happened? >> yeah, as we look towards the traffic flow, no problems crossing the bay. i told you we saw the crash over in oakland, and now you see the slowing here. the crash itself reported near beaumont, and east bay 580, chp called for a traffic break heading towards this crash. there could be a shift in location -- actually, it just changed in our traffic input. we will get you this note. it's away from 980 and 24. i would strongly suggest using somebody 880 instead of the east bay 580 getting away from the bay bridge toll plaza. back to you. >> thank you very much. breaking news we are covering for you in the south bay, a deadly shooting overnight ended in a violent standoff.

this is close to the minute chester mystery house. police say the man who was shot was armed with a machete and held three people hostage, including two children. the three captives were all found safe. today in the bay's kris sanchez will have a live update coming up in the next half hour. in a matter of hours new york city grand jury considering charges against former president donald trump plan to reconvene. today in the bay is live in washington tracking the latest developments. i know one thing a lot are thinking about, the jury was told to stay home yesterday? >> yeah, it's not clear on why they were told to stay home. it's important to remember that if there is ultimately an indictment in this case, it's not likely that the former

president trump would appear in manhattan to face charges until next week at the earliest. this is over the allegations hush-money back in 2016. trump called alvin bragg a rogue prosecutor having a hard time making a case. the former president continues to talk to friends and advisers about his possible arrest that he thought would take place tuesday, and he has mused openly about whether or not he should smile for the assembled media. >> a perp walk is not going to

happen, and you will not see him in handcuffs unless he brings his own. >> trump's legal troubles continues in another investigation. a judge ruled the former president committed a crime through his attorneys when it comes to the probe surrounding classified documents found at his mar-a-lago state. it appears he lost an appeal of that ruling and that will force one of his lawyers to testify to a grand jury in the criminal probe. >> a lot to considerand think about here. i know a lot of people are watching. chris pallone in washington, thank you. this morning we are digging deeper into a potential move by the u.s. to ban tiktok. today the ceo is expected to get grilled on capitol hill in a

hearing. the white house last week threatened to ban tiktok in the u.s. if the chinese do not sell their stake. i want to start out with that hearing on capitol hill today. what questions do you think tiktok ceo is expected to face? i would imagine consumer privacy and data security? >> absolutely. the biggest question will be how far can the chinese government or chinese authority have access to the data of the u.s. user? that will be the biggest thing because it's national security at this level. >> it's interesting to think how cavalier businesses are and users are as well. do you think they don't feel any sort of threat? i mean, 150 million users. >> that's the biggest point. the key thing is if you know what kind of information they are collecting you would be

worried about that. it's from the location of the device, and the phone company you are using for that device, and even the diagnostic of your device and your files and contacts and other things. this information will give a huge advantage for the chinese government, you know, getting this information and influencing the move of the society by pushing some kind of propaganda. >> if tiktok is purchased by an american company, what is saying it will stop that data from really getting in the wrong hands? >> the key thing, once it belongs to the u.s. entity, any kind of a structure for the network and the software for getting into the data and analyzing the data will be rechecked and so there will be no backdoor, there will be no privileges for anybody other

crash that killed a peninsula mother and father is due in court this morning. the car slammed into the couple and their two 7-year-old daughters that survived that crash. a san josé police sergeant in critical condition this morning after a tree smashed into his unmarked car during tuesday's storm. he's a 16-year veteran of the force. the tree left him trapped until first responders could free him. elsewhere in the city, two people died from falling trees. one in the tenderloin and another near golden gate park where a bystander was left shaken up by what she saw. >> i show them, the police officer car here and we walked by and we show the paramedic people and doing cpr.

>> the falling trees in tuesday's storm blamed for now five deaths across the bay area. happening for you now this morning, tri-valley drivers are being told to prepare for delays this morning on east bay 580. chp closed two lanes yesterday and will close another one today from now until 1:30 this afternoon. caltrans will be closing lanes to make the repairs to that cracked road that popped up monday after the retaining wall collapsed. for a closer look at the closure, let's bring in mike inouye. how do drivers need to get around this? >> they can't. that's the problem, marcus. they have to go over the bridge which is damaged by that slide you saw. the problem is they will have to go this direction right here. this is where the morning commute comes in and that's why they are using the morning to close the additional lane, and they will go over the area slower, and in the afternoon it will build up. that's why they are trying to clear it by 1:30, because that's when the afternoon and evening

commute kicks in. >> prepare for extra time? >> absolutely. out of tracy, out of livermore, out of sunol and the interchange, that would be the direction. for the morning, we are looking at the opposite direction, and that's moving fine out of the altamont pass. east bay, we do have slowing but the good news, the traffic break and the full blockage has cleared to two lanes now, and that's opposite your main commute. you are down two lanes over at beaumont and 14th, but that crash has moved out of two lanes, two lanes are now open. we are looking towards the bay bridge, and the drive there will be smooth. everything moving nice there. i have green sensors but not the road weather index -- yesterday that meant rain, but not today. >> yeah, it's a nice break from the rain today. let's go mid bay right now, san mateo commute.

