my babies out of there. >> what did the kids do, say >> they were screaming i think they -- they knew as well that they had to get out of there, but they were extremely frightened and screaming >> the police chief said after that you had ensured that the kids got to a safe place he said your actions were heroic do you remember, what were the next things that you did >> that is still kind of a blur.

got them out, and i went to get help for myself. i knew -- well, i didn't know at the time that my lung had collapsed, but i started not being able to breathe. very raspy breaths in. my vision started going out. i remember i went to the office, and i just passed out. i thought i had died >> the ambulance came. you were rushed to the hospital. what did doctors say about the condition you were in and your injuries >> it could have been fatal.fat. we believe, like my hand being we believe, with my hands being up with it going through my hand first, we believe that by the bullet going through the hand first that it most likely saved my life. >> everything about this is so unthinkable. i wonder what you think or how you feel about this student. abt

that the boy had a gun with him the day that abigail zwerner was shot she plans to file a lawsuit in two weeks. >> there have been many failures, and there are multiple people responsible for those failures >> do you feel like you could have been better protected by the school >> yes >> you feel like they should have done more >> yes >> the prosecutor announced there would not be criminal charges against the six-year-old boy. do you have an opinion about that decision? >> i'm not going to weigh in to the prosecutor's decision, but i am following very closely the newport news prosecutor to see what they do in this case and who they do charge ultimately, if they do charge anybody. >> when you think about what's happened and what happened to you, what does justice mean to you in this case >> that's a tough question to answer >> yeah. diane, for you >> as abbie said, that is very tough to answer. my job is to hold those accountable that i can hold accountable, and i'm going to deal with that abbie has to deal with this your

off label for weight loss. >> we don't have a good understanding of what they are in people who are not diabetic because that's what it was tested in. we understand those to a certain extent. we're not quite sure. you hear stories from people saying, yes, i had no side effects. i had tons of side effects. on top of that, kidney failure. you have to be careful and you won't know until you start using it. you don't know until you start taking it. >> as mentioned, this is being prescribed off label, which is -- it is not illegal, but it is off label, and that's created a shortage of the medicine. how is that being addressed? >> so off label means that it was fda approved for something, diabetes in this case, and in this case it is used for weight loss. doctors can do that. your manufacturers are trying to manufacture, especially the pins. but on top of that, there are other medications as well, other

types of hormone mimickers as well that are out there. you see the ads for them. >> and those are for weight loss. >> those are for weight loss. but on top of that, these are pharmacies that will basically make this from the base unit of that synthetic hormone and give you the hormone and give you something to mix it with. you have to be careful with those because those are not fda-approved products. they're not watched by the fda as well. it is a little bit of the wild west. >> it's like the delivery device that it's the shortage of, not the medicine. >> contactually. they're sending you the raw materials, so you have to mix it yourself. >> finally, some have reported a side effect or a feature is they're less interested in drinking alcohol. does that make sense? >> it does make sense to a certain extent because we talked early on in the first question about how it gets to the who roan receptor in the brain and reduces food cravings. some people are saying it

sitting here with you now and the season is over, i feel like it was just yesterday we were starting it up in october. so it's a whirlwind. >> one of the things that i have always admired about you and i said this to you in beijing when i saw you there, you have overcome so much adversity. and i remember watching you on the hill in beijing, and you were distraught. and to now be the greatest in the history of the sport. does that make it extra sweet? >> i think just in general in life, your setbacks mike the try yums more sweet. loving where i am at actually with my skiing, i love the feeling of skiing. and all of that passion and everything and the work that i do and the whole team, everybody around me does, that does make it really satisfying. but you are not going to avoid the setbacks. and i feel like it's going to be

challenging again in the coming seasons. there is -- something is going to happen that's not going to go my way and i'll think back on this time thinking, why couldn't it always be wonderful like it was that season? life has ups and downs, i guess. >> the helmet that you wear when you race, it has two special sayings on the back. there is a picture of it for folks at home. tell us about those sayings. >> yeah. so the first one, one of my idols in ski racing wrote that on a poster for me, always be faster than the boys. she just wrote this to all of her -- basically all of her fans any time she signed a poster. and i ended up writing that on my skis when i was younger. and now it's on my helmet. and the other be nice, think first, have fun. that's something my mom and dad told me, just instilled this philosophy that you -- i don't know. i guess the values you want to have in life.