novato, currently at 48 degrees just seeing clouds passing through right now. we will go into the mid-50s by this afternoon with a slight chance of spotty showers as we move through the day. i will track that for you coming up in the full forecast. and then the cones from the golden gate bridge, and the north side should have full access, and coming towards us the headlights, light traffic. we're still watching the east bay and that crash. we will talk about what is going on on 580 in oakland, coming up. a big tiktok hearing coming up, but let's talk with the fed and banking. stocks took a big hit when janet yellen walked back comments that the fed would back deposits over $250,000.

powell did what we were saying yesterday, he said the banks are lending less. this is a good prediction. it's going to get harder to get a loan. the federal reserve also said it will do its own internal investigation into the handling of silicon valley bank, not what went wrong but how come the fed had not figured it out faster that things were going wrong at silicon valley bank. and the ceo of tiktok will testify on capitol hill, and there are concerns bytedance might pass on personal information gathered from the app to the chinese government. there are laws in china requiring chinese companies to comply with the government's data request. now, all apps try to track you. we have gone on for years about accusations against facebook, right? you know your apple watch tracks

>> yeah, "law & order," and weather. >> weather and rain. let's talk about what we can expect as we go into thursday. right now out there we are looking at mid to upper 40s and 50s for you. we have 40 in pacifica. 50 in oakland, and 50 for you in tohe peninsula now, palo alto currently at 50 degrees. it will mix out nicely into clouds and sun this afternoon, if you want to take the lunch outside. if you do take the lunch outside, make sure to bring a windbreaker. it will range 15 to 25-mile-per-hour winds by 2:003:00, and then in the afternoon, still breezy. if you have lunch plans outside or cleaning up from the storm, just make sure and wear another layer. no rain in the way of getting into your thursday plans. let's take it hour by hour.

but i will leave you with the 7-day forecast. we are going to take a dip in the temperatures, so prepare for chilly mourns ahead. >> mike? over here the, the bay bridge, we did have results of a disabled vehicle, and our buddy in the operation center scanning with the camera didn't see any problems. this is a little slowing approaching the toll plaza and the incline. this is a pretty typical pattern getting to the bay bridge and across your commute westbound. remember, we are down two lanes as you approach beaumont. the earlier crash cleared from half the freeway, but now slowing from 980 to about 14th. golf lynx road, that's the commute direction out of castro valley and heading towards the

temperatures right now pretty comfortable, i would say. 50 in oakland. 46 for you right now in gilroy. maybe you are headed to work in the peninsula, and let's go to redwood city. temperatures will take a dip as we go into 7:00, 8:00. we will warm up in the mid-50s this afternoon, with a spotty chance of rain but we will track that for you in the full weekend outlook. for now, mike, you are talking about a crash on the bay bridge or something going on? >> we see the flashing lights. good eye there, and we look at a build in the commute. the flashing lights, cinthia, that's because i just heard about a tire they reported to that side of the approach of the toll plaza. they could be blocking that lane for folks to clear the tire. the speed sensors don't show any

major slowing. we're watching that critical spot on the bay bridge showing a critical build right now. and then only two lanes are open and two lanes closed east bay getting away from the bay bridge. grand avenue, the new location. good news out of castro valley heading up towards the bay bridge toll plaza. police are still trying to determine why a man took three people captive before being shot by officers. >> today in the bay's kris sanchez is live. what you have been able to learn? >> we know in the last hour or so the big mobile command unit drove away, but the crime scene unit is still here because they are still gathering evidence after that man was shot by police officers and died overnight. this all started as a hostage

situation, as you said, in an apartment. this is southeast of 280 and the expressway where they connect. that man was holding a woman and two children in the apartment, and neighbors heard at least three gunshots. the police confirmed the man was shot at least once by officers. he was taken to the hospital and then just after 1:00 this morning, police announced the suspect died at that hospital. san josé police tweeted the woman and children were removed safely so they are physically safe, but they are no doubt traumatized this morning. we suspect there will be an autopsy on the suspect, and we do know in the cases of officer-involved shootings, we often hear from the police chief himself. when that happens, we will bring that to you.

kris sanchez for "today in the bay." >> thank you, kris. meanwhile, scott mcgrew continues to cover donald trump's woes. >> we are still waiting for the announcement from the grand jury in manhattan, but there are four investigations into trump and the one from mar-a-lago and the classified documents is the one causing him the most problems. the judge ruled that the crime fraud exception negates some attorney/client privilege, in other words, trump's attorney could be a witness and requested and the private documents could be turned over to the prosecution. as for the manhattan case, the grand jury has been called back. this is the one trump himself expect to be arrested over.

it's getting big attention because it's the first potential indictment, but it's really not the most serious. some washington republicans, meanwhile, indicating they are willing to investigate the prosecutors investigating trump. jim jordan of ohio sent letters to two manhattan prosecutors who he claims pressured the d.a. in going forward with the case against the former president. everybody has been wrong on their predictions before, but there are three prosecutors, four cases. as we saw wednesday, developments can come from anywhere. the "today" show will continue with that coverage and that starts at 7:00, and, of course, throughout the day. if there are any major developments, nbc bay area will bring that to you. a short time ago pg&e updating us there are now 24,000 outages.

the east bay is still the hardest hit with about 11,000. on the peninsula, it's down to 9,000. meanwhile, people in one oakland neighborhood said they sat in the dark for 24 hours without power and pg&e not even knowing there was a problem. customers on 36th street could not see it on the utilities outage map, and they called nbc bay area asking us to convince the utility the power was out. >> i think i deserve this, this is what i work for. >> yes, you do, peggy. pg&e says the teams are now trying to figure out why the meters of a dozen or so neighbors did not reflect an outage, and they say they can file claims for expenses due to the outage. and then take a look at that.

the coastline. a beautiful weekend out in santa cruz if you want to go and support any local economy that has been battered by the storm, and it's looking good but make sure you bring a jacket because temperatures are in the mid-50s with sun. we have a little trouble but it's trouble for people that expected the span to clear. the metering lights had been activated, and it looks like they cleared that tire on the approach. we are ready for all these folks to approach the bay bridge toll plaza, and then a little slow on the incline here. this is highway 4 where it's just starting to show a build, we expect those coming in your commute direction towards me. east 580, chp issues an alert. there was an oil spill on the ground, and two lanes still remain closed, getting away from 980 and the bay bridge itself

up. officials are searching for a 7-year-old child. this is north of monterey. there was a child left on the beach unattended. he said his brother went swimming with his mother. his mother was found unconscious. the 7-year-old boy has not been found. the search is expected to resume as soon as the sun is out. a san francisco art gallery seen on video spraying somebody with a water hose is due in court for a plea hearing. it sparked anger when it went viral. the business owner apologized explaining the person was loitering.

he is facing a misdemeanor battery charge. and then we have a live look at the picketing this morning. thousands of service workers walked off the job on tuesday morning over stalled contract talks. the strike brought classes to a standstill leaving parents across los angeles scrambling. after two days neither side has yet to announce any significant progress. schools are expected to return to a full schedule tomorrow morning. trending for you this morning, today is national puppy day in honor of the special day, the san francisco spca wants to remind you that you can give a puppy in their shelter a forever home. >> you will make a forever friend. here on "today in the bay," many of our furry family members were adopted, including my own dog. they're great. love them. i think bob redell has the best assignment of the day today.

>> reporter: from your point of view here, you are always trying to get dogs adopted. is there anything about this day from your point of view? >> yeah, i think it's great because it's recognized as a national holiday, and people are recognizing shelters have puppies, and you don't have to go and go to breeders and puppy mills, and you can find puppies that are two months old at your local shelter. highlighting national puppy day really puts that out for the public to understand that. >> reporter: is there a misperception about adopting a puppy. we talked about it earlier, and you can do this. >> yeah, can you do it if you have the commitment. that's the commitment with time and energy, too. i think it's really important. everybody always wants a puppy,

because they are adorable. they stay very cute, but they don't always, you know, stay this size. i think it's important when somebody is considering a puppy is what is the lifestyle, right? does this puppy fit into your lifestyle? if you are a couch potato, you have to keep up with somebody who is extremely energetic that needs to get socialized and go through training, and maybe a puppy is not the right fit, but the adult dog that you know the temperament and the energy might be a better fit. >> you can house train them. it's not rocket science. i think you are also touching on this, i rescued a couple adult dogs, yes, and they are great to adopt, too, and i know it's national puppy day, but adult dogs are sometimes overlooked. >> yeah, often they are overlooked. but puppies, for somebody who, again, wants to make sure they have the right training, the
